The Livingstons Of Liberty Hall: Changes And Restrictions Of Gender In Eighteenth- Century America., Jennifer M. Tobin
Graduate Theses, Dissertations, and Problem Reports (ETD)
The Livingstons of Liberty Hall: Changes and Restrictions of Gender in Eighteenth- Century America explore issues of masculinity and femininity during the settlement of New York and New Jersey through the American Revolution. In it, theories relating to social order, economics and law are explored as they pertain to three generations of the Livingston family. Ideas regarding class and cultural diffusion, as well as the transformation of British colonial subjects to American citizens are seen through the education, lives and changes experienced by the Livingston family. Each Livingston son and daughter reacted and participated to the war and the changes …

[Re]Dux : Adaptive Architecture, [Re]Use & Mixed Use, Rachel Horntvedt
Architecture Theses
This thesis examines the implications a building’s history/past has on its future development. It is guided by the idea that some structures are more capable than others in making the transition from one function to another and that the need for this transition is inevitable if the economy in which these structures exist is to survive. The outcome of this research will be realized through the mixed use [re]development of a building located in Milwaukee, Wisconsin’s, Pabst Brewery complex which will serve to create a sustainable neighborhood that will positively influence the environment, the people who live and/or work there …

Legal Capital And The Model Business Corporation Act: An Essay For Bayless Manning, James J. Hanks Jr.
Legal Capital And The Model Business Corporation Act: An Essay For Bayless Manning, James J. Hanks Jr.
Law and Contemporary Problems
Hanks discusses the distribution provisions of the Model Business Corporation Act. The relatively smooth operation and interpretation of the MBCA's distribution provisions is an excellent example of the reflection, sophistication, care, and skill of the Committee on Corporate Laws in considering, drafting, revising, and updating the Model Business Corporation Act over the past sixty years. The overall success of the distribution provisions is a tribute to the many lawyers, judges, and law professors who have participated in the Committee's very successful efforts to advance the law of corporations in this country and elsewhere.

The Case For Iterative Statutory Reform: Appraisal And The Model Business Corporation Act , Robert B. Thompson
Law and Contemporary Problems
Appraisal may be the Model Business Corporation Act's (MBCA) most distinctive and creative corporate law product in its sixty year history. Through a series of changes, beginning in the late 1970s and early 1980s, and continuing through revisions in 1999 and 2006, the MBCA has shown the value that can come from an ongoing revision process of corporate law. Thompson examines the challenges that have long plagued appraisal statutes, and then evaluating the product that has resulted from the MBCA approach.

A'S From Zzzz's? The Causal Effect Of School Start Time On The Academic Achievement Of Adolescents, Scott E. Carrell, Teny Maghakian, James E. West
Economics
Recent sleep research finds that many adolescents are sleep-deprived because of both early school start times and changing sleep patterns during the teen years. This study identifies the causal effect of school start time on academic achievement by using two policy changes in the daily schedule at the US Air Force Academy along with the randomized placement of freshman students to courses and instructors. Results show that starting the school day 50 minutes later has a significant positive effect on student achievement, which is roughly equivalent to raising teacher quality by one standard deviation. Transnational Class Actions And The Illusory Search For Res Judicata, Tanya J. Monestier
Transnational Class Actions And The Illusory Search For Res Judicata, Tanya J. Monestier
Journal Articles
The transnational class action—a class action in which a portion of the class consists of non-U.S. claimants—is here to stay. Defendants typically resist the certification of transnational class actions on the basis that such actions provide no assurance of finality for a defendant, as it will always be possible for a non-U.S. class member to initiate subsequent proceedings in a foreign court. In response to this concern, many U.S. courts will analyze whether the “home” courts of the foreign class members would accord res judicata effect to an eventual U.S. judgment prior to certifying a U.S. class action containing foreign …

The Order And Significance Of The Sealed Tribes Of Revelation 7:4-8, Michael W. Troxell
Master's Theses
Problem. John’s list of twelve tribes of Israel in Rev 7, representing those who are sealed in the last days, has been the source of much debate through the years. This present study was to determine if there is any theological significance to the composition of the names in John’s list. Of particular interest to this study is the meaning of the inclusion of Levi and Manasseh and the exclusion of Dan and Ephraim. -- Methodology. Intertextual comparisons between John’s list and the many Old Testament lists of Israelite tribes were used to identify any theological significance to the composition …

Are Lawyers Unsung Disaster Heroes?: The Importance Of Well-Prepared Domestic Legal And Regulatory Frameworks For Effective Disaster Response, Elyse Mosquini
Are Lawyers Unsung Disaster Heroes?: The Importance Of Well-Prepared Domestic Legal And Regulatory Frameworks For Effective Disaster Response, Elyse Mosquini
Emory International Law Review
The aftermath of a natural disaster unquestionably calls for action amid chaos. No matter its character'a sudden-onset earthquake, seasonal hurricane, or flooding'a natural disaster's immediate-term impact is similar: families and communities confronting loss of life and property and struggling to meet their basic needs. The affected population may be displaced from their homes, supply chains of essential items such as food and fuel may be cut off, and social services may be interrupted. When these basic needs outstretch local capacities, the complexity of the response operation mounts. This Article highlights the importance of well-prepared domestic regulatory frameworks for effective disaster …
Dueling Nationalities: Dual Citizenship, Dominant And Effective Nationality, And The Case Of Anwar Al-Aulaqi, Abraham U. Kannof
Dueling Nationalities: Dual Citizenship, Dominant And Effective Nationality, And The Case Of Anwar Al-Aulaqi, Abraham U. Kannof
Emory International Law Review
This Comment argues that when hearing a case involving a suspected terrorist who holds dual citizenship, a domestic court should first determine, as a threshold matter, the dominant and effective nationality of the accused. This determination is significant because a dominant foreign national can essentially be treated as a non-citizen, for the purposes of adjudication, and may not be entitled to the full rights and protections of domestic citizenship.

With the rise of new technologies, geographical and political boundaries between companies are disappearing. Managers within multinational organizations are faced with the challenge of adapting to new paradigms of leadership while leading employees who may share different backgrounds. With businesses becoming more globalized, it is important to know and understand how to lead and interact with people from other cultures. The purpose of the study is to explore and describe similarities or differences with managers from the United States and managers from Taiwan in relation to the 29 leadership traits overall as well as at individual management levels. As a …

Choice of law issues in marine pollution events engage federal admiralty/general maritime law, federal environmental legislation and the reserved powers of the states to protect their natural resources and economic welfare. Admiralty and general maritime law enjoyed center stage throughout the first two thirds of the last century. Federal marine pollution statutes were few and weak, and state initiatives were typically deemed preempted in all but the so-called “marine but local” cases. The equilibrium began to shift in favor of state police powers and federal environmental values in the mid-1960’s in consequence of the Supreme Court’s solicitude for the former, …
Reconstituting Land Use Federalism To Address Transitory And Perpetual Disasters: The Bimodal Federalism Framework, Blake Hudson
Reconstituting Land Use Federalism To Address Transitory And Perpetual Disasters: The Bimodal Federalism Framework, Blake Hudson
Journal Articles
Scholars analyzing the intersection of federalism and disaster law and policy have primarily focused on the difficulties federalism poses for interjurisdictional coordination of disaster response. Though scholars have highlighted that rising disaster risks and costs are associated with “land-use planning that exacerbates, rather than mitigates, disaster risk,” a more holistic analysis of land-use-related disaster law and policy is needed. This Article provides a more comprehensive framework within which to analyze prospective mitigation or prevention of disaster risk and costs through a rebalancing - or reconstituting - of the respective roles of the federal and state governments in land-use planning. The …

Open Access And Liberal Education: A Look At Armenia, Azerbaijan And Georgia, D. Aram Donabedian, John Carey
Publications and Research
In the post-Soviet era, libraries in Armenia, Azerbaijan and Georgia have faced increasing budgetary challenges. In response to socioeconomic restructuring and the introduction of private enterprise, libraries have been forced to seek alternatives to commercial publishing and licensing models. This paper will assess the status of the open access movement and of Internet filtering controls in the countries of the South Caucasus. It will also argue that developing open models for scholarly communications is crucial to the strengthening of liberal education and civic participation in these aspiring democracies. Libraries, in their role as providers of and advocates for shared information, …

Victorian Children's Book Illustrations, Melinda Muscato
Other Faculty of Arts, Humanities and Business Theses
In the nineteenth century, as society in Victorian Britain adjusted to the effects of urbanization and industrialization, social roles began to shift, changes that were reflected in the children’s book illustrations of Randolph Caldecott, Henry J. Ford, and Beatrix Potter. This time period was considered the golden age of children’s book illustrations due to a large boom in both number and quality available. These children’s books illustrators had a lasting impact on culture and aesthetics and reinforced the social constructions of the new urban middle class. Randolph Caldecott’s illustrations of nursery rhymes gave new interpretations to familiar texts, some of …
