The Bramble Bush Of Forking Paths: Digital Narrative, Procedural Rhetoric, And The Law, Lucille A. Jewel Jan 2011

The Bramble Bush Of Forking Paths: Digital Narrative, Procedural Rhetoric, And The Law, Lucille A. Jewel

Scholarly Works

This Article explores ways to harness the persuasive and narrative power of computer games for practical legal purposes. The mental experiences we have when we play computer games relate to what attorneys do every day. Playing computer games and practicing law both require engagement with interactive plots where the outcomes depend on a series of choices in a complex system.

The analogues between computer games and the practice of law are one reason that lawyers should take a deeper look at this emerging narrative theory. The other reason has to do with the fact that millions of people play computer …

Awareness : Students Connecting With The Environment, Elizabeth Chagolla Jan 2011

Awareness : Students Connecting With The Environment, Elizabeth Chagolla

Capstone Projects and Master's Theses

Awareness is the first step in making a difference in any issue. The more aware you are, the more you will understand and know how to make a difference. Through my Capstone Project my students did a series of lessons that’s main focus was to make them more aware of the environment. Through the readings that I did for my issue I found that the best way to make students more aware was through place-based education, which is why most of the lessons were done outdoors where the students were able to work hands on with nature. Overall My Capstone …

Potential Impacts Of Groundwater Withdrawal And Wildfires Along The Big Sur River : An Assessment Of Oncorhynchus Mykiss Habitat, Casey Lanier

Capstone Projects and Master's Theses

Oncorhynchus mykiss (steelhead trout) are a federally threatened species currently found in the Big Sur River in Monterey County. Dam construction, culverts, water diversions and sedimentation are leading causes in habitat degradation for steelhead. A recent capstone study found that near-stream groundwater wells were extracting enough water to cause a decrease in surface flow, generating motivation for this study. The Basin Complex and Indians fire of 2008 burned 84% of the Big Sur watershed creating the potential for elevated fine sediment yields. Post-wildfire sediment yield increases from background conditions to an unknown level at an unknown magnitude. The threat of …

Contextualizing The Gospel To Muslims, Maya J. Morgan Jan 2011

Contextualizing The Gospel To Muslims, Maya J. Morgan

Seminary Masters Theses

Muslims are considered some of the least reached peoples in the world. As "Christianity" is often associated with Colonialism, the Crusades, and Western culture, traditional models of “casting the seed” have proven ineffective. Those seeking to share the goodness with Muslims must explore new contextual ways to communicate the message of Christ to the Islamic community. This thesis begins by defining and giving a brief history of contextualization. Basic methods of contextualization are explained, and issued of syncretism are addressed in chapter one.

Contextualization must be practiced when communicating the good news. Chapter two focuses on the aspects of cross-‐cultural …

Guiding Students From Consuming Information To Creating Knowledge: A Freshman English Library Instruction Collaboration, Carolyn White Gamtso, Susanne F. Paterson Jan 2011

Guiding Students From Consuming Information To Creating Knowledge: A Freshman English Library Instruction Collaboration, Carolyn White Gamtso, Susanne F. Paterson

Library Community Scholarship

In this paper we examine how faculty and librarians’ own approaches to and attitudes toward library tools, as well as their assumptions about student research practices, impede students’ ability to view learning as a recursive, creative, and ongoing inquiry. We propose first that librarians and faculty examine the assumptions of knowledge that characterize their respective university constituencies; second that they dismantle some of the disciplinary boundaries that separate these constituencies; third that they collaborate to craft analytical assignments that stress knowledge as process; and fourth that they transform library instruction from tool-based demonstrations to analytical, problem-based learning exercises. Finally, we …

Chilean Blue Whales As A Case Study To Illustrate Methods To Estimate Abundance And Evaluate Conservation Status Of Rare Species, Rob Williams, Sharon L. Hedley, Trevor A. Branch, Mark B. Bravington, Alexandre N. Zerbini, Ken P. Findlay Jan 2011

Chilean Blue Whales As A Case Study To Illustrate Methods To Estimate Abundance And Evaluate Conservation Status Of Rare Species, Rob Williams, Sharon L. Hedley, Trevor A. Branch, Mark B. Bravington, Alexandre N. Zerbini, Ken P. Findlay

United States Department of Commerce: Staff Publications

Often abundance of rare species cannot be estimated with conventional design-based methods, so we illustrate with a population of blue whales ( Balaenoptera musculus) a spatial model-based method to estimate abundance. We analyzed data from line-transect surveys of blue whales off the coast of Chile, where the population was hunted to low levels. Field protocols allowed deviation from planned track lines to collect identification photographs and tissue samples for genetic analyses, which resulted in an ad hoc sampling design with increased effort in areas of higher densities. Thus, we used spatial modeling methods to estimate abundance. Spatial models are increasingly …

Beauty And The Barbie Doll: When Life Imitates Plastic, Alexandra Gaudio Jan 2011

Beauty And The Barbie Doll: When Life Imitates Plastic, Alexandra Gaudio

American Studies Senior Theses

My project will consist of three major parts. I want to take a brief look at how the hegemonic ideals of feminine beauty in the United States have evolved over the past fifty years, since Barbie was introduced in 1959. Also, I will go through a history of Mattel’s Barbie doll, including the development of the doll and some of its many different manifestations over the years. Then I will use these two components to investigate the relationship between exposure to the doll and young women’s perception of beauty, as well as other potentially subconscious ideals they may internalize from …

Effects Of Global Trade Liberalisation On Forestry Products And Forest Sustainability Using The Gtap Model, Luz C. Stenberg, Mahinda Siriwardana Jan 2011

Effects Of Global Trade Liberalisation On Forestry Products And Forest Sustainability Using The Gtap Model, Luz C. Stenberg, Mahinda Siriwardana

Business Conference Papers

The paper analyses the effects of trade liberalization amongst the leading exporters and importers of forest products, in particular, as well as global merchandise, in general. The study utilises the Global Trade Analysis Project (GTAP) model and its database, version 7. Given that forest products only comprise a small proportion of world merchandise trade, it is expected that trade liberalisation would cause small changes in terms of trade, real GDP, production, consumption and prices of forest products in most countries. In the short-run, national welfare in China and Japan would increase substantially by more than $US400 million while the opposite …

When The State Demands Disclosure, Rebecca Aviel Jan 2011

When The State Demands Disclosure, Rebecca Aviel

Sturm College of Law: Faculty Scholarship

The obligation to provide certain types of information to government authorities — reporting child abuse, say, or insurance fraud — is proliferating. Are these laws enforceable against lawyers who obtain the sought-after information in the course of representing a client? This Article sets out to answer exactly that question. It begins by explaining why it is wrong to approach the question by balancing the policies that underlie attorney-client confidentiality against those underlying reporting statutes. Such an approach fails to grasp the essential nature of the question, which is one of legislative power and legislative intent. This Article is the first …

Hypoxic And Low Ph Water In The Nearshore Marine Environments Of Monterey Bay, California : Characterizing A Decade Of Oxygen And Ph, And Drivers Of Variability, J. Ashley Tomer Booth Jan 2011

Hypoxic And Low Ph Water In The Nearshore Marine Environments Of Monterey Bay, California : Characterizing A Decade Of Oxygen And Ph, And Drivers Of Variability, J. Ashley Tomer Booth

Capstone Projects and Master's Theses

A decade-long time series recorded in southern Monterey Bay, California demonstrates that the shallow, near-shore environment (17 m depth) is regularly inundated with pulses of cold, hypoxic and low pH water. During these episodes, oxygen can drop to biologically threatening levels, and pH levels were lower than expected. Weekly water chemistry monitoring revealed that the saturation state of aragonite (the more soluble form of calcium carbonate) was often below saturation and had a moderate positive relationship with pH, however, analytical and human error could be high. Pulses of hypoxia and low pH water with the greatest intensity arise at the …

Nitrate Transport To Coastal Monterey Bay : Investigating Source Inputs From Elkhorn Slough, Tanya Novak Jan 2011

Nitrate Transport To Coastal Monterey Bay : Investigating Source Inputs From Elkhorn Slough, Tanya Novak

Capstone Projects and Master's Theses

Nitrate transport from Elkhorn Slough (ES) to the nearshore surface waters of Monterey Bay is examined using two years of time-series data from the Land-Ocean Biogeochemical Observatory (LOBO). Hourly nitrate, temperature and salinity measurements from nearshore moorings 2.5 km north (summer, 2008) and 2.5 km south (summer– fall, 2009, winter 2010) of the Moss Landing Harbor entrance at 20-m depth were monitored with the objective of observing high nitrate events associated with terrestrial-sourced waters. Nearshore nitrate supply from ES was quantified in comparison to upwelling and internal waves based on estimates of volume transport and average nitrate concentration observed at …

Curious Food Procurement In The Eastern North Pacific Kyphosidae, Clinton J. Moran Jan 2011

Curious Food Procurement In The Eastern North Pacific Kyphosidae, Clinton J. Moran

Capstone Projects and Master's Theses

The aims of this study were to quantify the kinematics of two feeding behaviors exhibited by G. nigricans. A scraping behavior was elicited by allowing G. nigricans to scrape from a block of brine shrimp gelatin and a picking behavior was elicited by allowing G. nigricans to feed on Ulva spp. During feeding events it became apparent that G. nigricans does not use, or has lost, the ability to suction feed. When feeding on non-attached diet items they approached their prey with their gape wide open until the prey was in their mouth, likely to reduce the bow wave created …
