Thoughts On Preemption In The Wake Of The Levine Decision, Erika Lietzan, Sarah E. Pitlyk

This article discusses the prospects for preemption doctrine in the wake of the Supreme Court’s decision in Wyeth v. Levine. Part I describes the Levine decision. Part II examines the majority’s holding as it relates to impossibility preemption and considers the future of the doctrine in failure-to-warn suits after Levine. We argue that the announced standard for impossibility preemption — the clear evidence standard — should be interpreted reasonably and not in a manner that effectively eviscerates the doctrine. We also describe other instances of impossibility in the food and drug regulatory context that were not presented to the Court. …

Building models to describe the dynamics of macroscopic currents through ion channels has been the object of numerous studies in the literature with the aim of understanding ion-channel function. Following a perturbation, typically a step in voltage or ligand concentration, the response is formed by a combination of different processes such as activation or inactivation that pull the measured quantity (macroscopic current) in the same or opposite directions with different strengths and different time constants. Abstract

Phosphoinositides like phosphatidylinositol 4,5-bisphosphate (PIP2) are negatively charged lipids that play a pivotal role in membrane trafficking, signal transduction, and protein anchoring. We have designed a force field for the PIP2 headgroup using quantum mechanical methods and characterized its properties inside a lipid bilayer using molecular dynamics simulations. Macroscopic properties such as area/headgroup, density profiles, and lipid order parameters calculated from these simulations agree well with the experimental values. However, microscopically, the PIP2 introduces a local perturbation of the lipid bilayer. The average PIP2 headgroup orientation of 45° relative to the bilayer …

SUMMARY

  • Coral reef ecosystems are global biodiversity hotspots that depend on the massive calcium carbonate structures mainly deposited by scleractinian (i.e., “hard”) corals. Scleractinian coral distribution is primarily limited by sea-surface temperature, light, depth, ocean pH, sea water salinity, nutrients and sediment loads. These ecosystems are currently threatened by localized stresses such as overfishing and destructive fishing practices, pollution, terrestrial nutrient and sediment run-off, but are increasing impacted by direct and indirect impacts of rising CO2 concentrations and climate change.

A total of 19 pop-up satellite archival tags (PSATs) were deployed on sailfish in the southern Gulf of Mexico between 2005 and 2007 aboard a commercial pelagic longline vessel (n = 18) and a recreational rod-and-reel vessel (n = 1). All PSATs were programmed to collect pressure (depth), temperature, and light-level data for 10 days at approximately 90-second intervals. These point-level data were not summarized prior to transmission, allowing the reconstruction of vertical movement patterns. Three tags suggested mortality events and were excluded from subsequent analyses. We present the preliminary data analyses from the remaining 16 PSATs. Sailfish are primarily …

The Virginia Institute of Marine Science has conducted a fishery-independent longline survey during summer months since 1974. Data for sandbar sharks and dusky sharks captured in the survey between 1975 and 2009 are presented. Most of the sandbar sharks encountered by the survey were immature, with females composing almost all of the mature sandbar catch. Almost all dusky sharks captured were immature. Most of the catch since the early 1990’s has been composed of 0-4 year age classes. Nominal and standardized catch rates are presented. Seasonal And Salinity Effects On The Distribution Of Higher Filamentous Marine Fungi At Rookery Bay, Fl., Julia Ossler

More than 500 species of higher marine fungi in over 300 genera have been described. Many marine fungi are highly specialized for marine environments relative to their terrestrial counterparts, having appendaged ascospores and conidia to aid in buoyancy, entrapment, and adherence to substrates. They have been reported to inhabit a wide variety of substrates including decaying wood, leaves, calcareous and chitinous substrates, seaweeds, and seagrasses. Most early studies on marine fungi were carried out in temperate regions. Investigations have now shifted to tropical locations in order to better evaluate the abundance and diversity of marine fungi on a global basis. …

The chain length dependence of the interaction of PFOA, a persistent environmental contaminant, with dimyristoyl- (DMPC), dipalmitoyl- (DPPC) and distearoylphosphatidylcholine (DSPC) was investigated using steady-state fluorescence anisotropy spectroscopy, differential scanning calorimetry (DSC) and dynamic light scattering (DLS). PFOA caused a linear depression of the main phase transition temperature Tm while increasing the width of the phase transition of all three phosphatidylcholines. Although PFOA's effect on Tm and the transition width decreased in the order DMPC > DPPC > DSPC, its relative effect on the phase behavior was largely independent of the phosphatidylcholine. Northern quahogs, Mercenaria mercenaria (L.), frequently are infected with the parasite Quahog Parasite Unknown (QPX, Labyrintohomorpha, Thraustochytriales), which can cause morbidity and mortality of the quahogs. Possible interactions between this parasitic disease and exposure to the harmful dinoflagellate Prorocentrum minimum in M. mercenaria were studied experimentally. Quahogs from Massachusetts with variable intensity of QPX infection were exposed, under controlled laboratory conditions, to cultured P. minimum added to the natural plankton at a cell density equivalent to a natural bloom. Congress created the U.S. Court of Appeals for the Federal Circuit to alleviate the overcrowded dockets of the regional circuits and to send all patent appeals to one court. The court has achieved many of the goals for which it was created, but it may not be responding effectively to some fields' patent issues. Further, in the last decade the Supreme Court has reversed a very high percentage of the Federal Circuit's patent decisions. In their articles, Professors Cotropia and Wagner dispute some of the criticism that the Federal Circuit has attracted. Cotropia refutes the critics with empirical evidence of …

Hierarchical Linear Modeling Of Drinking To Cope With Anxiety Among College Students, Bradley Wetzell, Matthew R. Pearson, James Henson

Previous research has assumed that drinking motives (reasons for drinking) remain fairly stable over time (traits). The current study examines how drinking motives of college students may vary over time (states). Weekly measures were completed by 125 undergraduates at Old Dominion University, which examined how average levels of anxiety interacted with anxiety coping motives to influence drinking. Using Hierarchical Linear Modeling, it was found that anxiety coping motives were less predictive for participants with elevated average anxiety levels, as opposed to participants with normal to low anxiety levels. Implications and possible explanations are discussed.

Lakes of varying salinity are ubiquitous in dune environments with semiarid climates. Often these lakes become solute traps due to specific groundwater flow conditions. Over geological time after emergence of such lakes, the groundwater flow and mass transport processes lead to accumulation of solutes. This salinity increase can result in mineral deposition and free convection from lakes. However, high solute concentrations in these lakes are often not observed. We propose a conceptual model that estimates the lake salinity dynamics and yields concentration profiles beneath the lakes over centennial and millennial scales. The electron emission properties of a material subject to incident radiation flux are key parameters in determining to what equilibrium charge a spacecraft will established under given environmental conditions. However, there is a complex relation between these emission properties and the charge built up in spacecraft insulators. Complex modeling codes have been developed to predict the potential a spacecraft will adopt as a consequence of its interaction with the space plasma. These require correct models of the electron yields as a function of charge to accurately predict the both the charge build up and the equilibrium potential of spacecraft components. …

The ability to conditionally turn on a signal or induce a function in the presence of a user-defined RNA target has potential applications in medicine and synthetic biology. Although sequence-specific pumilio repeat proteins can target a limited set of ss- RNA sequences, there are no general methods for targeting ssRNA with designed proteins. As a first step toward RNA recognition, we utilized the RNA binding domain of argonaute, implicated in RNA interference, for specifically targeting generic 2-nucleotide, 3′ overhangs of any dsRNA. Large amounts of data from high throughput metabolomic experiments are commonly visualized using a principal component analysis (PCA) 2D scores plot. The question of the similarity or difference between multiple metabolic states then becomes a question of the degree of overlap between their respective data point clusters in PC scores space. A qualitative visual inspection of the clustering pattern in PCA score plots is a common protocol. This report describes the application of tree diagrams and bootstrapping techniques for an improved quantitative analysis of metabolic PCA data clustering.
