Promises To Keep: Diplomatic Assurances Against Torture In Us Terrorism Transfers, Human Rights Institute Dec 2010

Promises To Keep: Diplomatic Assurances Against Torture In Us Terrorism Transfers, Human Rights Institute

Human Rights Institute

“Diplomatic assurances” are promises not to torture. They are sought when transferring a detainee from the custody of one government to another. Not surprisingly, they are sought from governments that typically torture.

This report surveys the law and practice of assurances in the US and, comparatively, in Canada and Europe. It is the culmination of a long-term engagement by Columbia’s Human Rights Clinic and its faculty to research and support advocacy on diplomatic assurances. That process has involved advocacy with Swedish NGOs, support for research by Human Rights Watch, FOIA requests with the ACLU and collaborative efforts with UN mechanisms. …

Out Of The Frying Pan, Into The Fire: Trauma In The Lives Of Homeless Youth Prior To And During Homelessness, John Coates, Sue Mckenzie-Mohr

The Journal of Sociology & Social Welfare

Anecdotal evidence from those who work with homeless youth indicates that trauma permeates these young people's lives. This paper presents the findings from a study of 100 homeless youth regarding the presence of trauma in their lives, both before and during homelessness. Participants living in the Maritime Provinces volunteered to take part in a semi-structured interview lasting one to two hours. The interview questionnaire was conducted by a trained interviewer, and was composed of standardized and adapted survey instruments, as well as questions regarding demographics, experiences prior to becoming homeless, assistance received while dealing with stressors, and current needs. The …

Native American Students: Perceptions Of Lived Experiences Attending A Small Predominantly White University In The Upper Midwest, Dennis Richard Simons

Theses and Dissertations

The purpose of this qualitative study was to better understand the lived experiences of Native American students when studying on a predominantly white campus at a small university in the Upper Midwest. Using a phenomenological approach, the researcher interviewed each of the eight participants for one hour, although there were two interviews that took longer. Two participants agreed to meet for a second interview and, again, the time taken was approximately one hour. The resulting audio-recorded interviews were then transcribed, coded, and analyzed.

Three themes emerged from the analysis of the data. Theme One: Participants depended on the support of …

Commercial Sex Workers: Lives And Practices, Sarah J. Knowles Dec 2010

Commercial Sex Workers: Lives And Practices, Sarah J. Knowles

UNLV Theses, Dissertations, Professional Papers, and Capstones

Commercial sex workers epitomize a population who is both stigmatized and underrepresented in marriage and family therapy research. Through this research I hope to gain understanding about the gains of being a commercial sex worker, which many people may overlook due to their moral opposition to the occupation. I will also be exploring some of the challenges that commercial sex workers face that are unique to their line of work, especially in regards to their relationships, as many aspects of this may have been generalized or disregarded. Finally, I plan to address any implications for therapists who work with commercial …

Evaluating And Improving The Quality Of Teacher’S Language Modeling In Early Childhood Classrooms, Lillian White Englund Dec 2010

Evaluating And Improving The Quality Of Teacher’S Language Modeling In Early Childhood Classrooms, Lillian White Englund

UNLV Theses, Dissertations, Professional Papers, and Capstones

The relationship between pre-school teachers and the children in their classrooms directly influences the degree of success the children experience in school and in life. The emphasis on quality pre-K education in the U.S. has resulted in an increased need for highly qualified teachers who are capable of engaging in meaningful interactions with young children. An important component of high-level teacher-child interactions is the teacher's ability to model language for children as they acquire vocabulary and language context.

This mixed-methods study was designed to examine the effectiveness of a professional development intervention designed to improve the quality of language modeling …

Employment Of People With Criminal Records: An Exploratory Study Of The State Of Georgia, Michael Dutcher Dec 2010

Employment Of People With Criminal Records: An Exploratory Study Of The State Of Georgia, Michael Dutcher

Dissertations, Theses and Capstone Projects (Full IR Collection)

Individuals in Georgia with criminal records have many barriers and collateral consequences which impact their ability to find employment upon release from prison. Collateral consequences are those repercussions which impact the ex-offender’s civil liberties after they are released from prison. Research has shown that ex-offenders who do not find gainful employment upon release from prison are more likely to return to prison than those who find gainful employment after they are released.

The purpose of this exploratory study is to examine the current state and federal programs along with nonprofit organizations and discuss how they affect Georgians with criminal records. …

The Arrest Of Henry Louis Gates, Jr., Donald E. Wilkes Jr. Dec 2010

The Arrest Of Henry Louis Gates, Jr., Donald E. Wilkes Jr.

Popular Media

Police forces tend to be among the most secretive and least accountable of all organizations. When pressed for accountability or sued for malfeasance, obfuscation and evasiveness are the typical response. The phenomenon is hardly limited to certain countries or societies–the unassailability of police organizations seems to be universal.–Michael H. Fox The serve-and-protect model of police motivation that was drummed into police corps across the country in the aftermath of the response to anti-war demonstrations in the sixties and seventies has been heavily encroached on by the control-and-suppress model.–J. Ackerman The best motto for a police officer is that sticks and …

Waiver, Certification, And Transfer Of Juveniles To Adult Court: Limiting Juveniles Transfers In Texas., Emily Ray Dec 2010

Waiver, Certification, And Transfer Of Juveniles To Adult Court: Limiting Juveniles Transfers In Texas., Emily Ray

The Scholar: St. Mary's Law Review on Race and Social Justice

The adult criminal justice system is worse for juveniles who commit crimes. Underlying principles upon which the juvenile justice system was founded remain viable and worthy goals, and Texas law should reflect that understanding. Part II traces the development of juvenile justice in this country, including the evolution of the first American juvenile courts, and summarizes the due process rights afforded to juveniles by the U.S. Supreme Court. In Part III, I argue juvenile transfers to adult court should be limited in Texas with a special emphasis on young peoples' development, decision-making and reasoning abilities, and insights scientific research provides …

What Is The Impact Of Liquor Licensing Laws On Portland’S Entertainment Venues? A Case Study, Will Etheridge

Muskie School Capstones and Dissertations

In January 2009, Port City Music Hall in Portland, Maine was preparing to open its doors to the public for the first time. With a capacity for nearly six hundred attendees, Port City Music Hall was designed to attract national touring acts to Portland too big for the bar scene, but not suited for the Merrill Auditorium or Cumberland Civic Center. With the State Theatre still shuttered at the time, this new venue hoped to fill an important niche in the city’s creative economy, bringing a diverse array of performers that would not otherwise be able to find a viable …

Administrators' And Teachers' Perceptions Of In-School Suspension, Amelia Shondra Jackson Dec 2010

Administrators' And Teachers' Perceptions Of In-School Suspension, Amelia Shondra Jackson

Dissertations

Providing a safe and orderly school environment for students to learn is of paramount importance to school administrators, teachers, students, and the general public; however, the learning process should not be compromised while trying to maintain such an environment. There are many alternative approaches that can be utilized that would rectify the problem we as educators face in providing a safe and orderly environment. At-risk students are usually the ones who have the most serious infractions. These students exhibit a cyclical pattern of recalcitrant behavior. It is imperative that these at-risk students be identified as early as possible, and intervention …

Religiosity And Fear Of Crime, Jonathan Bolen Dec 2010

Religiosity And Fear Of Crime, Jonathan Bolen

Boise State University Theses and Dissertations

Previous research investigating fear of crime has returned little universal agreement as to what exacerbates and what reduces an individual’s level of fear of crime. In this thesis the researcher seeks to add to the mountain of literature on fear of crime and to include a novel independent variable, religiosity, in effort to better inform the fear of crime debate. Analyzing survey data collected from students at an urban university, the researcher finds that (1) females are far more fearful than their male counterparts; (2) religiosity is not informative on varying levels of fear of crime in the sample. An …

Selling Knowledge: A Sociological Analysis Of Attorney Advertisement In Las Vegas, Giselle Velasquez Dec 2010

Selling Knowledge: A Sociological Analysis Of Attorney Advertisement In Las Vegas, Giselle Velasquez

UNLV Theses, Dissertations, Professional Papers, and Capstones

I analyze how Las Vegas attorneys represent themselves, their associates and clients in televised law firm commercials. I use attorney commercials as a case to explore cultural beliefs in media representations. Using an inductive method, I analyze the textual, visual, and aural symbols that appear most frequently in television commercials to interpret how law firm advertisements convey themes of attorney expertise, knowledge, ethnic and gender stereotyping. I introduce this study with a historical evaluation of the rise of advertisement in the United States. I continue discussing how the media is an important realm of discourse that affects people's identity. Using …

Duke Law Journal

This Article is a reflection on personal experience as well as an account of what has happened to the Federal Rules of Civil Procedure in the most recent quarter century It observes that the Supreme Court of the United States has assigned to itself a role in making procedural law inconsistent with the Rules Enabling Act of 1934 or any more-recent utterance of Congress This procedural law made by the Court is responsive to the desire of business interests to weaken the ability of citizens to enforce laws enacted to protect them from business misconduct The Article concludes with the …

Grand Jury Innovation: Toward A Functional Makeover Of The Ancient Bulwark Of Liberty, Roger Fairfax Dec 2010

Grand Jury Innovation: Toward A Functional Makeover Of The Ancient Bulwark Of Liberty, Roger Fairfax

Scholarly Articles in Law Reviews & Journals

The grand jury is a "much maligned" organ of the criminal justice system.' Regularly employed in only about half of the states and grudgingly tolerated in the federal system,2 the American grand jury for two centuries has been criticized as costly, ineffective, overly-compliant, and redundant. Prescriptions have ranged from reforms designed to improve the grand jury's performance of its traditional filtering and charging functions to the outright abolition of the grand jury. Consequently, much of the scholarly defense of the grand jury seemingly has done little more than attempt to justify its very existence.

This Article seeks to take the …

Is Punishment Relevant After All? A Prescription For Informing Juries Of The Consequences Of Conviction, Jeffrey Bellin Dec 2010

Is Punishment Relevant After All? A Prescription For Informing Juries Of The Consequences Of Conviction, Jeffrey Bellin

Vanderbilt Law School Faculty Publications

The American jury, once heralded as "the great corrective of law in its actual administration," has suffered numerous setbacks in the modern era. As a result, jurors have largely become bystanders in a criminal justice system that relies on increasingly severe punishments to incarcerate tens of thousands of offenders each year. The overwhelming majority of cases are resolved short of trial and, even when trials occur, jurors are instructed to find only the facts necessary for legal guilt. Apart from this narrow task, jurors need not, in the eyes of the law, concern themselves with whether a conviction and subsequent …

Mandatory Reporting In The Context Of Home Visitation Programs, Danielle Marie Davidov Dec 2010

Mandatory Reporting In The Context Of Home Visitation Programs, Danielle Marie Davidov

Graduate Theses, Dissertations, and Problem Reports (ETD)

Each year in the United States, 4.8 million physical assaults and rapes are committed against 1.5 million women by an intimate partner. An estimated 3.3 to 10 million children are exposed to some form of intimate partner violence (IPV) in their own homes annually. Although mandatory reporting laws regarding child abuse and/or neglect are implemented in all 50 U.S. states, the extent to which these laws are appropriate for IPV between adults and children exposed to IPV is undetermined. A comprehensive examination of the perspectives of those required to report abuse is critical, as their roles as mandated reporters often …

Attitudinal Measures Of College Students' Punitiveness Toward Sex Offenders, Antonio Zamorano Dec 2010

Attitudinal Measures Of College Students' Punitiveness Toward Sex Offenders, Antonio Zamorano

Theses and Dissertations - UTB/UTPA

The following experiment investigates punitiveness toward sex offenders using a sample of one hundred sixty students from the University of Texas-Pan American student population recruited from undergraduate introductory psychology courses and compensated with extra course credit. Punitiveness toward sex offenders was measured with six-point bipolar Likert scales using two attitudinal research methodologies: a randomly assigned between group experiment using a manipulated hypothetical crime scenario, and a survey using a shortened version of the Community Attitudes Toward Sex Offenders Scale (CATSOS). A one-way analysis of variance (ANOVA) and multiple comparison tests of attitudinal responses to the hypothetical crime scenario determined that …
