Milk Winter, Elizabeth Cundiff Mcconaghy May 2010

Milk Winter, Elizabeth Cundiff Mcconaghy

Theses

Milk Winter is a collection of non-fiction essays and fiction short stories representing defining moments in the life of the writer as she navigates early married life, social landscapes, fear and neurosis, devastation and attempts at grace. This collection explores the narrow space between tragedy and hilarity, concluding that to cross that space is to receive circumstances as they are given. Milk Winter shows early adult life in its searing, soaring moments and resolves, in the end, to accept them all.

Safety And Security In Urban Academic Libraries: A Risk Assessment Approach To Emergency Preparedness, Thomas Edgar Raffensperger May 2010

Safety And Security In Urban Academic Libraries: A Risk Assessment Approach To Emergency Preparedness, Thomas Edgar Raffensperger

Urban Library Journal

Academic libraries have developed a wide range of emergency preparedness policies, procedures, and training programs. Libraries have traditionally focused on the recovery of collections after an emergency. Risk assessment has focused on collections, largely as an outgrowth of valuation for insurance purposes and the core responsibility of libraries to safeguard collections. Risk assessment has rarely been systematically applied to personal safety and security. There is an anecdotal sense that urban academic libraries are subject to higher risk from property and violent crime than other academic libraries. This study examines the level of risk of property and violent crime using Clery …

The Inviolate Home: Housing Exceptionalism In The Fourth Amendment, Stephanie M. Stern May 2010

The Inviolate Home: Housing Exceptionalism In The Fourth Amendment, Stephanie M. Stern

All Faculty Scholarship

The ideal of the inviolate home dominates the Fourth Amendment. The case law accords stricter protection to residential search and seizure than to many other privacy incursions. The focus on protection of the physical home has decreased doctrinal efficiency and coherence and derailed Fourth Amendment residential privacy from the core principle of intimate association. This Article challenges Fourth Amendment housing exceptionalism. Specifically, I critique two hallmarks of housing exceptionalism: first, the extension of protection to residential spaces unlikely to shelter intimate association or implicate other key privacy interests; and second, the prohibition of searches that impinge on core living spaces …

A Layered Framework Approach To Mitigate Crimeware, Mathew Nyamagwa May 2010

A Layered Framework Approach To Mitigate Crimeware, Mathew Nyamagwa

Annual ADFSL Conference on Digital Forensics, Security and Law

Crimeware attacks are growing at such an alarming rate and are becoming so prevalent that the FBI now rank cybercrime among its top priorities after terrorism and espionage. New studies estimate cyber crimes cost firms an astounding $1 trillion annually. But the good news? Over 80% of them are preventable. Crimeware is not a purely technical threat but more or a socio-technical affair. This clearly brings out the fact that computers do not commit a crime, but we (humans) do! In this paper I propose a layered approach that involves all stakeholders from end-users to service-providers and law enforcement to …

Conscription And Crime: Evidence From The Argentine Draft Lottery, Sebastian Galiani, Martín A. Rossi, Ernesto Schargrodsky May 2010

Conscription And Crime: Evidence From The Argentine Draft Lottery, Sebastian Galiani, Martín A. Rossi, Ernesto Schargrodsky

Fondazione Eni Enrico Mattei Working Papers

We estimate the causal effect of mandatory participation in the military service on the involvement in criminal activities. We exploit the random assignment of young men to military service in Argentina through a draft lottery to identify this causal effect. Using a unique set of administrative data that includes draft eligibility, participation in the military service, and criminal records, we find that participation in the military service increases the likelihood of developing a criminal record in adulthood. The effects are not only significant for the cohorts that performed military service during war times, but also for those that provided service …

Predictors Of Completion In A Batterer Treatment Program: The Effects Of Referral Source Supervision, Sara J. Barber, Emily M. Wright May 2010

Predictors Of Completion In A Batterer Treatment Program: The Effects Of Referral Source Supervision, Sara J. Barber, Emily M. Wright

Criminology and Criminal Justice Faculty Publications

Domestic violence offenders who are court mandated to attend a batterer treatment program are more likely to complete treatment than offenders who voluntarily attend. However, few studies have examined the amount or severity of referral source supervision and its effect on treatment completion. This study uses data from three referral sources in South Carolina (i.e., pretrial intervention, criminal domestic violence court, and summary court) to determine whether higher levels of monitoring during a 26-week hybrid cognitive-behavioral batterer treatment program increase the likelihood of completion among batterers. Results indicate that increased supervision exercised over the clients by the referral source during …

The Nexus Between The Ballot And Bullet: Popular Support For The Pkk And Post-Election Violence In Turkey, Nadir Gergin May 2010

The Nexus Between The Ballot And Bullet: Popular Support For The Pkk And Post-Election Violence In Turkey, Nadir Gergin

Theses and Dissertations

This study examines the relationship between popular support for the Kurdish Worker’s Party (PKK), which is an ethnic insurgent and terrorist organization mainly operating in Turkey, and its terrorist activities during the pre-and post-election periods in Turkey . Popular support has been measured through popular votes for the political party affiliated with the PKK in 1999 general, 2004 local and 2007 general elections. Two leading theories of social movements, Resource Mobilization Theory (RMT) and Relative Deprivation Theory (RD), were used as theoretical approach. The study uses secondary data and constructs a longitudinal design. An advanced statistical analysis technique, a generalized …

Juvenile Justice, Sullivan, And Graham: How The Supreme Court’S Decision Will Change The Neuroscience Debate, Johanna Cooper Jennings May 2010

Juvenile Justice, Sullivan, And Graham: How The Supreme Court’S Decision Will Change The Neuroscience Debate, Johanna Cooper Jennings

Duke Law & Technology Review

Over the past twenty years, neuroscientists have discovered that brain maturation continues through an individual’s mid-twenties. The United States Supreme Court cited this research to support its abolition of the juvenile death penalty in Roper v. Simmons. Now the Court is faced with two cases that challenge the constitutionality of sentencing juveniles to life imprisonment without parole. Many believe these studies indicate that juveniles are both less culpable for their actions and more likely to reform; therefore, life in prison for juveniles is disproportionate, cruel, and unusual. However, others caution against the use of these studies in deciding issues of …

Cityland – Vol. 7, No. 4, Center For New York City Law

CityLand - 2010

The May 2010 issue of CityLand covers major land use and zoning developments across New York City. Highlights include the City Council’s approval of the Rose Plaza on the River project in Williamsburg, which increased affordable housing to 30% of units. The City Planning Commission reviewed the proposed redevelopment of the Domino Sugar site, raising concerns about infrastructure and affordability. A zoning text amendment was introduced to regulate car-share vehicle parking citywide. The Council approved Knickerbocker Commons, a Bushwick apartment building designed to meet Passive House energy standards. Staten Island’s Grymes Hill and Sunnyside neighborhoods were rezoned to preserve low-density …
