Fiscal federalism is a staple of economic theory that underlies the federal-state partnership in the nation‘s largest federal grant-in-aid programs, such as Medicaid and Title IV-E Foster Care. This Article undertakes the first ever analysis of the consequences of the justice and legal system’s extensive use of lethality assessment tools for women subjected to abuse. An increasing number of states are now requiring their police, prosecutors, civil attorneys, advocates, service providers, and court personnel to assess women in order to obtain a score that indicates the woman’s lethality risk because of domestic violence. The mandated danger assessment screen of all women subjected to violence focuses only on the risk of homicide and thereby limits the definition of what is domestic violence. Seafloor geology and potential benthic habitats were mapped in Muir Inlet, Glacier Bay National Park and Preserve, Alaska, using multibeam sonar, ground-truth information, and geological interpretations. Muir Inlet is a recently deglaciated fjord that is under the influence of glacial and paraglacial marine processes. High glacially derived sediment and meltwater fluxes, slope instabilities, and variable bathymetry result in a highly dynamic estuarine environment and benthic ecosystem. We characterize the fjord seafloor and potential benthic habitats using the Coastal and Marine Ecological Classification Standard (CMECS) recently developed by the National Oceanic and Atmospheric Administration (NOAA) and NatureServe. This Article explores what is and what is not in adjudication and mediation, thus illuminating the profound differences between these two processes. The Article does this work in four parts. First, it offers an analysis of cognitive mapmaking and its inevitability in constructing meaning. It then explores how adjudication defines meaning in a particular way. This Article then conducts a comparable analysis of mediation. Finally, it focuses on the bridging function attorneys play between the worlds of mediation and adjudication.

Semi-volatile organic compounds (SVOCs) in estuarine waters can adversely affect biota but watershed sources can be difficult to identify because these compounds are transient. Natural bacterial assemblages may respond to chronic, episodic exposure to SVOCs through selection of more organotolerant bacterial communities. We measured bacterial production, organotolerance and polycyclic aromatic hydrocarbon (PAH) mineralization in Charleston Harbor and compared surface sediment from stations near a known, permitted SVOC outfall (pulp mill effluent) to that from more pristine stations. Naphthalene additions inhibited an average of 77% of bacterial metabolism in sediments from the more pristine site (Wando River). Production in sediments nearest …

We discuss Lehodey et al.’s (2009) approach to linking ocean models to population dynamics of large marine predators, consider its benefits and limitations, and outline alternative approaches. We advocate a middle ground between Lehodey et al.’s pragmatic, phenomenological approach and the detailed mechanistic approach common to most individual based models. These models should capture the essence of critical processes controlling recruitment and dynamic density-dependent and environmental effects.

New Options For State Indirect Purchaser Legislation: Protecting The Real Victims Of Antitrust Violations, Robert H. Lande

In Illinois Brick v. Illinois Co., the Supreme Court held that, under federal antitrust law, only direct purchasers have standing to sue antitrust violators for damages. Since most products travel through one or more intermediaries before reaching consumers, this decision left most true victims of illegal cartels and other antitrust violations without a remedy to compensate them. Illinois Brick Co. also had the effect of undermining the objective of optimal deterrence of antitrust violations-because direct purchasers often have a suboptimal incentive to sue, the Court's decision often allows violators to escape paying significant damages. This article will (1) define the consumer choice approach to competition law or antitrust law and show how it differs from other approaches; (2) discuss the types of situations where a consumer choice focus is likely to make a difference in enforcement outcomes, producing better results than the other paradigms; (3) show that another important advantage of using the consumer choice approach would be to nudge decisions in the right direction; and (4) offer a brief overview of implementation issues.

The survey was intended to gather information related to how many of the show attendees who visited a Montana Travel Region booth actually took a trip to Montana during 2009, what types of information they used in making decisions about the trip, and what they did while in Montana.

The Atlas Inner Detector Commissioning And Calibration, Kerstin M. Perez

The ATLAS Inner Detector is a composite tracking system consisting of silicon pixels, silicon strips and straw tubes in a 2 T magnetic field. Its installation was completed in August 2008 and the detector took part in data-taking with single LHC beams and cosmic rays. The initial detector operation, hardware commissioning and in-situ calibrations are described. Tracking performance has been measured with 7.6 million cosmic-ray events, collected using a tracking trigger and reconstructed with modular pattern-recognition and fitting software. Natural fibres are increasingly being considered as the reinforcement for polymer matrix composites as they are perceived to be sustainable being a renewable resource. However, they suffer from higher variability in mechanical properties and concerns about their long-term durability in a moist environment. In this study the physical properties of the jute fibres were characterised, the fibre length distribution was determined and the fibre cross-section was analysed using digital images. Resilience Against Death Anxiety In Relationship To Post-Traumatic Stress Disorder And Psychiatric Co-Morbidity, Mark Hoelterhoff

Research was conducted examining death anxiety from existential, psychodynamic, cognitive and sociological perspectives. The intent was to consider the role of death anxiety on well-being; four studies were conducted to examine how death anxiety influenced PTSD and mental health among people who have experienced a life-threatening event. These studies were conducted using undergraduate university students in Lithuania. The first study used a mixed-method design and in phase 1, participants (N=97) completed self-report questionnaires that gathered information on demographics, death anxiety, trauma and well-being. Results indicated a significant correlation between death anxiety and PTSD, but not psychiatric co-morbidity. Phase 2 attempted …

With the current expansion of offshore oil activities in Arctic regions, there is an urgent need to establish the potential effects of oil-related compounds on Arctic organisms. The scallop Chlamys islandica is distributed throughout the sub-Arctic and has been proposed as a sentinel species for this region. In addition, the temperate scallop Pecten maximus occurs in regions of oil activity and, with increasing sea temperatures, the limit of its distribution may extend further into sub-Arctic regions. P. maximus also accumulates contaminants to a greater extent than the current temperate sentinel Mytilus edulis. A hierarchical approach, similar to that adopted to …

Reasoning and judgment under uncertainty are often based on a limited number of simplifying heuristics rather than formal logic or rule-based argumentation. Heuristics are low-effort mental shortcuts, which save time and effort, and usually result in accurate judgment, but they can also lead to systematic errors and biases when applied inappropriately. In the past 40 years hundreds of papers have been published on the topic of heuristics and biases in judgment and decision making. The effects of sanitary and phytosanitary (SPS) measures in the fisheries sector of The Gambia including the factors affecting the safety and spoilage of fish were investigated. Reasoning from all knowledge and belief is an adaptive approach to thinking about the world. It has been robustly shown that conditional ‘if then’ reasoning with everyday content is influenced by the background knowledge an individual has available. If we are presented with the statement ‘if it rains, then John will get wet’ then we are told that it is raining and asked if John will get wet, we may consider a number of possibilities before answering the question; perhaps John has an umbrella or is sheltered from the rain. This thesis has been undertaken with the purpose of investigating how adult speech processing systems are affected by. and how they cope with, the presence of different regional and foreign accents in speech, and to investigate the developmental origins of adult accent perception capabilities. Experiments 1 to 4 were designed to investigate the long term effects of exposure to different accents, and whether short term adaptation to an accent was possible, using a lexical decision task. Human activities are degrading marine ecosystems and undermining the ecological functions and processes which provide valued goods and services. European and UK marine policy developments aim to implement the Ecosystem Approach to support better management of activities and maintain the health of regional seas. Current public perceptions of the UK marine environment are overwhelmingly negative, creating a barrier to engaging society with marine environmental issues and policy. This thesis conducts a study of the attributes of a suite of 72 UK marine species to identify those which contribute most to marine ecological health. The groups of painters in England who experimented with new visual expressions of modernity between 1910 and 1915 are the subject of this historiographical research. More precisely, the accounts of Vorticism, Bloomsbury post-Impressionism and the modern art of painters associated with Sickert, (principally the Camden Town Group), have been critically examined over a forty year period in order to trace the narrative of their place in contemporary art criticism and their entry into histories of what soon became the recent past. This research examines the issues and visual processes that arise in the production of self-representations derived from literary texts. The construction of a series of photographic and video installations drawing upon T. S Eliot’s poem 'The Waste Land' (1922) allowed for the exploration and analysis of how literature functions as a device to represent autobiographical experience within my media arts practice.
