Probabilistic Knowledge Of Third-Party Trademark Infringement, Mark P. Mckenna Jan 2011

Probabilistic Knowledge Of Third-Party Trademark Infringement, Mark P. Mckenna

Journal Articles

This essay views secondary trademark liability in light of tort law’s treatment of parties whose actions expose a plaintiff to third party-wrongdoing. Broadly speaking, tort law imposes liability on a party for contributing to the tortious activity of another in two different ways. In vicarious and accomplice liability cases, courts impose the same liability on the defendant as they would have on the direct tortfeasors, had they been defendants: if the third-party wrongdoer is a batterer, the defendant is liable for battery. Another line of cases imposes liability for unreasonably putting a defendant at risk of third-party wrongdoing, and these …

Introduction To Confronting The Climate Crisis: Catholic Theological Perspectives, Jame Schaefer

Theology Faculty Research and Publications

Confronting the Climate Crisis: Catholic Theological Perspectives is the culmination of a three-year study by participants in the Catholic Theology and Global Warming Interest Group of the Catholic Theological Society of America (CTSA). This interest group was established in 2008 when several members of the CTSA shared a desire to respond theologically to the complex and vexing problem of global climate change. Some had already been addressing environmental issues from the perspectives of the various sub-disciplines of theology in which we have been trained (e.g., biblical, historical, systematics, ethics) because inherent in our vocation as theologians is a calling by …

Microsurgical Reconstruction Of Large, Locally Advanced Cutaneous Malignancy Of The Head And Neck, Joseph L. Hill, Brian Rinker Jan 2011

Microsurgical Reconstruction Of Large, Locally Advanced Cutaneous Malignancy Of The Head And Neck, Joseph L. Hill, Brian Rinker

Surgery Faculty Publications

Large, locally advanced cutaneous malignancy of the head and neck region is rare. However, when present, they impart a significant reconstructive challenge. These cancers have a tendency to invade peripheral tissues covering a large surface area as well as expose deeper structures such as skull, dura, orbit, and sinus after resection. Complicating the reconstructive dilemma is the high incidence of individuals who have undergone previous surgery in the region as well as adjuvant radiation therapy, which may preclude the use of local flaps or skin graft. Free tissue transfer provides a reconstructive surgeon the ability to provide well-vascularized tissue with …

Stability Of Affinity Based Layer-By-Layer Polymeric Self-Assemblies For Oral Wound Applications, Sundar Prasanth Authimoolam Jan 2011

Stability Of Affinity Based Layer-By-Layer Polymeric Self-Assemblies For Oral Wound Applications, Sundar Prasanth Authimoolam

Theses and Dissertations--Chemical and Materials Engineering

Oral mucositis is a painful and debilitating chronic inflammatory condition that can result from chemo and/or radiotherapy. While current treatment strategies which provide temporary relief exist, there is still an unmet clinical need for a robust long active barrier strategy which can simultaneously provide protection and release drug to enhance the wound healing response. It is proposed that an affinity based layer-by-layer self-assembled barrier administered as a series of mouth rinses can allow for wound specific drug delivery, providing an effective regenerative therapy.

In this work, biotinylated poly(acrylic acid) is used to develop LBL assemblies based upon biotin-streptavidin affinity interactions. …

Cell And Protein-Based Sensing Systems For The Detection Of Environmentally And Physiologically Relevant Molecules, Kendrick Bruce Turner Jan 2011

Cell And Protein-Based Sensing Systems For The Detection Of Environmentally And Physiologically Relevant Molecules, Kendrick Bruce Turner

Theses and Dissertations--Chemistry

The detection of small molecules in complex sample matrices such as environmental (surface and ground water, sediment, etc.) and biological (blood, serum, plasma, etc.) samples is of paramount importance for monitoring the distribution of environmental pollutants and their patterns of exposure within the population as well as diagnosing and managing diseases. Biosensors have demonstrated a singular ability to sensitively and selectively detect analytes in complex samples without the need for extensive sample preparation and pretreatment. Nature has demonstrated myriad examples of exquisite selectivity in spite of complexity and we seek to take advantage of that attribute in the development of …

Opioid Codrugs For Pain Management, Ujjwal Chakraborty Jan 2011

Opioid Codrugs For Pain Management, Ujjwal Chakraborty

Theses and Dissertations--Chemistry

Pain is an unpleasant sensory and emotional experience associated with actual or potential tissus damage or described in terms of such damage. Opioids are effective in treating moderate to severe pain, but opioid alone therapy is associated with several adverse effects, development of tolerance and addiction potential. One way to solve these problems is to administer opioids with adjuvant drugs. In this project several opioid molecules were combined with other adjuvant drugs in a single chemical entity to form a codrug.

A series of codrugs were prepared by conjugation of an opioid with S-(-)-nornicotine, ketamine, norketamine and gabapentin. Several …

Does Quantitative Or Qualitative Data Lower Stigma Of Those Suffering From Schizophrenia?, Fred A. Washburn Jan 2011

Does Quantitative Or Qualitative Data Lower Stigma Of Those Suffering From Schizophrenia?, Fred A. Washburn

Masters Theses

This study examines social tolerance and support for legal coercion for people suffering from schizophrenia. Mental illness, defined as a biomedical illness, has decreased stigma and support for legal coercion for other mental illnesses but has the inverse relationship with schizophrenia (Phelan, Yang, Cruz-Rojas, 2006; Schnittker, 2008). This increase in stigma may be linked to scientific quantitative data that places the illness in control of the person. The study examines Eastern Illinois University students' (N=130) level of social tolerance and support for legal coercion for people suffering from schizophrenia after they have been exposed to qualitative data, quantitative data, or …

Perceptions Of Body Image: A Study Of College Women In Sororities And Not In Sororities, Amy L. Piekarski

Masters Theses

College students, especially women, experience several extreme changes during their undergraduate years. These changes occur in areas of physical development, mental capacity, personality expression, and interpersonal relationship development. With these women leaving home and trying to find their place and fit in at their new institution, they seek out various groups of people and organizations to join. One group or organization that many college women engage in is sorority membership. To date, minimal research has been conducted to investigate whether membership in a sorority has a negative or positive effect on their self images. The purpose of the present study …

Β3-Adrenergic Agonists Mimic Eustress Response And Reduce Leptin-Mediated Proliferation In A Gbm Cell Line , Johnathan Lawrence, Nicholas J. Cook, Richard A. Rovin, Robert J. Winn

Journal Articles

A great deal of mental stress, depression, and anxiety often overwhelm cancer patients; those diagnosed with glioblastoma multiforme (GBM) are no exception. Different types of stress invariably impact what has been termed “the brain-adipocyte BDNF/leptin axis” (Dr. Cao and colleagues of the Comprehensive Cancer Center at The Ohio State University). For example, eustress (good stress) and distress (bad stress) both lead to increased sympathetic activity and adrenal gland stimulation, yet eustress reduces leptin levels and attenuates tumor growth while distress increases leptin levels and augments tumor growth. Complicating matters in GBM is that leptin and its receptor are expressed at …

School of Biological Sciences: Faculty Publications

Selenoproteins are essential in vertebrates because of their crucial role in cellular redox homeostasis, but some invertebrates that lack selenoproteins have recently been identified. Genetic disruption of selenoprotein biosynthesis had no effect on lifespan and oxidative stress resistance of Drosophila melanogaster. In the current study, fruit flies with knock-out of the selenocysteine-specific elongation factor were metabolically labeled with 75Se; they did not incorporate selenium into proteins and had the same lifespan on a chemically defined diet with or without selenium supplementation. These flies were, however, more susceptible to starvation than controls, and this effect could be ascribed to the …

Sem-Based Composite Reliability Estimates Of The Crisis Acuity Rating Scale With Children And Adolescents, Steven Thurber, Michael R. Bonynge Jan 2011

Sem-Based Composite Reliability Estimates Of The Crisis Acuity Rating Scale With Children And Adolescents, Steven Thurber, Michael R. Bonynge

Archives of Assessment Psychology

A Likert-type rating scale of crisis acuity was completed by on-call clinicians with 227 children and adolescents admitted consecutively to a youth crisis unit of a rural community mental health center. Traditional methods of estimating reliability for the scale were precluded. In particular, the scale was not found to be unidimensional when subjected to confirmatory factor analysis. This rendered Cronbach's alpha coefficient inappropriate. A six-factor oblique model corresponding to apriori subscales was supported. SEM-based reliability estimates for this confirmed factor structure using a phantom composite was detailed. The results yielded a point estimate of .845 with a bootstrap (1000 samples) …

Prediction Of Mmpi-2 Clinical Scales For Incomplete Protocols: Comprehensive Short-Form Analysis, F. Scott Winstanley, Bradley N. Axelrod, Leif V. Lalone

Archives of Assessment Psychology

The MMPI-2 is a thorough tool for personality assessment that has substantial importance in the field of neuropsychology. However, there have been reported problems for many neurologically impaired individuals who do not complete the test because of the demands of its length. Incomplete protocols are of little value with no formal way of scoring and interpreting the completed items. The following study examined the clinical utility of short-form versions of the MMPI-2 validity and clinical scales. Raw score correlations between various short-form and full-form tests on all validity and clinical scales, as well as mean raw score differences between short-form …
