In The Name Of Watergate: Returning Ferpa To Its Original Design, Mary Margaret Penrose Jan 2011

In The Name Of Watergate: Returning Ferpa To Its Original Design, Mary Margaret Penrose

Faculty Scholarship

This article seeks to proffer an improved definition for “education records” without altering the legislation's original design. Part I provides a historical account of Watergate's climate to illustrate why privacy rights blossomed during the 1970s and provided an atmosphere conducive to the passage of FERPA. Part II details FERPA's legislative history. Part III presents the statute's current definition of “education records” and evaluates how courts interpret FERPA. Part IV suggests a modernized definition that considers the computerization of education and, correspondingly, education records. The section begins with a comparison of FERPA and the Privacy Act of 1974. Thereafter, it exposes …

The Psychological Foundations Of Behavioral Law And Economics, Jeffrey J. Rachlinski Jan 2011

The Psychological Foundations Of Behavioral Law And Economics, Jeffrey J. Rachlinski

Cornell Law Faculty Publications

Over the past decade, psychological research has enjoyed a rapidly expanding influence on legal scholarship. This expansion has established a new field—“Behavioral Law and Economics” (BLE). BLE’s principal insight is that human behavior commonly deviates from the predictions of rational choice theory in the marketplace, the election booth, and the courtroom. Because these deviations are predictable, and often harmful, legal rules can be crafted to reduce their undesirable influence. Ironically, BLE seldom recognizes that its intellectual origins lie with psychology more so than economics. This failure leaves BLE open to criticisms that can be answered only by embracing the underlying …

Cerebral Perfusion In Chronic Stroke: Implications For Lesion-Symptom Mapping And Functional Mri, Jessica D. Richardson, Julie M. Baker, Paul S. Morgan, Chris Rorden, L. Bonilha, Julius Fridriksson

Faculty Publications

Lesion-symptom mapping studies are based upon the assumption that behavioral impairments are directly related to structural brain damage. Given what is known about the relationship between perfusion deficits and impairment in acute stroke, attributing specific behavioral impairments to localized brain damage leaves room for speculation, as impairments could also reflect abnormal neurovascular function in brain regions that appear structurally intact on traditional CT and MRI scans. Compared to acute stroke, the understanding of cerebral perfusion in chronic stroke is far less clear. Utilizing arterial spin labeling (ASL) MRI, we examined perfusion in 17 patients with chronic left hemisphere stroke. The …

Invention Center: A Building Of Inventions, Jonathan T. Archbald Jan 2011

Invention Center: A Building Of Inventions, Jonathan T. Archbald

Architecture Theses and Projects

In today’s world, the word sustainable often goes hand in hand with design. As a recent trend the LEED standards are used as a way to “prove” a building’s commitment to being sustainable. LEED however is only the tip of the sustainable iceberg of what design can actually be. The term Sustainable has to be linked with the term efficient. Sustainability is more than the design and construction of a project. It has to be involved with all aspects of a project’s life.

Examining Comparative Value Arguments, Capital Sentencing Evidence, And Legal Safeguards, Rachel Small Jan 2011

Examining Comparative Value Arguments, Capital Sentencing Evidence, And Legal Safeguards, Rachel Small

Psychology Theses

Comparative value arguments (CVA) suggest to jurors that a death sentence is appropriate because the victim’s value surpasses the defendant’s value. Jurors exposed to CVA are likely to misuse mitigation and victim impact evidence. The present study has a sample of 140 university students. A 2 x 4 + 1 between-groups factorial design was utilized to examine effects of mitigation and victim impact evidence in the context of CVA (held constant); and to test legal safeguard efficacy. A main effect was found of legal safeguards on jurors’ perceptions of prosecutorial misconduct, and a significant association was found between legal safeguards …

The Role Of Parents' Medication Beliefs, Religious Problem-Solving, And Risks For Treatment Nonadherence In Urban Families With Asthma, Sue K. Adams, Karla Klein Murdock, Elizabeth L. Mcquaid, Lori-Ann Lima Jan 2011

The Role Of Parents' Medication Beliefs, Religious Problem-Solving, And Risks For Treatment Nonadherence In Urban Families With Asthma, Sue K. Adams, Karla Klein Murdock, Elizabeth L. Mcquaid, Lori-Ann Lima

Human Development and Family Science Faculty Publications

Childhood asthma is highly prevalent, affecting approximately nine million children in the United States. Negative effects of pediatric asthma are disproportionately experienced by ethnic minorities living in low-income, urban settings. Given the great diversity in families' ways of addressing children's asthma symptoms, sociocultural factors underlying asthma disparities must be examined. The current study investigated associations among parents' beliefs about conventional and holistic/alternative medications, parents' religious problem-solving strategies and childrens' risks for asthma treatment nonadherence. The sample included 66 parents of ethnically diverse children with asthma living in urban settings. Factor analysis of the Religious Problem Solving Questionnaire yielded two factors, …

The Reinventing the Wheel project is the process of developing a Bicycle Refinement Plan for the City of Redmond. A group of volunteer urban & regional planning graduate students from Portland State University, known as b:spoke Planning & Design, has been charged with developing strategies to increase bicycle ridership and remove barriers to transit options in Redmond. The project is a "refinement plan", as it involves the refinement of and building upon existing City plans such as the Transportation Systems Plan (TSP), Bicycle Master Plan, and Parks & Recreation Trails Master Plan. This project was conducted under the supervision of …

From Fur Baby To Chick Magnet: A Sociological View Of Dogs And Their People, Ariel Teresa Leigh Petersen Jan 2011

From Fur Baby To Chick Magnet: A Sociological View Of Dogs And Their People, Ariel Teresa Leigh Petersen

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Since their domestication, dogs have played an important role in human society. People put them to work hunting game, herding livestock and guarding the home, and also keep them as companions. As dogs increasingly occupy a meaningful position in the lives of their owners, the startling lack of research on dog-human interaction becomes increasingly apparent.

This research discovers different ways people relate to their dogs, and the meaning dogs hold for their owners. While conducting observations, I identified and interviewed owners who exhibited an emotionally meaningful attachment to their dogs. I then used Glaser and Strauss’ grounded theory approach to …

Corn And Culture: The Influence Of Zea Mays Across Cultural And Historical Boundaries, Ginny Marie Mueller Jan 2011

Corn And Culture: The Influence Of Zea Mays Across Cultural And Historical Boundaries, Ginny Marie Mueller

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Corn's status as a critical food crop, and its location within indigenous new world cosmographies, illustrate the important sociocultural role the plant has played for millennia. However, modern society has elevated Zea mays far above the status of mere plant, fashioning it into a commodity intimately connected to systems of control and capitalism. Consequently, corn has played an essential role in colonization, industrialization, and the advent of overproduction. The beliefs and literature of numerous new world cultures, along with the literatures of modern Western cultures, offer a striking analysis of corn's current position in western society. The far-reaching impacts that …

Amplify Pdx, Becky Bodonyi, Julia Crain, Rowan Steele, David West Jan 2011

Amplify Pdx, Becky Bodonyi, Julia Crain, Rowan Steele, David West

Master of Urban and Regional Planning Workshop Projects

A two-pronged process, AmplifyPDX required managing two parallel and concurrent but mutually informative processes: creation of the Community Assessment Workbook as well as implementation of the Workbook in a particular community. To develop the Workbook, Mosaic Planning Group conducted a literature review, assembled an Advisory Committee and interviewed key informants with expertise on neighborhood planning, community organizing, and the Portland metropolitan region. Finally, in order to develop a user-friendly and effective community assessment workbook, Mosaic Planning Group tested certain elements of the Workbook in the Southeast Portland neighborhoods of Brentwood-Darlington and Woodstock. This project was conducted under the supervision of …

Portland Mercado: Community Economic Development To Revitalize, Uplift, And Empower, Abigail Cermak, David Ruelas, Bridger Wineman, Ellen Wyoming

Master of Urban and Regional Planning Workshop Projects

Realizing public goals of an inclusive and vibrant society requires an advocacy approach to urban planning and economic development. Adelante Planning outlines strategies based on research and case studies to successfully implement a Mercado as an economic development and business incubation strategy for Portland’s Latino community. A Mercado is a strategic planning approach targeted toward Latino populations and other minorities, particularly in gentrifying locations of the Portland Metro region.

This project was conducted under the supervision of Ellen Bassett, Lisa Bates, Karen Gibson, Ken Pirie, and Sumner Sharpe.

The purpose of this study is to gain an understanding of the experiences of women that lead them to pursue a Ph.D in Counseling, as well a study of their experiences in their doctoral program. The goal of this study is to identify those factors related to women’s academic success. This study applies the resiliency and emotional intelligence (EI) framework to analyze the subjects' experiences. Another construct related to EI and resilience, Antonovsky’s (1987) theory of coherence, is employed to explain the way in which the subjects converted negative external factors into achievement motivation. A three and a half hour …

Care Coordination, Family-Centered Care And Functional Ability In Children With Special Health Care Needs In The United States, Madeline Marti-Morales Jan 2011

Care Coordination, Family-Centered Care And Functional Ability In Children With Special Health Care Needs In The United States, Madeline Marti-Morales

Walden Dissertations and Doctoral Studies

Children with special health care needs (CSHCN) generally have physical, mental, or emotional conditions that require a broader range and greater quantity of health and related services compared to typical children. Care coordination (CC) and family-centered care (FCC) are necessary in the quality of health care for CSHCN. A gap exists in the literature regarding the impact of CC and FCC on children's functional ability (FA). Previous researchers have focused on met and unmet health care needs, but not on health outcomes or functionality. The purpose of this study was to determine if there was an association between CC, FCC, …

Assessing City Preparedness For A Biological Attack, Joseph T. Moore Jan 2011

Assessing City Preparedness For A Biological Attack, Joseph T. Moore

Walden Dissertations and Doctoral Studies

The lack of preparedness by local communities in the event of a biological attack is a predicament that will result in chaos and an increase in casualties. Assessing city preparedness is essential in the event of a biological attack. The potential for an enormous number of casualties is real; it is imperative, therefore, for local communities to be prepared in the event of a biological attack. This descriptive single case study investigated whether one city in the southeastern United States is prepared for a biological attack. System theory provided the theoretical framework for this research, with the unit of analysis …

Early Childhood Educators Teaching And Learning In Professional Learning Communities: A New Approach To Professional Development For Preschool Teachers In A Southern California School District, Robin Fairfield Jan 2011

Early Childhood Educators Teaching And Learning In Professional Learning Communities: A New Approach To Professional Development For Preschool Teachers In A Southern California School District, Robin Fairfield

Walden Dissertations and Doctoral Studies

Early childhood education teachers have been challenged with the demands for accountability in literacy and English language development, as well as kindergarten readiness skills of preschool children. Researchers have studied professional learning communities (PLCs) as a framework for professional development and student achievement. However, few have studied the effects of PLCs in preschool. The purpose of this qualitative case study was to explore how PLCs support preschool teachers in Head Start and other preschool programs. The research questions involved understanding teaching and learning opportunities for early childhood education (ECE) that can produce positive child outcomes. Using social constructivist assumptions, data …

Public Safety Directors' Leadership Role For The Implementation Of The National Incident Management System, John C. Mccauley Jan 2011

Public Safety Directors' Leadership Role For The Implementation Of The National Incident Management System, John C. Mccauley

Walden Dissertations and Doctoral Studies

The National Incident Management System (NIMS) is the result of Homeland Security Presidential Directive 5 (HSPD-5). NIMS requires the Secretary of Homeland Security to develop a national policy template for state, local, regional, and federal agencies to work together during emergencies. One difficulty with NIMS is that state and local agencies interpret and implement NIMS requirements differently. Using Lusier & Achua's theory of integrative leadership and Burns, Bass, Kouzes, and Posner's concept of transformational leadership, this study examined the relationship between the leadership provided by city public safety directors (CPSDs) and effective NIMS implementation at the local level. Two research …
