Frontline Providers Of Mental Healthcare: The Role Of Police Officers In Involuntary Psychiatric Assessments Under The Mental Health Care And Treatment Act, Jude Hall

Dalhousie Journal of Legal Studies

This article advances the proposition that police officers in Newfoundland and Labrador are, and should be, viewed as frontline providers of mental healthcare services. A frontline provider of mental healthcare service could be defined as any person who in the performance of employment acts as a facilitator of initial delivery of mental healthcare for a consumer in need of such service. The central proposition requires qualification and context and is advanced through pursuit of the following research objectives: to assess the extent that variability in police officer mental health training programs may impact upon the performance of statutory duties of …

The Obstacles Of Outsourcing Imported Food Safety To China, Chenglin Liu Jan 2010

The Obstacles Of Outsourcing Imported Food Safety To China, Chenglin Liu

Faculty Articles

Outsourcing regulatory power through a bilateral agreement with China is unlikely to ensure the safety of imported food for two primary reasons: (1) shifting the regulatory burden does not present a feasible alternative to the traditional enforcement tools of outcome-based and production-based inspections and sanctions; and (2) China's burgeoning food safety regime, based on an entirely different culture and legal system, provides little incentive for Chinese food manufacturers to increase production costs to comply with U.S. standards.

There are three approaches for securing food safety in the U.S.: (1) increase inspections at the borders by utilizing traditional outcome-based enforcement tools; …

Case Disposition In The Drug Court: Who Is The Most Central Actor?, Salmon A. Shomade Jan 2010

Case Disposition In The Drug Court: Who Is The Most Central Actor?, Salmon A. Shomade

Political Science Faculty Publications

In recent years, the number of drug courts has proliferated throughout the country. One widely held belief is that the central figure in a drug court is the judge. While the judge may be the central actor in the courtroom, what is not clear is whether the drug court judge is the most central actor in the actual disposition of cases. This article presents the findings of a research project that asked actors participating in staffing about the centrality of the drug court judge. I found that while the drug court judge is a central actor, the most central actor …

Jurists For Jesus, Barbara L. Atwell Jan 2010

Jurists For Jesus, Barbara L. Atwell

Elisabeth Haub School of Law Faculty Publications

This article focuses on Jesus’ fundamental mandate to ―love your neighbor as yourself. These five words encompass two prongs: honoring every individual (yourself), and caring for the human community as a whole (Your neighbor). This article refers to these two fundamental prongs as the Jesus Principles. An individual does not need to be a Christian or otherwise religious to embrace the Jesus Principles; in fact, they are universal. Developing laws and policies consistent with the basic concept of love reflected in the Jesus Principles can guide us toward a more just society.

Raising The Bar: Standards-Based Training, Supervision, And Evaluation, Adele Bernhard

Elisabeth Haub School of Law Faculty Publications

In this short Article, I sketch the methodology my colleagues and I at Pace Law School use to incorporate practice standards into our clinical teach-ing and reflect on how a standards-based teaching paradigm could be adapted to the training, supervision, and evaluation of public defenders. Then, I briefly consider how standards and standards-based teaching assist in the administration of assigned counsel plans and in the evaluation of the performance of public defender organizations. Although this Article does not cover any of these topics in depth, my goal is to introduce the reader to a standards-based approach to teaching and suggest …

Diasporic Cultural Citizenship: Negotiate And Create Places And Identities In Their Refugee Migration And Deportation Experiences, Shirley S. Tang

Trotter Review

In 2002, the oldest Khmer (Cambodian) American community organization in Massachusetts, the Cambodian Community of Massachusetts (CCM), closed its doors to constituents in the state’s North Shore metro region, where the adjacent gateway cities of Lynn and Revere were home to the country’s fifth-largest concentration of Cambodian Americans, according to the 2000 Census. Founded by Cambodian refugees and their supporters in 1981 as one of the first-generation mutual assistance associations encouraged by the federal Office for Refugee Resettlement, CCM had operate as an ethnic-based, multiservice agency that helped survivors of war and trauma in Cambodia to adjust to U.S. society …

Near Impossible To Enforce At Best, Unconstitutional At Worst: The Consequences Of Maryland’S Text Messaging Ban On Drivers, Alan Lazerow

Richmond Journal of Law & Technology

A local newspaper reports that your state recently passed a law prohibiting citizens from “writ[ing] or send[ing] a text message while operating a motor vehicle.” Armed with the knowledge of the texting ban, you, being a reasonable citizen, are likely to proceed in one of at least three ways, each of which exposes the statute’s fundamental flaws.

Sorry Seems To Be The Hardest Word: The Fair Sentencing Act Of 2010, Crack, And Methamphetamine, Kyle Graham

Faculty Publications

This Essay considers the circumstances that led to the enactment of the Fair Sentencing Act of 2010, which increased the quantities of crack cocaine necessary to implicate mandatory minimum prison sentences for federal drug trafficking crimes, and considers whether the Act might facilitate re-evaluation of the penalty scheme applicable to methamphetamine.

The Wholesale Decommissioning Of Vacant Urban Neighborhoods: Smart Decline, Public-Purpose Takings, And The Legality Of Shrinking Cities, Ben Beckman Jan 2010

The Wholesale Decommissioning Of Vacant Urban Neighborhoods: Smart Decline, Public-Purpose Takings, And The Legality Of Shrinking Cities, Ben Beckman

Cleveland State Law Review

This Note is principally concerned with those takings that arise from the State's exercise of eminent domain, either directly or through the State's designee. To put a finer point on it, this Note addresses the distinction that property-rights advocates have developed to delegitimize certain types of takings. This distinction divides condemnations into disfavored-yet-legitimate takings-the direct-government-use and common-carrier takings-and ostensibly illegitimate public-purpose takings. The property-rights movement unequivocally places economic-development takings in the illegitimate category. The status of blight-remediation takings is ambiguous but tends toward legitimacy.

Coral Reefs In The Philippines, Mary Stevens Jan 2010

Coral Reefs In The Philippines, Mary Stevens

PEEL Alumni Scholarship

In 1959, petitioner and his fellow corporate associates purchased a waterfront parcel of land in Rhode Island that was primarily a salt marsh plagued by tidal flooding. Over a period of many years, the corporation filed several petitions seeking to develop the land with various government agencies and was consistently denied. In 1971, Rhode Island promulgated regulations designating salt marshes, such as petitioner's, as protected coastal wetlands. In 1978, petitioner became the corporation's sole shareholder and received title for the land. In the 1980's, he applied to the state to fill in his marshland and was rejected based on the …

The Role Of Precedent At The European Court Of Human Rights: A Network Analysis Of Case Citations, Yonatan Lupu, Erik Voeten Jan 2010

The Role Of Precedent At The European Court Of Human Rights: A Network Analysis Of Case Citations, Yonatan Lupu, Erik Voeten

2010

While political scientists have become increasingly interested in the output of international courts, they have paid little attention to the manner by which these courts justify their decisions and develop legal norms. We address these issues through a network analysis of European Court of Human Rights (ECtHR) citations. We argue that, like domestic review courts, the ECtHR uses its legal justifications at least in part to convince “lower” (domestic) courts of the legitimacy of its judgments. Several empirical observations are consistent with this view. First, country-specific factors do not determine the case-law on which the Court relies. Instead, it cites …

The Evolution Of Emergency Management Networks: The Brazos County, Tx Evacuation Network From 2000-2009, Scott E. Robinson Jan 2010

The Evolution Of Emergency Management Networks: The Brazos County, Tx Evacuation Network From 2000-2009, Scott E. Robinson

2010

Emergency management is a field in which collaborative activities are inescapable. Emergency planning and response increasingly involves a diverse array of actors across field (emergency management, public health, law enforcement, etc.), sector (government, nonprofit, and for-profit), and level of government (local, state, and federal). The necessity of collaboration is built into the logic of escalation in the Stafford Act and the nature of emergency events as boundary spanning threats. While the necessity of collaboration is clear, the dynamics of this collaboration are less well understood. This paper assesses the temporal dynamics of an emergency management network in a moderately sized …

“Don’T Let Government Touch My Medicare”: How Media Framing Shapes Public Support For Health Care Reform, Stacey L. Pelika, Jennifer Hayes Clark, Elizabeth Rigby Jan 2010

“Don’T Let Government Touch My Medicare”: How Media Framing Shapes Public Support For Health Care Reform, Stacey L. Pelika, Jennifer Hayes Clark, Elizabeth Rigby

2010

When covering the policymaking process, the media typically cover both substantive aspects of the issue at hand and the political wrangling that occurs as lawmakers attempt to agree on a course of action. In this paper, we use the recent health care debate to investigate the effects of what we call ‘policy’ and ‘process’ frames on the citizens’ perceptions that reform would benefit the nation. First, we apply social network analysis to articles from 144 daily U.S. newspapers in order to track the changing centrality of each type of frame in media coverage. We then combine the results of this …
