Building Civic Capacity On Campus Through A Radically Inclusive Teaching And Learning Initiative, Alice Lesnick, Alison Cook-Sather Jan 2010

Building Civic Capacity On Campus Through A Radically Inclusive Teaching And Learning Initiative, Alice Lesnick, Alison Cook-Sather

Education Program Faculty Research and Scholarship

In this article we explore the definition and development of civic capacity at a liberal arts college through a specific teaching and learning initiative. This initiative encourages faculty, staff, and students to share the roles of teacher, learner, and colleague as they gain educational opportunities and foster these for others. Through a description of two programs and analysis of participants’ reflections, we identify four stages of change that foster civic capacity. We suggest that this initiative invites a re-interpretation of the institution as a site of educational opportunities and raises questions about how to broaden access to these opportunities.

The Rights Of Migrants: An Optimal Contract Framework, Adam B. Cox, Eric A. Posner Jan 2010

The Rights Of Migrants: An Optimal Contract Framework, Adam B. Cox, Eric A. Posner

Articles

Why do migrants enjoy some of the rights associated with citizenship? Existing accounts typically answer this question in terms of obligation-of a duty on the part of states to confer citizenship. Moreover, scholars tend to lump together the rights conventionally associated with citizenship when they answer this question. In contrast, this Article disaggregates the rights associated with citizenship, asks what both states and migrants want, and inquires into how the suite of rights associated with citizenship might advance those interests. States want to encourage migrants to enter their territory and to make country-specific investments, but states also have an interest …

Predicting Crime, M. Todd Henderson, Justin Wolfers, Eric Zitzewitz Jan 2010

Predicting Crime, M. Todd Henderson, Justin Wolfers, Eric Zitzewitz

Articles

Prediction markets have been proposed for a variety of public policy purposes, but no one has considered their application in perhaps the most obvious policy area.: crime. This Article proposes and examines the use of prediction markets to forecast crime rates and the potential impact on crime policy, such as changes in resource allocation, policing strategies, sentencing, post-conviction treatment, and so on. First, we argue that prediction markets are especially useful in crime rate forecasting and criminal policy analysis because information relevant to decisionmakers is voluminous, dispersed, and difficult to process efficiently. After surveying the current forecasting practices and techniques, …

Facilitating Intergovernmental Dialogue: Judicial Review Of The Division Of Powers In The Supreme Court Of Canada, Wade K. Wright Jan 2010

Facilitating Intergovernmental Dialogue: Judicial Review Of The Division Of Powers In The Supreme Court Of Canada, Wade K. Wright

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This article provides a novel account of the the ory of judicial review that is evident in the Supreme Court of Canada’s recent division of powers decisions (2000-2009). Under this the ory, the Supreme Court encourages the political branches to take the lead in defining the division of powers, by working out a mutually acceptable allocation of jurisdiction in each regulatory area. The Supreme Court limits itself primarily to facilitating intergovernmental dialogue about the division of powers, and managing the conflicts that result where the political branches fail to agree. The Supreme Court does not completely refuse to play a …

2001 Supreme Court Redux, Mary Stevens Jan 2010

2001 Supreme Court Redux, Mary Stevens

PEEL Alumni Scholarship

In 1959, petitioner and his fellow corporate associates purchased a waterfront parcel of land in Rhode Island that was primarily a salt marsh plagued by tidal flooding. Over a period of many years, the corporation filed several petitions seeking to develop the land with various government agencies and was consistently denied. In 1971, Rhode Island promulgated regulations designating salt marshes, such as petitioner's, as protected coastal wetlands. In 1978, petitioner became the corporation's sole shareholder and received title for the land. In the 1980's, he applied to the state to fill in his marshland and was rejected based on the …

One Tough Pill To Swallow: A Call To Revise North Carolina's Drug Trafficking Laws Concerning Prescription Painkillers, Evan M. Musselwhite Jan 2010

One Tough Pill To Swallow: A Call To Revise North Carolina's Drug Trafficking Laws Concerning Prescription Painkillers, Evan M. Musselwhite

Campbell Law Review

This Comment takes the position that when the legislature enacted the statute for trafficking in opium or heroin in 1979, it never intended the statute to apply to prescription drugs containing oxycodone and acetaminophen. The statute was enacted during America's "war on drugs," a time when the country was concerned with the rise of illegal street drugs such as heroin, LSD, cocaine, and marijuana, a time when prescription drug abuse was not nearly as prevalent as it is today and twenty years before Percocet was first introduced.

Between Elite Interests And Pro-Poor Resistance: The Nigerian Courts And Labour-Led Anti-Fuel Price Hike Struggles (1999-2007), Obiora Chinedu Okafor

Articles & Book Chapters

Between 1999 and 2007, a popular Labour-led movement led a pro-poor struggle to resist the fuel price hike policy of the Nigerian government. Waged in the context of the poverty in which nearly 70 per cent of Nigerians lived, the operation of powerful incentives to raise fuel prices, and Labour’s extraordinary socio-political leverage, these struggles triggered much government frustration. One of the strategies adopted by the government to legitimize its attempt to repress the movement was to resort to the courts. This article analyses, from a socio-legal perspective, the key cases relating to the validity of the government’s attempts to …
