Capturing Individual Harms, Katrina Fischer Kuh Jan 2011

Capturing Individual Harms, Katrina Fischer Kuh

Hofstra Law Faculty Scholarship

The aggregated lifestyles and behaviors of individuals impose significant environmental harms yet remain largely unregulated. A growing literature recognizes the environmental significance of individual behaviors, critiques the failure of environmental law and policy to capture harms traceable to individual behaviors, and suggests and evaluates strategies for capturing individual harms going forward. This Article contributes to the existing literature by approaching the problem of environmentally significant individual harms through the lens of environmental federalism. Using climate change and individual greenhouse gas (‘CHG’) emissions as an exemplar, the Article illustrates how local information, local governments, and local implementation can enhance policies designed …

A Framework For The Extraction And Modeling Of Fact-Finding Reasoning From Legal Decisions: Lessons From The Vaccine/Injury Project Corpus, Vern R. Walker, Nathaniel Carie, Courtney C. Dewitt, Eric Lesh Jan 2011

A Framework For The Extraction And Modeling Of Fact-Finding Reasoning From Legal Decisions: Lessons From The Vaccine/Injury Project Corpus, Vern R. Walker, Nathaniel Carie, Courtney C. Dewitt, Eric Lesh

Hofstra Law Faculty Scholarship

This article describes the Vaccine/Injury Project Corpus, a collection of legal decisions awarding or denying compensation for health injuries allegedly due to vaccinations, together with models of the logical structure of the reasoning of the factfinders in those cases. This unique corpus provides useful data for formal and informal logic theory, for natural-language research in linguistics, and for artificial intelligence research. More importantly, the article discusses lessons learned from developing protocols for manually extracting the logical structure and generating the logic models. It identifies sub-tasks in the extraction process, discusses challenges to automation, and provides insights into possible solutions for …

Social And Legal Debate About The Affordable Care Act, Janet L. Dolgin, Katherine R. Dieterich Jan 2011

Social And Legal Debate About The Affordable Care Act, Janet L. Dolgin, Katherine R. Dieterich

Hofstra Law Faculty Scholarship

Never the closest of bedfellows, law and technology mix uneasily within the realm of alternative reproductive practices. More than twenty years ago, the drama of Baby M provoked a fierce debate about the legal and biological contours of parenthood. In pondering the issue, the New Jersey Supreme Court attempted to erect a barrier between a natural mother’s right and what it saw as a dangerous and exploitive new mechanism for producing and marketing human life. Since that time, the practice of surrogacy and the use of alternative reproductive technologies have taken firm hold in our culture, creating families where, previously, …

Coping With Chronic Illness: Do Strategies Differ By Illness Type?, Kerry T. Eldred Jan 2011

Coping With Chronic Illness: Do Strategies Differ By Illness Type?, Kerry T. Eldred

UNF Graduate Theses and Dissertations

While coping varies with individuals and is a product of complex, interrelated factors, the primary interest of this study was determining how coping behaviors manifest according to these chronic illness types: those of known pathology (e.g., asthma, osteoarthritis, lupus) and those that lack a clear, structural pathology (i.e., functional somatic syndromes and medically unexplained symptoms). Data for this study were gathered from a series of four comprehensive online surveys, which included measures of coping (Brief COPE), pain and health outcomes (SF-36), negative affect (I-PANAS-SF) and depression (PHQ- 8). The analyzed sample was comprised of 148 participants (119 Female, 28 Male …

Physical Activity And Self-Esteem In Females During Late Adolescence, Katrina Dembeck Jan 2011

Physical Activity And Self-Esteem In Females During Late Adolescence, Katrina Dembeck

UNF Graduate Theses and Dissertations

In the United States, obesity is on the rise while physical activity is declining. Educational funding cuts result in less time and resources for physical education in schools and youth are increasingly more sedentary with technological advances. Advance practice nurses have a role in promoting physical activity and health in this population.

The purpose of this study was to examine the relationship between physical activity and self-esteem in females during late adolescence and the effect of perceived benefits and barriers to physical activity on this relationship. E-mail invitations to participate in an online survey were sent to female undergraduate students …

The Women’S Convention, Reproductive Rights And The Reproduction Of Gender, Barbara Stark Jan 2011

The Women’S Convention, Reproductive Rights And The Reproduction Of Gender, Barbara Stark

Hofstra Law Faculty Scholarship

President Barack Obama has asked Senator John Kerry, Chair of the Senate Foreign Relations Committee, to move forward on the Convention on the Elimination of All Forms of Discrimination Against Women ("CEDAW" or the "Women's Convention"), which President Jimmy Carter signed in 1978. This Article focuses on the consequences of ratification for reproductive rights. Under CEDAW, I argue, the United States would be required to fully assure these rights, including subsidized family planning services and abortion.

Part I of this Article describes CEDAW's broad prohibition against what I call 'the reproduction of gender,' including the "sexual division of labor based …

Why Misdemeanors Matter: Defining Effective Advocacy In The Lower Criminal Courts, Jenny Roberts Jan 2011

Why Misdemeanors Matter: Defining Effective Advocacy In The Lower Criminal Courts, Jenny Roberts

Hofstra Law Faculty Scholarship

Most individuals accused in our nation’s criminal courts are not charged with murder, rape, drug sales, or even less serious felonies. The vast majority of charges are in the lower courts, for misdemeanors such as marijuana possession, driving with a license suspension for failure to pay tickets, assault, disorderly conduct, or public intoxication. Misdemeanor adjudications have exploded in recent years, with one recent study estimating that the volume of misdemeanor cases nationwide has risen from five to more than ten million between 1972 and 2006. At the same time, violent crime and the number of felony cases across the country …

Financial Literacy Or Financial Castigation?, John A. E. Pottow Jan 2011

Financial Literacy Or Financial Castigation?, John A. E. Pottow

Articles

This year, the Canadians- through their government-convened Task Force on Financial Literacy - have proudly produced, "Canadians and their Money: Building a Brighter Financial Future." Armed with 30 recommendations, its most dramatic innovation is to recommend the creation of a Financial Literacy Leader. I have been asked to provide an American perspective on this report specifically and the broader agenda of "financial literacy" more generally as a consumer welfare intervention. Let me start by acknowledging the critiques of the Canadian Task Force. For example, my Canadian colleague, Saul Schwartz, has already drafted a compelling analysis of the political economy behind …

Democracy At The Corner Of First And Fourteenth: Judicial Campaign Spending And Equality, James Sample Jan 2011

Democracy At The Corner Of First And Fourteenth: Judicial Campaign Spending And Equality, James Sample

Hofstra Law Faculty Scholarship

The Supreme Court recently decided in Caperton v. A.T. Massey Coal Co. that substantial independent expenditures in support of a judicial candidate present threats to judicial impartiality similar to those posed by direct contributions. This Article posits that the Caperton holding, guaranteeing due process of law in state courts, presents a compelling state interest justifying the regulation of spending in judicial elections.

The Supreme Court's landmark decision in Buckley v. Valeo is understood to hold that only an "anti-corruption" rationale can justify campaign finance regulations. Buckley drew a rigid distinction between political campaign "expenditures" and "contributions, " holding that the …

Integrating International And U.S. Students: A Strategic Plan For Cultural Appreciation, Mary Gill Jan 2011

Integrating International And U.S. Students: A Strategic Plan For Cultural Appreciation, Mary Gill

Iowa Journal of Communication

American colleges and universities historically have had increasing interest in international students for a variety of reasons. Unfortunately, for many if not most of these institutions, too little attention has been focused on developing integration plans whereby international and U.S. students are truly integrated in a co-learning environment academically and socially. A culture-specific integration model for minimizing challenges and maximizing global learning for international as well as U.S. students is offered.

A Recombinant Myeloid-Binding Adenovirus For Targeted Pulmonary Gene Therapy, Michael O. Alberti Jan 2011

A Recombinant Myeloid-Binding Adenovirus For Targeted Pulmonary Gene Therapy, Michael O. Alberti

All ETDs from UAB

Inflammation and airway destruction are hallmarks of many debilitating lung diseases such as chronic obstructive pulmonary disease (COPD), cystic fibrosis (CF), acute lung injury (ALI), and cancer. Gene-based therapeutic interventions that modulate this pathologic inflammatory response are likely to reduce the progressive destruction to lung airways. In this regard, a number of strategies have been evaluated for targeting the pul-monary vasculature; particularly those based on serotype 5 Adenovirus (Ad5). The ad-vantages of Ad over other vector systems include: in vivo stability, low oncogenic poten-tial, and large packaging capacity. Yet, specific and efficient gene delivery to the lung has been hampered …

Vitamin D And Insulin Sensitivity Among African American And European American Adolescents And Adults, Jessica Alejandra Alvarez Jan 2011

Vitamin D And Insulin Sensitivity Among African American And European American Adolescents And Adults, Jessica Alejandra Alvarez

All ETDs from UAB

Adequate vitamin D status is associated with a reduced risk for type 2 diabetes (T2DM); the relationship may be mediated by insulin sensitizing effects of vitamin D. African Americans (AA) are at a greater risk for T2DM and insulin resistance, as well as vitamin D deficiency, compared to European Americans (EA). The primary objective of this dissertation was to investigate the independent relationships of vitamin D with various measures of insulin sensitivity. Investigations were performed in a series of studies involving adolescent and adult female cohorts. The intravenous glucose tolerance test-derived insulin sensitivity index (SI) or the oral glucose tolerance …

Biometic Self-Assembled Nanomatrix For Bone Tissue Regeneration, Joel Matthew Anderson Jan 2011

Biometic Self-Assembled Nanomatrix For Bone Tissue Regeneration, Joel Matthew Anderson

All ETDs from UAB

Formation of the native bone extracellular matrix (ECM) provides an attractive template for bone tissue engineering. At the cellular level, structural support and biological complexity of bone ECM are provided within a composite microenvironment that consists of an organic fibrous network reinforced by inorganic hydroxyapatite (HA) nanostructured crystals. To synthetically recreate this biphasic assembly, a bone ECM analogous scaffold comprised of self-assembling peptide amphiphile (PA) nanofibers and interspersed HA nanoparticles was investigated. The PAs have been endowed with biomolecular ligand signaling using synthetically inscribed peptide sequences (i.e. RGDS, DGEA) derived from the native bone ECM and integrated with HA nanoparticles …

Post-Translational Modifications, Structure And Function Of Human Lens Crystallins, Chinwe Asomugha Jan 2011

Post-Translational Modifications, Structure And Function Of Human Lens Crystallins, Chinwe Asomugha

All ETDs from UAB

Cataract is an opacification of the lens causing reduction in vision over time. It is one of the leading causes of vision loss among adults age 55 and older. The lens is a transparent structure that focuses incoming light onto the retina for visual perception. It has a high protein content, attributed mainly to water-soluble proteins known as crystallins. With age, crystallins undergo post-translational modifications (PTMs) that alter their structural and/or functional properties and, in turn, lead to cataract formation. The purpose of this research was to take a top-down approach in understanding changes in lens proteins with age, starting …

The Effect Of Sulfasalazine On Functional Recovery And Neuropathic Pain Following Spinal Cord Injury, Kelly Dunham Atkins Jan 2011

The Effect Of Sulfasalazine On Functional Recovery And Neuropathic Pain Following Spinal Cord Injury, Kelly Dunham Atkins

All ETDs from UAB

Spinal cord injury (SCI) is a devastating condition resulting in loss of motor function as well as sensory abnormalities. Insight into the pathophysiology of SCI progression has been gained through use of pre-clinical animal models, however these have not been successful in yielding pharmacological interventions for clinical management of SCI. One proposed reason for this discrepancy may be the use of SCI models which are not fully clinically relevant and do not assess the contribution of gray matter pathology to SCI functional outcomes. Post-SCI inflammation is well-documented and may lead to downstream loss of motor function. Additionally, inflammation is thought …

Significance And Regulation Of Cd68 Expression In The Osteoclast, Jason Waid Ashley Jan 2011

Significance And Regulation Of Cd68 Expression In The Osteoclast, Jason Waid Ashley

All ETDs from UAB

The mucin-like Lysosome Associated Membrane Protein (LAMP) family member CD68 is a primarily myeloid lineage restricted transmembrane protein that is expressed in macrophages and osteoclasts. While the existence and expression pattern of human CD68 and mouse CD68 (sometimes called macrosialin) are well-known, and these molecules are routinely used as histological markers of tissue macrophages, the functional signific-ance of CD68 expression remains an unanswered question. Our overall goal is to deter-mine the significance and characterize the function of CD68 in osteoclasts and explore the effects of Receptor Activator of Nuclear Factor κB (RANK) signaling on CD68 post-translational modification. To achieve this …

The Patient Protection And Affordable Care Act Of 2010: Rulemaking The Shadow Of Incentive-Based Regulation, Sam F. Halabi

Faculty Publications

While legislators, scholars and mainstream observers are focused on the intense debates surrounding the constitutionality of the Patient Protection and Affordable Care Act’s individual mandate, the Department of Health and Human Services and other agencies are proceeding apace in promulgating rules to implement the law’s other requirements. Congress’s substantial delegation of administrative authority to HHS and other agencies will provide a second key area for constitutional challenges after the U.S. Supreme Court resolves the initial lawsuits based on the individual mandate. Between facial constitutional challenges to the Affordable Care Act and lawsuits based on defects in agency rules or the …
