Nothing To Hide: The False Tradeoff Between Privacy And Security (Introduction), Daniel J. Solove Jan 2011

Nothing To Hide: The False Tradeoff Between Privacy And Security (Introduction), Daniel J. Solove

GW Law Faculty Publications & Other Works

"If you've got nothing to hide," many people say, "you shouldn't worry about government surveillance." Others argue that we must sacrifice privacy for security. But as Daniel J. Solove argues in this book, these arguments and many others are flawed. They are based on mistaken views about what it means to protect privacy and the costs and benefits of doing so.

In addition to attacking the "Nothing-to Hide Argument," Solove exposes the fallacies of pro-security arguments that have often been used to justify government surveillance and data mining. These arguments - such as the "Luddite Argument,"the "War-Powers Argument," the "All-or-Nothing …

Cerebral Perfusion In Chronic Stroke: Implications For Lesion-Symptom Mapping And Functional Mri, Jessica D. Richardson, Julie M. Baker, Paul S. Morgan, Chris Rorden, L. Bonilha, Julius Fridriksson Jan 2011

Cerebral Perfusion In Chronic Stroke: Implications For Lesion-Symptom Mapping And Functional Mri, Jessica D. Richardson, Julie M. Baker, Paul S. Morgan, Chris Rorden, L. Bonilha, Julius Fridriksson

Faculty Publications

Lesion-symptom mapping studies are based upon the assumption that behavioral impairments are directly related to structural brain damage. Given what is known about the relationship between perfusion deficits and impairment in acute stroke, attributing specific behavioral impairments to localized brain damage leaves room for speculation, as impairments could also reflect abnormal neurovascular function in brain regions that appear structurally intact on traditional CT and MRI scans. Compared to acute stroke, the understanding of cerebral perfusion in chronic stroke is far less clear. Utilizing arterial spin labeling (ASL) MRI, we examined perfusion in 17 patients with chronic left hemisphere stroke. The …

Implications Of Hydrologic Data Assimilation In Improving Suspended Sediment Load Estimation In Lake Tahoe, California, Marc Leisenring Jan 2011

Implications Of Hydrologic Data Assimilation In Improving Suspended Sediment Load Estimation In Lake Tahoe, California, Marc Leisenring

Dissertations and Theses

Pursuant to the federal Clean Water Act (CWA), when a water body has been listed as impaired, Total Maximum Daily Loads (TMDLs) for the water quality constituents causing the impairment must be developed. A TMDL is the maximum daily mass flux of a pollutant that a waterbody can receive and still safely meet water quality standards. The development of a TMDL and demonstrating compliance with a TMDL requires pollutant load estimation. By definition, a pollutant load is the time integral product of flows and concentrations. Consequently, the accuracy of pollutant load estimation is highly dependent on the accuracy of runoff …

Examining News Coverage And Framing In The Context Of Environmental Reporting: Using The Sea Lion And Salmon Controversy At The Bonneville Dam As A Case Study, Tess Mcbride

Dissertations and Theses

This thesis examines how the construction of news stories reveals relationships among groups of stakeholders and how their views unfold within environmental conflict coverage. This study uses a content analysis of 161 newspaper articles concerning the sea lion and salmon controversy at the Bonneville Dam, focusing on source use and blame and solution frames in environmental conflict coverage. This analysis of articles published between January 2003 and June 2010 in Oregon, Washington, Idaho, California, and Montana contributes to research concerning journalistic norms (i.e., balance and objectivity) and news production routines, specifically within the field of environmental reporting. The findings indicate …

Riparian Wetland Response To Livestock Exclusion In The Lower Columbia River Basin, Sarah Ann Holmen Jan 2011

Riparian Wetland Response To Livestock Exclusion In The Lower Columbia River Basin, Sarah Ann Holmen

Dissertations and Theses

The purpose of this study was to examine the characteristics of riparian plant communities along a succession gradient of livestock exclusion in the Lower Columbia River Basin (LCRB). Livestock exclusion is an example of a passive restoration practice throughout the region. However, few studies have focused on the effects of livestock or livestock exclusion on riparian wetland ecosystems in this area. Two passive restoration sites, 3 and 13 years since livestock exclusion, and a control site with a continued livestock grazing presence were examined. It was hypothesized that native plant species richness would be lower in the excluded wetlands than …

Erosion And Adjustment: A Bourdieuian-Inspired Analysis Of Imprisonment And Release, Joshua David Seim Jan 2011

Erosion And Adjustment: A Bourdieuian-Inspired Analysis Of Imprisonment And Release, Joshua David Seim

Dissertations and Theses

Sociologists of punishment generally agree that the American prison exacerbates social inequality, but the mechanisms by which it does so remain somewhat fuzzy. This thesis pulls from the tradition of Pierre Bourdieu (1930-2002), a canonical theorist of power and inequality, and specifically his three "thinking tools" of field, capital, and habitus, to unveil these mechanisms. Empirically, I turn to ethnographic data I collected in a minimum-security men's prison that is generally reserved for convicts who will be released to one of the three most populated counties in Oregon. I explore how soon-to-be-released prisoners (i.e., prisoners who will be released within …

Identifying Victims Of Domestic Minor Sex Trafficking In A Juvenile Custody Setting, Jonathan Dickinson Dabney Jan 2011

Identifying Victims Of Domestic Minor Sex Trafficking In A Juvenile Custody Setting, Jonathan Dickinson Dabney

Dissertations and Theses

Domestic Minor Sex Trafficking (DMST) is a severe form of child sexual exploitation. Thus far, DMST studies have been qualitative or relied on secondary data. There has been no quantitative attempt to directly identify victims in a methodical way in order to determine the prevalence of DMST at a local level or the nature and strengths of its correlates. The present study used a three-tiered screening process to identify victims of DMST in a juvenile detention center. All youth taken into custody over a three and a half month period (N = 738) received a short assessment to identify those …

Examining The Portland Music Scene Through Neo-Localism, Tyler James Brain Jan 2011

Examining The Portland Music Scene Through Neo-Localism, Tyler James Brain

Dissertations and Theses

This study explores the Portland music scene as a context in which local identity is constructed and communicated in a globalized world. Specifically, neo-localism is utilized as a theoretical lens through which the impacts of globalization were explored. Portland bands (n=8) were interviewed concerning their experiences in the local music scene. The results showed that participants conceptualized local identity as being 1) based in community, 2) culturally saturated and 3) connected to musical production. Further, results showed that participants were increasingly aware of this local identity, were aware of a global perception of this local identity and were aware of …

Segmenting Motivation: An Analysis Of Fantasy Baseball Motives And Mediated Sport Consumption, Brendan Dwyer, Stephen L. Shapiro, Joris Drayer Jan 2011

Segmenting Motivation: An Analysis Of Fantasy Baseball Motives And Mediated Sport Consumption, Brendan Dwyer, Stephen L. Shapiro, Joris Drayer

Human Movement Studies & Special Education Faculty Publications

Fantasy sport consumer behavior research is a burgeoning area of inquiry as this growing segment of sport fans exhibits unconventional, yet robust media consumption habits. In addition, consumer motivation and market segmentation represent core principles within the study of marketing, yet the integration of these two essential concepts with regard to sport consumers is limited. The purpose of this study was to explore fantasy baseball motives, develop a motive-based taxonomy of users, and quantify the differences between segments through an examination of mediated sport consumption. An exploratory hierarchal cluster analysis with a subsequent K-means analysis was conducted to determine the …

Feminism, Power, And Sex Work In The Context Of Hiv/Aids: Consequences For Women's Health, Aziza Ahmed Jan 2011

Feminism, Power, And Sex Work In The Context Of Hiv/Aids: Consequences For Women's Health, Aziza Ahmed

Faculty Scholarship

This paper examines the involvement of feminists in approaches to sex work in the context of HIV/AIDS. The paper focuses on two moments where feminist disagreement produced results in favor of an "anti-trafficking" approach to addressing the vulnerability of sex workers in the context of HIV. The first is the UNAIDS Guidance Note on Sex Work and the second is the "anti-prostitution pledge" found in the Presidents Emergency Plan for AIDS Relief. This article also examines the anti-sex work position articulated by abolitionist feminists and demonstrates the unintended consequences of the abolitionist position on women's health. By examining the actual …

Upper-Level Courses: Three Examplars, Mark Fagan, Tamar Frankel, Eric J. Gouvin, Kathy Z. Heller

Faculty Scholarship

I'm Mark Fagan, and I co-teach a course on securitization with Tamar Frankel at Boston University School of Law. We have come together to teach several interdisciplinary courses that combine law, business and public policy. Our course on securitization is a wonderful exemplar because it touches so many aspects of law as well as business and public policy.

We spent quite a bit of time wrestling with how to teach it. Do you teach it in a process fashion? Do you teach it by legal topic? Do you take examples and examine them? After much debate and discussion, we actually …

American Vertigo: Dual Use, Prison Physicians, Research, And Guantanamo, George J. Annas Jan 2011

American Vertigo: Dual Use, Prison Physicians, Research, And Guantanamo, George J. Annas

Faculty Scholarship

Physicians can be used by governments for nonmedical purposes, and physician acceptance of their nonmedical use is usually denoted as "dual loyalty, " although it is more analytically helpful to frame it "dual use. " Dual use of physicians has been on display at Guantanamo where physicians have consistently been used to break hunger strikes as part of the military security mission in ways that directly violate medical ethics. Guantanamo itself has also been seen worldwide as a uniquely horrible prison, which can tell us little about other American prisons. The contrary seems to be true: Guantanamo, and the use …

The In Rem Forfeiture Of Copyright-Infringing Domain Names, Andrew Sellars Jan 2011

The In Rem Forfeiture Of Copyright-Infringing Domain Names, Andrew Sellars

Faculty Scholarship

In the summer of 2010, the Immigration and Customs Enforcement Division of the Department of Homeland Security began "Operation In Our Sites," an enforcement sweep targeted towards websites allegedly dealing in counterfeit goods and copyright-infringing files. The operation targeted the websites by proceeding in rem against their respective domain names. For websites targeted for copyright infringement, ICE Agents used recently-expanded copyright forfeiture remedies passed under the 2008 PRO-IP Act, providing no adversarial hearing prior to the websites being removed, and only a probable cause standard of proof.

This Paper examines three specific harms resulting from Operation In Our Sites, and …

Tweeting To Topple Tyranny, Social Media And Corporate Social Responsibility: A Reply To Anupam Chander, Erika George

Faculty Scholarship

This Essay offers critical reflections on the role of social media in social change and outlines how the obligation of corporations in the information communications technology sector to avoid complicity in rights violations may evolve over time. Part I explores the Internet's potential to further democratic discourse and inclusion or foster discrimination and exclusion. It also queries whether the Internet industry has an obligation to protect against hate propaganda. Part II examines whether other industry sectors can also be said to have special obligations based on the human rights consequences of their conduct. Part III explains the nature of the …

The Human Right To Health And Hiv/Aids: South Africa And South-South Cooperation To Reframe Global Intellectual Property Principles And Promote Access To Essential Medicines, Erika George

Faculty Scholarship

The HIV/AIDS pandemic has had a devastating and disproportionate impact in countries of the Global South. The experience of an individual infected with HIV in Africa is very different than that of an individual infected with HIV in America. Life expectancy varies sharply. The ability or inability to access medicines essential for treatment accounts for much of the variance. This article examines how the rhetoric of human rights used in the context of South Africa's AIDS crisis resonated across the Global South, resulted in a powerful social movement for access to medicines, and contributed to important changes in international intellectual …

Characteristics Of Difficult Patients In Prisons Compared To Difficult Patients In Primary Care Settings, Emily Kistler

All-Inclusive List of Electronic Theses and Dissertations

Research has found that patients perceived as being difficult by their physicians share a number of characteristics. These "difficult" characteristics include Axis I disorders, personality disorders, somatization, complex health problems, and aggression. Current research has focused on defining "difficult patients" in community populations, while other populations have gone overlooked. One population that has prevalence rates of the "difficult" characteristics identified in community samples is offenders. As a group, offenders tend to have high rates of mental illness, chronic health problems, and behavioral issues such as aggression. While difficult patients in prison may resemble difficult patients in the community, research has …

Hear My Voice: An Examination Of The Views Of Parents Who Are Raising Children Of African American Descent, Chavez Maurice Phelps

All-Inclusive List of Electronic Theses and Dissertations

Researchers have demonstrated that children who attend early childhoodEducation programs benefit academically and socially (National Institute for EarlyEducation Research, 2003). However, other researchers have shown that African American students may still lag behind their counterparts when they enter school (National Center forEducation Statistics ([NCES], 2004). To explain this phenomenon, scholars and practitioners have relied on deficit theories, such as Ruby Paynes (2005) culture of poverty theory or John Ogbus (1992) oppositional culture identity theory, which shift the blame solely on the child or their parents. However, there are other researchers who have stressed the importance of examining the impact of …
