The following article is an attempt to provide a coherent theory that international tribunals may use to ground the imposition of vicarious liability for collective crimes. Currently, the case law and the literature is focused on a debate between the Joint Criminal Enterprise (JCE) doctrine applied by the ICTY and the co-perpetration doctrine applied by the ICC, which defines co-perpetrators as those who have joint control over the collective crime. The latter doctrine, influenced by German criminal law theory, has recently won many converts, both in The Hague and in the Academy, because it allegedly avoids many of the pitfalls …

Agricultural activities are major sources of non-point pollutants causing eutrophication. Constructed wetlands are used as a best management practice for sequestration of nutrients from agricultural runoff. This dissertation focuses on the influence of vegetation on bacterial community structure, microbial enzyme activities, and phosphorus retention capacity of constructed wetland systems. A greenhouse experiment was conducted using unvegetated or vegetated mesocosms with Juncus effusus, Carex lurida or Dichanthelium acuminatum var. acuminatum in monoculture or mixed culture.

On April 20, 2010, British Petroleum's Deepwater Horizon drilling rig located in the Gulf of Mexico exploded, creating the largest oil spill in U.S. history. BP launched a major public relations response that targeted its online audience through strategic use of its corporate website, Twitter feed, Facebook page, YouTube channel, and Flickr photostream. This content analysis examines BP's use of Twitter during the crisis response phase of the oil spill. BP tweeted on 1,161 occasions from the time of the explosion to the capping of the well. The courtship displays of male manakins (Pipridae) involve an array of acrobatic and postural elements. Previously it was found that species with elaborate displays exhibit specializations in motor planning and coordination areas of the brain. Several studies have suggested a relationship between cerebellum (Cb) morphology and distinct motor-related functions for the anterior Cb (somatosensory, flying, hopping/walking), posterior Cb (vision, audition, flying, hopping/walking), and vestibular Cb (flying, hopping/walking, vestibular). Dams are a vital part of a nation's infrastructure. Considering the fact that many of the dams in the United States have approached or are approaching their projected life expectancy of 50 years, these critical infrastructures represent a risk to public safety. Nanotoxicology is the study of the potential toxic effects of anthropogenic and biogenic nanostructures on living organisms. The influence of nanostructures such as nanoparticles on the human airway has gained interest due to increased susceptibility of translocation into other regions of the body. Adverse effects such as oxidative stress and inflammation have been found after the inhalation of airborne nanoparticles in airway epithelial cells. Oxidative stress and inflammation in mice models have been attenuated through the consumption of antioxidant containing plant compounds called phytochemicals. The purpose of this study was to determine the prevalence of Attention Deficit-Hyperactivity Disorder (ADHD) and general psychological characteristics in an adult, presurgery population of patients seeking Gastric Bypass (GB). An ADHD diagnosis was defined as clinically significant scores as measured by the Conners Adult ADHD Rating Scale (CAARS). Other psychological characteristics were assessed using the Minnesota Multiphasic Personality Inventory – Second Edition (MMPI-2). The sample was selected from a homogeneous adult outpatient population. Benefits Of Opt-In Federalism, The, Brendan Maher

The Affordable Care Act (“ACA”) is a controversial and historic statute that mandates people make insurance bargains. Unacknowledged is an innovative mechanism ACA uses to select the law that governs those bargains: opt-in federalism. Opt-in federalism – in which individuals choose between federal and state rules – is a promising theoretical means to make and choose law. This Article explains why, and concludes that the appeal of opt-in federalism is independent of ACA. Whatever the statute’s constitutional fate, future policymakers should consider opt-in federalist approaches to answer fundamental but exceedingly difficult questions of health and retirement law.

Trademark dilution is a highly controversial cause of action that has been the subject of hundreds of law review articles, but no significant scientific work. We analyze 60 years of telephone white pages, corporate & LLC naming data, advertisements from the New York Times, Wall Street Journal, and Washington Post, state and federal trademark databases, and all recorded dilution litigation. Our data suggest strongly that famous trademarks are frequently borrowed for use as trade names in services, but almost never as trade marks on products. Molecular imaging modalities are important tools to evaluate the efficacy of gene delivery systems and cell-based therapies. Development and application of these modalities will advance our understanding of the mechanism of transgene expression and cell fate and functions. Physical gene transfer methods hold many advantages over viral vectors among gene therapeutic strategies. Here, we evaluated the efficacy of biolistic (“gene gun”) gene targeting to tissues with non-invasive bioluminescence imaging (BLI) methods. This thesis details the design and optimization of a buoy used to collect renewable energy from ocean waves. The proposed buoy is a point absorber—a device that transforms the kinetic energy of the vertical motion of surface waves into electrical energy. The focus of the research is on the mechanical system used to collect the energy, and methods to improve it for eventual use in an actual wave energy harvester. The quatrefoil is a pan-Mesoamerican symbol with considerable time-depth. For the Maya, use of the symbol peaked during the Classic Period, reaching its highest frequency and largest geographical spread. Consequently, understanding its meaning has the potential to illuminate information about Precolumbian Maya worldview. Contract law is generally understood to require no more of a person who breaches a contract than to give the injured promisee the "benefit of the bargain." The law is thus assumed to permit a promise-breaker to keep any profit remaining from breach, after putting the victim in the position he would have been in had the promise been performed. This conventional description is radically wrong: across a wide range of circumstances, standard contract doctrines actually do require people to keep their promises, or to disgorge their entire profit from breach if they do not. The Caligidae (Siphonostomatoida, Copepoda) comprises more than 465 parasitic species, over 250 of which belong to Caligus Müller, 1785 (Boxshall and Halsey 2004). Caligus spp. are primarily marine; but some representatives routinely inhabit brackish or fresh water (Margolis et al. 1975). Some Caligus spp. have been widely reported from several oceans, others have been documented from a single location, and a few have only been collected as free-swimming individuals not associated with a host (Margolis et al. 1975). Caligus spp. range from being stenoxenous to euryxenous, with most species infecting actinopterygians (Actinopterygii), a much smaller group exclusively or non-exclusively infecting …

This paper reports on an exploratory study which used a graphical programming environment, Scratch, to facilitate the comprehension of a scripting programming language, ActionScript. Online survey questionnaires were distributed to 34 enrolled students, in a graduate level programming course with a 70% response rate. Findings indicated that Scratch contributed to the understanding of basic programming concepts such as event handling, sequential, and conditional statement but it was less helpful in assisting students’ understanding of more abstract concepts such as variables. A Provisional Phenomenology Of The Audiobook, Dylan E. Wittkower

In this preliminary phenomenology of the experience of an audiobook, I compare the engagement with language with that of reading and listening to a present speaker, as well as approaching the particularities of embodied audiobook listening on its own terms. The process of constructing meaning at the level of individual sentences is treated exhaustively, while the remainder is approached only in its general contours. We see that the audiobook contains its own temporal structure and forms a context in which physical and social experiences become background.

Previously we observed an excess risk for occupational asthma among florists with rhinitis. To further evaluate the link between upper and lower airways, we investigated united airways disease in the same occupational group. Occupational history, symptoms and atopy were investigated among 128 florists. Age-, smoking-, and gender-adjusted risks were calculated using logistic regression models comparing symptomatic and asymptomatic individuals. The prevalence of work-related rhinitis symptoms was 13.3%, conjunctivitis symptoms and asthma-like symptoms were 14.1%. We observed an excess risk of work-related asthma symptoms among florists with work-related conjunctivitis (OR: 8.5, 95% CI: 2.4-29.9) and rhinitis (OR: 13.1, 95% CI: 3.0- …

To further our understanding of the effects of biomass burning emissions on atmospheric composition, we report measurements of trace species in biomass burning plumes made by the Atmospheric Chemistry Experiment Fourier Transform Spectrometer (ACE-FTS) instrument on the SCISAT-1 satellite. An extensive set of 15 molecules, C2H2, C2H6, CH3OH, CH4, CO, H2CO, HCN, HCOOH, HNO3, NO, NO2, N2O5, O-3, OCS and SF6 are used in our analysis. Margaret Atwood's novels of speculative fiction Oryx and Crake and The Year of the Flood articulate a currently possible future world of corporate control marked by profitable practices of death. Narrated by both individuals of privilege and also of the underclass, the novels reveal insidious systems of self-perpetuating diseases and cosmetic enhancements that ultimately bankrupt or kill the consumers. Mathematical modeling of infectious diseases is increasingly used to explicate the mechanics of disease propagation, impact of controls, and sensitivity of countermeasures. The authors demonstrate use of a Rift Valley Fever (RVF) model to study efficacy of countermeasures to disease transmission parameters. RVF is a viral infectious disease that propagates through infected mosquitoes and primarily affects animals but also humans. Vaccines exist to protect against the disease but there is lack of data comparing efficacy of vaccination with alternative countermeasures such as managing mosquito population or destroying infected livestock.
