The Benefits Of Opt-In Federalism, Brendan S. Maher Nov 2011

The Benefits Of Opt-In Federalism, Brendan S. Maher

Faculty Scholarship

The Affordable Care Act (“ACA”) is a controversial and historic statute that mandates people make insurance bargains. Unacknowledged is an innovative mechanism ACA uses to select the law that governs those bargains: opt-in federalism.

Opt-in federalism – in which individuals choose between federal and state rules – is a promising theoretical means to make and choose law. This Article explains why, and concludes that the appeal of opt-in federalism is independent of ACA. Whatever the statute’s constitutional fate, future policymakers should consider opt-in federalist approaches to answer fundamental but exceedingly difficult questions of health and retirement law.

Evaluating Summer School Programs And The Effect On Student Achievement: The Correlation Between Stanford-10 Standardized Test Scores And Two Different Summer Programs, Alicia Kaye Bottorff

Dissertations

Educators have been looking for a solution to increasing yearly student achievement while at the same time ensuring that the achievement gap between students of high and low socioeconomic status does not continue to widen each year. Many studies examined show that students experience summer learning loss if not in school during the months of June through September. Because of this research, the district being studied extended their summer school program format from four-weeks to six-weeks. This collaborative, quantitative study examined assessment data from the SAT 10 to explore the correlation between middle school math and language arts test data …

Forecasting Zero: U.S. Nuclear History And The Low Probability Of Disarmament, Jonathan Pearl Mr. Nov 2011

Forecasting Zero: U.S. Nuclear History And The Low Probability Of Disarmament, Jonathan Pearl Mr.

Books, Monographs & Collaborative Studies

A vigorous debate is occurring among American elites with respect to whether and when the United States should relinquish its nuclear weapons. Bolstering hopes for tangible results is that a U.S. President is again publicly and forcefully supporting disarmament. While this debate, which addresses both technical and political factors related to abolition, may be the most serious one of its kind since the dawn of the nuclear age, the future of U.S. nuclear weapons policy remains uncertain. The general approach advanced today in U.S. policy circles largely hews, after all, to the logic of the past 65 years: arms control …

Design And Application Of A Direct-Push Vadose Zone Gravel Permeameter, Ronald B. Miller, Derek M. Heeren, Garey A. Fox, Daniel E. Storm, Todd Halihan Nov 2011

Design And Application Of A Direct-Push Vadose Zone Gravel Permeameter, Ronald B. Miller, Derek M. Heeren, Garey A. Fox, Daniel E. Storm, Todd Halihan

Department of Agricultural and Biological Systems Engineering: Faculty Publications

A borehole permeameter is well suited for testing saturated hydraulic conductivity (Ksat) at specific depths in the vadose zone. Most applications of the method involve fine-grained soils that allow hand auguring of test holes and require a small water reservoir to maintain a constant head. In non-cohesive gravels, hand-dug test holes are difficult to excavate, holes are prone to collapse, and large volumes of water are necessary to maintain a constant head for the duration of the test. For coarse alluvial gravels, a direct-push steel permeameter was designed to place a slotted pipe at a specific sampling depth. …

Non-Intrusive Identification Of Speech Codecs In Digital Audio Signals, Frank Jenner Nov 2011

Non-Intrusive Identification Of Speech Codecs In Digital Audio Signals, Frank Jenner

Theses

Speech compression has become an integral component in all modern telecommunications networks. Numerous codecs have been developed and deployed for efficiently transmitting voice signals while maintaining high perceptual quality. Because of the diversity of speech codecs used by different carriers and networks, the ability to distinguish between different codecs lends itself to a wide variety of practical applications, including determining call provenance, enhancing network diagnostic metrics, and improving automated speaker recognition. However, few research efforts have attempted to provide a methodology for identifying amongst speech codecs in an audio signal. In this research, we demonstrate a novel approach for accurately …

Implementation And Validation Of The Ζ-F And Asbm Turbulence Models, Dustin Van Blaricom Quint Nov 2011

Implementation And Validation Of The Ζ-F And Asbm Turbulence Models, Dustin Van Blaricom Quint

Master's Theses

The use of Computational Fluid Dynamics (CFD) tools throughout the engineering industry has become standard. Simulations are used during nearly all steps throughout the life cycle of products including design, production, and testing. Due to their wide range of use, industrial CFD codes are becoming more flexible and easier to use. These commercial codes require robustness, reliability, and efficiency. Consequently, linear eddy viscosity models (LEVM) are used to model turbulence for an increasing number of flow types. LEVM such as k-ε and k-ω provide modeling with little loss of computational efficiency and have proven to be robust. The LEVM that …

Verification And Expansion Of Single-Degree-Of-Freedom Transformation Factors For Beams Using A Multi-Degree-Of-Freedom Non-Linear Numerical Analysis Method, Takayuki Yokoyama Nov 2011

Verification And Expansion Of Single-Degree-Of-Freedom Transformation Factors For Beams Using A Multi-Degree-Of-Freedom Non-Linear Numerical Analysis Method, Takayuki Yokoyama

Master's Theses

The single-degree-of-freedom (SDOF) transformation factors as tabulated in John Biggs’ textbook (Biggs 1964) are accepted as the equivalent factors for simplifying and analyzing a component's response to blast. The study validates the stiffness and mass transformation factors through multi-degree-of-freedom (MDOF) numerical methods. After validating the transformation factors, the MDOF numerical method is used to create new stiffness and mass transformation factors for loading cases not already included in Biggs’ textbook.

The validated factors, as well as the newly developed factors are used in SDOF analyses. The deflections from the SDOF responses accurately predict the MDOF responses as long as the …

Investigating The Roles Of Ndj1 And Tid1 In Crossover Assurance In Saccharomyces Cerevisiae, Rianna Knowles Nov 2011

Investigating The Roles Of Ndj1 And Tid1 In Crossover Assurance In Saccharomyces Cerevisiae, Rianna Knowles

Master's Theses

Meiosis is the specialized process of cell division utilized during gametogenesis in all sexually reproducing eukaryotes, which consists of one round of DNA replication followed by two rounds of chromosome segregation and results in four haploid cells. Crossovers between homologous chromosomes promote proper alignment and segregation of chromosomes during meiosis.

Crossover interference is a genetic phenomenon in which crossovers are non-randomly placed along chromosomes. Crossover assurance ensures that every homologous chromosome pair obtains at least one crossover during Prophase I. Crossovers physically connect homologous pairs, allowing spindle fibers to attach and separate homologs properly. However, some organisms have shown an …

Detecting Suspicious Behavior With Low-Cost Sensors, Ahren Alexander Reed Nov 2011

Detecting Suspicious Behavior With Low-Cost Sensors, Ahren Alexander Reed

Master's Theses

A proof of concept is created that demonstrates how low-cost sensors and a simple software solution can be used to proactively detect IED placement. The main goal is to detect suspicious behavior; Specifically we derive requirements that loitering, meandering, improper location and object placement shall be detected. Current methods being used to detect Improvised Explosive Devices (IEDs) are costly in terms of equipment and risk to life, and many are retroactive; IED detection occurs long after explosives are placed. A prototype system is explored with the quality attributes of being low-cost, proactive and using simple software methods. A wireless sensor …

Velocity Contour Weighting Method. I: Algorithm Development And Laboratory Testing, Daniel J. Howes, Brett F. Sanders Nov 2011

Velocity Contour Weighting Method. I: Algorithm Development And Laboratory Testing, Daniel J. Howes, Brett F. Sanders

BioResource and Agricultural Engineering

An algorithm is developed for real-time estimation of the cross-sectional average velocity of a channel flow by using an upward-looking pulsed wave acoustic Doppler velocity meters (ADVM). The Velocity Contour Weighting Method (VCWM) is applicable to gradually varied flows in prismatic channels and requires little to no calibration. VCWM estimates the average velocity as a weighted average of ADVM bin velocities. Weights are based on the velocity distribution sampled by the ADVM. Collectively, the VCWM is able to adapt to a wide range of channel geometry and roughness features. Expressions for the velocity weights are developed by first applying a …

Agricultural Irrigation Using Municipal Effluent, Charles M. Burt Nov 2011

Agricultural Irrigation Using Municipal Effluent, Charles M. Burt

BioResource and Agricultural Engineering

The paper describes the development of a design and management plan for disposing of secondary effluent originating in the urban communities. It highlights the differences in approach that a public utility must take, versus a typical agricultural irrigation application. Costs and requirements for municipal effluent irrigation are many times greater. The complexity of regulations and agency procurement procedures relegates the actual irrigation system design to a relatively small role in the total project.

Geography Faculty Publications and Presentations

This study investigated potential impacts of climate change on travel disruption resulting from road closures in two urban watersheds in the Portland metropolitan area. We used ensemble climate change scenarios, a hydrologic model, stream channel survey, a hydraulic model, and a travel forecast model to develop an integrated impact assessment method. High-resolution climate change scenarios are based on the combinations of two emission scenarios and eight general circulation models. The Precipitation-Runoff Modeling System was calibrated and validated for the period 1988-2006, and simulated for determining the probability of floods from 2020-2049. We surveyed stream cross sections at five road crossings …

Crime-Severity Distinctions And The Fourth Amendment: Reassessing Reasonableness In A Changing World, Jeffrey Bellin Nov 2011

Crime-Severity Distinctions And The Fourth Amendment: Reassessing Reasonableness In A Changing World, Jeffrey Bellin

Vanderbilt Law School Faculty Publications

A growing body of commentary calls for the Supreme Court to recalibrate its Fourth Amendment jurisprudence in response to technological and social changes that threaten the traditional balance between public safety and personal liberty. This Article joins the discussion, highlighting a largely overlooked consideration that should be included in any modernization of Fourth Amendment doctrine-crime severity. The Supreme Court emphasizes that "reasonableness" is the "touchstone" of Fourth Amendment analysis. Yet, in evaluating contested searches and seizures, current Fourth Amendment doctrine ignores a key determinant of reasonableness, the crime under investigation. As a result, an invasive search of a suspected murderer …
