A Tale Of Two Crises, William K. Black
A Tale Of Two Crises, William K. Black

The savings and loan debacle of the 1980s was the worst financial scandal in U.S. history. The estimated present value cost to the taxpayers was $150-175 billion ($1993). The debacle was a major contributor to a sharp recession in real estate values in the Southwest. However, it had only a negligible effect on the general economy.
The Japanese economy, the second largest in the world, also experienced a crisis in the 1980s. Twin “bubbles” in its stock and real estate markets hyper inflated for most of the decade of the 1980s. In general, the bigger the bubble, the worse the …

Hassan Saleh bin Attash, a Yemeni national, was just seventeen at the time of his September 2002 arrest in Pakistan. The young man spent four days in a Karachi prison before being taken to a United States-run prison in Kabul, where he was held and allegedly tortured through the middle of September. He was then rendered to Jordan.

Alaska Justice Forum ; Vol. 26, No. 4 (Winter 2010), Deborah Periman, André B. Rosay, Thomas S. Begich, Teresa W. Carns
Vols 21-30 (2004-2014)
The Winter 2010 issue of the Alaska Justice Forum leads off with an article on a recent Ninth Circuit decision holding that a Washington state law denying felons the right to vote is a violation of the Voting Rights Act. Other articles include profiles of correctional populations in Alaska and the U.S., an update on the work of the Criminal Justice Working Group, a pilot program aimed at reducing probation revocations rates, a study of juvenile probation officer workloads, and a discussion of the Language Interpreter Center, which works to provide qualified interpreters in legal, medical, social services, and educational …
Designing A Public Train Station Shelter To Minimise Anti-Social Behaviour And Crime In Melbourne’S Metropolitan Rail Environment, Jessica Diec, Selby Coxon, Arthur De Bono
Designing A Public Train Station Shelter To Minimise Anti-Social Behaviour And Crime In Melbourne’S Metropolitan Rail Environment, Jessica Diec, Selby Coxon, Arthur De Bono
World Transit Research
The Melbourne metropolitan train network has experienced incidents of anti-social behaviour and crime across the network over recent years. Identification of this problem has lead to design research aimed at exploring ways to minimise anti-social behaviour, improve passenger security and the perceptions of Melbourne’s railway system.
A literature review has revealed that good sightlines and visibility, minimised obstructions, sufficient lighting solutions, and controlled access are the principal factors that contribute to a safe and successful station environment. The key findings, used as guidelines, are intended to inform a design process in developing a potential design solution that is novel and …

The New Digital Dating Behavior - Sexting: Teens' Explicit Love Letters: Criminal Justice Or Civil Liability, Terri Day
UC Law SF Communications and Entertainment Journal
This paper proposes a unique response to the explosive combination of teens, sex and technology. It discusses why most teen sexting does not meet the Ferber definition of child pornography; therefore, a civil remedy for the dignitary and emotional harm caused by the public dissemination of private sexual pictures is far superior to imposing criminal sanctions. The proposed statutory civil cause of action would hold parents vicariously liable for the harms caused by their children's sexting when done with actual malice. Recognizing that common law tort liability is legally unsustainable, this approach strikes a balance between protecting First Amendment rights …

May a former criminal defendant bring a civil rights action against a prosecutor who fabricated evidence during an investigation and then introduced that evidence against the defendant at trial? The Seventh and Second Circuits have divided in answering this question. On November 4, 29, the Supreme Court heard oral argument in an Eighth Circuit case raising this question, Pottawattamie County v. Harrington, 547 F.3d 922 (8th Cir. 28), cert. granted, 129 S. Ct. 22 (April 2, 29), and many expected the Court to resolve the circuit split later this term. But on January 4, 21, the Court dismissed the case …

Aba Explains Prosecutor's Ethical Disclosure Duty, Peter A. Joy, Kevin C. Mcmunigal
Faculty Publications
The ABA Standing Committee on Ethics and Professional Responsibility recently issued an advisory ethics opinion explaining that the ethical duty of the prosecutor under Model Rule 3.8(d) to disclose exculpatory evidence and information to the defendant is separate from, and more expansive than, the disclosure obligations under the Constitution. This column reviews the opinion and its implications for discovery in criminal cases.
Scientific Fraud, Paul C. Giannelli
Scientific Fraud, Paul C. Giannelli
Faculty Publications
Although scientific fraud is rare, when it occurs, it needs to be identified and documented. This article discusses two of the most notorious cases in forensic science. Part I focuses on the misconduct of Fred Zain, a serologist with the West Virginia State Police crime laboratory and later with the County Medical Examiner’s laboratory in San Antonio, Texas. Part II examines the misconduct of Joyce Gilchrist, a forensic examiner with the Oklahoma City Police Department.
