The View Behind Rubber Bars: An Analysis And Examination Of Faith And Non-Faith Jail Reentry Programs In Central Florida, Gautam Nayer
The View Behind Rubber Bars: An Analysis And Examination Of Faith And Non-Faith Jail Reentry Programs In Central Florida, Gautam Nayer
Contemporary Issues in Juvenile Justice
This paper examined the usefulness of jail reentry programs as an alternative towards increased jail and prison costs. Policy issues for returning inmates could and often did include future employment prospects, housing and public safety. Prisoner reentry programs generally fell into two broad categories; faith and non-faith based. Generally, non-faith programs were conducted in jail or prison while the individual was incarcerated for an extended period of time.Non-faith type programs involved classes on anger management, G.E.D. attainment, college credits, or alcohol or drug abuse therapy. Faith based programs were generally Christian based, although they usually did not discriminate against other …

Humonetarianism: The New Correctional Discourse Of Scarcity, Hadar Aviram
UC Law Journal of Race and Economic Justice
Criminological accounts of penological discourse in the United States often focus on the transition to more punitive policies beginning in the late 1970s, which led the U.S. to top international charts of incarceration rates per capita. However, recent developments in punitive policies and practices suggest a reversal of the punitive pendulum. This article maps these developments, arguing that they represent the emergence of a new correctional discourse, called humonetarianism, which focuses on scarcity of resources and on cost-benefit analysis as its main raison d'être.
This article begins by tracing the history of humonetarianism, offering two complementary genealogies for this discourse. …

The High Cost Of Free Speech: Anti-Solicitation Ordinances, Day Laborers And The Impact Of 'Backdoor' Local Immigration Regulations, Kristina M. Campbell
Journal Articles
This paper examines how local efforts to regulate the activities of immigrants, while not regulation of immigration per se, can have a substantial and detrimental effect on the civil rights of immigrants and Latinos. The paper discuss how day laborers - individuals, mostly Latino men, who seek short-term employment in public fora - are routinely targeted by state and local governments, federal immigration authorities, anti-immigrant activists, and the general public as a symbol of the employment of unauthorized aliens. Even though many day laborers are lawfully present, or have authorization to work in the United States, due to the high-profile …

Understanding Space Weather Customers In Gps-Reliant Industries, Jennifer L. Meehan, G. Fisher, W. Murtagh
All Physics Faculty Publications
Since the last solar maximum, society has become extremely reliant on the Global Positioning System (GPS), which is often referred to as the “fourth utility” behind electricity, water, and natural gas. As the economy depends more and more on positioning, navigation, and timing, society's vulnerability to space weather continues to increase because space weather can be a significant cause of GPS errors. Critical applications such as railway control, highway traffic management, precision agriculture, emergency response, commercial aviation, and marine navigation all require GPS services. With such widespread and critical usage, industries are becoming more aware of how space weather can …

Recklessness In Context: Individual And Situational Correlates To Aggressive Driving, Paul B. Harris, John M. Houston
Recklessness In Context: Individual And Situational Correlates To Aggressive Driving, Paul B. Harris, John M. Houston
Faculty Publications
Traffic-related injury and fatality are major health risks in the United States and worldwide. One contributor to road accidents is unsafe and aggressive driving practices. We examined individual and situational aspects of aggressive driving by having 152 undergraduate students complete self-report measures. Aggressive driving was related to personality variables, such as hostility, sensation seeking, and competitiveness, as well as to social variables such as driving without passengers and characteristics of the target vehicle (e.g., passengers, age, and status of driver), environmental variables (e.g., type of road, traffic, and weather), and temporal variables (e.g., time pressure and time of day).

A Critical Legal Pluralist Analysis Of The Begum Case, Amy Jackson
Comparative Research in Law & Political Economy
This paper considers the advantages of a critical legal pluralist analysis of the English case R (on the application of Begum) v. Headteacher and Governors of Denbigh High School [2007] 1 AC 100. The case concerns whether a state school’s decision to exclude a pupil (Shabina Begum) for wearing an Islamic veil (a jilbab, which is a long coat-like garment which covers the whole body except the hands and face) infringed her right to manifest her religion and her right to an education protected under Articles 9 and 2 (of the First Protocol) of the European Convention of Human Rights …

Incarcerated Adults Sentenced In Adult Criminal Court While Juveniles: Knowledge, Understanding, And Perceptions Of Their Sentences, Karen Miner-Romanoff
Incarcerated Adults Sentenced In Adult Criminal Court While Juveniles: Knowledge, Understanding, And Perceptions Of Their Sentences, Karen Miner-Romanoff
Walden Dissertations and Doctoral Studies
An estimated 200,000 juveniles are tried as adults yearly and receive punitive sentences intended to deter juvenile crime and increase public safety. Few qualitative studies on juveniles sentenced as adults and contradictory results indicate a need for further research. This study used a qualitative, phenomenological interpretive design, with the conceptual frameworks of general and specific deterrence and rational choice theories. In-depth interviews took place with 12 incarcerated adults serving sentences (24--540 months) for juvenile crimes. The research questions explored their knowledge of transfer laws and adult sentencing and perceptions of deterrence from future criminal activity. Coding of transcripts and audio …
The Law Of Sustainable Development: Keeping Pace, John R. Nolon
The Law Of Sustainable Development: Keeping Pace, John R. Nolon
Elisabeth Haub School of Law Faculty Publications
This article describes the emerging field of sustainable development law and examines whether it is up to the challenge it faces. In a world of finite resources overrun by sprawl, threatened by climate change, short on fuel, and long on greenhouse gas emissions, the law must keep pace. After discussing what sustainable development law is, the article considers the relationship between change in society and the evolution of legal principles, strategies, and practices, particularly with respect to land use, property, and natural resources. Documented in this review is the steady change exhibited in the common law applicable to the ownership, …

Call To Police The Margins: The Eighth Circuit's Expansion Of Miranda's Public-Safety Exception, A, Bradley S. Dixon
Missouri Law Review
The right of every citizen against compulsory self-incrimination is a principle firmly embedded in the American justice system. The Supreme Court of the United States in Miranda v. Arizona, a decision that has established itself in the public consciousness, found the abuses of law enforcement so grave that the Court mandated certain prophylactic measures to protect Fifth Amendment rights. In doing so, the Court recognized that it was balancing the interest of protecting individuals' Fifth Amendment rights against the potential detrimental costs to effective law enforcement. In New York v. Quarles, the Supreme Court found a public policy exception to …
Guardians Of Municipal Public Trees: Commonwealth Of Massachusetts Tree Wardens’ Authority And Accountability, Julie E. Steiner
Guardians Of Municipal Public Trees: Commonwealth Of Massachusetts Tree Wardens’ Authority And Accountability, Julie E. Steiner
Western New England Law Review
Today’s tree wardens are continually called upon to strike a balance between preservation of public trees and protection of the public from hazardous tree conditions. The Commonwealth of Massachusetts has been a pioneer in tree protection legislation, including the enactment of the first state legislation requiring a municipal tree warden. As guardians of the municipal landscape, tree wardens decide whether and when to plant new public shade trees, or to permit those that already exist to be cut, trimmed, or removed. This Article describes the important historical role the Commonwealth of Massachusetts has played in protecting public trees, the legal …
