Nigeria’S Human Rights Violation Investigation Commission (Hrvic) And Restorative Justice: The Promises, Tensions And Inspirations For Transitional Societies, Raymond Olúsèsan Àìná
Nigeria’S Human Rights Violation Investigation Commission (Hrvic) And Restorative Justice: The Promises, Tensions And Inspirations For Transitional Societies, Raymond Olúsèsan Àìná
African Journal of Criminology and Justice Studies
The lack of peace in most post-colonial African nation-states is tied to unresolved political asymmetry among peoples with contending narratives of origins and power relations. The Justice system bequeathed to these states at their ‘flag’ independence has been unsuitable for evolving a justicecontinuum that can ameliorate the asymmetry and consequent conflicts. However, Restorative Justice appears to hold promises and inspirations for affected nation-states. Nevertheless, this article contends that a perceived hyper-romanticisation of Restorative Justice’s promises must be tempered with critical realism about its ambiguities. Nigeria’s Restorative Justice experiment, “Human Rights Violation Investigation Commission”, serves as point of reference.
Modeling The Differential Incidence Of "Child Abuse, Neglect And Exploitation" In Poor Households In South Africa: Focus On Child Trafficking, Paulin Mbecke
African Journal of Criminology and Justice Studies
This paper is based on an in-progress Ph.D. research 2 themed: “Modeling the Differential Incidence of Child Abuse, Neglect and Exploitation in Poor Households in South Africa”. The aim of the research is to build a theoretical grounding and to propose a practical model for understanding child abuse. The research argues that the gaps and shortcomings in understanding child abuse are, to a large extent, the consequence of an over-estimation of socio-economic variables as main variables contributing to the incidence of child abuse. The paper does not attempt to collect data on child trafficking to explain its extent in South …
The Progress Of Democratic Policing In Post-Apartheid South Africa, William R. Pruitt
The Progress Of Democratic Policing In Post-Apartheid South Africa, William R. Pruitt
African Journal of Criminology and Justice Studies
Since the end of apartheid in South Africa the country has been forced to democratize. A major part of that democratization is the new police organization that was implemented post-apartheid. This article looks at the policy changes in the police department and the effects these policies have had on making the South African police a democratic police force. Using data from the Afrobarometer, the public’s opinion of the new police over a three year span is analyzed to see if the police have succeeded in their new role in South Africa. Major changes were required to assist the South African …
A Three-Pronged Approach: How The United States Can Use Wto Disclosure Requirements To Curb Intellectual Property Infringement In China, Mark Liang
Chicago Journal of International Law
Counterfeiting and the piracy of consumer goods in China are serious and globally recognized problems. Despite concerns expressed by the US and past efforts, China has been unable to enforce IP rights effectively for decades. As a result, American businesses seeking to sell IP-protected goods in China suffer tens of billions of dollars in losses every year. This Comment aims to determine and assess what measures the US may take to reduce IP infringement in China in the short term. China's weak IP enforcement record is a result of both long-term and short-term causes. Short-term causes (that is, causes that …

Preventing Violence In Low-Income Communities: Facilitating Residents' Ability To Intervene In Neighborhood Problems, Mary L. Ohmer, Barbara D. Warner, Elizabeth Beck
The Journal of Sociology & Social Welfare
The violence found in low-income communities, including areas of concentrated poverty, is often extensive and can involve illegal drugs, juvenile delinquency, and even homicide. A large body of research has emerged which points to the positive effects of informal social control and social capital in preventing violence in lowincome communities, including neighbors taking leadership roles by intervening themselves. This article contains a description of an exploratory study ofa pilot training program the authors developed to facilitate residents' ability to intervene in neighborhood problems in a low-income community in Atlanta, Georgia. The training incorporated concepts from restorative justice, peacemaking criminology, and …

Court-Involved African American Males And Social Capital Within Chicago Public Schools, Troy Harden
Court-Involved African American Males And Social Capital Within Chicago Public Schools, Troy Harden
College of Education Theses and Dissertations
This qualitative study explores how eleven court-involved African American males in Chicago Public Schools gain entry and access into mainstream society via schooling, exploring their choices, interactions and networks in the context of schooling, and how they develop trust or the lack thereof in the educational process. Five themes emerged from interviews of the eleven young men, including school engagement, neighborhood bonds, school exclusion, purgatory and social capital reconceptualized. The young men in this study reported their trajectories associated with schooling, including how they were often “pushed out”, in part by their own behavior and attitude towards schools, and school …

Aba Criminal Justice Standards On The Treatment Of Prisoners, Margo Schlanger, Margaret C. Love, Carl Reynolds
Articles
or more than i O years, corrections professionals and others concerned about the treatment of prisoners have despaired over conditions in California's prisons. Crowding, violence, racial segregation, abysmal medical care, an obstructionist corrections union. and a state budget crisis have combined to bring the system to the point of constitutional meltdov,n. In 2008. a state appellate court found conditions of "'extreme peril to the safety of persons and property,'' and a three-judge federal court confirmed the existence of a "substantial risk to the health and safety of the men and women who work inside these prisons and the inmates housed …

Women's Rights=Human Rights: Pakistani Women Against Gender Violence, Filomena M. Critelli
The Journal of Sociology & Social Welfare
Gender-based violence constitutes a major public health risk and is a serious violation of basic human rights throughout the world. Counter to many Western images of Muslim women as passive victims, women's groups in Pakistan have begun to organize to respond to these conditions. This study is based upon in-depth interviews conducted with the founders and senior staff of Dastak (Knock on the Door), a shelter for women in Lahore, Pakistan that uses a human rights framework to provide services and advocate for public support for women's rights to safety and security. The study explores how Pakistani women are taking …

Resurrecting Autonomy: The Criminal Defendant's Right To Control The Case, Erica J. Hashimoto
Resurrecting Autonomy: The Criminal Defendant's Right To Control The Case, Erica J. Hashimoto
Scholarly Works
In Faretta v. California, the Supreme Court exalted the value of autonomy – the criminal defendant’s interest in presenting and controlling the defense. Over the course of the past thirty-five years, however, the Court’s enthusiasm has dissipated, and commentators have criticized courts that have given defendants any measure of control over their cases. As a result, lower courts increasingly have shifted control from defendants to their lawyers. In light of that retrenchment, this Article reevaluates the autonomy interest on its merits. This reexamination confirms that Faretta got it right, and the Supreme Court should revitalize the constitutional interest of criminal …
Predicting Community College Tuition And Enrollments And Simulating The Initial Effects Of President Obama's American Graduation Initiative, Allison Frederick
Predicting Community College Tuition And Enrollments And Simulating The Initial Effects Of President Obama's American Graduation Initiative, Allison Frederick
Undergraduate Economic Review
This paper will identify the effects of supply and demand side factors on community college enrollment quantities and tuition prices and predict the initial effects of President Obama’s American Graduation Initiative. This bill proposes $12 billion of government spending, through grants and financial aid, in order to increase the number of community college graduates by 5 million over the next ten years. Limitations regarding the endogeneity of government appropriations prevents the forecasting of government funding increases; however, the model predicts that financial aid increases from the American Graduation Initiative will increase community college enrollments by over half a million.

Newborn Infants Learn During Sleep, William P. Fifer, Dana L. Byrd, Michelle Kaku, Inge-Marie Eigsti, Joseph R. Isler, Jillian Grose-Fifer, Amanda R. Tarullo, Peter D. Balsam
Publications and Research
Newborn infants must rapidly adjust their physiology and behavior to the specific demands of the novel postnatal environment. This adaptation depends, at least in part, on the infant’s ability to learn from experiences. We report here that infants exhibit learning even while asleep. Bioelectrical activity from face and scalp electrodes was recorded from neonates during an eye movement conditioning procedure in which a tone was followed by a puff of air to the eye. Sleeping newborns rapidly learned the predictive relationship between the tone and the puff. Additionally, in the latter part of training, these infants exhibited a frontally maximum …

Professional And Conviction Integrity Programs: Why We Need Them, Why They Will Work, And Models For Creating Them, Barry Scheck
Professional And Conviction Integrity Programs: Why We Need Them, Why They Will Work, And Models For Creating Them, Barry Scheck
Cardozo Law Review
The best way to effectively prevent Brady violations and other forms of prosecutorial misconduct that cause wrongful convictions is internal regulation of the District Attorney's office. Civil liability, state or bar disciplinary action, the stigma of appellate reversal, and the threat of criminal prosecution have failed to provide effective deterrence against Brady violations as well as other forms of misconduct. However, the lack of alternatives is not the reason why internal regulation is the most promising way to prevent Brady violations, but rather because prosecutors themselves are in the best position to implement procedures that achieve this goal.

Bridging The Gap: Linking Co-Curricular Activities To Student Learning Outcomes In Community College Students, Katie Lauren Storey
Bridging The Gap: Linking Co-Curricular Activities To Student Learning Outcomes In Community College Students, Katie Lauren Storey
Dissertations
This study investigated the extent to which participation in co-curricular events enhances the achievement of student-learning outcomes in community college students. One community college in Illinois—Chicago Metropolitan Area Community College (CMACC), a pseudonym—was selected to research based on its robust co-curricular activity programming. A concurrent nested mixed methodology (Plano Clark & Creswell, 2007) was used, nesting quantitative data within qualitative data.
To generate quantitative data, a student survey was distributed to 128 students involved with co-curricular activities at CMACC. Participating students were asked to identify their involvement with co-curricular programming and how this participation correlated with the institution’s general education …

Interactive Kinds, Muhammad Ali Khalidi
Interactive Kinds, Muhammad Ali Khalidi
Publications and Research
This paper examines the phenomenon of 'interactive kinds' first identified by Ian Hacking. An interactive kind is one that is created or significantly modified once a concept of it has been formulated and acted upon in certain ways. Interactive kinds may also 'loop back' to influence our concepts and classifications. According to Hacking, interactive kinds are found exclusively in the human domain. After providing a general account of interactive kinds and outlining their philosophical significance, I argue that they are not confined to the human realm, but that they can also occur elsewhere. Hence, I conclude by arguing that interactive …
An Analysis Of The Influence Of Sampling Methods On Estimation Of Drug Use Prevalence And Patterns Among Arrestees In The United States: Implications For Research And Policy, Janine Kremling
USF Tampa Graduate Theses and Dissertations
Using data from the Drug Use Forecasting (DUF) and the Arrestee Drug Abuse Monitoring (ADAM) programs collected by the National Institute of Justice the question whether the drug estimates of DUF, using a non-probability sample, and the drug use estimates of ADAM, using a probability sample, yield substantially different results will be explored. The following main questions will be addressed using equivalence analysis: Are there substantial differences in the DUF and ADAM samples with regard to the drug use information obtained from arrestees at nine sites across the United States? The analysis suggests that the drug use information contained in …
