Developing The Duffy Defect: Identifying Which Government Workers Are Constitutionally Required To Be Appointed, Stacy M. Lindstedt Nov 2011

Developing The Duffy Defect: Identifying Which Government Workers Are Constitutionally Required To Be Appointed, Stacy M. Lindstedt

Missouri Law Review

In 2007, Professor John Duffy wrote a brief article questioning whether administrative patent judges are constitutional officers and therefore subject to the Appointments Clause. A litigant latched onto the argument and challenged the validity of eight years of Board of Patent Appeals and Interferences determinations. Congress enacted a patch to provide for the appointment of patent judges, but the "Duffy Defect" did not stop there. Other scholars have questioned the constitutionality of various government actors from Bankruptcy Judges to the Pay Czar. The United States Tax Court dealt with a recent Appointments Clause challenge when a taxpayer questioned whether Internal …

The Headless Paragraph: Back-Forming Topic Sentences, Dan Gleason

Writing Bootcamp Unit

This exercise is designed to give students practice in creating and understanding topic sentences. The issues related to electronic content purchasing will be discussed in this article, including an overview of how academic libraries currently purchase materials, a review of issues facing libraries, and a summary of new business models being introduced in the …

What You Should Know (And Probably Don’T) About Teaching Ells, Nicole Sanchez Nov 2011

What You Should Know (And Probably Don’T) About Teaching Ells, Nicole Sanchez

The Utah English Journal

As an intern teacher at a middle school in Payson, I struggled on a daily basis to juggle all the balls a teacher keeps in the air: trying to come up with engaging lesson plans, differentiated instruction, classroom management, connecting with parents, and so on. In January, just as I was finally getting to a point where I felt somewhat confident, Ana arrived. She had just moved to Utah from Mexico and was a brand new English Language Learner (ELL). Her vocabulary consisted entirely of “hi” and “good.” I was baffled as to what I could do. How could I …

Returning To Ulysses: The Need For Ireland's Higher Education Institutions To Re-Imagine The Provision Of Entrepreneurship Education, Thomas Cooney, Kathleen Farrell, Paul Hannon

Conference papers

This paper is a detailed analysis of entrepreneurship education in Higher Education Institutions (HEIs) on the island of Ireland based on a survey of all twenty-six institutions. The paper examines the number and types of courses and activities currently being offered to students and concludes that the vast majority of the existing provision is quite traditional in its approach. It is further argued that entrepreneurship education needs to be re-imagined if it is to meet the needs of Ireland’s current economic and social challenges, and that educators should seek inspiration from some of the island’s most creative artists from its …

Distress Tolerance Moderates The Relationship Between Negative Affect Intensity With Borderline Personality Disorder Levels, Marina Bornovalova, Alexis Matusiewicz, Elizabeth Rojas Nov 2011

Distress Tolerance Moderates The Relationship Between Negative Affect Intensity With Borderline Personality Disorder Levels, Marina Bornovalova, Alexis Matusiewicz, Elizabeth Rojas

Psychology Faculty Publications

A number of studies have suggested that negative emotionality and negative affect intensity play key roles in the development and maintenance of borderline personality disorder (BPD). However, more recent research indicates that one's response to affective discomfort may be an even more important variable in the pathogenesis of BPD than either negative emotionality or negative affect intensity per se. As such, the current study aimed to empirically test the moderating role of 2 well-validated laboratory measures of the ability to tolerate psychological distress (distress tolerance) in the relationship of negative emotionality and negative affect intensity with BPD levels. Results provide …

Public Versus Private Sector Procurement Ethics And Strategy: What Each Sector Can Learn From The Other, Timothy Hawkins, Michael Gravier, Edward Powley Nov 2011

Public Versus Private Sector Procurement Ethics And Strategy: What Each Sector Can Learn From The Other, Timothy Hawkins, Michael Gravier, Edward Powley

Marketing Department Faculty Journal Articles

The government purchasing market constitutes the largest business sector in the world. While marketers would benefit from a deep understanding of both sectors, how the two sectors differ in terms of ethics and strategy largely remains unknown. The purpose of this research, therefore, is to explore differences between the for-profit and not-for-profit sectors on two critical aspects of business-to-business procurement: ethics and strategy. Using survey data from a sample of 328 procurement professionals in the for-profit and not-for-profit sectors, key differences are explored. Findings suggest that buyers in the for-profit sector are more likely to behave opportunistically. Conversely, the buyers’ …

Effects Of Column Stiffness On Seismic Behavior Of Steel Plate Shear Walls, Xuhua Guo Nov 2011

Effects Of Column Stiffness On Seismic Behavior Of Steel Plate Shear Walls, Xuhua Guo

Master's Theses

Steel plate shear walls (SPSWs) are a lateral force resisting system consisting of thin infill steel plates surrounded by boundary frame members. The infill steel plates are allowed to buckle in shear and subsequently form diagonal tension field actions during earthquake events. Hysteretic energy dissipation of this system is primarily achieved through yielding of the infill plates. Conceptually, in a SPSW system with ideally rigid columns pinned to ground, the infill plates at different stories will yield simultaneously as a result of the lateral loads. However, when the columns become flexible, infill plate yielding may initially occur at one story …
