The Maria Da Penha Case And The Inter-American Commission On Human Rights: Contributions To The Debate On Domestic Violence Against Women In Brazil, Paula Spieler Jan 2011

The Maria Da Penha Case And The Inter-American Commission On Human Rights: Contributions To The Debate On Domestic Violence Against Women In Brazil, Paula Spieler

Indiana Journal of Global Legal Studies

This article aims to demonstrate the contributions of the Maria da Penha case and the Inter-American Commission on Human Rights (IACHR) Report of 2001 to the debate on domestic violence against women in Brazil, with special emphasis to the adoption of the Maria da Penha Law. The IACHR was the first international human rights organ to bring to light the problem. Beside contributing to internal changes, this case has great relevance as it was the first one of domestic violence analyzed by the Inter-American Commission. It revealed the systematic pattern of violence against women in the country.

The Lightning-Tgf Relationship On Microsecond Ttimescales, Steven A. Cummer, Gaopeng Lu, Michael S. Briggs, Valerie Connaughton, Shaolin Xiong, Gerald Jerry Fishman, Joseph R. Dwyer Jan 2011

The Lightning-Tgf Relationship On Microsecond Ttimescales, Steven A. Cummer, Gaopeng Lu, Michael S. Briggs, Valerie Connaughton, Shaolin Xiong, Gerald Jerry Fishman, Joseph R. Dwyer

Aerospace, Physics, and Space Science Faculty Publications

We analyze the count rates of two terrestrial gamma-ray flashes (TGFs) detected by the Fermi Gamma-ray Burst Monitor (GBM) with the broadband magnetic fields (1 to 300 kHz) produced by the simultaneous lightning processes. The microsecond-scale absolute time accuracy for these data, combined with independent geolocations of the source lightning, enable this analysis with higher accuracy than previously possible. In both events, fast discharge-like processes occur within several tens of microseconds of the gamma-ray generation, although not with a consistent relationship. The magnetic field data also show a slower signal component produced by a source current that in both events …

Kindred And A Canticle For Leibowitz As Palimpsestic Novels, Sue Vander Hook Jan 2011

Kindred And A Canticle For Leibowitz As Palimpsestic Novels, Sue Vander Hook

All Graduate Theses, Dissertations, and Other Capstone Projects

This thesis is an investigation of a possible new categorization under the speculative fiction umbrella—a genre called palimpsestic novels. Palimpsestic novels are characterized by layers of time in the past, the present, and sometimes the future. In a fantastical setting, often with nonscientific time travel, the layers illuminate and provide contemporary significance to eras of history that have either become blurred or forgotten through time. The formation of a palimpsestic genre will provide an appropriate categorization for some speculative fiction novels that currently are nebulous mixtures of several genres, have no genre classification at all, or would better fit in …

Extra! Read All About It: Why Notice By Newspaper Publication Fails To Meet Mullane's Desire-To-Inform Standard And How Modern Technology Provides A Viable Alternative, Jennifer L. Case

Georgia Law Review

Decades ago the Supreme Court articulated that due
process requires adopting a means of service that one
would naturally adopt if he actually desired to inform
another. For generations newspaper publication has been
allowed where the party to be notified is not known or
cannot be located. But, given the rapid transformation

of information dissemination over our country's recent
history, are newspapers a method that anyone would use if
they truly wanted to relay information to another person?
This Note examines the shift in how American's receive
news and information in our modern society. It explores
the decline in newspaper …

'When The Ocean Begins' : Personal Narrative, Shifting Roles, And A Teenage Woman's Search Through The Wreckage, Lauren Michele Fazzio Jan 2011

'When The Ocean Begins' : Personal Narrative, Shifting Roles, And A Teenage Woman's Search Through The Wreckage, Lauren Michele Fazzio

Theses, Dissertations and Culminating Projects

I will argue that as the young women in this study approached graduation from high school, writing became a venue to write their identities in a safe space free from the expectations of others. The writing included in this study will show that early-adolescent identities, written from a senior-year perspective, value silence and passivity over confidence and voice. They were eager to use the written space provided to them in an elective writing course to script and negotiate their contradictory identities and ultimately transition into a more informed sense of self. Through personal writing completed in and out of school, …

Are Politics Good For Your Health? Adolescents’ Political Ideology And Health Seeking Behavior, George Olekson Jr. Jan 2011

Are Politics Good For Your Health? Adolescents’ Political Ideology And Health Seeking Behavior, George Olekson Jr.

Theses, Dissertations and Culminating Projects

Political ideology is now considered a factor that can influence one’s self-rated health status. However, to date, no studies have assessed the relationship between differences in political beliefs and a person’s health behaviors with respect to prevention of acquiring influenza. In the present study, college undergraduates were surveyed to determine how their political ideology, political associations, perception of influenza as assessed by the Health Belief Model (HBM) - here meaning perceived severity, perceived susceptibility, perceived benefits of and perceived barriers to treatment, and self rated health status (measured by the Short-Form 36 Health Survey) would influence their likelihood of taking …

Looking For A Few Good Philosopher Kings: Political Gerrymandering As A Question Of Institutional Competence, Luis Fuentes-Rohwer Jan 2011

Looking For A Few Good Philosopher Kings: Political Gerrymandering As A Question Of Institutional Competence, Luis Fuentes-Rohwer

Articles by Maurer Faculty

The redistricting season is about to begin in full swing, and with it will come renewed calls for the federal courts, and particularly the U. S. Supreme Court, to aggressively review the work of the political branches. This is an intriguing puzzle. Since the early 1960’s, the federal courts have regulated questions of politics aggressively. They have done this even in the face of difficult questions of political representation. The courts have taken sides, to be sure, but these can only be described as acts of volition and will, not constitutional law. The leading case is Reynolds v. Sims. This …

Rehabilitating Territoriality In Human Rights, Austen L. Parrish Jan 2011

Rehabilitating Territoriality In Human Rights, Austen L. Parrish

Articles by Maurer Faculty

For many years, territorial principles anchored an international system organized around nation-states. Recently, however, the human rights movement has sought to change the state-centric focus of international law and overcome the limitations of a system where the territorial state is the primary actor. The field of human rights has promoted a new legal orthodoxy that places the person at the center of the international legal system. Within this orthodoxy, non-state actors play a prominent role, unilateral domestic lawsuits are promoted, and territorial borders give way when necessary for humanitarian intervention. In contrast, territorial conceptions of international law are viewed as …

An Examination Of The Emerging Feminist Voice In Zora Neale Hurston's Their Eyes Were Watching God And Kate Chopin's The Awakening, Fran Shultz Jan 2011

An Examination Of The Emerging Feminist Voice In Zora Neale Hurston's Their Eyes Were Watching God And Kate Chopin's The Awakening, Fran Shultz

Theses, Dissertations and Culminating Projects

Zora Neale Hurston and Kate Chopin lived and wrote in different eras, but each woman was ahead of her time in terms of her depiction of women s roles and responsibilities in the patriarchal societies in which she lived. Due to the similarities in the feminist themes depicted by the female protagonists in Hurston s Their Eyes Were Watching God and Chopin’s The Awakening, this paper will trace the beginnings of a distinctly feminist voice emerging through these two works. Hurston’s portrayal of Janie’s journey to achieve autonomy represents the empowerment of the nascent African- American female voice within the …

Attitudes Toward Vaccination In The Event Of An Influenza Pandemic And The Characteristics Of Those Likely To Decline Vaccination, Michelle Lynn Cummings Jan 2011

Attitudes Toward Vaccination In The Event Of An Influenza Pandemic And The Characteristics Of Those Likely To Decline Vaccination, Michelle Lynn Cummings

Legacy Theses & Dissertations (2009 - 2024)

BACKGROUND: In addition to conscientious hygiene and limiting exposure, vaccination is an important public health intervention to limit influenza infection among high risk groups. However, limited research has been conducted among the general population to measure vaccine acceptance against a pandemic strain of influenza, and which specific concerns might hinder acceptance. Because this study was conducted prior to the H1N1 pandemic of 2009, it serves as a baseline measure of the population's perspectives on influenza vaccination. Subsequent studies will shed light on the degree to which a pandemic heightens acceptance.

Site Identification, Delineation, And Evaluation Through Quantitative Spatial Analysis : Geostatistical And Gis Methods To Facilitate Archaeological Resource Assessment, James Scott Cardinal Jan 2011

Site Identification, Delineation, And Evaluation Through Quantitative Spatial Analysis : Geostatistical And Gis Methods To Facilitate Archaeological Resource Assessment, James Scott Cardinal

Legacy Theses & Dissertations (2009 - 2024)

This thesis presents a brief overview of quantitative spatial analysis in archaeology with a discussion of the theoretical and methodological issues involved, and describes a set of methods for using Geographic Information System (GIS) software and spatial statistics for the assessment of archaeological resources. GIS has become a nearly ubiquitous and indispensable tool in many fields of resource management including archaeology. It is, however, applied by archaeologists most frequently for basic cartographic representations, large-scale regional analyses, or resource management data warehousing. Such applications underutilize the scale-independence of GIS, which is equally potent for intra-project data assessment. This thesis describes a …

Caribbean Hauntings And Transnational Regionalism In Nineteenth- And Twentieth-Century American Literature, Bethany Aery Clerico Jan 2011

Caribbean Hauntings And Transnational Regionalism In Nineteenth- And Twentieth-Century American Literature, Bethany Aery Clerico

Legacy Theses & Dissertations (2009 - 2024)

Caribbean Hauntings and Transnational Regionalism in Nineteenth- and Twentieth-Century American Literature offers a new literary map of U.S. history that is routed through the Caribbean and that intervenes in certain historiographic problems that exceptionalism creates for national literary studies. In the literature of Harriet Beecher Stowe, Martin R. Delany, Charles Chesnutt, William Faulkner, and Toni Morrison, I tease out references to the Caribbean that other critics have overlooked as a result of strictly national frames of analysis. These references evidence that each text is haunted by a Caribbean presence, a phrase that signifies both a "real" Caribbean, a political and …

Stories Of Transformation : Place-Based Education And The Developing Place-Consciousness Of Educators Along The Hudson River, Jennifer Karen Rosenthal Jan 2011

Stories Of Transformation : Place-Based Education And The Developing Place-Consciousness Of Educators Along The Hudson River, Jennifer Karen Rosenthal

Legacy Theses & Dissertations (2009 - 2024)

This phenomenological case study investigates the lived experiences of five educators who engage in on-board educational programs, offered by the non-profit environmental organization Hudson River Sloop Clearwater, Inc., and follows their stories of place-conscious development leading to place-based educational engagement. By analyzing surveys, participant-generated photographs, in-depth interviews, field observations, educator generated curricula, field notes, and member checking, this study examines each participants' recalled life story which provides a basis for understanding their present educational practices. Using a conceptual framework based upon Gruenewald's (2003) critical pedagogy of place supported by the constructs of conscientizacao (Freire, 1970) and the development of an …

The Importance Of Disease And Behavior In Mammalian Ecology And Behavior, Christopher R. Collins Jan 2011

The Importance Of Disease And Behavior In Mammalian Ecology And Behavior, Christopher R. Collins

Legacy Theses & Dissertations (2009 - 2024)

Causes of mortality reflect the evolutionary forces shaping the physiology and behavior of species. To evaluate the relative importance of these in North American Mammals I compared published data from 69 populations across 27 species. Of the known causes, humans are the main cause of mortality (51.8%), followed by natural causes (48.5%), with predation being the largest natural cause. Populations in remote areas experienced higher hunting mortality, and those closer to human populations suffered increased vehicle collision. Predation mortality was negatively correlated with body mass.

Biogeographic Consequences Of Historic And Contemporary Climate Change In Boreal Forest Birds, Joel Ralston Jan 2011

Biogeographic Consequences Of Historic And Contemporary Climate Change In Boreal Forest Birds, Joel Ralston

Legacy Theses & Dissertations (2009 - 2024)

In this dissertation, I combine ecological niche models (ENMs), which can be extrapolated through time to predict historic and future changes in species distributions, with mitochondrial and nuclear genetic markers to study the biogeographic consequences of historic and contemporary climate change on boreal forest birds, and in particular Blackpoll Warbler.

The Drinking Age Debates, Joy Shana Newman Getnick Jan 2011

The Drinking Age Debates, Joy Shana Newman Getnick

Legacy Theses & Dissertations (2009 - 2024)

In times when regulation, not prohibition, has prevailed, Americans have struggled to regulate youth and young adult alcohol use in a way that targets undesirable problem behaviors and future potential for severe abuse, while acknowledging the realities of youthful moderate drinking. Historically, changes in youth drinking laws reflected new adult understandings of youth alcohol use. These laws were a legislative manifestation of changing public opinion, and the perceived role that policy should play in promoting safe, intelligent drinking behavior.

Puerto Rican Intermarriages : The Intersectionality Of Race, Gender, Class And Space, Gabriel Aquino Jan 2011

Puerto Rican Intermarriages : The Intersectionality Of Race, Gender, Class And Space, Gabriel Aquino

Legacy Theses & Dissertations (2009 - 2024)

Puerto Ricans have an intermarriage rate of 38.5 percent, the highest among Mexican, Cubans, Dominicans, European Americans, and African Americans in the United States. What govern the process of Puerto Rican intermarriage? Who do Puerto Rican intermarry with? And, do these intermarriages affect Puerto Rican ethnic identity? Traditional theories of intermarriage use a one dimensional explanation for intermarriages and for many posit an eventual ethnic identity transition. I propose the use of an intersectionality paradigm that incorporates a multidimensional approach, specifically race, gender, class, and space to explain Puerto Rican intermarriage and to test Puerto Rican ethnic identity transformation through …

Confraternity And Community : Negotiating Ethnicity, Gender And Place In Colonial Tecamachalco, Mexico, Annette Dionne Richie Jan 2011

Confraternity And Community : Negotiating Ethnicity, Gender And Place In Colonial Tecamachalco, Mexico, Annette Dionne Richie

Legacy Theses & Dissertations (2009 - 2024)

Cofradías, lay religious brotherhoods introduced to New Spain by Mendicant friars in the mid-16th century, were optimal vehicles for corporate consciousness. This case study in colonialism, evangelization and ethnic politics centers on avenues and strategies for assessing, accommodating and rejecting cultural elements from "foreign" groups, as well as the freedom to assemble and incorporate, but also marginalize, others.

P-16 Initiatives : A Policy Discourse Analysis Approach To State Level Education Reform, Francesca T. Durand Jan 2011

P-16 Initiatives : A Policy Discourse Analysis Approach To State Level Education Reform, Francesca T. Durand

Legacy Theses & Dissertations (2009 - 2024)

This study articulates and maps the changes found in the historical discourses of P-16 national policy advocacy and state-level policy formation. The relationship between the momentum to create education reform through policy and the actual creation of the policy through state level regulatory entities is also explored in this research study. The theoretical model developed for this study frames three rationales for policy development- sociological, economic, and organizational rationales. Policy discourse analysis, an examination of policy language, is used as the methodology to develop the narrative of changing discourses. Understanding discourse is a way to understand the meanings, practices, and …

Western Equatorial Pacific Climate Variability From Restricted Basins: Century Scale Changes In Kau Bay To Glacial-Interglacial Changes In The Sulu Sea, Samantha J. Langton Jan 2011

Western Equatorial Pacific Climate Variability From Restricted Basins: Century Scale Changes In Kau Bay To Glacial-Interglacial Changes In The Sulu Sea, Samantha J. Langton

Geology Theses and Dissertations

The surface ocean in the western equatorial Pacific contains some of the warmest water on the planet in the western Pacific warm pool (WPWP). Changes in the size and scope of the warm pool have a significant impact on global climate. With the concern of changes in the extent of this body of water as a result of anthropomorphic changes in atmospheric composition, it is vital to investigate prior changes to the WPWP, the causes of such changes, and resultant effects. For my dissertation, I used several proxies to analyze sediments from Kau Bay and the Sulu Sea in Indonesia …

The Raven Loup : A Modern-Day Romance Novella, Andrew John Hamilton Jan 2011

The Raven Loup : A Modern-Day Romance Novella, Andrew John Hamilton

Legacy Theses & Dissertations (2009 - 2024)

In her appropriately-titled study, Romance, Barbara Fuchs introduces the romantic in literature as the "textual strategy[:] a concatenation of both narratological elements and literary topoi, including idealization, the marvelous, narrative delay, wandering, and obscured identity, that [...] both pose a quest and complicate it". The purpose of this thesis is to creatively employ the "textual strategy" of romance, applying it to a story set in the near-present with modern-day symbols, events, and characters. With this in mind, the traditional romantic hero is a warrior, a general, or a knight with physical or mental prowess that goes beyond the scope of …
