Institutional Structures Of Opportunity In Refugee Resettlement: Gender, Race/Ethnicity, And Refugee Ngos, Stephanie J. Nawyn Mar 2010

Institutional Structures Of Opportunity In Refugee Resettlement: Gender, Race/Ethnicity, And Refugee Ngos, Stephanie J. Nawyn

The Journal of Sociology & Social Welfare

Previous research suggests that social welfare assistance can further subordinate already disadvantaged recipients. Refugee resettlement, essentially a social welfare program, offers a diferent perspective on how welfare assistance might exert social control. Using data gathered from 60 in-depth interviews with people working in resettlement and observations at refugee non-governmental organizations (NGOs), this paper argues that refugee NGOs provide a complex institutional opportunity structure that has the potential to reproduce the gender and racial/ethnic subordination embedded in refugee welfare policy while also providing opportunities for refugees to counteract subordinating gender and racial/ethnic relations through advocacy and cultural activities. These findings refine …

Balancing Lenity, Rationality, And Finality: A Case For Special Verdict Forms In Cases Involving Overlapping Federal Criminal Offenses, Meghan A. Ferguson Mar 2010

Balancing Lenity, Rationality, And Finality: A Case For Special Verdict Forms In Cases Involving Overlapping Federal Criminal Offenses, Meghan A. Ferguson

Duke Law Journal

The Framers placed a high premium on jury independence and viewed the jury's ability to dispense lenity as an important check on the legislative and executive branches. Many features of the criminal justice system are designed to interpose the jury between the accused and overzealous legislators and prosecutors. The general verdict and the absolute finality of acquittals, for example, empower the jury to acquit a defendant against the weight of the evidence. Although these features of the criminal justice system were conceived to protect defendants, they may be more harmful than helpful to defendants, given changes in the criminal justice …

The Costs And Benefits Of The Dark Triad: Implications For Mate Poaching And Mate Retention Tactics, Peter K. Jonason, Norman P. Li, David M. Buss Mar 2010

The Costs And Benefits Of The Dark Triad: Implications For Mate Poaching And Mate Retention Tactics, Peter K. Jonason, Norman P. Li, David M. Buss

Research Collection School of Social Sciences

The Dark Triad – narcissism, Machiavellianism, and psychopathy – have traditionally been considered to be undesirable traits. However, emerging work suggest that not only may there be a positive side to possessing these traits but they may also serve important adaptive functions, even if the strategies associated with them are viewed as socially undesirable. In an online survey (N = 336), we investigated the costs and benefits of the Dark Triad within the domain of mating psychology. The social style and lower order personality traits of the Dark Triad traits facilitated increased mateships in the form of poaching mates from …

A Sense Of Duty: The Illusory Criminal Jurisdiction Of The U.S./Iraq Status Of Forces Agreement, Chris Jenks Mar 2010

A Sense Of Duty: The Illusory Criminal Jurisdiction Of The U.S./Iraq Status Of Forces Agreement, Chris Jenks

San Diego International Law Journal

This Article will examine the Iraq SOFA’s use of duty status as a basis for determining which State has primary jurisdiction over U.S. service members for alleged criminal misconduct in Iraq. In the third section, the Article will briefly explain what a SOFA is, and how and why they are used, focusing on the North Atlantic Treaty Organization (NATO) SOFA. This section will also utilize examples of U.S. service member misconduct, both associated with and detached from official duty, to illustrate the application of an acts-based SOFA jurisdiction article. The fourth section turns to the Iraq SOFA’s status-based jurisdiction article, …

Plea Bargaining As A Legal Transplant: A Good Idea For Troubled Criminal Justice Systems, Cynthia Alkon Mar 2010

Plea Bargaining As A Legal Transplant: A Good Idea For Troubled Criminal Justice Systems, Cynthia Alkon

Faculty Scholarship

Countries struggling with overburdened criminal justice systems often decide to introduce U.S.-style plea bargaining as part of a larger process of criminal procedure reform. Plea bargaining, however, is not simply a technical change in process. Policymakers and rule of law assistance providers should consider the consequences of this new procedure beyond simple case processing. The introduction of plea bargaining requires legal professional to adapt to a new way of doing their jobs. It potentially changes how defendants and victims view the system. It also carries the potential to change how the general public views the legal system. This can be …

Digital Copyright Reform And Legal Transplants In Hong Kong, Peter K. Yu Mar 2010

Digital Copyright Reform And Legal Transplants In Hong Kong, Peter K. Yu

Faculty Scholarship

Since the mid-1990s, countries have struggled to respond to copyright challenges created by the internet and new communications technologies. Although the law and policy debate in recent years has focused primarily on the entertainment industry’s aggressive tactics toward individual end-users, online service providers, and other third parties, a recent wave of legislative actions and lobbying efforts has rejuvenated the debate on the proper legal response to the digital copyright challenges.

Like many other jurisdictions, Hong Kong, in the past few years, has been busy exploring copyright law reform to respond to challenges created by the internet and new communications technologies. …

"Can't Anyone Be A Teacher Anyway?": Student Perceptions Of Academic Librarians As Teachers, Mark Aaron Polger, Karen Okamoto Mar 2010

"Can't Anyone Be A Teacher Anyway?": Student Perceptions Of Academic Librarians As Teachers, Mark Aaron Polger, Karen Okamoto

Publications and Research

The study explores student perceptions of the academic librarian as teachers. A questionnaire was distributed to 500 students at two City University of New York colleges. Convenience and snowball sampling were employed to reach as many respondents as possible. Questionnaires were administered following a library instruction class and in the campus cafeteria. Contrary to results from previous studies, many respondents consider librarians to be teachers.

The occurrence of highly conserved amyloid-forming sequences in Candida albicans Als proteins (H. N. Otoo et al., Eukaryot. Cell 7:776–782, 2008) led us to search for similar sequences in other adhesins from C. albicans and Saccharomyces cerevisiae. The beta-aggregation predictor TANGO found highly beta-aggregation-prone sequences in almost all yeast adhesins. These sequences had an unusual amino acid composition: 77% of their residues were beta-aggregation aliphatic amino acids Ile, Thr, and Val, which is more than 4-fold greater than their prevalence in the S. cerevisiae proteome. High beta-aggregation potential peptides from S. cerevisiae Flo1p and C. albicans Eap1p rapidly formed insoluble …

Structure And Function Of Glycosylated Tandem Repeats From Candida Albicans Als Adhesins, Aaron T. Frank, Caleen B. Ramsook, Henry N. Otoo, Cho Tan, Gregory Soybelman, Jason M. Rauceo, Nand K. Gaur, Stephen A. Klotz, Peter N. Lipke Mar 2010

Publications and Research

Tandem repeat (TR) regions are common in yeast adhesins, but their structures are unknown, and their activities are poorly understood. TR regions in Candida albicans Als proteins are conserved glycosylated 36-residue sequences with cell-cell aggregation activity (J. M. Rauceo, R. De Armond, H. Otoo, P. C. Kahn, S. A. Klotz, N. K. Gaur, and P. N. Lipke, Eukaryot. Cell 5:1664–1673, 2006). Ab initio modeling with either Rosetta or LINUS generated consistent structures of three-stranded antiparallel beta-sheet domains, whereas randomly shuffled sequences with the same composition generated various structures with consistently higher energies. O- and N-glycosylation patterns showed that each TR …

Once Upon A Time In Law: Myth, Metaphor, And Authority, Linda H. Edwards Feb 2010

Once Upon A Time In Law: Myth, Metaphor, And Authority, Linda H. Edwards

Scholarly Works

We have long accepted the role of narrative in fact statements and jury arguments, but in the inner sanctum of analyzing legal authority? Surely not. Yet cases, statutes, rules, and doctrines all have stories of their own. When we talk about legal authority, using our best formal logic, we are actually swimming in a sea of narrative, oblivious to the water around us. As the old Buddhist saying goes, "We don’t know who discovered the ocean, but it probably wasn’t a fish."

This article teases out several familiar archetypes hidden in discussions of cases and statutes. In the midst of …
