'There Isn't Anything Like A Gal': The Guardian Ad Litem Service In Ireland, Ann Mcwilliams, Claire Hamilton

Irish Journal of Applied Social Studies

This article examines the role of the guardian ad litem service in Ireland within the context of public law proceedings. In the first part, the role of the guardian ad litem in Irish courts is outlined and this is followed by a discussion of the broader legal context informing the right of children to be heard in Irish courts. The article discusses some of the concerns about the lack of statutory regulation, standards and structure in the Irish guardian ad litem system. The tension inherent in expressing the wishes and views of children while making recommendations regarding their welfare and …

Unheard Voices: Adoption Narratives Of Same-Sex Male Couples, Malcolm Dort Jan 2010

Unheard Voices: Adoption Narratives Of Same-Sex Male Couples, Malcolm Dort

Canadian Journal of Family Law

This is the first legal study in Canada on same-sex adoption law, adoption administrative practice, and the social realities of parenting as experienced specifically by same-sex male couples. This paper identifies a gap in existing legal literature and jurisprudence with respect to the adoption narratives of same-sex male couples. Next, focusing on the province of Québec, it offers insight into how legal rules and social expectations construct families headed by such couples. It also highlights how, post-adoption, same-sex male couples conceive of their own families in a legal and social environment that continues to privilege heterosexual family models. Contradictorily, by …

One Judge For One Family: Differentiated Case Management For Families In Continuing Conflict, Nicholas Bala, Rachel Birnbaum, Donna Martinson Jan 2010

One Judge For One Family: Differentiated Case Management For Families In Continuing Conflict, Nicholas Bala, Rachel Birnbaum, Donna Martinson

Canadian Journal of Family Law

Understanding the differences between family cases and other types of litigation is essential for an appropriate response to family disputes. Judges have a role in family cases that markedly differs from the traditional judicial role. The authors argue that an effective and accessible family justice system requires pre-trial and post-trial case management by a single judge, an approach to family justice reflected in the slogan: "One judge for one family." Judges should have the necessary knowledge, skills, and training needed to resolve family disputes and to help effect changes in parental behaviours and attitudes, as well as the willingness to …

Navigating Potentially Conflicting Political Rationalities: Discursive Strategies About “Family” In Alberta’S Child Welfare Law, Joshua Friedstadt Jan 2010

Navigating Potentially Conflicting Political Rationalities: Discursive Strategies About “Family” In Alberta’S Child Welfare Law, Joshua Friedstadt

Canadian Journal of Family Law

This paper empirically investigates how lawmakers navigate family law's contested terrain. Using Alberta's newest child welfare law, the Child, Youth and Family Enhancement Act (2004) as a case, I explain the discursive strategies used to pass this unique law through a socio-political context dominated by political rationalities with partially divergent ideas of "family." Analysis reveals two dominant discursive strategies. The first creates a discursive framework that expels welfarist rationalities and centers tensional neoliberal and neoconservative logics. The second navigates the tensions between neoliberal and neoconservative images of family by constituting the content of families as autonomous and responsible while leaving …

Msculine Identity And The Education And Parental Involvement Of African American Teen Fathers, Milissa Mcclaire Gary

College of Education Theses and Dissertations

African American males are more likely to become teenage fathers than their white counterparts, and the risk is increased for those living in low-income communities. This qualitative work is a case study exploring the life experiences of one African American teen father from a working class urban area. The research investigates the ways in which conceptions of masculinity impact the identity formation and parental engagement of African American teen fathers. It also explores the ways in which they may seek to fulfill multiple, and often competing, social roles including father, student, and young Black man in society. The findings acknowledge …

Faculty Reward Systems And Academic Capitalism: Business Faculty Income Inside And Outside The Institution, Shan Lin Jan 2010

Faculty Reward Systems And Academic Capitalism: Business Faculty Income Inside And Outside The Institution, Shan Lin

Mid-Western Educational Researcher

Market forces have driven American higher education from a public good regime to an academic capitalist regime. To examine how this regime shift influences the quality of business education in the US, we use field of specialty, institutional characteristics, demographics, and personal achievements to predict faculty income from inside and outside the institution of employment. We find that inside and outside incomes conflict with each other in that variables measuring faculty quality are positively related to inside income, but negatively related to outside income. This implies that the regime shift brings potential damage to the quality of American business education …

Still Pioneers: Special Social And Economic Hardships For Elderly Gays And Lesbians, Annick Persinger

UC Law SF Journal on Gender and Justice

Part II will investigate how federal law and policy affects lesbian and gay elders' ability to obtain health care benefits and save for retirement. Part III will examine state and municipal solutions for same-sex couples, in the face of federal discrimination. Part IV will illustrate the necessity of acquiring an attorney because of the challenges in preparing for a lesbian or gay elder's incompetence, and the …

Soviet Education: Communism In The Classroom, Alison W. Berryman Jan 2010

Soviet Education: Communism In The Classroom, Alison W. Berryman

Honors Theses

My thesis examines the Soviet Union’s educational system during Stalin’s rule. It proves that the goal of the Soviet educational system in the 1920s and 1930s was to instill strong Communist loyalty from a very early age and to expedite the process of industrialization by educating future workers in “socially useful” labor.

The Accidental Elder Law Professor, A. Kimberley Dayton Jan 2010

The Accidental Elder Law Professor, A. Kimberley Dayton

Faculty Scholarship

This Article discusses my somewhat unusual and erratic path to becoming an Elder Law professor. My story, told more or less in chronological order, is a first-person narrative of one woman’s journey to achieve, if not academic renown, then at least personal satisfaction in the realm of the legal academy. It does not aspire to convey ponderous wisdom about the best way to teach Elder Law or the importance of scholarly productivity as a measure of one’s legitimacy. On the contrary, I hope the Article will illustrate that, in the same way the field of Elder Law has grown and …

Solving The Childcare And Flexibility Puzzle: How Working Parents Make The Best Feasible Choices And What That Means For Public Policy, Arthur C. Emlen Jan 2010

Solving The Childcare And Flexibility Puzzle: How Working Parents Make The Best Feasible Choices And What That Means For Public Policy, Arthur C. Emlen

Regional Research Institute for Human Services

This monograph’s contribution to knowledge was two-fold: 1) reliable measures of the quality of childcare as perceived and assessed by the parents themselves; and 2) discovery that the quality of the care chosen by working parents depends upon the amount of flexibility they can muster from their immediate environment at work, at home, or from accommodating childcare providers. It doesn’t matter which source of flexibility works best for them. It’s the flexibility that allows optimum choice. The findings suggest that public policy should recognize the vast diversity of parental choices and the flexibility needed to improve their choices. That means …

Standard Of Care For Students With Disabilities: The Intersection Of Liability Under The Idea And Tort Theories, Ralph D. Mawdsley Jan 2010

Standard Of Care For Students With Disabilities: The Intersection Of Liability Under The Idea And Tort Theories, Ralph D. Mawdsley

Law Faculty Articles and Essays

This article explores issues of legal liability for school personnel where students with disabilities are injured in school settings or cause injuries to employees and other students in schools. While questions related to legal liability are varied, they tend to fall within two broad areas: standard of care relating to injuries to or by students; and, standard of care for employees working with students with or training others to work with students with disabilities. In both areas, the legal issue revolves around the concept of heightened standard of care, especially where framed by the language of students' IEPs (Individualized Education …

The Role Of Governments In The Overindebtedness Of The Economically Disadvantaged, Stephanie Ben-Ishai, Saul Schwartz, Jeremy Barretto Jan 2010

The Role Of Governments In The Overindebtedness Of The Economically Disadvantaged, Stephanie Ben-Ishai, Saul Schwartz, Jeremy Barretto

All Papers

In this article, Professors Stephanie Ben-Ishai and Saul Schwartz examine several ways in which the government becomes a creditor of economically disadvantaged Canadians and its role in limiting the options available for resolving the resulting overindebtedness. Specifically, the authors explore how government transfer programs, and the debts that result from benefit overpayment, affect those already marginalized by poverty. Ben-Ishai and Schwartz then argue that the two main remedies available to Canadians facing insolvency - credit counselling and bankruptcy - are simply too costly for low-income individuals, a term the authors use to describe those who are poor even before they …
