The Use And Abuse Of Blight In Eminent Domain, Martin E. Gold, Lynne B. Sagalyn
Fordham Urban Law Journal
This Article examines the term "blight" and how it is used in eminent domain cases. Part I discusses the development of the term and how various states define it. Part II lays out a hierarchy which may be used to compare the private benefits on one hand and the public benefits on the other hand in redevelopment projects. In Part III, the Columbia University expansion in Manhattanville is examined, at both the New York Appellate Division and Court of Appeals levels. Part IV discusses how forty-three states redefined blight after the Kelo case. Part V discusses how political and business …

Examining Variables Related To Help-Seeking And Victimization Differences After Coercive Intercourse, Ginger Faulkner
All-Inclusive List of Electronic Theses and Dissertations
The issue of sexual violence against women has been an area of interest to psychological researchers because of its importance and prevalence in America. A problem that has been attracting more attention recently is sexual coercion against women, especially on college campuses. Researchers have consistently found that over half of college women have been victim to coercive sexual encounters (Struckman-Johnson, Struckman-Johnson, & Anderson, 2003) making this a serious problem in need of greater understanding. Researchers have also found that sexual coercion can cause a variety of problems, yet victims typically do not seek help after these experiences (Fisher, Daigle, Cullen, …

Teacher Self-Efficacy Beliefs Related To Chronic Disruptive Behavior, Kalinda R. Jones
All-Inclusive List of Electronic Theses and Dissertations
In the current study, elementary teachers' self-efficacy beliefs regarding working with students displaying chronic disruptive behavior (CDB) were explored. CDB was defined as persistent observable actions that have a negative impact on academic or social functioning. To address the infrequently researched construct of self-efficacy beliefs specific to teaching students exhibiting CDB, a modified version of the Teachers' Sense of Efficacy Scale (short form) was used. Factor analysis results indicated the three self-efficacy factors of instructional strategies self-efficacy, classroom management self-efficacy, and student engagement self-efficacy. No significant relationships were found between each of the three types of teacher self-efficacy beliefs and …
Assured Identity For The Cloud, Jeff Daniels
Assured Identity For The Cloud, Jeff Daniels
All-Inclusive List of Electronic Theses and Dissertations
It has been widely reported the largest security concerns with cloud computing design and implementation are centered on identity and access management. Pearson (2009) identifies open security challenges such as where processing takes place, auditability of transactions, and data sensitivity in distributed systems. Cloud computing builds on prior research in virtualization, distributed computing, utility computing, networking, and web services (Vouk, 2008). A recent study conducted by the Office of Homeland Security found that cyber security is a national problem (Homeland Security, 2009). The study recommended that ―managing identities‖ must be part of a comprehensive national cyber security strategy. The Department …

Acute Renal Failure Requiring Renal Replacement Therapy In The Intensive Care Unit: Impact On Prognostic Assessment For Shared Decision-Making, Robert F. Johnson Jr., Jillian Gustin
Peer Reviewed Articles
A 69 year-old female was receiving renal replacement therapy (RRT) for acute renal failure (ARF) in an intensive care unit (ICU). Consultation was requested from the palliative medicine service to facilitate a shared decision-making process regarding goals of care.
Clinician responsibility in shared decision-making includes the formulation and expression of a prognostic assessment providing the necessary perspective for a spokesperson to match patient values with treatment options. For this patient, ARF requiring RRT in the ICU was used as a focal point for preparing a prognostic assessment. A prognostic assessment should include the outcomes of most importance to a discussion …

Object Associations Of Early-Learned Light And Heavy English Verbs, Josita Maouene, Aarre Laakso, Linda B. Smith
Peer Reviewed Articles
Many of the verbs that young children learn early have been characterized as ‘light.’ However, there is no agreed upon definition of ‘lightness’ and no usable metric that could be applied to a wide array of verbs. This article provides evidence for one metric by which the ‘lightness’ of early-learned verbs might be measured: the number of objects with which they are associated (in adult judgment) or co-occur (in speech to and by children). The results suggest that early-learned light verbs and heavy verbs differ in the breadth of the objects they are associated with: light verbs have weak associations …

Reactions To Participating In Dating Violence Research: Are Our Questions Distressing Participants?, Ryan C. Shorey, Tara L. Cornelius, Kathryn M. Bell
Peer Reviewed Articles
In recent years, there has been increased research focus on dating violence, producing important information for reducing these violent relationships. Yet Institutional Review Boards (IRBs) are often hesitant to approve research on dating violence, citing emotional distress of participants as a possible risk of participation. However, no known research has examined the reactions of research participants to questions about dating violence. The current study examined the reactions among college students to completing a self-report measure on dating violence. Results showed that participants reported numerous positive experiences as a result of their research participation, with only mildly increased negative emotional reactions …
Sites Of Exclusion: Disabled Women’S Sexual And Reproductive Rights, Roxanne Mykitiuk, Ena Chadha
Sites Of Exclusion: Disabled Women’S Sexual And Reproductive Rights, Roxanne Mykitiuk, Ena Chadha
Articles & Book Chapters
“Women with disabilities commonly find themselves precluded from performing the major life functions commonly assigned to women”. This is nowhere more true than in the areas of sexuality, reproduction and parenting. While women generally are identified with, and indeed valorized for, their nurturing roles, sexual attractiveness and reproductive capacities, women with disabilities are all too often regarded as lacking in each case. Disability affects whether and how women are permitted to participate in sexual, reproductive and nurturing activities. In a culture where women are still defined, to a significant extent, as sexual beings, reproducers and nurturers, the, “general culture limits …

Clerical Errors In The Patent Office, David Vaver
Clerical Errors In The Patent Office, David Vaver
Articles & Book Chapters
This paper discusses how clerical errors made in documents relating to patents should be dealt with. It takes as its cue a recent case that overturned the Canadian Patent Office’s refusal to correct an error – a patent agent’s supply of the wrong serial number of a patent when remitting maintenance fees – that resulted in the patent automatically lapsing. Patent offices these days claim to be “client-centric” but their behaviour often belies their puffery. The paper looks broadly at the concept of clerical error, and compares how a client-centric organization might deal with such mistakes in paperwork with the …

Sprucing Up Patent Law, David Vaver
Articles & Book Chapters
This paper, commissioned for the now defunct UK Strategic Advisory Board for Intellectual Property, looks at some aspects of UK patent law and asks whether some of the activities it rewards deserve the protection they get. The argument is that patent law should more precisely match and reward the advance the inventor discloses, that patents should not be granted for activities that need no stimulus or are already adequately stimulated by other intellectual property laws, that specifications should disclose all the inventor knows about the invention to as wide an audience as possible, that only activities the patent holder and …

A Public Role For The Intentional Torts, Dan Priel
Articles & Book Chapters
The recent litigation that ended in the House of Lords’ decision in Ashley v. Chief Constable of Sussex Police has brought the intentional torts back to the focus of judicial attention. Most commentary on this decision has focused on a few dicta that purport to support a reading the decision as concerned with private vindication of rights. In this article I examine this decision against a broad shift that has been taking place within tort law, and in particular the tort of negligence, away from ‘private law’ concern with the particular individuals involved in the litigation and towards broader ‘public’ …

Have The Norms And Jurisprudence Of The African Human Rights System Been Pro-Poor?, Obiora Chinedu Okafor, Basil E. Ugochukwu
Articles & Book Chapters
Drawing upon the important insight of critical human rights scholars that 'pro-human rights' are not necessarily 'pro-poor', this article mainly utilises Baxi's germinal thesis on the emergence of a trade-related market-friendly human rights (TREMF) paradigm (that is slowly but surely displacing what he refers to as the UDHR paradigm, much to the advantage of global capital and the rich/powerful/elite, and greatly to the disadvantage of the poor) in assessing the extent to which the norms and jurisprudence of the African human rights system have been pro-poor. After demarcating its scope, outlining its limitations and offering an explanation of the conception …

In the present study, we evaluated a multiple-hit animal model of schizophrenia in an attempt to capture the complex interactions among various adverse developmental factors in schizophrenia. Sprague–Dawley rats were assigned to receive either repeated daily 3-h maternal separation for eight days (first “hit”) on postnatal days (PND) 3 to 10, and/or avoidance conditioning for six days (second “hit”) on PND 49–56, and/or repeated phencyclidine treatment (third “hit”, 3.0 mg/kg, sc) immediately after each daily avoidance conditioning. Prepulse inhibition (PPI) of acoustic startle reflex was assessed at late adolescence (PND 41–43) and early adulthood (PND 62–63). The change in %PPI …

Treatment Effects For Common Outcomes Of Child Sexual Abuse: A Current Meta-Analysis, Emily Trask, Kate Walsh, David K. Dilillo
Department of Psychology: Faculty Publications
The present meta-analysis examined the effects of psychosocial treatments at reducing deleterious outcomes of sexual abuse. The meta-analysis included a total of 35 published and unpublished studies written in English, focusing on youth under the age of 18, and evaluating the effectiveness of treatments for the most common negative outcomes of sexual abuse: PTSD symptoms, externalizing problems, and internalizing problems. Results revealed medium effect sizes for PTSD symptoms, externalizing problems, and internalizing problems following treatment for sexual abuse. This study also examined the potential moderating effects of treatment (e.g., modality, duration, and inclusion of caregiver) and participant (e.g., age, gender, …

Are There Ethical Implications Of Karma?, Thomas Pynn

Though Americans have been exposed to Asian philosophical traditions since the nineteenth century – with much recent help from the Beat writers of the 1950s and 1960s – too little attention has been paid to the texts and ideas of these traditions and to their implementation in daily life. This is especially true with regard to Buddhist ideas of ethics and karma. Compounding the problem is the commercial exploitation of Asian philosophical terms like Dharma, karma, tantra and reincarnation, which tends to impede deeper understanding of these important concepts. In America, ethics are once more on the lips of many …

EPA will soon propose performance standards under Section 111 of the Clean Air Act for greenhouse gas pollution from the two largest emitting stationary source sectors – fossil-fueled power plants and petroleum refineries. The form these standards will take remains unclear. A key issue that will shape the effectiveness of the regulations is the degree to which they enable regulated entities to use flexible approaches to achieve the standards. This discussion paper provides the content of a letter to EPA Administrator Jackson that describes areas of general academic agreement on the EPA’s authority to use compliance flexibility options under Section …

Uranyl Reactions With Dithionite, L-Ascorbic Acid, And Supported Nanosized Zero-Valent Iron, Shanna Estes
All Theses
This work examined several reductants for remediation of low pH aqueous uranium contamination by reductive precipitation. Reductants included sodium dithionite, L-ascorbic acid, and nanosized zero-valent iron (nZVI). Additionally, the reductive capacity of nZVI successfully entrapped within a silicate matrix (cryogel) was also examined. This supported nZVI is expected to increase nZVI stability in the subsurface, and to provide a convenient in situ delivery mechanism for other remediation systems which may combine entrapped reductant and catalyst.
Fluorescence and absorbance spectroscopy were used to investigate the interaction between hexavalent uranium (U(VI), uranyl) and both sodium dithionite and L-ascorbic acid at pH 2. …

'In So Many Ways Do The Planets Bear Witness': The Impact Of Copernicanism On Judicial Astrology At The English Court, 1543-1660, Justin Dohoney
All Theses
The traditional historiography of science from the late-nineteenth through the mid-twentieth centuries has broadly claimed that the Copernican revolution in astronomy irrevocably damaged the practice of judicial astrology. However, evidence to the contrary suggests that judicial astrology not only continued but actually expanded during the sixteenth and early seventeenth centuries. During this time period, judicial astrologers accomplished this by appropriating contemporary science and mathematics. Copernicus's De revolutionibus, in particular, provided better mathematics for determining the positions of the planets than the prevailing Ptolemaic system and reformist astrologers interested in making astrology a precise, mathematical science embraced this new astronomy.
