Real-Time Performance Reviews According to Jim Whitt, performance reviews end up being “check the boxes” exercises that have little influence on performance because they take place after the fact. Employees need and want direction. How and when it is done is what makes the difference

Discharge Of Rcra Injunctive Claims In Bankruptcy: The Seventh Circuit's Decision In United States V. Apex Oil Co., Inc., Diana E. Rdzanek
Seventh Circuit Review
In its recent decision in United States v. Apex Oil, Inc., the Seventh Circuit considered whether an injunction under an environmental statute, even one that requires significant expenditures on the part of the debtor, could ever be a "right to payment" under the Bankruptcy Code, which would allow the claim to be discharged in the bankruptcy. The Seventh Circuit answered in the negative. Since the Supreme Court's decision in Ohio v. Kovacs, the federal circuits have disagreed on the discrete issue of when a claim arises for purposes of bankruptcy with respect to clean-up injunctions under environmental laws. …

Acta, Fool: Explaining The Irrational Support For A New Institution, Gabriel Michael
Acta, Fool: Explaining The Irrational Support For A New Institution, Gabriel Michael
Joint PIJIP/TLS Research Paper Series
The key players in the Anti-Counterfeiting Trade Agreement (ACTA) negotiations were driven to establish a new institution for intellectual property enforcement because the traditional venues for such matters, the WTO and WIPO, had become inhospitable forums. Yet given the significant division in U.S. domestic economic interests over ACTA’s provisions and the lack of solid theoretical or empirical evidence supporting claims made by proponents of the agreement, it is puzzling that ACTA has commanded the support of the U.S. executive, even across two administrations from opposing political parties. I show why this support cannot be explained as a result of the …
The Politics Of Smoke-Free Policies In Developing Countries: Lessons From Africa, Jeffrey Drope
The Politics Of Smoke-Free Policies In Developing Countries: Lessons From Africa, Jeffrey Drope
Political Science Faculty Research and Publications
The public health rewards of smoke-free policies are well documented. But in their enthusiasm to achieve such policies, public health advocates and policymakers frequently underestimate the political complexity of passing laws, and then implementing and enforcing them. Using 12 African countries as the focus of discussion, this research examines the basic political process for and the barriers to achieving smoke-free policies. Moreover, in addition to the obstacles, it examines why some countries have been experiencing comparatively more success in the smoke-free policy area. The findings of the research suggest strongly that the presence of a vigorous tobacco control civil society …

Joint PIJIP/TLS Research Paper Series
Although the term “anti-counterfeiting” suggests an agreement limited to preventing trade in counterfeit products, ACTA’s draft provisions, to date, would set new minimum enforcement standards for a range of intellectual property rights. In several areas, these standards could impede legitimate competition, shortchange legal process and shift costs of enforcing private commercial rights to the public.
The parties to ACTA have agreed to narrow some of its provisions in recent months. Despite these improvements to its text, ACTA continues to present risks for global access to medicines, including potentially restricting free transit of generics, imposing chilling effects on the medicines trade, …

Planning And Deploying Transit Signal Priority In Small And Medium-Sized Cities: Burlington, Vermont, Case Study , Kleoniki Vlachou, John Collura, Alex Mermelstein
Journal of Public Transportation
Innovations in traffic signal systems have generated a great deal of interest in the provision of preferential traffic signal strategies and treatments for transit buses and other vehicles at signalized intersections in cities of all sizes. The primary objective of this paper is three fold: 1) to synthesize the literature of the lessons learned associated with planning and deploying transit signal priority (TSP) strategies in small and medium-sized cities; 2) to demonstrate the application of a micro-simulation model, VISSIM, to assess transit priority impacts in small and medium-sized communities where the required VISSIM input data are often limited; and 3) …

A Comparison Of The Career And Technical Education Programs In A Us Community College And A Chinese Institution, Harry Hou
Dissertations
This research study explores and compares the career and technical education programs offered in a US community college and the vocational/career and technology education programs offered in a comparable Chinese postsecondary institution. The study sought to find positive transferable characteristics of the career and technical education programs in each country, which could be shared by similar institutions in China and the US.
Under the impact of globalization, international cooperation and collaboration between institutions and programs becomes more and more important, particularly considering there are many shared problems and thus the potential for shared solutions. This research offers insights and information …
Web-Based Weapons Of Mass Destruction Training For Transit Police, Lori A. Magda, Allison N. Canton, Robyn R.M. Gershon
Web-Based Weapons Of Mass Destruction Training For Transit Police, Lori A. Magda, Allison N. Canton, Robyn R.M. Gershon
Journal of Public Transportation
In response to increased terrorist attacks on mass transit systems worldwide, emergency planning and security efforts have intensified. One of the most important planning elements is the provision of training for first-response personnel. Yet few terrorism-related training programs specific to the mass transit sector are available. To address this unmet need, a web-based weapons of mass destruction (WMD) simulation training program, specifically designed for transit police, was recently developed, implemented, and evaluated. Results indicate that this program was effective in improving transit police officers’ ability to recognize and respond to WMD simulations.

I am proud to introduce the 19th annual Southwestern Oklahoma State University Fact Book. The Fact Book provides a ready source of information to answer frequently asked questions about the University and its operations. Unless otherwise noted, the information in this Fact Book came from computer-generated reports that are printed following the tenth class day of each fall semester. Because of student fluctuations during the semester, numbers will not match other published enrollment numbers that may be based on enrollment at the end of a semester.

Crimes And Offenses Offenses Against Public Safety And Order, Georgia State University Law Review
Georgia State University Law Review
The Act clarifies current law relating to where weapons may be carried or possessed. It defines the offense of carrying a weapon without a valid license. The Act changes provisions relating to the carrying of weapons onto private property, public property, and campus grounds. It also provides for uniform security features of weapons carry licenses issued on or after January 1, 2012.

A Synthesis Of Overweight Truck Permitting, Muhammad K. Bilal, Muhammad Irfan, Anwaar Ahmed, Samuel Labi, Kumares C. Sinha
JTRP Technical Reports
For purposes of safety and system preservation, trucking operational characteristics are regulated through legislation and policies. However, special permits are granted for trucks to exceed specified operational restrictions. Thus, the Indiana DOT not only seeks highway operations policies that retain/attract heavy industry including those that haul large loads but also seeks to protect the billions of taxpayer dollars invested in highway infrastructure. As such, it is sought to avoid policies that may lead to premature and accelerated deterioration of assets through excess loading or undue safety hazard through oversize loads. This study was carried out primarily to document the state …
