Although the numbers of students entering bachelor level study in New Zealand is growing and is high relative to OECD averages, the number of students leaving with a qualification is low compared to many other countries. Data from the Ministry of Education show that completion rates are relatively low, particularly among certain groups of students. Around one-third of students who began a bachelor degree in 2002 had not completed the degree, or a degree at the same or a higher level, eight years after starting. Completion rates are higher among Asian New Zealand students, but much lower among Maori and …

Acute strength exercise elicits a transient oxidative stress, but the factors underlying the magnitude of this response remain unknown. The purpose of this investigation was to determine whether muscle-fiber type relates to the magnitude of blood oxidative stress after eccentric muscle activity. Eleven college-age men performed 3 sets of 50 eccentric knee-extensions. Blood samples taken pre-, post-, and 24, 48, 72, and 96 hr postexercise were assayed for comparison of muscle damage and oxidative-stress biomarkers including protein carbonyls (PCs). Vastus lateralis muscle biopsies were assayed for relative percentage of slow-and fast-twitch muscle fibers. There was a mixed fiber composition (Type …

Training may be the most vital aspect of competition for serious athletes. The goal of training is to improve athletic performance by improving physiological performance, but there are instances when training can push an athlete physiologically beyond the threshold of tolerance. Most coaches and athletic trainers are aware that overtraining leads to physical injury when little recovery time is allowed, but what is still unclear is how overtraining affects the emotional and psychological stability of the athlete. In this paper, I consider a particular amoralist challenge against those who would morally criticize our single-player video play, viz., 'come on, it's only a game!' The amoralist challenge with which I engage gains strength from two facts: the activities to which the amoralist lays claim are only those that do not involve interactions with other rational or sentient creatures, and the amoralist concedes that there may be extrinsic, consequentialist considerations that support legitimate moral criticisms. I argue that the amoralist is mistaken and that there are non-consequentialist resources for morally evaluating our single-player game play. On my view, some …

Antitrust Review Of The At&T/T-Mobile Transaction, Maurice Stucke, Allen Grunes

In this Essay, we review AT&T Inc.’s proposed $39 billion acquisition of T-Mobile USA, Inc., under federal merger law, under the U.S. Department of Justice and Federal Trade Commission’s 2010 Horizontal Merger Guidelines, and with a focus on possible remedies. We find, under a rule of law approach, that the proposed acquisition is presumptively anticompetitive, and the merging parties in their public disclosures have failed to overcome this presumption. Next we find that under the Merger Guidelines, there is reason to believe that the transaction may result in higher prices to consumers under several different plausible theories. Finally, we turn …

Information is being created at an astonishing rate, and the electronic storage of personal data is at the forefront of this growth. Social security numbers, home and email addresses, and financial records are almost universally stored electronically, whether on internal servers, hard drives, or portable devices, such as flash drives and diskettes. The ubiquity of this information has undoubtedly benefitted commerce, but it has not come without drawbacks. As recent evidence suggests, personal information is increasingly vulnerable to hacking and other forms of theft, putting the consumer at serious risk of identity theft and misuse of their personal information. It was our objective to study the role of mechanical stimulation on fibronectin (FN) reorganization and recruitment by exposing fibroblasts to shear fluid flow and equibiaxial stretch. Mechanical stimulation was also combined with a Rho inhibitor to probe their coupled effects on FN. Mechanically stimulated cells revealed a localization of FN around the cell periphery as well as an increase in FN fibril formation. Mechanical stimulation coupled with chemical stimulation also revealed an increase in FN fibrils around the cell periphery. Complimentary to this, fibroblasts exposed to fluid shear stress structurally rearranged pre-coated surface FN, but unstimulated and stretched cells …

A Deep Insight Into The Sialotranscriptome Of The Gulf Coast Tick, Amblyomma Maculatum, Shahid Karim, Parul Singh, José M.C. Ribeiro

Background
Saliva of blood sucking arthropods contains compounds that antagonize their hosts' hemostasis, which include platelet aggregation, vasoconstriction and blood clotting; saliva of these organisms also has anti-inflammatory and immunomodullatory properties. Perhaps because hosts mount an active immune response against these compounds, the diversity of these compounds is large even among related blood sucking species. Because of these properties, saliva helps blood feeding as well as help the establishment of pathogens that can be transmitted during blood feeding.

Biological soil crust ecology in the hot Mojave Desert is poorly understood with regard to crust distribution and abundance, as well as the impacts of trampling disturbance on crust development. Our objective was to study biological soil crusts in 2 areas of differing disturbance pressures in the high desert region of Joshua Tree National Park, California, with respect to visible crust cover and frequency, chlorophyll a, and soil stability. Impacts on biological soil crusts from 2 disturbance regimes, historic grazing and recent high knot traffic, were compared using a disturbance indicator. It covered the State of Maine only. The list was begun and maintained for many years by Jean Vermette in Bangor, and later operated by Zack Paakkonen of Portland. Over the years it evolved from a social activities newsletter into a business directory, classified ad service, and community bulletin board.

Coastlines, like riverbanks, are dynamic. They continually move, usually imperceptibly, but in storm events they can move a great distance. This movement affects both private and public property rights. The State owns "submerged lands," wherever they happen to be at the time.' In legal documents in Texas, terms such as "along the river" and "with the meanders of the river" describe property boundaries. The difference between Gulf of Mexico and riverfront property is gulf beaches are open to the public, whereas the sand along rivers is private property. There is no Open Beaches Act for rivers. Although heralded as an emancipation proclamation for people with disabilities, the Americans with Disabilities Act ("ADA") has done little over the course of its twenty-year history to increase the number or quality of employment opportunities available to individuals with a disability. Title I of the ADA requires employers to make reasonable accommodations for qualified employees with a disability so long as the accommodations do not impose an undue hardship on the employer. Regardless of whether you believe that human activities cause or contribute to global warming, regulatory action seeking to mitigate the future consequences of climate change will impact the lives of every American. On January 2, 2011, U.S. Environmental Protection Agency ("EPA") regulation of greenhouse gas emissions from stationary sources took effect. The EPA rule implementing this regulation is the conclusion, for the time being, of a sequence of recent judicial and administrative activities comparable to a regulatory domino effect. The Supreme Court started the cascade of regulation in Massachusetts v. EPA, in which the Court held that the EPA has …
