The Freedom of Information Act ("FOIA" or "the Act") serves an important purpose in informing the citizenry of its government's actions. Congress created it as a disclosure statute, the Supreme Court has decided FOJA in favor of disclosure, and the D. C. Circuit has kept that goal of disclosure by refusing to broaden its exemptions. Despite this history of consistent treatment, the Third Circuit attempted to change the game with its holding in AT&T v. FCC. The Third Circuit held that corporations may have personal privacy under FOIA Exemption 7(C). This paper will argue that this holding contradicted three FOIA …

Structural Determinants Of Homicide: The Big Three, Maria Tcherni

Building upon and expanding the previous research into structural determinants of homicide, particularly the work of Land, McCall and Cohen (1990), the current paper uses county-level data to disentangle three major influences on homicide rates: poverty, racial composition, and the disruption of family structure. Theoretical foundations of these influences are laid out, and the effects of the three factors on homicide rates are tested at two time periods as far removed from one another as possible: 1950-1960 and 1995-2005. All major variables typically used in homicide research are included as controls. The results of analyses show that the effects of …

Legislating By Proxy: Did President Obama Amend The Texas Labor Code When He Signed The Lilly Ledbetter Fair Pay Act?, Charles Hill

Does the Texas Labor Code permit Congress to amend Texas law by proxy? Specifically, does the Texas Commission on Human Rights Act automatically incorporate Title VII amendments? This is the question posed to Texas courts and federal courts interpreting the limitations period for filing employment discrimination claims with the Texas Workforce Commission. Despite almost two decades of court precedent interpreting Texas's equal employment opportunity law, the answer is anything but clear. With the passage of the Lilly Ledbetter Fair Pay Act, Texas courts must decide whether the law automatically incorporates the federal act or not. Given Title VII's deference to …

The northeastern USA has a long history of acid rain, which has impacted soil fertility and raised concerns about the sustainability of the forests in the region. To facilitate recovery of these forests, calcium addition, in the form of wollastonite, was evaluated as a remedial tool at Hubbard Brook Experimental Forests in New Hampshire, USA. In order to study the effects of these amendments on soil organic matter and soil microbes, I characterized the structural chemistry of soil organic matter (SOM) and its hot-water extractable organic matter (HWEOM) fraction for Hubbard Brook soils and studied the changes in the structure …

The Youth Internet Safety Surveys (YISS‐1, YISS‐2, and YISS‐3) were conducted in order to quantify and detail youth experiences with unwanted or problematic Internet experiences including sexual solicitations, harassment, and unwanted exposure to pornography on the Internet. YISS‐3 collected additional information about youth produced sexual images (YPSI) or “sexting.” The YISS‐1, YISS‐2 and YISS‐3 studies were conducted in 2000, 2005 and 2010, respectively, providing important comparative information on changes in the numbers of youth reporting unwanted or problematic Internet experiences at 5‐year intervals since 2000. This is a critical timeframe for observation given the sharp rise in the use of …

Utilizing a pacifist feminist position, this paper looks at the relationship between ideas of masculinity and war, militarism and peacekeeping intervention. I argue that it is necessary to revise and redefine a pacifist feminist position, especially because, from this viewpoint, the current masculinist war-prone world order may best be combated by attacking its gender biases. In this context, pacifist feminists have often been challenged by non-feminists, but also by non-pacifist feminists who accuse them of drawing on essentialist notions of women as peace –makers. A non-violent attack on oppressive masculinity would need to be successful in disseminating a counter-hegemonic and …

The transition from an intra- to extra-uterine environment leaves its mark in deciduous teeth (and first permanent molars) as an accentuated enamel incremental ring called the neonatal line (NL). This prominent microfeature separates the enamel formed during intrauterine life from that formed after leaving the womb. However, while the physical structure of this scar is well known, the bases of its formation are still a matter of investigation. In this paper we study a new logistic competition model. We will investigate stability and bifurcation of the model. In particular, we compute the invariant manifolds, including the important center manifolds, and study their bifurcation. Saddle-node and period doubling bifurcation route to chaos is exhibited via numerical simulations.

Many neurological disorders result in disordered motion. The effects of a disorder can be decrease by an appropriate rehabilitation. To make rehabilitation efficient, we need to monitor the patient and check how well he or she improves. In our previous papers, we proposed a fuzzy-based semi-heuristic method of gauging how well a patient improved. Surprisingly, this semi-heuristic method turned out to be more efficient that we expected. In this paper, we provide a justification for this efficiency.

In many practically useful cases, we know how to efficiently compute the exact range of a function over given intervals (and, possibly, under additional constraints). In other words, we know how to efficiently compute the minimum and maximum of a given function f(x1, ..., xn) on any box. From the practical viewpoint, it is important not only to find the value of the corresponding maximum or minimum, but also to know for what values of the parameters xi this optimum is attained. It is well known that an arbitrary continuous function on a bounded set -- e.g., on an interval [a,b] -- can be, with any given accuracy, approximated by a polynomial. Usually, polynomials are described as linear combinations of monomials. It turns out that in many computational problems, it is more efficient to represent a polynomial as Bernstein polynomials -- e.g., for functions of one variable, a linear combination of terms (x-a)k * (b-x)n-k. How Does The Rural Food Environment Affect Rural Childhood Obesity?, David Hartley Phd, Mha, Nathaniel J. Anderson Ms, Mph, Kimberley Fox Mph, Jennifer D. Lenardson Mhs

Objective: Assess the impact of the rural food environment on the eating behaviors and BMI of rural low-income children. Method: Statewide (Maine, 2009) household survey of parents of children on Medicaid (n=1722), oversampled in six rural communities, resulting in n=272 for six target communities. Food environment measured using modified Nutrition Environment Measures Survey in Stores (NEMS-S) for 46 retail food outlets. Multi-variate analysis assessed factors affecting home food environment, child's eating behavior and BMI. Results: Home food behaviors (how often: family eats together, child eats breakfast, vegetables served) and parent food consumption were significantly associated with children's healthy eating behaviors. …

The mobile computing environment provides many benefits such as ubiquitous access to computing but include constraints on resources such as: Available bandwidth and battery life. Replication is a widely recognized method for balancing the demands of storage space with bandwidth and battery life. We propose a novel scheme that seeks to strategically balance these constrained resources through a cooperative game-theoretic approach for replication in a mobile environment. Our replication strategy relies on the cooperation of the nodes within the network to make replica caching decisions which are spatiotemporally local-optimal for the network from an energy and bandwidth conservation standpoint. in …

This intersectional and interdisciplinary social science qualitative dissertation in six chapters is grounded in critical research and theory for the purpose of engaged public service. This project is grounded in three formal disciplines: education, criminology, and peace and conflict studies. Within those three disciplines, this project interweaves newly emerging fields of study together, including critical animal studies, eco-ability, disability studies, environmental justice, transformative justice, green criminology, anarchist studies, and critical criminology, This dissertation adopts three qualitative methodologies; autoethnography, case study, and critical pedagogy. Several actions by Congress and the IRS aimed to reduce improper claims of the earned income tax credit by increasing preparer penalties and due diligence procedures. * Litigation over restricted stock-based compensation focused on the proper date of the stock's market valuation and the effect of company and SEC restrictions on disposition of the stock. * The Tax Court applied the IRS's recent practice of allowing professional gamblers to deduct ordinary and reasonable nonwagering business expenses over their gambling winnings, overturning a 1951 case holding. * The Tax Court also held that limited partners of a limited partnership who perform …

In 2008, the Ord Irrigation Expansion Project was approved by the Western Australian Government to develop irrigated agriculture on the Weaber Plain.
An important concern is the effect the Weaber Plain agricultural development may have on the water quality of the downstream Border Creek and Keep River
This report assembles and reviews all available physico-chemical water quality data for the lower Keep River and Border Creek systems and presents data from the initial year of a targeted baseline monitoring program (June 2010 – June 2013).

This article reviews the development of universal women’s human rights since 1970. It begins by discussing how the international feminist movement influenced the development of women’s legal human rights, and continues by reviewing three debates in the literature on women’s rights. The first debate is whether human rights as originally formulated were actually men’s rights; the second debate is about the relationship between culture and women’s rights; and the third considers the effects of globalization on women’s rights. The author defends a liberal approach to human rights via the principles of equality and autonomy for women, but also argues that …

Oregon Population Estimates and Reports
The Tri-City Service District (TCSD) and Clackamas County Service District #1 (CCSD #1), both of Clackamas County, requested that the Population Research Center (PRC) at Portland State University produce long-term population forecasts for each of the two sewer service districts. In addition, CCSD#1 requested that forecasts also be developed to include the entire city of Damascus to account for possible future annexation into its district; and the city of Milwaukie, as CCSD#1 leases services to Milwaukie. The forecast horizon extends 30 years from 2010 to 2040, and projections are produced in 5-year intervals. For the 2010-2015 interval, forecast numbers for …
