Judicial Gatekeeping And The Seventh Amendment: How Daubert Infringes On The Constitutional Right To A Civil Jury Trial, Brandon L. Boxler
Richmond Public Interest Law Review
This Article begins by reviewing the history, purpose, and function of the Seventh Amendment within the American constitutional system. It then discusses the Supreme Court's analytical framework for preserving the fundamental features of the right to a civil jury trial while simultaneously permitting rational legal development of the jury system. Next, the Article provides a brief overview of the Court's Daubert jurisprudence, and argues that the creation of judicial gatekeeping has caused an institutional shift of adjudicatory authority away from juries and into the hands of judges in violation of the Seventh Amendment. The Article concludes by suggesting three legal …

Health Care Reform In Virginia: Lessons Learned Before, During, And After The 2011 Virginia General Assembly, Hunter W. Jamerson
Richmond Public Interest Law Review
This article surveys Virginia's initial foray into health care reform. This process began with the Virginia Health Reform Initiative, which had a significant presence in the Virginia 2011 General Assembly session. While the nascent health care reform efforts this session reflect only incremental steps, they are indicative of Virginia's direction and commitment to change. Such change, however, will carry great political and professional strife. This article highlights some examples of the challenges faced on the road to health care reform and discusses possible directions of future legislation in the Virginia General Assembly.

Legislative Control Of The Menhaden Fishery, Nicole M. Rovner, Matthew G. Curtis
Richmond Public Interest Law Review
This year, six menhaden- related bills were introduced in the Virginia General Assembly. Delegate John Cosgrove (RChesapeake) introduced legislation in the House of Delegates that was identical to Senate Bill 765, a bill that proposed to shift oversight of the menhaden fishery to the VMRC. This article aims to highlight the unique stance taken by Virginia's legislature and explain why this management is better left to the commission responsible for managing every other fishery in the Commonwealth. While there may not be a conclusive link between reduction industry practices and a decline in water quality, Virginia's legislators should recognize the …

Sex Bias In Neuroscience And Biomedical Research, Annaliese K. Beery, Irving Zucker
Sex Bias In Neuroscience And Biomedical Research, Annaliese K. Beery, Irving Zucker
Neuroscience: Faculty Publications
Female mammals have long been neglected in biomedical research. The NIH mandated enrollment of women in human clinical trials in 1993, but no similar initiatives exist to foster research on female animals. We reviewed sex bias in research on mammals in 10 biological fields for 2009 and their historical precedents. Male bias was evident in 8 disciplines and most prominent in neuroscience, with single-sex studies of male animals outnumbering those of females 5.5 to 1. In the past half-century, male bias in non-human studies has increased while declining in human studies. Studies of both sexes frequently fail to analyze results …

Current Therapies For Chronic Hepatitis C, Mckenzie C. Ferguson
Pharmacy Faculty Research, Scholarship, and Creative Activity
Hepatitis C virus affects more than 180 million people worldwide and as many as 4 million people in the United States. Given that most patients are asymptomatic until late in the disease progression, diagnostic screening and evaluation should be performed in patients who display high-risk behaviors associated with acquisition of hepatitis C. Chronic hepatitis C is associated with cirrhosis, hepatic failure, and death; therefore, treatment is aimed at reducing these complications, as well as improving quality of life and minimizing adverse effects. The American Association for the Study of Liver Diseases Practice Guidelines on the Diagnosis, Management, and Treatment of …

Wildlife Deterrent System: The "Scare Wave" Audio Deterrent System, Ferdd Mari C. Lansang, Kevin Wong
Electrical Engineering
The “Wildlife Deterrent System – The “SCARE WAVE” Audio Deterrent System” project involved working with a client, Mr. Robert Alberti, who requested the production of a device that would be used to scare away wildlife around his property, namely the Acorn Woodpecker. It was specified that this device be weatherproof and able to produce a 75 dB gunshot sound, when remotely triggered, which would cover a 30 ft radius circle of area. However, we have taken these specifications and went above and beyond with the final product. Our final product is weatherproofed and able to produce four user-specifiable, via provided …

Phones are now an integral component in the daily lives of people. Smartphones give access to movies, internet, and even books. This versatility and increased use can also lead to a shorter battery life. A phone with video viewing capabilities will be a heavy load on the unit’s battery. With phones utilizing 3G and 4G technology, even heavier demands are placed on the battery. As technology improves even further to provide for a larger entertainment experience on the phone, this could also lead to further battery degradation if the current battery situation isn’t addressed. To have a fully operational phone …

Pathways From Child Sexual Abuse To Adult Depression: The Role Of Parental Socialization Of Emotions And Alexithymia, Renu A. Thomas, David Dilillo, Kate Walsh, Melissa A. Polusny
Department of Psychology: Faculty Publications
Objective: Depression is common among adult survivors of child sexual abuse (CSA), but the intervening processes responsible for this outcome have not yet been fully delineated. The present study investigated the mediating role of perceived parental emotion socialization and alexithymia (difficulties identifying and describing feelings) in explaining the link between CSA and adult depressive symptoms in female veterans.
Method: Cross-sectional data were collected from 110 female veterans who completed self-report questionnaires measuring demographics, sexual victimization history, perceived parental emotion socialization, and current symptoms of alexithymia and depression.
Results: Linear regression analyses showed that CSA predicted greater depression, which was partly …

Current Jurisdictional And Recognitional Issues In The Conflict Of Laws, Vaughan Black, Joost Blom, Janet Walker
Articles & Book Chapters
In honour of the 40th Consumer and Commercial law Workshop and the 50th volume of the Canadian Business Law Journal the authors were asked to provide a retrospective of developments in the conflict of laws that highlights emerging issues. They present their comments in a conversational fashion in which each presents a perspective upon which the other two authors comment. The following issues are discussed: reorientation of Canadian private international law following the Morguard decision (Supreme Court of Canada, 1990), convergence - both international and interprovincial, and becoming more worldly in a changing world.

Restricted Access To Justice For Canadians Mistreated Abroad: Abdelrazik V. Canada (Re: Interim Costs), Sean Rehaag
Articles & Book Chapters
Abousfian Abdelrazik is a Canadian citizen who, after having his name added to various anti-terrorism lists, and after being tortured by Sudanese officials, found himself unable to return home from Sudan largely because of Canadian government actions. Abdelrazik sought to challenge the constitutionality of these restrictions on his ability to return to Canada. However, he had no money and no means of support, as he was unable to leave a Canadian embassy in Sudan where he had sought refuge to avoid further torture by Sudanese officials. He therefore brought a motion for interim costs in Canada’s Federal Court. If granted, …

Aggressors' Rights: The Doctrine Of ‘Equality Between Belligerents’ And The Legacy Of Nuremberg, Michael Mandel
Articles & Book Chapters
The moral and legal debate over the separation of jus in bello from jus ad bellum generally assumes that the law of war supports this separation and the concomitant doctrine of ‘equality between belligerents’, also known as the ‘duality’ or the ‘symmetry’ principle. This article examines the Nuremberg-era precedents and legal scholarship, as well as more recent legal and scholarly material, and argues that the general assumption is wrong and that the arguments supporting the radical legal separation of the two jus's are unconvincing.

Sign- Vs. Goal-Tracking In A Feature Positive Discrimination Task With Nicotine: Importance Of Spatial Location Of The Conditional Stimulus, Amanda M. Dion, Carmela M. Reichel, Rick A. Bevins
Sign- Vs. Goal-Tracking In A Feature Positive Discrimination Task With Nicotine: Importance Of Spatial Location Of The Conditional Stimulus, Amanda M. Dion, Carmela M. Reichel, Rick A. Bevins
Department of Psychology: Faculty Publications
We assessed whether sign-tracking developed along with goal-tracking in a Pavlovian drug discrimination task. Rats had nicotine sessions intermixed with saline sessions. For nicotine sessions, 15-sec illumination of a light near (Experiment 1) or far (Experiment 2) from the dipper receptacle was followed by sucrose. Saline sessions were similar except sucrose was withheld. Regardless of location, the light evoked goal-tracking only on nicotine sessions. Only rats with the light near the dipper developed sign-tracking.

Nicotine Trained As A Negative Feature Passes The Retardation-Of-Acquisition And Summation Tests Of A Conditioned Inhibitor, Jennifer E. Murray, Andrew W. Walker, Chia Li, Nicole R. Wells, Rachel D. Penrod, Rick A. Bevins
Department of Psychology: Faculty Publications
Nicotine functions as a negative feature in a Pavlovian discriminated goal-tracking task. Whether withholding of responding to the conditional stimulus (CS) reflects nicotine functioning as a conditioned inhibitor is unknown. Accordingly, the present research sought to determine whether nicotine trained as a negative feature passed the retardation-of-acquisition and summation tests, thus characterizing it as a pharmacological (interoceptive) conditioned inhibitor. In the retardation test, rats received either nicotine (0.4 mg/kg) or chlordiazepoxide (5 mg/kg) negative feature training in which the drug state signaled when a 15-sec light CS would not be paired with sucrose; light was paired with sucrose on intermixed …
An Examination Of Nmda Receptor Contribution To Conditioned Responding Evoked By The Conditional Stimulus Effects Of Nicotine, Jennifer E. Murray, Andrew W. Walker, Robert J. Polewan, Rick A. Bevins
An Examination Of Nmda Receptor Contribution To Conditioned Responding Evoked By The Conditional Stimulus Effects Of Nicotine, Jennifer E. Murray, Andrew W. Walker, Robert J. Polewan, Rick A. Bevins
Department of Psychology: Faculty Publications
Rationale—Research using a drug discriminated goal-tracking (DGT) task showed that the Nmethyl- D-aspartate (NMDA) channel blocker MK-801 (dizocilpine) reduced the nicotine-evoked conditioned response (CR).
Objectives—Given the unknown mechanism of the effect, Experiment 1 replicated the MK-801 results and included tests with NMDA receptor ligands. Experiments 2a and 2b tested whether MK-801 pretreatment blocked DGT via a state-dependency effect.
Methods—In Experiment 1, adult male Sprague–Dawley rats received intermittent access to liquid sucrose following nicotine (0.4 mg base/kg); no sucrose was delivered on intermixed saline sessions. Conditioning was indicated by increased anticipatory dipper entries (goal-tracking) on nicotine compared to saline sessions. Antagonism …
Thinking About The Future Cognitive Remediation Therapy—What Works And Could We Do Better?, Til Wykes, William D. Spaulding
Thinking About The Future Cognitive Remediation Therapy—What Works And Could We Do Better?, Til Wykes, William D. Spaulding
Department of Psychology: Faculty Publications
This article reviews progress in the development of effective cognitive remediation therapy (CRT) and its translational process. There is now enough evidence that cognitive difficulties experienced by people with schizophrenia can change and that the agenda for the next generation of studies is to increase these effects systematically through cognitive remediation. We examine the necessary steps and challenges of moving CRT to treatment dissemination. Theories which have been designed to explain the effects of cognitive remediation, are important but we conclude that they are not essential for dissemination which could progress in an empirical fashion. One apparent barrier is that …
Nicotine Competes With A Visual Stimulus For Control Of Conditioned Responding, Jennifer E. Murray, Nicole R. Wells, Rick A. Bevins
Nicotine Competes With A Visual Stimulus For Control Of Conditioned Responding, Jennifer E. Murray, Nicole R. Wells, Rick A. Bevins
Department of Psychology: Faculty Publications
Environmental stimuli that co-occur with tobacco use come to evoke drug-related conditioned responses (CRs) that appear involved in continued use of nicotine-containing products. In rats, nicotine can serve as a conditional stimulus (CS) for non-drug unconditioned stimuli (USs), prompting the question of whether the nicotine CS can compete with, or overshadow, a non-drug environmental stimulus for control of a CR. In Experiment 1, male Sprague-Dawley rats were assigned to a group [0, 0.01, 0.03, 0.045, or 0.06 mg nicotine (base)/kg/infusion]. During each session, there were 10 intravenous infusions followed by a 30-second houselight to form a compound CS. At light …

Research has shown that many students are not interested in learning mathematics; they find it difficult to understand, irrelevant to their daily lives, and uninteresting. This thesis explores elements of computer games that may satisfy children’s learning needs and ultimately motivate them to learn mathematical concepts.
According to a 2008 survey conducted by the Washington, D.C. based Pew Research Center, 97% of children between the ages of 12 and 17 in the United States play computer, Web, portable or console games. Based on these numbers we can conclude young students like video games. Over the past few years, a new …

Articles & Book Chapters
This article examines the Supreme Court of Canada’s cost-benefit analysis of freedom of conscience and religion guaranteed by s. 2(a) of the Canadian Charter of Rights and Freedoms in Alberta v. Hutterian Brethren of Wilson Colony. The article finds that while the Supreme Court’s reasoning was ultimately flawed, its use of cost-benefit analysis may be a positive development in the freedom of religion framework. The article also looks at the Court’s treatment of the freedom of conscience guarantee in relation to freedom of religion. The article suggests that this treatment may foreshadow a more uniform approach to the broader …
