Revisiting The Regulatory Status Of Broadband Internet Access: A Policy Framework For Net Neutrality And An Open Competitive Internet, Lee L. Selwyn, Helen E. Golding

A decade of broadband access deregulation has landed the FCC at a legal deadend. After the D.C. Circuit's Comcast decision, the FCC finds itself unable to enforce its "net neutrality" goals. To reassert its jurisdiction over "net neutrality," the FCC proposes to reclassify broadband Internet access as a Title II "telecommunications service" while continuing to forbear from most other facets of common carrier regulation. The FCC's current dilemma results from an unfortunate combination of unverified predictive judgments associating deregulation with investment; overly optimistic assessments of competition in the consumer broadband market; the abandonment of the "bright line" between transmission and …

With the recent growth in farmers markets and the demand for local, fresh foods there has been a push to allow individuals to produce and sell foods made in their homes. This report will explain why Mississippi should follow the trend set by over 30 states to allow in-home production and sale of certain low-risk or non-potentially hazardous foods like baked goods, jams, jellies, and dried herbs. Metabolic Profile Of The Ironman World Championships: A Case Study, John S. Cuddy, Dustin R. Slivka, Walter S. Hailes, Charles Dumke, Brent Ruby

Integrative Physiology and Athletic Training Faculty Publications

Purpose: The purpose of this study was to determine the metabolic profile during the 2006 Ironman World Championship in Kailua-Kona, Hawaii. Methods: One recreational male triathlete completed the race in 10:40:16. Before the race, linear regression models were established from both laboratory and field measures to estimate energy expenditure and substrate utilization. The subject was provided with an oral dose of (2)H(2)(18)O approximately 64 h before the race to calculate total energy expenditure (TEE) and water turnover with the doubly labeled water (DLW) technique. The Modulation Of Trpm7 Currents By Nafamostat Mesilate Depends Directly Upon Extracellular Concentrations Of Divalent Cations, Xuanmao Chen, Tomohiro Numata, Minghua Li, Yasuo Mori, Beverley A. Orser, Michael F. Jackson, Zhi-Gang Xiong, John F. Macdonald

Molecular, Cellular & Biomedical Sciences

Concentrations of extracellular divalent cations (Ca2+ and Mg2+) fall substantially during intensive synaptic transmission as well as during some pathophysiological conditions such as epilepsy and brain ischemia. Here we report that a synthetic serine protease inhibitor, nafamostat mesylate (NM), and several of its analogues, block recombinant TRPM7 currents expressed in HEK293T cells in inverse relationship to the concentration of extracellular divalent cations. Lowering extracellular Ca2+ and Mg2+ also evokes a divalent-sensitive non-selective cation current that is mediated by TRPM7 expression in hippocampal neurons. In cultured hippocampal neurons, NM blocked these TRPM7-mediated currents with an apparent affinity of 27 μM, as …

This paper explores some of the business diagnostic tools useful in evaluating elevator maintenance performance and setting elevator performance objectives. In October 2008, The FASB and the IASB issued a discussion letter for comment proposing a complete redesign of financial statements. This was the result of a project that began for both boards in 2001. More than 200 comment letters were received from individuals, accounting firms, professional societies, corporations, and others from the business community. The FASB and IASB have analyzed the input, and are currently preparing an exposure draft scheduled for release in early 2011. This paper reviews the proposed changes to the financial statements, summarizes the favorable and unfavorable responses contained in the comment letters, and examines the …

This report examines the sustainability of Trane’s EarthWiseTM climate control systems in the Salt Lake Valley (and the United States Mountain West in general). A simulation is performed to determine the best climate control system for a LEED Silver, 5-story tenant office building. This new building is a duplication of a pre-existing building. The climate control system installed at the preexisting building is used as a baseline against which three (3) alternative systems are compared. Pillow speakers are a healthcare communications tool that allow for hospital patients to control many entertainment and environmental components of the hospital room from one controller. The characterization of rock strength for cap rock, low-permeability and high capillary entry pressure, lithologies is important for modeling their response to increased fluid pressures in CO2 sequestration schemes and other geo-engineering operations such as waste disposal and recovery of fluids from plays with insufficient permeability. We investigate Mesozoic fine-grained sequences to evaluate the nature of sedimentological and structural processes that may control the nature of brittle deformation observed in these sequences. To characterize these fine-grained sequences we use a combination of data obtained from outcrop, including fracture orientation and density, lithologic stacking patterns, grain-size distributions and mineralogy to predict …

This study assessed the efficacy of the United States Safe Harbor Framework by approximating the size of a population of large United States organizations (50,000 - 500,000 employees) that were eligible to participate in the Safe Harbor that did not participate. The Safe Harbor Framework, administered by the United States Department of Commerce, is a voluntary program that assists United States organizations in complying with the European Union Data Privacy Directive. Out of a population of 337 large organizations, 168 were potentially eligible to participate in the Safe Harbor Framework. One hundred and ten, or 66%, of these organizations did …

Literacy in secondary mathematics continues to be difficult for many. Mathematics teachers and researchers continue to develop support documents for secondary math teachers. It is important to utilize the literacy strategies already established by other content areas. It is feasible to adjust these strategies to suit the needs of mathematics students. Literacy across the content areas is a relatively new idea in education, but literacy in mathematics is even more foreign. Unbeknownst to many lawyers, numerous jurisdictions - including New York and California - have statutes on the books that single out lawyers who engage in deceit or collusion. In nearly all of these jurisdictions, a lawyer found to have engaged in deceit or collusion faces criminal penalties and/or civil liability in the form of treble damages. Until recently, these attorney deceit statutes have languished in obscurity and, through a series of restrictive readings of the statutory language, have been rendered somewhat irrelevant.
