Modern Police Practices: Arizona V. Gant's Illusory Restriction Of Vehicle Searches Incident To Arrest, Seth W. Stoughton Nov 2011

Modern Police Practices: Arizona V. Gant's Illusory Restriction Of Vehicle Searches Incident To Arrest, Seth W. Stoughton

Faculty Publications

In 2009, the Supreme Court overturned thirty years of precedent with a decision that purported to dramatically cut back on the ability of law enforcement officers to conduct warrantless vehicle searches incident to the arrest of a vehicle occupant. Scholars and commentators celebrated Arizona v. Gant’s constraint of police, and subsequent scholarship has focused exclusively on peripheral concerns such as alternative justifications for warrantless searches and Gant’s effect on non-vehicle searches. This Note challenges the core assumption that Gant will substantially limit vehicle searches incident to arrest, contending that Gant is far more permissive than it appears. In most cases, …

Chemical and structural heterogeneity and the resulting interaction of coexisting phases can lead to extraordinary behaviours in oxides, as observed in piezoelectric materials at morphotropic phase boundaries and relaxor ferroelectrics. However, such phenomena are rare in metallic alloys. Here we show that, by tuning the presence of structural heterogeneity in textured Co1−xFex thin films, effective magnetostriction λeff as large as 260 p.p.m. can be achieved at low-saturation field of ~10 mT. Assuming λ100 is the dominant component, this number translates to an upper limit of magnetostriction ofλ100≈5λeff >1,000 p.p.m. Microstructural analyses …

A Low Frequency Stable Epa Method Accelerated By The Adaptive Cross Approximation Algorithm, Zu Hui Ma, Lijun Jiang, Zhi Guo Qian, Lijun Jiang Nov 2011

A Low Frequency Stable Epa Method Accelerated By The Adaptive Cross Approximation Algorithm, Zu Hui Ma, Lijun Jiang, Zhi Guo Qian, Lijun Jiang

Electrical and Computer Engineering Faculty Research & Creative Works

Low frequency full wave electromagnetic modeling is of great importance to a number of applications. But it is also a great challenge in the research of computational electromagnetics (CEM). To address this issue, in this paper, we will discuss incorporating the augmented electric field integral equation (A-EFIE) into the low frequency augmented equivalence principle algorithm (A-EPA) method. It effectively improves the low frequency simulation stability. But this method involves the calculation of the translation process which is exceptionally time-consuming and memory-consuming. In order to surmount this problem, we use the adaptive cross approximation (ACA) to accelerate the calculation of this …

Students' Learning Style Preferences And Teachers' Instructional Strategies: Correlations Between Matched Styles And Academic Achievement, Mary L. Wilson Nov 2011

Students' Learning Style Preferences And Teachers' Instructional Strategies: Correlations Between Matched Styles And Academic Achievement, Mary L. Wilson

Doctoral Dissertations and Projects

The purpose of the current study was to identify the extent to which learning styles influence the educational process as well as the outcome of students, particularly elementary-age students, in terms of academic achievement. This study examined the potential relationship between the degree of match (as determined by comparing learning style preferences of students with instructional strategies of teachers) and the academic achievement of fourth grade students as shown by Palmetto Assessment of State Standards scores in four academic content areas, namely English language arts, mathematics, science, and social studies. The researcher collected data from a sample of approximately 200 …

Florida Charter Schools: The Effects Of Types And Socioeconomic Status On Academic Achievement, Reginald Thompson Nov 2011

Florida Charter Schools: The Effects Of Types And Socioeconomic Status On Academic Achievement, Reginald Thompson

Doctoral Dissertations and Projects

No Child Left Behind (NCLB) was established in 2002 with the primary goal of closing the achievement gap between low socioeconomic students and their more advantaged peers. Charter schools are a part of NCLB's school choice policy and are intended to be a form of intervention to close the achievement gap. Much research has been conducted to measure charter school student achievement compared to regular public schools. But little has been done in distinguishing the differences between charter schools and their impact on student achievement. This quantitative study identifies the different types of public charter schools in Florida using Carpenter's …

Georgia High-Stakes Testing: The Correlation Between Eighth Grade And Ninth Grade Achievement, Venita Lee Bruton Nov 2011

Georgia High-Stakes Testing: The Correlation Between Eighth Grade And Ninth Grade Achievement, Venita Lee Bruton

Doctoral Dissertations and Projects

Standardized tests are an education reality and an important accountability consideration in most states and school systems. Most states require standardized assessments to meet requirements of the federal No Child Left Behind Act of 2001. Changes to curriculum and instruction and to the school culture frequently occur through a school improvement process, and standardized test data are often used to inform these decisions. The school improvement process and professional development should focus on student learning, but how administrators and teachers perceive standardized testing and the ensuing data analyses is an important consideration in understanding what needs improvement and the professional …

A New Closed-Form Evaluation Of Layered Medium Green's Function, Yongpin P. Chen, Weng Cho Chew, Lijun Jiang Nov 2011

A New Closed-Form Evaluation Of Layered Medium Green's Function, Yongpin P. Chen, Weng Cho Chew, Lijun Jiang

Electrical and Computer Engineering Faculty Research & Creative Works

A new closed-form evaluation of layered medium Green's function is proposed in this paper. The discrete complex image method (DCIM) is extended to sampling along the Sommerfeld branch cut, to capture the far field interaction. Contour deformation technique is applied to decompose the Green's function into radiation modes (branch cut integration) and guided modes (surface-wave poles). The matrix pencil method is implemented to get a closed-form solution, with the help of an alternative Sommerfeld identity. Numerical results are presented to demonstrate the accuracy of this method. © 2011 IEEE.

Musings On Mediation, Kleenex, And (Smudged) White Hats, Nancy A. Welsh Nov 2011

Musings On Mediation, Kleenex, And (Smudged) White Hats, Nancy A. Welsh

Faculty Scholarship

This Essay speculates on the global future of mediation. It anticipates that mediation’s popularity will continue to grow both in the U.S. and abroad particularly as courts continue to encourage and institutionalize the process. Meanwhile, the Essay acknowledges the existence and continuing development of a relatively small cadre of elite lawyers and retired judges who serve as private mediators in large, complex matters.

The Essay also raises concerns, though, regarding the current lack of clarity in the goals and procedural characteristics that define mediation. The Essay asserts that such lack of clarity invites abuse of the mediation privilege and exclusionary …

Decentralized Optimal Control Of A Class Of Interconnected Nonlinear Discrete-Time Systems By Using Online Hamilton-Jacobi-Bellman Formulation, Shahab Mehraeen, Sarangapani Jagannathan Nov 2011

Decentralized Optimal Control Of A Class Of Interconnected Nonlinear Discrete-Time Systems By Using Online Hamilton-Jacobi-Bellman Formulation, Shahab Mehraeen, Sarangapani Jagannathan

Electrical and Computer Engineering Faculty Research & Creative Works

In this paper, the direct neural dynamic programming technique is utilized to solve the Hamilton-Jacobi-Bellman equation forward-in-time for the decentralized near optimal regulation of a class of nonlinear interconnected discrete-time systems with unknown internal subsystem and interconnection dynamics, while the input gain matrix is considered known. Even though the unknown interconnection terms are considered weak and functions of the entire state vector, the decentralized control is attempted under the assumption that only the local state vector is measurable. the decentralized nearly optimal controller design for each subsystem consists of two neural networks (NNs), an action NN that is aimed to …

Linear Precoding For Mimo Multiple Access Channels With Finite Discrete Inputs, Mingxi Wang, Weiliang Zeng, Chengshan Xiao Nov 2011

Linear Precoding For Mimo Multiple Access Channels With Finite Discrete Inputs, Mingxi Wang, Weiliang Zeng, Chengshan Xiao

Electrical and Computer Engineering Faculty Research & Creative Works

In this paper, we study linear precoding for multiple-input multiple-output (MIMO) multiple access channels (MAC) with finite discrete inputs. We derive the constellation-constrained capacity region for the MIMO MAC with an arbitrary number of users and find that the boundary can be achieved by solving the problem of weighted sum rate maximization with constellation and individual power constraints. Due to the non-concavity of the objective function, we obtain a set of necessary conditions for the optimization problem through Karush-Kuhn-Tucker analysis. to find the optimal precoding matrices for all users, we propose an iterative algorithm utilizing alternating optimization strategy. in particular, …

Rules, Standards, And The Attorney-Client Privilege: When The Privilege Is "At-Issue" In The Discovery Rule Context, Kenneth Duvall Nov 2011

Rules, Standards, And The Attorney-Client Privilege: When The Privilege Is "At-Issue" In The Discovery Rule Context, Kenneth Duvall

Northern Illinois University Law Review

Ask a non-lawyer what the purpose of the judicial system is, and a popular answer would surely be to determine what happened between the parties. However, every attorney knows that the adversarial process is not as straight-forward as that, as many interests must be juggled by the judge as well as by the attorneys in the case. One of the interests that should be protected is the need for a legal mechanism within which clients can freely discuss their problems with their attorneys. This need is largely satisfied by the attorney-client privilege, which necessarily acts as one of the great …

Understanding Student Disaffection Through The Lens Of Alternative Education, Gwen C. Marchand

Policy Briefs and Reports

This partnership project between UNLV and Clark County School District’s Student Support Services Division (SSSD) focuses on identifying risk and protective factors leading to student disaffection and placement in alternative education. Alternative education students are primarily male, with an overrepresentation of minority and special education designations, and who face increased odds of school drop-out. This project will use a mixed-methods approach to chart student trajectories toward alternative education and explore student educational experiences through a motivational and emotional lens. The partnership should result in increased potential for data-driven decision making by SSSD staff and scholarship opportunities for UNLV.

Culture, Language, And Gendered Violence In Southern Nevada, Kathleen Ja Sook Bergquist Nov 2011

Culture, Language, And Gendered Violence In Southern Nevada, Kathleen Ja Sook Bergquist

Policy Briefs and Reports

The U.S. Census estimated approximately 25.1% of Nevadans in 2006 to 2008 to be non-white, 27.3% speak English as a second language, and 24.9% Hispanic. The three most commonly spoken languages in Las Vegas are English, Spanish, and Tagalog, reflecting the growing Spanish-speaking and Asian communities in Southern Nevada. Service providers struggle with providing relevant services for these communities, to include addressing gendered violence. This project seeks to further current knowledge about gendered violence in Spanish-speaking and Asian communities, to examine the capacity of local providers, and identify possible linguistic and cultural barriers that may compound education, outreach, and intervention.
