Missionaries, Moral Advocacy, And The Transformation Of Police Court Procedure In London, 1876-1930, Sascha Auerbach Jan 2010

Missionaries, Moral Advocacy, And The Transformation Of Police Court Procedure In London, 1876-1930, Sascha Auerbach

Studio for Law and Culture

This paper examines how informal courtroom negotiations transformed formal trial procedures, significantly expanded the social roles of local courts, and helped shape discourses of class, gender, race, and nationalism in British courtrooms. Specifically, it explores the origins, development, and impact of London’s first unofficial probation officers, the Police Court Missionaries. The introduction of these missionaries, who were paid agents of the Church of England Temperance Society (CETS), into the courts of the metropolis represented a watershed in the relationship between the state, private philanthropy, and working-class men and women. From the evolving dialogue between missionaries, working-class defendants, and magistrates emerged …

Knowledge Games, Truth Seeking, And Organ Transplants Regulation, Marie-Andrée Jacob Jan 2010

Knowledge Games, Truth Seeking, And Organ Transplants Regulation, Marie-Andrée Jacob

Studio for Law and Culture

In this paper, I examine how different relations to knowledge are enacted among experts working in the governance of kidney transplants. Using fieldwork material gathered in transplant hospital and bureaus, I analyse how legal knowledge transacts with expert and lay knowledge in the context of very pragmatic tasks: detect the "intention to donate" and the "altruistic motivations" of those who procure a kidney to someone in need. My focus is on the management and circulation of knowledge, rather than the object of knowledge - transplants. Here, the law assigns its regulatory power onto experts, and the committees of experts in …

“Wife Beating” And “Uninvited Kisses” In The Supreme Court And Society In The Early Twentieth Century, Elizabeth Katz Jan 2010

“Wife Beating” And “Uninvited Kisses” In The Supreme Court And Society In The Early Twentieth Century, Elizabeth Katz

Studio for Law and Culture

This paper challenges the conventional narrative that domestic violence victims were ignored by both law and society in the early 1900s. It begins by questioning the dominant position a single Supreme Court tort case, Thompson v. Thompson, holds in the domestic violence discourse. Far from being a strong or unified statement in favor of family privacy or against battered women’s legal rights, the case was decided by a four-Justice majority that pointed victims toward two very public alternative remedies: divorces with alimony and criminal prosecutions. The paper then proceeds to evaluate whether these proffered remedies were available and sufficient. …

Rca V. Whiteman: Contested Authorship, Copyright, And The Racial Politics Of The Fight For Property Rights In Musical Recordings In The 1930s, Kurt Newman

Studio for Law and Culture

Between the Progressive Era and World War II, African American jazz music became the source of big profits for some white entrepreneurs in the United States. The encounter between whites and jazz was both a propertization and a privatization of African American group resources. While new technologies of recording and radio broadcasting were critical factors facilitating these cultural enclosures, the sine qua non was the embeddedness of American intellectual property law in the logic of white supremacy. In this paper, I focus on the popular jazz bandleader Paul Whiteman, best known to most contemporary legal scholars as the defendant in …

In particular, this study focuses on data gathered through interviews, informal conversations, and participant observations to draw a narrative case study of a female, Bangladeshi, Muslim student attending a comprehensive elementary and middle school. The study explores tensions and growth among this Muslim student, her parent, and …

Legislatures, Judges, And Parole Boards: The Allocations Of Discretion Under Determinate Sentencing, Dhammika Dharmapala, Nuno Garoupa, Joanna Shepherd

Faculty Articles

The most significant development in criminal sentencing in recent decades has been the shift from indeterminate to determinate sentencing. Yet no study has systematically explored the factors leading to this shift. In this Article, we provide the first analysis to explain why state legislatures enact reforms that significantly reduce both judges’ and parole boards’ discretion over criminal sentencing. First, we develop a political economy model that explains why legislatures acting in their own self-interest may be motivated to enact these laws. Our model predicts that legislatures are more likely to enact determinate sentencing reforms when there is tension among the …

Body Polluted: Questions Of Scale, Gender, And Remedy, Dayna Nadine Scott Jan 2010

Body Polluted: Questions Of Scale, Gender, And Remedy, Dayna Nadine Scott

Articles & Book Chapters

This Article offers a critique of tort remedies grounded in feminist theory of the body. It demonstrates how tort law is invested in a notion of an individuated legal subject, which fails to capture the critical interconnectedness of bodies in a social, political, historical, and colonial context. Taking the "injury" of endocrine disruption in a Canadian Aboriginal community as an example of a contemporary pollution harm, the analysis considers various torts on a conceptual level, and what they might offer the Aamjiwnaang First Nation in the way of remedies. In each case, what the tort can do depends on how …

The Impact Of Web-Scale Discovery On The Use Of A Library Collection, Doug Way Jan 2010

The Impact Of Web-Scale Discovery On The Use Of A Library Collection, Doug Way

Scholarly Papers and Articles

Grand Valley State University Libraries implemented Serials Solutions' web-scale discovery tool, Summon, during the fall of 2009. This case study explores whether Summon had an impact on the use of the library's resources during its first semester of implementation. An examination of usage statistics showed a dramatic decrease in the use of traditional abstracting and indexing databases and an equally dramatic increase in the use of full-text resources from full-text database and online journal collections. The author concludes that the increase in full-text use is linked to the implementation of a web-scale discovery tool.

Problem

This study explores the relationship between leader practices, peer collaboration, acknowledgment towards the leader, employee development, work environment, and identification with the company’s objectives with employee satisfaction at the Good Hope Clinic, during 2009.

Methodology

An adaptation of Merck, Sharp, & Dohme’s questionnaire was used to measure organizational climate. The instrument measures six dimensions of organizational climate: leader practices, peer collaboration, acknowledgment towards the leader, employee development, work environment, and identification with the company’s objectives. Employee satisfaction was measured with a short scale. The population consisted of 467 employees from the Good Hope Clinic. The employees were gathered to …

The Civil Case At The Heart Of Criminal Procedure: In Re Winship, Stigma, And The Civil-Criminal Distinction, W. David Ball Jan 2010

The Civil Case At The Heart Of Criminal Procedure: In Re Winship, Stigma, And The Civil-Criminal Distinction, W. David Ball

Faculty Publications

In criminal cases, any fact which increases the maximum punishment must be found by a jury beyond a reasonable doubt. This rule, which comes from Apprendi v. New Jersey, looks to what facts do, not what they are called; in Justice Scalia’s memorable turn of phrase, it applies whether the legislature has labeled operant facts “elements, enhancements, or Mary Jane.” Civil statutes, however, can expose an individual to the same or greater deprivation of liberty on identical facts without needing to meet the beyond a reasonable doubt standard of proof. If Apprendi is, indeed, functional, why is it limited to …

Lifecode: An Examination Of The Shape, The Nature, And The Usage Of The Oikoscode, A Replicative Nonformal Learning Pattern Of Ethical Education For Leadership And Community Groups, Thom Wolf Jan 2010

Lifecode: An Examination Of The Shape, The Nature, And The Usage Of The Oikoscode, A Replicative Nonformal Learning Pattern Of Ethical Education For Leadership And Community Groups, Thom Wolf

Dissertations

Problem

The problem investigated in this study is how the oikoscode (Haustafeln), a pattern of ethical education replicated by earliest Christianity, can be developed into a theoretical model. The oikoscode is the lifestyle pattern, the lifecode of attitudinal framing and behavioral conduct that guided earliest Christianity, the generation of the first 25 years after the resurrection of Jesus.

Method

For this study in theory construction, Lynham‘s five-phased (conceptual development, operationalization, application, confirmation or disconfirmation, and continuous refinement and development) theory-building recursive system was used, delimited to only two of the five phases, conceptual development and operationalization. Data regarding the shape, …

Puppet Theater In The German-Speaking World, Connor Bartlett Doe Jan 2010

Puppet Theater In The German-Speaking World, Connor Bartlett Doe

Dissertations and Theses

This work begins with a brief history of puppet theater in Germany. A look at important social aspects, pertinent philosophical discussions and the significance of puppet theater in the German literary tradition follow. The final chapter looks at Peter Schumann, a German puppeteer and artist who lives in America. In Germanistik, German puppet theater deserves a devoted place in the field of legitimate study in terms of its history, content and influence.

Puppet theater's historical development in Germany represents the larger evolution of Germany. From ancient times up to the present day, this artistic form of representation has enjoyed …

Protests In The Sixties, Kellie C. Sorey, Dennis Gregory Jan 2010

Protests In The Sixties, Kellie C. Sorey, Dennis Gregory

Educational Leadership & Workforce Development Faculty Publications

The imminent philosopher George Santayana said, "Those who do not remember the past are condemned to repeat it" (1905). The protests that occurred on American campuses in the 1960s may lend support for that statement. This article will describe major events of the protest movement during this period, describe the societal and institutional contexts within which these protests occurred, and will hopefully encourage student affairs professionals to examine the emerging student activism of today to avoid the mistakes of the past. Many of today's senior administrators and faculty were college students during the protest era. These authors suggest that these …

The Impact Of Race, Gender, And Age On The Pretrial Decision, Tina L. Freiburger, Carly M. Hilinski Jan 2010

The Impact Of Race, Gender, And Age On The Pretrial Decision, Tina L. Freiburger, Carly M. Hilinski

Peer Reviewed Publications

There is an abundance of studies that examine judicial discretion in the final sentencing stages; however, few have examined discretion in the early stages of court decisions. Pretrial release is especially concerning as it has been strongly correlated with a final sentence of incarceration and deprives defendants of their freedom. This study examined whether race, gender, and age influence judges’ decisions to detain or release a defendant prior to trial. The results indicate that females and younger defendants were less likely to be detained. Race was not significant after economic variables were included. When examining males and females separately, race …

Cohabiting, Family And Community Stressors, Selection, And Juvenile Delinquency, Christopher A. Kierkus, Brian R. Johnson, John D. Hewitt Jan 2010

Cohabiting, Family And Community Stressors, Selection, And Juvenile Delinquency, Christopher A. Kierkus, Brian R. Johnson, John D. Hewitt

Peer Reviewed Publications

Prior research has established that children from traditional, two-parent nuclear families experience a lower risk of delinquency than children raised in alternative family structures. However, many studies have ignored the effect of parental cohabiting on delinquent development. A growing body of research suggests that cohabiting (even among biological parents) may be harmful to children. This study tests the hypothesis that cohabiting is associated with four different types of delinquent behavior. It examines two theoretical models, a family stress model and a community stress/selection model, as possible explanations of ‘‘the cohabiting effect.’’ The analysis reveals that cohabiting is generally associated with …

From Judge To Dean: Reflections On The Bench And The Academy, David F. Levi Jan 2010

From Judge To Dean: Reflections On The Bench And The Academy, David F. Levi

Faculty Scholarship

In July of 2007, having served nearly seventeen years as a United States District Judge with chambers in Sacramento, California, I moved to Durham, North Carolina, to become the fourteenth dean of the Duke University Law School. I would concede that in the grand scheme of things such a transition must be deemed unremarkable. Lawyers have become soldiers, presidents, artists, and inn keepers. Judges have left the bench to do much the same. Nonetheless, in the somewhat closed worlds of the federal bench and the legal academy, at a time when the two worlds have seemed to drift apart, such …
