Stories Told And Untold: Confidentiality Laws And The Master Narrative Of Child Welfare, Matthew I. Fraidin
Stories Told And Untold: Confidentiality Laws And The Master Narrative Of Child Welfare, Matthew I. Fraidin
Georgetown Law Faculty Publications and Other Works
In most states, child welfare hearings and records are sealed or confidential. This means that by law, court hearings and records may not be observed. The same laws and court rules also preclude those who are authorized to enter and watch from discussing anything learned or observed in a closed courtroom or from a sealed court record with anyone not involved in the case. It is the restriction on speech—on telling stories about child welfare—with which this Article is concerned.
The master narrative of child welfare depicts foster care as a haven for child-victims savagely brutalized by “deviant,” “monstrous” parents. …
Pharmaceutical Patent Litigation Settlements: Implications For Competition And Innovation, John R. Thomas
Pharmaceutical Patent Litigation Settlements: Implications For Competition And Innovation, John R. Thomas
Georgetown Law Faculty Publications and Other Works
Although brand-name pharmaceutical companies routinely procure patents on their innovative medications, such rights are not self-enforcing. Brand-name firms that wish to enforce their patents against generic competitors must commence litigation in the federal courts. Such litigation ordinarily terminates in either a judgment of infringement, which typically blocks generic competition until such time as the patent expires, or a judgment that the patent is invalid or not infringed, which typically opens the market to generic entry. As with other sorts of commercial litigation, however, the parties to pharmaceutical patent litigation may choose to settle their case. Certain of these settlements have …
“To Remand, Or Not To Remand”: Ventura’S Ordinary Remand Rule And The Evolving Jurisprudence Of Futility, Patrick J. Glen
“To Remand, Or Not To Remand”: Ventura’S Ordinary Remand Rule And The Evolving Jurisprudence Of Futility, Patrick J. Glen
Georgetown Law Faculty Publications and Other Works
It is a foundational principle of administrative law that a reviewing court should not dispose of a petition for review or appeal on grounds not relied upon by the agency, and should not reach issues in the first instance not addressed administratively. In such circumstances, there is a strong presumption that the reviewing court should remand the case to the agency for further proceedings rather than reach out to decide the disputed issues. The United States Supreme Court explicitly extended operation of the “ordinary remand rule” to the immigration context in its 2002 decision in INS v. Ventura. Notwithstanding subsequent …

Social-Ecological Resilience Of A Nuosu Community-Linked Watershed, Southwest Sichuan, China, Lauren S. Urgenson, R. Keala Hagmann, Amanda C. Henck Schmidt, Stevan Harrell, Thomas M. Hinckley, Sara Jo Shepler, Barbara L. Grub, Philip M. Chi
Faculty & Staff Scholarship
Farmers of the Nuosu Yi ethnic group in the Upper Baiwu watershed report reductions in the availability of local forest resources. A team of interdisciplinary scientists worked in partnership with this community to assess the type and extent of social-ecological change in the watershed and to identify key drivers of those changes. Here, we combine a framework for institutional analysis with resilience concepts to assess system dynamics and interactions among resource users, resources, and institutions over the past century. The current state of this system reflects a legacy of past responses to institutional disturbances initiated at the larger, national system …
Design And Development Of Structurally Feasible Antennas For Deployment On Inflatable Wings Of Small Unmanned Aerial Vehicles, Rohit Reddy Tammannagari
Design And Development Of Structurally Feasible Antennas For Deployment On Inflatable Wings Of Small Unmanned Aerial Vehicles, Rohit Reddy Tammannagari
University of Kentucky Master's Theses
This study is focused on designing conformal antennas to be deployed with the inflatable wings for unmanned aerial vehicles (UAV). The main emphasis is on utilizing the structure of the wing to develop antennas for various frequency bands, while maintaining the wing’s aerodynamic performance. An antenna modeler and optimizer software called 4NEC2 and a program called WIRECODE were used to design and determine the characteristics of the antennas. The effect of flexibility of the inflatable wing on the antenna characteristics during flight is also evaluated.
Close Enough For Government Work: The Committee Rulemaking Game, Paul Stancil
Close Enough For Government Work: The Committee Rulemaking Game, Paul Stancil
Faculty Scholarship
Procedural rules in U.S. courts often have predictable and systemic substantive consequences. Yet the vast majority of procedural rules are drafted, debated, and ultimately enacted by a committee rulemaking process substantially removed from significant legislative or executive supervision. This Article explores the dynamics of the committee rulemaking process through a game-theoretical lens. The model reveals that inferior players in the committee rulemaking game - advisory committees, the Standing Committee on Rules of Practice and Procedure, the Judicial Conference and the Supreme Court - are sometimes able to arbitrage Congressional transaction costs to obtain results at odds with the results Congress …
Outcomes Of Giant Inguinoscrotal Hernia Repair With Local Lidocaine Anesthesia, Osarumwense Osifo, Taiwu I. Amusan
Outcomes Of Giant Inguinoscrotal Hernia Repair With Local Lidocaine Anesthesia, Osarumwense Osifo, Taiwu I. Amusan
Saudi Medical Journal
OBJECTIVE: To report outcomes of giant inguinoscrotal hernia repair using local lidocaine anesthesia in a resource-poor subregion. METHODS: Patients treated with giant inguinoscrotal hernia at 2 private healthcare facilities in Nigeria were studied between January 2004 and December 2008. RESULTS: A total of 134 patients aged between 13 and 70 (mean 32 ± 7.6) years, accounting for 51.3% adults treated for groin hernias, had open repair of 136 giant inguinoscrotal hernia using lidocaine. Average duration of symptoms (14.5 years) before presentation was influenced by lack of awareness in 82 (61.2%) and financial constraint in 34 (25.4%). The procedure was well …

Is Long-Term Hunger (Ramadan Model) A Risk Factor For Acute Appendicitis?, Barlas Sulu, Yusuf Gunerhan, Baris Ozturk, Hasan Arslan
Saudi Medical Journal
OBJECTIVE: To investigate whether long-term hunger and the changes in nutritional routines during Ramadan constitute risk factors in acute appendicitis on the model of Ramadan fasting in this study. METHODS: This retrospective study was carried out in 2 different hospitals (Istanbul Haydarpasa Numune Training and Research Hospital and Kars State Hospital, Kars, Turkey) between January 2004 and December 2007. The data obtained from the patients were classified according to age, gender, age group, and pathological characteristics of the appendix. The data obtained during the Ramadan fasting period was compared with the periods before and after. RESULTS: Nine hundred and ninety-two …

"It's Not Easy Being Green": Local Initiatives, Preemption Problems, And The Market Participant Exception, Michael Burger
"It's Not Easy Being Green": Local Initiatives, Preemption Problems, And The Market Participant Exception, Michael Burger
Sabin Center for Climate Change Law
This Article considers whether the market participant exception should be interpreted to exempt local climate change and sustainability initiatives from the "ceilings" imposed by existing environmental laws and pending federal climate change legislation. In the decades-long absence of federal action on climate change, local governments – along with the states – positioned themselves at the forefront of climate change and sustainability planning. In fact, state and local actions account for most of the nation's greenhouse gas reduction efforts to date. Yet, front-running localities are being limited by a preemption doctrine that fails to account for both the motives behind their …
