American Vertigo: Dual Use, Prison Physicians, Research, And Guantanamo, George J. Annas Jan 2011

American Vertigo: Dual Use, Prison Physicians, Research, And Guantanamo, George J. Annas

Faculty Scholarship

Physicians can be used by governments for nonmedical purposes, and physician acceptance of their nonmedical use is usually denoted as "dual loyalty, " although it is more analytically helpful to frame it "dual use. " Dual use of physicians has been on display at Guantanamo where physicians have consistently been used to break hunger strikes as part of the military security mission in ways that directly violate medical ethics. Guantanamo itself has also been seen worldwide as a uniquely horrible prison, which can tell us little about other American prisons. The contrary seems to be true: Guantanamo, and the use …

An Upper Limit For Macromolecular Crowding Effects, Andrew C. Miklos, Congang Li, Courtney D. Sorell, L. Andrew Lyon, Gary J. Pielak

Biology, Chemistry, and Environmental Sciences Faculty Articles and Research

Background: Solutions containing high macromolecule concentrations are predicted to affect a number of protein properties compared to those properties in dilute solution. In cells, these macromolecular crowders have a large range of sizes and can occupy 30% or more of the available volume. We chose to study the stability and ps-ns internal dynamics of a globular protein whose radius is similar to 2 nm when crowded by a synthetic microgel composed of poly(N-isopropylacrylamide-co-acrylic acid) with particle radii of similar to 300 nm.

Results: Our studies revealed no change in protein rotational or ps-ns backbone dynamics and only mild …

Hiv And Women: Incongruent Policies, Criminal Consequences, Aziza Ahmed Jan 2011

Hiv And Women: Incongruent Policies, Criminal Consequences, Aziza Ahmed

Faculty Scholarship

UN Women must take an aggressive role in the standardization of laws and policies at the global and national level where their incongruence has negative and often criminal consequences for the health and lives of women and girls. This article focuses in on three such examples: opt-out testing for HIV, criminalization of vertical transmission, and the new World Health Organization guidelines on breastfeeding.

Feminism, Power, And Sex Work In The Context Of Hiv/Aids: Consequences For Women's Health, Aziza Ahmed Jan 2011

Feminism, Power, And Sex Work In The Context Of Hiv/Aids: Consequences For Women's Health, Aziza Ahmed

Faculty Scholarship

This paper examines the involvement of feminists in approaches to sex work in the context of HIV/AIDS. The paper focuses on two moments where feminist disagreement produced results in favor of an "anti-trafficking" approach to addressing the vulnerability of sex workers in the context of HIV. The first is the UNAIDS Guidance Note on Sex Work and the second is the "anti-prostitution pledge" found in the Presidents Emergency Plan for AIDS Relief. This article also examines the anti-sex work position articulated by abolitionist feminists and demonstrates the unintended consequences of the abolitionist position on women's health. By examining the actual …

Pay For Regulator Performance, M. Todd Henderson, Frederick Tung Jan 2011

Pay For Regulator Performance, M. Todd Henderson, Frederick Tung

Faculty Scholarship

Few doubt that executive compensation arrangements encouraged the excessive risk taking by banks that led to the recent Financial Crisis. Accordingly, academics and lawmakers have called for the reform of banker pay practices. In this Article, we argue that regulator pay is to blame as well, and that fixing it may be easier and more effective than reforming banker pay. Regulatory failures during the Financial Crisis resulted at least in part from a lack of sufficient incentives for examiners to act aggressively to prevent excessive risk. Bank regulators are rarely paid for performance, and in atypical cases involving performance bonus …

Illustrative Neighborhood Redevelopment, Bradley Bethel Jan 2011

Illustrative Neighborhood Redevelopment, Bradley Bethel

Theses

Urban planning is implemented under many theories and purposes. But often times, due to difference in public preferences, plans can become inconsistent and lack harmony with other neighborhoods. Design theories may become muddled in other design theories. Sometimes, even basic design principles are undermined or ignored completely. The city of Buffalo, New York is distinguished by several major characteristics in area planning. However, those plans have been threatened by inconsistent planning from the past sixty years. Only in recent years have plans been sought for more concise methods to preserve the past and establish newer, progressive plans. The Illustrative Neighborhood …

Freight Transportation And The Environment: Using Geographic Information Systems To Inform Goods Movement Policy, Arindam Ghosh Jan 2011

Freight Transportation And The Environment: Using Geographic Information Systems To Inform Goods Movement Policy, Arindam Ghosh

Theses

The freight transportation sector is a major emitter of the greenhouse gas carbon dioxide (CO2) which has been recognized by numerous experts and science organizations as a significant contributor to climate change. The purpose of this thesis is to develop a a framework for obtaining the freight flows for containerized goods movement through the U.S. marine, highway, and rail systems and to estimate CO2 emissions associated with the freight traffic along interstate corridors that serve the three major U.S. ports on the West Coast, namely the port of Los Angeles and Long Beach, the Port of Oakland and the Port …

Modeling Lean Six Sigma In The Small Packaging Industry In India, Robin Patel Jan 2011

Modeling Lean Six Sigma In The Small Packaging Industry In India, Robin Patel

Theses

This thesis is a result of my interest in implementing Lean Six Sigma into Indian packaging companies because the Indian industry is growing at 18-20% annually (Samal, 2010). This growth rate is expected to triple in the next five years. With USA outsourcing to foreign nations this substantial growth, as I envision the USA companies who are seeking India packaging materials will benefit from my original approach for converting the Indian packaging industry using Lean Six Sigma. I have a strong personal and professional desire to improve the manufacturing within India. It is the country in which I grew up …

Parliament's Role In Prospering European Integration And The Relations Between The Republic Of Kosov And The Republic Of Serbia : [Presentation Given On September 6, 2011], Ariana Musliu

Theses

There are several difficulties enforcing Kosovo in European Integration. One of these is most notably the relation with Serbia. The EU does not accept members into its family that have regional disagreements. One solution that was offered by the European Union and the United States of America was for a technical dialogue to solve the problems between these two states ... Based the results from the research study the technical dialogue between Republic of Kosovo and the Republic of Serbia will continue.

Biased Advice, Christopher Robertson Jan 2011

Biased Advice, Christopher Robertson

Faculty Scholarship

The modern capitalist society, characterized by decentralized decision making and increasingly sophisticated products and services, turns on relationships of epistemic reliance, where laypersons depend upon advisors to guide their most important decisions. Yet many of those advisors lack real expertise and may be biased by conflicting interests. In such situations, laypersons are likely to make suboptimal decisions that sometimes aggregate into systematic failures, from soaring health care costs to market crashes. Regulators can attempt to manage the symptoms and worst abuses, but the fundamental problem of biased advice will remain. There are many potential policy solutions, from outright bans on …

A Cautionary Tale On Arbitral Authority: Judges, Arbitrators And The Stolt-Nielsen Decision, William W. Park Jan 2011

A Cautionary Tale On Arbitral Authority: Judges, Arbitrators And The Stolt-Nielsen Decision, William W. Park

Faculty Scholarship

Few matters prove as slippery as the allocation of tasks between judges and arbitrators in commercial disputes. A choice to arbitrate implicates waiver of access to otherwise competent courts in favor of adjudication which is both private and binding. Respect for this bargain means that judges should not normally disturb an arbitrator’s substantive conclusions.

Background: We tested the hypothesis that 5-Hydroxydecanoic acid (5HD), a putative mitoKATP channel blocker, will reverse sepsis-induced cardiodynamic and adult rat ventricular myocyte (ARVM) contractile dysfunction, restore mitochondrial membrane permeability alterations and improve survival. Methodology/Principal Findings: Male Sprague-Dawley rats (350-400 g) were made septic using 400 mg/kg cecal inoculum, ip. Sham animals received 5% dextrose water, ip. The Voltage Dependent Anion Channels (VDAC1), Bax and cytochrome C levels were determined in isolated single ARVMs obtained from sham and septic rat heart. Mitochondria and cytosolic fractions were isolated from ARVMs treated with norepinephrine (NE, 10 µmoles) in the presence/absence of 5HD …

Comparing Species And Ecosystem-Based Estimates Of Fisheries Yields, John H. Steele, Dian J. Gifford, Jeremy S. Collie Jan 2011

Comparing Species And Ecosystem-Based Estimates Of Fisheries Yields, John H. Steele, Dian J. Gifford, Jeremy S. Collie

Graduate School of Oceanography Faculty Publications

Three methods are described to estimate potential yields of commercial fish species: (i) single-species calculation of maximum sustainable yields, and two ecosystem-based methods derived from published results for (ii) energy flow and for (iii) community structure. The requirements imposed by food-web fluxes, and by patterns of relative abundance, provide constraints on individual species. These constraints are used to set limits to ecosystem-based yields (EBY); these limits, in turn, provide a comparison with the usual estimates of maximum sustainable yields (MSY). We use data on cod and haddock production from Georges Bank for the decade 1993–2002 to demonstrate these methods. We …

Martha, Jeremiah B. Knapp, Samson William Smith, Kevin C. Stein, Dee R. Denver

Biology Faculty Publications and Presentations

Background: Mutations that impair mitochondrial functioning are associated with a variety of metabolic and age-related disorders. A barrier to rigorous tests of the role of mitochondrial dysfunction in aging processes has been the lack of model systems with relevant, naturally occurring mitochondrial genetic variation. Toward the goal of developing such a model system, we studied natural variation in life history, metabolic, and aging phenotypes as it relates to levels of a naturally-occurring heteroplasmic mitochondrial ND5 deletion recently discovered to segregate among wild populations of the soil nematode, Caenorhabditis briggsae. The normal product of ND5 is a central component of the …

Financial Literacy Or Financial Castigation?, John A. E. Pottow Jan 2011

Financial Literacy Or Financial Castigation?, John A. E. Pottow

Articles

This year, the Canadians- through their government-convened Task Force on Financial Literacy - have proudly produced, "Canadians and their Money: Building a Brighter Financial Future." Armed with 30 recommendations, its most dramatic innovation is to recommend the creation of a Financial Literacy Leader. I have been asked to provide an American perspective on this report specifically and the broader agenda of "financial literacy" more generally as a consumer welfare intervention. Let me start by acknowledging the critiques of the Canadian Task Force. For example, my Canadian colleague, Saul Schwartz, has already drafted a compelling analysis of the political economy behind …

Malpractice Suits And Physician Apologies In Cancer Care, Eugene Chung, Jill R. Horwitz, John A.E. Pottow, Reshma Jagsi

Articles

Conside the following case: The patient is a 44-year-old woman who presents for radiation treatment of an isolated locoregional recurrence of breat cancer in her chest wall, 3 years after undergoing masectomy. At the time of diagnosis, she had T2N2M0 disease, with four of 15 lymph nodes involved with tumor. She received a masectomy with negative margins and appropriate chemotherapy, but none of her physicians talked to her about postmasectomy radiation therapy, which would clearly have been indicated to reduce her risk of locoregional failure and would have been expected to improve her likelihood of survival. She asks the radiation …

Losing It, William I. Miller Jan 2011

Losing It, William I. Miller

Articles

You are in your sixties, even fifties, and you are walking by a shop window, or in some area in which a security monitor shows a scan of the line you are in. You sneak a look. You see someone in the space where you should be but you do not recognize the interloper. Then, after an unseemly lag of a second or two you are forced to remake your own acquaintance; it seems you no longer know yourself at first sight. The you behind your eyes believes you look like you did twenty years ago, and it assumes that …

Nevada County’S Assisted Outpatient Treatment Program: A Model For Other California Counties To Adopt?, Ralph J. Murrieta Jr.

Master's Projects

In May 2008, Nevada County became the first county in California to fully implement an Assisted Outpatient Treatment (AOT) program under the guidelines established by Assembly Bill 1421 (Keller, 2011). The Assisted Outpatient Treatment Demonstration Project Act of 2002, more commonly known as “Laura’s Law”, established guidelines for the court ordering of treatment for persons incapacitated by a mental disorder (California Department of Mental Health [CA DMH], 2003).

Passed in September 2002, the bill was highly controversial leading up to its passage and remains a very divisive issue today (Fagan, 2010). This paper will focus on the provisions of the …

Confidentiality Explained: The Dialogue Approach To Discussing Confidentiality With Clients, Elisia M. Klinka, Russell G. Pearce

Faculty Scholarship

Many lawyers lie to their clients by saying, “Everything you tell me is confidential” despite the existence of some rules that require lawyers to disclose client confidences and others that permit lawyers to disclose confidences to protect themselves or collect fees. In an effort to encourage clients to speak honestly, a number of commentators urge lawyers to provide either a general or specific notice of the exceptions to confidentiality. This Article offers a different approach. It seeks to promote an honest and open dialogue between lawyer and client that will create a relationship of mutual trust and will make it …

Student Preferences In Library Website Vocabulary, Mark Aaron Polger Jan 2011

Student Preferences In Library Website Vocabulary, Mark Aaron Polger

Publications and Research

This study explores student preferences to library website vocabulary and compares the data with what librarians report on their library's website. Two questionnaires were distributed in the fall of 2009 to students (N=300) and librarians (N=527). Students were asked to identify the terms they prefer from a larger list of library website vocabulary. Librarians were asked to report the terms that were used on their library's website. Twenty-seven terms were selected for both the student and librarian questionnaires. The 27 terms were culled from library literature, library instruction classes, and reference desk interactions. Of the 300 students, 54% were freshmen, …

Linking Cd Accumulation And Effect In Resistant And Sensitive Freshwater Invertebrates, Tony Straus Jan 2011

Linking Cd Accumulation And Effect In Resistant And Sensitive Freshwater Invertebrates, Tony Straus

Theses and Dissertations (Comprehensive)

There has been recent discussion within the field of environmental toxicology as to the viability of using the bioaccumulation of a chemical toxicant to predict toxic effects. Current literature has shown this concept to carry some merit, although there is a major flaw in that with many cases, namely those involving sensitive species, body burdens cannot be reliably linked to effects (Adams et al. (2010)). Bearing this issue in mind the goal of this thesis was to assess the viability of using bioaccumulation as a measure of effect in a different way.

The proposed idea utilized Cd accumulation in a …

Effective Islamic Spiritual Care: Foundations And Practices Of Imams And Other Muslim Spiritual Caregivers, Nazila Isgandarova

Theses and Dissertations (Comprehensive)

In Canada, Muslim communities turn to Muslim spiritual caregivers, especially to imams, for help with various problems. Research has shown that many Muslim spiritual caregivers are familiar with the Arabic language and Islamic values but have limited practice in Islamic counseling and psychotherapy. This study is intended to examine the effectiveness of Muslim spiritual caregivers in the context of Canadian Muslims’ health care. Cross-sectional ethnographic research with fifteen Muslim spiritual caregivers and interviews with them were conducted.

Our results show that even though the majority of Muslim spiritual caregivers have no formal training in Western psychotherapy intervention, they nonetheless play …

Exegetical And Extispicic Readings Of The Bible In Turkana, Kenya, And North America, Kevin P. Lines Jan 2011

Exegetical And Extispicic Readings Of The Bible In Turkana, Kenya, And North America, Kevin P. Lines

The Asbury Journal

While a missional hermeneutic elucidates missiological interpretation of scripture, translation would be the key descriptive of missiological me of scripture. Articulating, a Turkana extispicic hermeneutic as both a critical and a valid process for interpreting the Bible, this paper proposes that Christians have the opportunity to engage in alternative intercontextual critical hermeneutical processes when "reading" the Bible. This engagement could reveal an ontic expansion of God-if we are able to overcome eclectic diversity and the fear of relativism. Three locations: theological institutions, missionaries, in the church, and diaspora communities are suggested for practical application of intercontextual hermeneutics.

Characterization Of Photochromogenic Mycobacterium Spp. From Chesapeake Bay Striped Bass Morone Saxatilis, D. T. Gauthier, A. M. Helenthal, M. W. Rhodes, W. K. Vogelbein, H. I. Kator

Biological Sciences Faculty Publications

A large diversity of Mycobacterium spp. has been isolated from striped bass Morone saxatilis in Chesapeake Bay, USA. The new species M. shottsii and M. pseudoshottsii are the dominant isolates, while the classical fish pathogen M. marinum is found much less frequently. M. fortuitum and M. chelonae, other Mycobacterium spp. known to commonly infect fishes, have not yet been aseptically isolated from striped bass within Chesapeake Bay. While M. pseudoshottsii and M. shottsii have been phenotypically and genotypically characterized, other less common mycobacterial isolates have not. In the present study, we describe 17 photochromogenic isolates from Chesapeake …

Infectious diseases ranging from the common cold to cholera affect our society physically, emotionally, ecologically, and economically. Yet despite their importance and impact, there remains a lack of effective teaching materials for epidemiology and disease ecology in K-12, undergraduate, and graduate curricula [2]. To address this deficit, we've developed a classroom lesson with three instructional goals: (1) Familiarize students on basic concepts of infectious disease ecology; (2) Introduce students to a classic compartmental model and its applications in epidemiology; (3) Demonstrate the application and importance of mathematical modeling as a tool in biology. The instructional strategy uses a game-based mathematical …
