The 'Show' In The 'Show Trial': Contextualizing The Politicization Of The Courtroom, Awol K. Allo Jan 2010

The 'Show' In The 'Show Trial': Contextualizing The Politicization Of The Courtroom, Awol K. Allo

Barry Law Review

Questioning the indifference of the law to its own normative correctness and its claim to legitimacy, this article explores the epistemological and ontological foundations upon which the concept and lexicon of show trial is predicated. By invoking the theory of performativity, the article distinguishes between the different models of show trials to allow for a more complex and nuanced reading of the particular nature of the show in judicial practices often called ‘show trials.’ By emphasizing the peculiarity of the ‘show’ in each ‘show trial’, the article seeks to reconceptualize the ambit of the criminal trial. Arguing against the emphasis …

Essays On Environmental Regulations And Performance Of Firms, Shrawantee Saha Jan 2010

Essays On Environmental Regulations And Performance Of Firms, Shrawantee Saha

Doctoral Dissertations

There has been a surge in the development of new, non-traditional and innovative approaches to address environmental problems in the last three decades of U.S. environmental policies. These new approaches affect polluting behavior via instruments other than taxes, permits or direct imperatives. They rely heavily on active engagement, collaboration and information sharing among firms and industry peers. This dissertation adds to our current understanding of these newer approaches by studying how external pressures and internal awareness affect a firm's polluting behavior. Two essays focus solely on the role of the print media, an external pressure to firms, under the U.S. …

Quality Of Life And Adolescents In Rural Kentucky, Hatim A. Omar, Søren Ventegodt, Joav Merrick

Pediatrics Faculty Publications

In many rural areas in Kentucky, adolescents lack the basic assets for a good quality of life, such as having caring adults, a safe place and useful activities after school. In this chapter we analyze data from middle and high school students referred to a comprehensive school based health promotion center (SBHPC). From August 2006 to February 2008, a total of 382 students (200 female, 182 male, aged 12-18 years) were referred to the SBHPC for help. Only two (0.5%) students had two parents living with them and 12 (3.1 %) had safe, organized after school activities. 19.9% of the …

Quality Of Life And Persons With Intellectual Disability: Can We Measure Qol In This Population?, Søren Ventegodt, Hatim A. Omar, Flemming Struve, Tove K. Nielsen, Isack Kandel, Joav Merrick

Pediatrics Faculty Publications

Quality of life (QOL) has been discussed by professionals working with persons with intellectual disability (ID) for some time, but since QOL is concerned with subjective well-being, satisfaction and happiness, how is it possible to measure, when the person in question is unable to communicate? Consciousness is believed to be an internal and personal thing, but we have done the simple experiment to ask observers to rate QOL of another person, also in sub dimensions like self-assessed physical and mental health, relationship with self, self-assessed sexual ability, self-assessed social ability, and we have found that people are able to assess …

Globalization And The Border: Trade, Labor, Migration, And Agricultural Production In Mexico, Chantal Thomas Jan 2010

Globalization And The Border: Trade, Labor, Migration, And Agricultural Production In Mexico, Chantal Thomas

Cornell Law Faculty Publications

The debate over immigration policy in the United States has reached a crescendo in recent years, with particular concern over illegal workers and their impact on social well-being in this country. Yet in the prevailing analysis of this issue, the relationship between immigration and contemporary international trade policy is often overlooked. In particular, few commentators recognize or understand that a significant part of the surge in illegal labor from Mexico--the source of the majority of undocumented workers in the United States—stems from reforms that Mexico undertook in cooperation with the United States to liberalize trade flows across the Mexico-United States …

First Principles For An Effective Federal Housing Policy, David J. Reiss Jan 2010

First Principles For An Effective Federal Housing Policy, David J. Reiss

Cornell Law Faculty Publications

Federal housing policy is heavily funded and made up of a morass of programs. This article provides a taxonomy of goals for housing policy. The article first asks what the aim of housing policy is. In other words, what can a well-designed and executed housing policy achieve? The answer to this question is not at all clear-cut. Some argue that the aim of housing policy is to allow all Americans to live in safe, well-maintained and affordable housing. Others argue for a more modest aim – achieving an income transfer to low- and moderate-income families that mandates that the income …

The Argument For Same-Sex Marriage, Nelson Tebbe, Deborah A. Widiss, Shannon Gilreath Jan 2010

The Argument For Same-Sex Marriage, Nelson Tebbe, Deborah A. Widiss, Shannon Gilreath

Cornell Law Faculty Publications

Professors Tebbe and Widiss revisit the arguments they made in "Equal Access and the Right to Marry" and emphasize their belief that distinguishing between different-sex marriage and same-sex marriage is inappropriate. They lament the sustained emphasis on the equal-protection and substantive-due-process challenges in the Perry litigation and suggest that an equal-access approach is more likely to be successful on appeal.

Professor Shannon Gilreath questions some of the fundamental premises for same-sex marriage. He challenges proponents to truly reflect on "what there is to commend marriage to Gay people," and points to his own reversal on the question as evidence. Though …

The New Family: Challenges To American Family Law, Cynthia Grant Bowman Jan 2010

The New Family: Challenges To American Family Law, Cynthia Grant Bowman

Cornell Law Faculty Publications

The vast demographic and social changes of the twentieth century have produced a variety of new family forms – cohabiting couples, same-sex couples, an increased number of single-parent families, and extended families resulting from divorce, for example. The legal system in the United States has yet adequately to address the legal problems that these new family forms create. This article discusses a number of major issues that arise from this failure, including: (1) the sometimes negative impact of gender-neutral rules in divorce upon women and children; (2) the ambiguity and inadequacy of property and support obligations between cohabitants; (3) the …

Experiences Of Gay Women Across Generations: Have Times Really Changed?, Kristen T. Nosti Jan 2010

Experiences Of Gay Women Across Generations: Have Times Really Changed?, Kristen T. Nosti

PCOM Psychology Dissertations

Society’s awareness of homosexuality has greatly increased over the past several decades. The current study sought to examine the experiences of lesbians in different age cohorts / generational groups utilizing an independent-measure research design. Survey data was used from 129 anonymous self identified adult lesbians who belonged in the Silent Generation, Baby Boomer, Generation X, or Millennial group. Significant generational differences (p < .05) were found regarding researched sexual minority milestones in relation to ages of self-identification, first same-sex sexual act, and self disclosure / coming out. Results showed that 50% of the women had tried to ignore or change their sexual orientation. Forty-one percent reported that they had felt discriminated against due to their sexual orientation and several women endorsed mental health and relational concerns related to their sexuality. As society’s position continues to evolve, it is important that research in this area reflects these changes.

Portraits Of Resistance: Lawyer Responses To Unjust Proceedings, Alexandra Lahav Jan 2010

Portraits Of Resistance: Lawyer Responses To Unjust Proceedings, Alexandra Lahav

Faculty Articles and Papers

This Article considers a question rarely addressed: what is the role of the lawyer in a manifestly unjust procedural regime? Many excellent studies have considered the role of the judge in unjust regimes, but the lawyer’s role has been largely ignored. This Article draws on two case studies: that of lawyers representing civil rights leaders during protests in Birmingham, Alabama in 1963 and that of lawyers representing detainees facing military commission proceedings in Guantánamo Bay, Cuba. These portraits illuminate the role of the lawyer in a procedurally unjust tribunal operating within a larger liberal legal regime such as our own. …

Obama And The American Civil Religion From The Political Left, David Fontana Jan 2010

Obama And The American Civil Religion From The Political Left, David Fontana

GW Law Faculty Publications & Other Works

Fred Gedicks has written an interesting paper on the future of civil religion in the United States. As Gedicks describes it, the American civil religion, as defined most notably by Robert Bellah several decades ago, argues that there is and should be a core series of basic principles at the heart of American nationalism, principles supportive of the American democratic order and derived from principles associated with the major religious traditions practiced by American citizens. Gedicks paints a dreary picture of the future of the American civil religion, arguing that civil religion is a theoretically undesirable concept and a practically …

Ideological Voting On The Supreme Court: An Analysis Of Judicial Activism On The Burger And Rehnquist Courts, 1969-2004, Tiahna Larsen Jan 2010

Ideological Voting On The Supreme Court: An Analysis Of Judicial Activism On The Burger And Rehnquist Courts, 1969-2004, Tiahna Larsen

Electronic Theses and Dissertations

The influence of ideology and attitudes on the decision-making process of Supreme Court justices has been well documented, such that the attitudinal model has emerged as the dominant paradigm for understanding judicial behavior. When ideology and personal preferences seem to eclipse legal factors, such as adherence to precedent and deference to the democratically-elected branches, outcries of 'judicial activism' have occurred. Previous studies (Lindquist and Cross 2009) have operationalized judicial activism and have provided measures for studying behavior that may be considered activist (as opposed to restrainist), further supporting the premise that ideology trumps other extra-attitudinal and legal factors in the …
