Confident Uncertainty, Excessive Compensation & The Obama Plan, Michael B. Dorff Apr 2010

Confident Uncertainty, Excessive Compensation & The Obama Plan, Michael B. Dorff

Indiana Law Journal

Public outrage at the enormous bonuses TARP recipients paid to senior executives recently prompted the Obama administration to impose sweeping new curbs on executive compensation. Shortly thereafter, Senator Dodd added restrictions on executive bonuses to the stimulus bill President Obama subsequently signed. These are understandable political reactions, but will they achieve the twin goals of reducing executive compensation in recipients of federal assistance while spurring better corporate performance? To examine this question, I analyze excessive compensation as the product of "confident uncertainty, "the tendency of even the most sophisticated actors to place unwarranted confidence in their ability to predict the …

Rio Drug Factions And The Children Of The Favelas, Melanie Davies, Jini Roby Apr 2010

Rio Drug Factions And The Children Of The Favelas, Melanie Davies, Jini Roby

FHSS Mentored Research Conference

Rio de Janeiro, among other major cities in Brazil, has been surrounded with slums for over a hundred years. These slums, called favelasby the natives, began springing up in the 1850’s (Gay, 1994). Many people migrated to the city in search of a better life. Unable to afford a home, they built shelters on the illegally claimed hillsides of Rio de Janeiro, intending to improve their situation from there (Villareal & Silva, 2006). Instead, the number of favelas has drastically increased over the years. In Rio de Janeiro alone, there are currently over 1800 favelas housing about 2 million people, …

Cracks In The Inexorable: Bourne And Addams On Pacifists During Wartime, Marilyn Fischer Apr 2010

Cracks In The Inexorable: Bourne And Addams On Pacifists During Wartime, Marilyn Fischer

Philosophy Faculty Publications

There is general consensus that Randolph Bourne was right in his criticism of Dewey's support for U.S. participation in World War One. Bourne's central argument against Dewey was that war is inexorable. War cannot be controlled; pragmatist method becomes inoperable. Jane Addams largely agreed with Bourne, but would question his claim that war's inexorability is absolute. I will use Addams's participation with the U.S. Food Administration to show cracks in the inexorability of war and also to raise questions about the pragmatist grounding of Bourne's attack on Dewey. I argue that although Addams's participation with the Food Administration was in …

The Promises And Pitfalls Of The Competitive Bidding Process, Jason Carruthers Apr 2010

The Promises And Pitfalls Of The Competitive Bidding Process, Jason Carruthers

Dissertations, Theses and Capstone Projects (Full IR Collection)

The specter of increased taxes casts a dark shadow upon the American landscape. At the same time public satisfaction with schools, public housing, crime, and infrastructure is on the down turn. The negative perception of public agencies as bureaucratic, inefficient, and wasteful is all the more pronounced when compared to the popular refrain lauding the virtues of the private sector. To stem the mounting inequities of public agencies law makers, think tanks, and members from every facet of society have suggested the expansion of private sector contracting into schools, public agency management, health and human services, police and fire, and …

Home-Based Therapy For Young Children In Low-Income Families: A Student Training Program, Ryan Mattek, Elizabeth T. Jorgenson, Robert Fox

College of Education Faculty Research and Publications

The purpose of this project was to develop an internship training program that offered in-home therapy for young children with significant emotional and behavior problems. The children lived in single-parent, low-income homes in unsafe neighborhoods of a large, urban area. A year-long, training and supervision program was implemented with 10 second-year, graduate students enrolled in 5 different university programs that prepared mental health professionals. Students received specialized instruction in working with diverse families living in poverty and in an evidence-based treatment program. They initially observed veteran counselors implementing the treatment program in homes and gradually assumed responsibility for conducting sessions …

Normative And Legal Pluralism: A Global Perspective, William Twining Apr 2010

Normative And Legal Pluralism: A Global Perspective, William Twining

Duke Journal of Comparative & International Law

This lecture sets out to demystify the topic of legal pluralism by examining the relationship between legal pluralism, normative pluralism, and general normative theory from a global perspective. The central theme is that treating legal pluralism as a species of normative pluralism decenters the state, links legal pluralism to a rich body of literature, and helps to show that some of the central puzzlements surrounding the topic can usefully be viewed as much broader issues in the general theory of norms and legal theory. A second theme is that so-called “global legal pluralism” is in several respects qualitatively different from …

Attitudes Towards Megan's Law And Juvenile Sex Offenders, Debra Lee Cochrane Apr 2010

Attitudes Towards Megan's Law And Juvenile Sex Offenders, Debra Lee Cochrane

UNLV Theses, Dissertations, Professional Papers, and Capstones

Sex offender registration laws are very controversial. All fifty states require adult sex offenders to register. Twenty-eight states have extended registration and community notification requirements to juveniles (Hiller, 1998). These states seem to have failed to look at the uniqueness of juvenile sex offending. Juveniles have a very low recidivism rate and complex issues of culpability from age-of-consent laws. Applying Megan's Law to juveniles could have considerable negative consequences for juveniles' social development, particularly because one of the main stipulations of the law requires the juvenile to notify their school. Rehabilitation is a key factor of the juvenile justice system …

What Would Saint Vincent De Paul Do About Today's Global Poverty? Personalism Vs. Paternalism: Social Work's Role Within A Vincentian Institution, Troy Harden Apr 2010

What Would Saint Vincent De Paul Do About Today's Global Poverty? Personalism Vs. Paternalism: Social Work's Role Within A Vincentian Institution, Troy Harden

Vincentian Studies

DePaul University’s mission and values statement and the National Association of Social Workers Code of Ethics are compared with the goal of forming lasting community/university partnerships for poverty eradication. In particular, DePaul’s social work program is examined. The university’s relationship to Chicago communities is explored. The article emphasizes importance of listening and responding to the needs of community organizations, rather than performing service based on our perceptions of those needs. The true value of service lies in transforming the outlook of those who serve and their resulting commitment to justice. Learning from the communities being served is just as essential …

Law School Programs That Reduce Poverty: The Example Of The Chiapas Human Rights Practicum, Leonard L. Cavise J.D.

Vincentian Studies

The purpose of the Chiapas Human Rights Practicum of DePaul University College of Law is to expose students to poverty in the hopes that they will choose careers in human rights or public service. Reasons why traditional law school programs do not encourage public service are delineated. The practicum’s history and the experiences and observations of students who have participated are described. The program encourages students to think about the causes of poverty, how they might effect change as lawyers, and how the legal system might better serve poor persons. The Chiapas experience has inspired students to undertake many different …
