There was a time when accessing pornographic and obscene materials was much more difficult than it is today. Prosecuted in 1868, Regina v. Hicklin was the first known obscenity case tried under the Obscene Publications Act in Great Britain. The United States Supreme Court first addressed obscenity in the 1957 case of Roth v. United States and grappled with setting standards or creating criteria by which obscenity could be defined. In the 1960s, multiple proposals for federal legislation to crack down on obscenity were offered. Previous studies of heading perception suggest that human observers employ spatiotemporal pooling to accommodate noise in optic flow stimuli. Here, we investigated how spatial and temporal integration mechanisms are used for judgments of heading through a psychophysical experiment involving three different types of noise. Furthermore, we developed two ideal observer models to study the components of the spatial information used by observers when performing the heading task. In the psychophysical experiment, we applied three types of direction noise to optic flow stimuli to differentiate the involvement of spatial and temporal integration mechanisms. Whatever its status in the statutory interpretation "wars," originalism-driven textualism has assumed an increasingly prominent role in constitutional interpretation, at least within the academy. The focus of this Article is on one such form, namely, "Supremacy Clause textualism", that is, recent textualist claims about the implications of the Supremacy Clause of Article VI. This Article addresses two such claims.

Immigrants often speak languages that natives do not understand, leading to intentional or inadvertent ostracism, which in turn may increase perceptions of threat. For example, English language participants excluded from a conversation in Spanish report more negative reactions than participants excluded in English (Hitlan, Kelly, & Zarate, 2010). Integrated threat theory (ITT) suggests that there are four threats that lead to prejudice toward outgroups such as immigrants: realistic threat, symbolic threat, intergroup anxiety, and negative stereotypes (Stephan, Ybarra, & Bachman, 1999). Ensuring that all students receive access to an appropriate education becomes vital to our future. Differentiated instruction has been suggested as one way to provide that access. The rise in the seventeenth and eighteenth centuries of a professional class of writers stimulated authors' demands for better remuneration from their writings. The increase in authors who sought to live from their work, rather than from patronage or personal fortune, likely provided at least one impulse for the author-protective provisions of the 1710 Statute of Anne. Under the regime of printing privileges that preceded the Statute of Anne, authors generally received from publisher-booksellers a one-time payment, made when the authors surrendered their manuscripts for publication. Philip Frickey's commitment to practical legal studies won my admiration early on in his career. In this welcome celebration of his extraordinary career, it seems fitting to essay something "practical" – to attempt a constructive approach to an enduring problem – that has some bearing on his lifelong attention to the problem of "interpretation." If it will not make the problem go away, perhaps it will provide a basis for understanding its inevitable tensions, and in that way will help us step past theoretical exegeses suggesting the possibility of simple answers.

Environmental concern has been frequently measured since the 1970's, however, much of this research has focused on adults. Of the studies that look at students, the majority focus on high school with little attention given to middle or elementary grades. None of these studies have looked at elementary, middle, and high school students from the same population. This study uses the NEP Scale for Children in conjunction with free response questions to examine the trends in environmental concern from 120 Catholic elementary, middle school, and high school students from Des Moines, Iowa. The purpose of this study was to explore mathematics instruction which implements reform-based problems within a traditionally taught classroom and its effect on struggling learners of mathematics. The reform-based problems implemented during the course of this study dealt with area and perimeter concepts at the fifth grade level. For this study, struggling learners of mathematics were defined as students scoring below the 40th percentile on the mathematics subtests of the Iowa Test of Basic Skills. To understand the impact of special education and educational changes that have occurred in rural schools in Iowa since 1975, this ethnographic qualitative inquiry examined the dispositions, beliefs, contexts, and recalled experiences of four teachers who began teaching around the time the Education for All Handicapped Children Act (EAHCA) was enacted in 1975 and continued teaching until after the No Child Left Behind Act (NCLB) was enacted in 2002. In addition, the research project explored the teachers' views of the impact various educational changes had on them, their colleagues, and the students they taught.

The purpose of this study was to investigate youth resiliency employing dual methodologies, auto-ethnography and life history research respectively, to reveal how two middle-aged adults (one African-American, the other Caucasian) achieved resiliency; and most importantly, how their experiences and insights might inform ongoing efforts to promote youth resiliency. The purpose of this study was to investigate non-cognitive motivational factors as indicators of academic achievement of male athletes and male non-athletes as measured by a secondary data analysis of the College Student Inventory (CSI) from Fall 2003 to Fall 2005. Deci and Ryan's (2000) self-determination theory provided the conceptual framework for this study.

The CSI was administered through a survey technique. Participants in the survey sample were selected from 142 first semester freshman male athletes and male non-athletes enrolled at a Midwestern University.

The purpose of this study was to measure the effects of the Iowa Smoke-Free Ban impact on: smoking behavior, knowledge of the ban and knowledge of smoking health effect, reported smoking in both indoor and outside venues; support for smoke-free public venues; and self-reported effects of the law on consumption and quitting. A non-random sample of 113 students (49.44% male and 50.44% female) participated in this study.

Sediment cores from two alpine lakes in Wyoming's Wind River Range were collected and analyzed to establish a record of depositional and mineralogical variability. Due to the hydrologic setting and isolation of Fiddlers and Louis lakes, these cores yielded the longest continuous limnological record in the region that extends back nearly 20,000 years to full-glacial conditions, a rarity for alpine lakes in the western United States.

To develop a paleolimnological record for Fiddlers and Louis lakes, the sediment cores were analyzed using four laboratory techniques. These techniques included particle size analysis, x-ray diffraction, heavy mineral analysis, and loss-on-ignition. Radiocarbon ages …

Research suggests that the propensity to forgive expressed by societies is often influenced by the cultural orientation of the society. Collectivistic societies tend to express a higher level of willingness to forgive than individualistic societies. This study examined how two samples of different cultural orientations, Lebanese and American, define forgiveness and express their feelings, thoughts and behavior towards a specific offender who has hurt them in the past. Hallux valgus is a common condition characterized by lateral deviation of the large toe and medial deviation of the first metatarsal. While some gait analyses of patients with hallux valgus have been performed using plantar pressures, very little is known about the kinematics of gait in this population. The purpose of this study was to evaluate triplanar kinematics in patients with hallux valgus using a multisegmental foot model. Contract interpretation remains the largest single source of contract litigation between business firms. In part this is because contract interpretation issues are difficult, but it also reflects a deep divide between textualist and contextualist theories of interpretation. While a strong majority of U.S. courts continue to follow the traditional, "formalist" approach to contract interpretation, some courts and most commentators prefer the "contextualist" interpretive principles that are reflected in the Uniform Commercial Code and the Second Restatement. Direct voting by property owners is a widespread but controversial tool for resolving disputes over local collective goods. Direct voting has powerful advantages, in that it can harness the superior knowledge of many local minds, resolve controversies in a way that is perceived to be legitimate, and eliminate corrupt dealmaking. But it also has serious pitfalls, if local voters are poorly informed, or if they ignore external effects on other communities, or if the process is distorted by majoritarian or minoritarian bias. Utilizing The Technology Acceptance Model To Assess The Employee Adoption Of Information Systems Security Measures, Cynthia M. Jones, Richard V. Mccarthy, Leila Halawi, Bahaudin Mujtaba

In this study, the factors that affect employee acceptance of information systems security measures were examined by extending the Technology Acceptance Model. Partial least squares structural equation modeling was applied to examine these factors. 174 valid responses from employees from companies in various industry segments in the United States and Canada were analyzed. The results of the statistical analysis indicate that subjective norm moderated by management support showed the strongest effect on intention to use information systems security measures.

Service-learning has gained popularity (Oster-Aaland, Sellnow, Nelson, & Pearson, 2004) particularly in public relations (Panici & Lasky, 2002). This paper presents a discipline-defined framework for service-learning in public relations, suggestions for implementing the assessment measure, and reflection on its use.
