This Article makes two overarching arguments. First, strategy is a major driver of legal evolution. Most scholarship and commentary on cyber-attacks capture only one dimension of this point, focusing on how international law might be interpreted or amended to take account of new technologies and threats. The focus here, however, is on the dynamic interplay of law and strategy – strategy generates reappraisal and revision of law, while law itself shapes strategy – and the moves and countermoves among actors with varying interests, capabilities, and vulnerabilities. Although possession of small quantities of marijuana has been decriminalized in New York State since the late 1970s, arrests for marijuana possession in New York City have increased more than tenfold since the mid-1990s, and remain high more than 10 years later. This rise has been a notable component of the city’s “Order Maintenance Policing” strategy, designed to aggressively target low-level offenses, usually through street interdictions known as “stop, question, and frisk” activity. We analyze data on 2.2 million stops and arrests carried out from 2004 to 2008, and identify significant racial disparities in the implementation of marijuana enforcement. These …

New research has identified the consequences of high rates of incarceration on neighborhood crime rates, but few studies have looked beyond crime to examine the collateral effects of incarceration on the social and economic well being of the neighborhoods themselves and their residents. We assess two specific indicia of neighborhood economic well-being, household income and human capital, dimensions that are robust predictors of elevated crime, enforcement and incarceration rates. We decompose incarceration effects by neighborhood racial composition and socio-economic conditions to account for structural disadvantages in labor force and access to wealth that flow from persistent patterns of residential segregation. …

Overweight and obesity is a growing epidemic among adults, adolescents, and children in the United States. Since 1980, rates of obesity have doubled among adults and tripled among children, and college students are not immune to this trend. This may be due, in part, to portion sizes that exceed individuals' caloric needs. The number of students with autism is on the rise. The main treatment for children with autism is their education. It is essential that teachers are prepared to work with students with autism. The purpose of this study was to determine the effectiveness of a teacher training workshop held by Area Education Agency 267. Fifty-one participants of the workshop training responded to a survey regarding their implementation of strategies learned, their understanding of the content and strategies learned, the change in their planning and delivery of instruction, and the impact on their students' achievement.

The UNM Science and Technology Corporation (STC) asked the Bureau of Business and Economic Research (BBER) to conduct a study of the economic impact on the economy of New Mexico of start-up companies using STC technologies; BBER conducted a similar analysis in 2004. This analysis updates the 2004 study and emphasizes the impact of high-tech start-up companies that have had a relationship with STC from 2004 to the present. Arguably since the Marshall Court and undoubtedly since the New Deal, the U.S. Constitution has been subverted to the point where its original meaning has been substantially lost inside a tangled knot of Supreme Court case law. Like termites eating away at the constitutional architecture, Supreme Court interpretations of provisions such as the Commerce Clause, taxing and spending power, Privileges or Immunities Clause, Ninth Amendment, Tenth Amendment, and Eleventh Amendment have so rotted them that they no longer serve the critical functions originally envisioned.

This article examines the global export of domestic U.S. legal projects and strategies in the realm of family law and gender justice to South Asia. While such projects have undoubtedly achieved substantial gains for women in the U.S., there have also been costs. At a remove of two decades, scholars have now begun to theorize those costs and argue that feminism needs to reconsider its commitments to particular projects that have been held central to women’s emancipation. The financial crisis served as an interesting backdrop for this study of the impact of identification upon banker engagement. Studies have shown that leadership style influences employee engagement, but little research reflects the impact of various levels of identity (nested identity) upon engagement. A survey of 511 mid-level bankers displayed the significance of career, organizational, and industry identity upon vigor, dedication, and absorption. Further, it was determined that organizational identity mediated the relationship between leadership and engagement. The present study, conducted in collaboration with a public school board in southern Ontario, Canada, focused on stakeholders’ perspectives of an English Literacy Development (ELD) program offered in secondary schools within this particular board. The phenomenon of physical disability stigma has been examined from many different perspectives, but a comprehensive theory of its functionality has yet to be tested. The evolutionary theory of stigma provides two compelling hypotheses, for stigma in general, and physical disability stigma in particular. The pathogen avoidance hypothesis maintains that stigma is an evolved response for protection against infectious diseases, whereas the social exchange concern hypothesis proposes that stigma serves to maximize fitness by cueing which interaction partners will contribute or detract most from one's well-being. Research has shown that there is relationship between money and an orientation toward self-interest, both at the individual and country-level. However, the causal relationship between these constructs is not fully understood. Based on Schwartz's theory of human values, which distinguishes between self-oriented and socially-oriented values, this study explored whether values have a causal influence on the importance people place on money. Four different sets of values were primed using a scrambled-sentences task to test their effects on the importance participants ascribed to money. Frustrated by federal inaction on immigration reform, several U.S. states in recent years have proposed or enacted laws designed to stem the flow of illegal immigrants into the U.S. and to facilitate their removal. An underappreciated implication of these laws is the potential alienation of immigrant communities – even law abiding, cooperative individuals – from the criminal justice system. The ability of the criminal justice system to detect and sanction criminal behavior is dependent upon the cooperation of the general public, including acts such as the reporting of crime and identifying suspects. The Effect Of Client Self-Disclosure On The Physiological Arousal Of The Therapist, Kristyn M. Blackburn

This quantitative study investigated the effect of client self-disclosure on the physiological arousal of the therapist and subsequent ratings of the therapeutic alliance, session smoothness, and session depth. Three therapists and 10 clients participated in a 40-minute videotaped therapy session while being attached to sensors that measured heart rate and skin conductance. The participants completed self-report questionnaires designed to assess the therapeutic alliance and session smoothness and depth immediately following the therapy session. The videotaped therapy sessions were later transcribed and coded by two independent coders for the occurrence of client self-disclosure. Correlation analyses were utilized to determine whether or …

Diffuse reflectance spectroscopy with a fiber optic probe is a powerful tool for quantitative tissue characterization and disease diagnosis. Significant systematic errors can arise in the measured reflectance spectra and thus in the derived tissue physiological and morphological parameters due to real-time instrument fluctuations. We demonstrate a novel fiber optic probe with real-time, self-calibration capability that can be used for UV-visible diffuse reflectance spectroscopy in biological tissue in clinical settings. Tall fescue is the most common cool-season grass in the eastern USA, with broad economic and ecological importance to the region. Tall fescue is known to associate with a fungal endophyte, Neotyphodium coenophialum, whose presence can decrease biotic and abiotic stress experienced by the plant. This thesis evaluates the response of tall fescue and the fungal endophyte symbiosis to predicted climate change. I participated in two multi-factor climate change projects where I investigated the response of tall fescue tissue chemistry and growth to various climate change factors. "A series of novel purine-based fluoroaryl triazoles were synthesized and assayed for their neuroprotective effects of hippocampal slice culture exposed to amyloid beta (Aß) oligomers. A monofluorinated triazole has been identified which has comparable neuroprotective effect as that of flavopiridol and roscovitine against the Aß induced neurotoxicity. Carnosine and histidine are biologically interesting antioxidants. In order to probe whether they exert their antioxidant effect through metal ion chelation, the Cu(ll) ion chelating abilities of these compounds were measured by UV-vis spectroscopy. "Jatropha curcas is has often been touted as the most sustainable biofuel source. Jatropha curcas is a drought resistant perennial plant belonging to the Euphorbiaceae family. Interest in this plant as a biofuel source is related to high lipid (triglyceride) content of its seeds. However, economics of jatropha as a biofuel source has been marred by the toxicity of the oil and its protein rich meal. As a result of high toxicity the protein rich meal is used only as a very low or no economic value organic fertilizer. "There is a considerable recent interest in the applications of room temperature ionic liquids (RTILs) as green solvents in organic synthesis and as nonvolatile electrolytes in lithium ion batteries. A variety of commercially available imidazolium based RTILs have been used for these applications, mainly due to their negligible vapor pressures, high thermal stabilities, wide liquid range, wide electrochemical windows and high anodic stability. The state of the art lithium ion batteries require the use of electrolytes that have relatively low viscosities at temperatures as low as -35°C. "Trees have been used to locate contaminated soil and groundwater, augmenting traditional methods, such as well drilling, that are time-consuming and expensive. In the past decade, plant sampling has gained acceptance as a reliable method for site screening. In this new field of phytoforensics, research efforts focus on developing quicker, more accurate and more informative sampling and analysis methods for measuring contaminant concentrations in trees. These phytoforensic tools are a novel approach to site assessments, potentially reducing cost while more effectively locating contaminated groundwater. This report is part of a series developed to provide updates on the progress of the Missouri Foundation for Health’s Tobacco Prevention and Cessation Initiative (TPCI). The report provides an overview of the activities and short-term outcomes that occurred between 2005 and 2010. Several changes to the TPCI structure occurred during this time period. In 2009, changes to the Initiative’s structure included the end of the regional and community grantee structure and the integration of School and Worksite Strategies into one Community Grants Strategy.
