Legal Preparedness For Pandemic Influenza: Is Virginia Ready?, Kristen Digirolamo
Legal Preparedness For Pandemic Influenza: Is Virginia Ready?, Kristen Digirolamo
Law Student Publications
This paper attempts to identify the legal issues at stake during a pandemic and how those issues need to be discussed as a whole when preparing. Part II of this paper will give a brief description of pandemic influenza and look at the Spanish Flu pandemic of 1918. Part III will examine the origins of legal authority during a pandemic at the federal, state, and local levels of government. Part IV will look at some of the specific legal issues that may arise during a pandemic and discuss what decision-makers need to be thinking about in order to plan comprehensively. …

Transitioning To College [Brochure And Video], Sean Giddings, Kalin Holland
Counseling Concepts and Applications for Student Affairs Professionals (CNS 577)
The transition from high school to college can be a challenging time for some students. Feelings of loneliness, being homesick, and being anxious about starting a new chapter in life are common emotions a transitioning college student may have. Solid preparation and mental foresight can prove to be useful in making for a successful transition to college from high school. Often times the new college atmosphere is too much for some students to handle, so it is encouraged that future college students learn all they can before this transition begins.
The False Dilemma Of The Economic Loss Doctrine, Ralph A. Anzivino
The False Dilemma Of The Economic Loss Doctrine, Ralph A. Anzivino
Marquette Law Review
A defective product causes various types of damages. The type of damage suffered generally determines whether contract or tort law will govern resolution of the parties’ dispute. Contract law will control when the loss suffered is considered to be solely economic loss. For example, when a machine does not produce the number of parts/minute as warranted by the seller, the loss is solely an economic loss. On the other hand, when a defective product causes personal injury, tort law will be utilized to resolve the dispute. However, when the defective product causes “other property” damage (not economic loss or personal …
An Analysis Of Restaurant Food Safety Violations: Human Factors, Non-Human Factors, And Food-Borne Illness, Jai Choung
An Analysis Of Restaurant Food Safety Violations: Human Factors, Non-Human Factors, And Food-Borne Illness, Jai Choung
UNLV Theses, Dissertations, Professional Papers, and Capstones
An estimated 76 million food-borne illnesses occur in the United States each year, causing 325,000 hospitalizations and 5,000 deaths, according to the U.S. Food and Drug Administration. Food safety is an increasingly important topic to governmental food regulators, not only in trying to reduce the number of illnesses from contaminated food. Governmental regulators also are becoming aware of the vulnerability of the food supply chain as a target for bioterrorism. Recommendations have been developed to protect the U. S. food supply from terrorism, but little of the research and recommendations relate to the food-service level.

Attitudes Towards Megan's Law And Juvenile Sex Offenders, Debra Lee Cochrane
Attitudes Towards Megan's Law And Juvenile Sex Offenders, Debra Lee Cochrane
UNLV Theses, Dissertations, Professional Papers, and Capstones
Sex offender registration laws are very controversial. All fifty states require adult sex offenders to register. Twenty-eight states have extended registration and community notification requirements to juveniles (Hiller, 1998). These states seem to have failed to look at the uniqueness of juvenile sex offending. Juveniles have a very low recidivism rate and complex issues of culpability from age-of-consent laws. Applying Megan's Law to juveniles could have considerable negative consequences for juveniles' social development, particularly because one of the main stipulations of the law requires the juvenile to notify their school. Rehabilitation is a key factor of the juvenile justice system …

Who Draws The Line In El Paso, Texas: Multiscalar Interactions And The Chances For Border Reform, Robert L. Heyman
Who Draws The Line In El Paso, Texas: Multiscalar Interactions And The Chances For Border Reform, Robert L. Heyman
Geography Honors Projects
The question of how borders are defined and enforced has always been an important issue both to the state and to residents between whom make and must deal with those decisions. This project examines El Paso, Texas as a case study for shaping a more progressive future for border and immigration enforcement. It does so by reporting on 16 interviews with key actors in border policy discussions. El Paso offers an excellent opportunity to study how border and immigration enforcement approaches are negotiated between scales, including federal enforcement agencies, state government, city and county officials, and community activists. Immigration enforcement …

Why Care About Mass Incarceration?, James Forman Jr.
Why Care About Mass Incarceration?, James Forman Jr.
Michigan Law Review
Advocates for less punitive crime policies in the United States face long and dispiriting odds. The difficulty of the challenge becomes clear if we compare our criminal justice outcomes with those of other nations: We lock up more people, and for longer, than anyone else in the world. We continue to use the death penalty long after Europe abandoned it, we are the only country in the world to lock up juveniles for life, and we have prisoners serving fifty-year sentences for stealing videotapes from Kmart. Our courts offer little relief: the German Constitutional Court prohibits a sentence of life …

Public Attitudes Toward Crime And Incarceration In Finland, Ikponwosa O. Ekunwe, Richard S. Jones, Kaley Mullin
Public Attitudes Toward Crime And Incarceration In Finland, Ikponwosa O. Ekunwe, Richard S. Jones, Kaley Mullin
Social and Cultural Sciences Faculty Research and Publications
The following paper provides insights into Finland’s criminal justice system and discusses the policies that emphasize using prison for rehabilitation, not merely for punishment. These methods of prevention and rehabilitation, in conjunction with correctional and educational staff within and outside the prison walls, have contributed to consistently low recidivism rates in Finland. This study discusses many ideological similarities between public opinions towards criminals and crime in Finland and the United States. Like Americans, Finns are intolerant of crime and violence, yet open to the idea of alternative forms of punishment, especially for non-violent and juvenile offenders. People in both countries …

Optical Limiting Study Of Double Wall Carbon Nanotube-Fullerene Hybrids, Kang-Shyang Liao, Jun Wang, Daniel Fruchtl, Nigel Alley, Enrico Andreoli, Eoghan Dillon, Andrew Barron, Hansoo Kim, Hugh Byrne, Werner Blau, Seamus Curran
Articles
In order to merge complementary temporal and spatial nonlinear optical characteristics of Fullerene and carbon nanotubes, synthesis of double wall carbon nanotube-Fullerene hybrid was performed by covalently linking DWNT and C60 by amination reaction with polyethylenimine. DWNT-Fullerene hybrids were characterized by thermogravimetric analysis, UV-vis spectroscopy and transmission electron microscopy. Optical limiting performance of DWNT-Fullerene hybrids is superior to those of Fullerenes and SWNTs at the same level (~ 80%) of transmission. Whereas nonlinear scattering is an evident mechanism, reverse saturable absorption from Fullerene moieties has significant contribution. Charge transfer between the DWNT and Fullerene moieties may play an important role …
The Criminalization Of Homelessness, Sarah Mckenzie Prather
The Criminalization Of Homelessness, Sarah Mckenzie Prather
UNLV Theses, Dissertations, Professional Papers, and Capstones
The current study is an analysis of the problem of homelessness in American society today. It focuses on the demographic characteristics of the homeless in addition to some of the contributing factors that explain homelessness. Of particular concern is how the criminal justice system responds to homelessness, including the criminalization and stigmatization of homeless individuals and the implications of such a response. The data used in this study come from a recent survey conducted in a jail setting in a northwest city. The present study compares those who have been homeless at one time or another and those who have …

Trafficking In Persons & Transit Countries: A Canada-U.S. Case Study In Global Perspective, Benjamin Perrin
Trafficking In Persons & Transit Countries: A Canada-U.S. Case Study In Global Perspective, Benjamin Perrin
All Faculty Publications
International trafficking in persons is often facilitated by the movement of victims through one or more transit countries in order to reach a destination country where the victim will ultimately be subjected to sexual exploitation or forced labour. Despite this recognized pattern, there has been a relative lack of attention paid to the response of transit countries in addressing their role in this transnational criminal activity and systematic human rights abuse. This working paper begins by identifying several characteristics common to transit countries, including: (1) geographic proximity by land, sea, or air to attractive destination countries; (2) insufficient legislation and …
Answer Distortion On The Epworth Sleepiness Scale During The Commercial Driver Medical Examination, Keith E. Proctor
Answer Distortion On The Epworth Sleepiness Scale During The Commercial Driver Medical Examination, Keith E. Proctor
USF Tampa Graduate Theses and Dissertations
Commercial vehicle drivers are required to maintain Department Of Transportation medical certification which entails a Commercial Driver Medical Examination (CDME) and optimally leads to a two-year certification. The examination must be performed by a licensed "medical examiner" administered by a variety of health care providers including physicians, advanced registered nurse practitioners, physician assistants and doctors of chiropractic. Unfavorable findings in the examination can yield either a shortened medical certification period or denial of certification. Sleep disorders including sleep apnea are assessed by a single question located in the health history portion of the CDME form which is filled-out by the …

Participants' Perceptions Of The Value And Effectiveness Of The Leadership Boca Program, Kristen L. Moraz
Faculty and Staff Publications & Presentations
Leadership development is critical to organizations and communities alike. Worthwhile to such organizations is to sponsor programs and curriculum to support the assertion that individuals with developed leadership skills will benefit the community through contribution and service. This study examined the effectiveness of the Leadership Boca program from the participants’ perspectives. Graduates’ perceptions regarding the usefulness of the program were measured by the researcher facilitating a questionnaire. In addition, the merits for participation and the graduates’ confidence in the program’s ability to meet its commitments were measured. The results from the study indicated graduates’ favorable perceptions of the program meeting …

An Offer They Can't Refuse: Racial Disparity In Juvenile Justice And Deliberate Indifference Meet Alternatives That Work, Edgar Cahn, Cynthia Robbins
University of the District of Columbia Law Review
While young people of all races commit delinquent acts, some are provided treatment while others are detained and incarcerated. Once incarcerated, these youth begin their slide down a slippery slope; they lack an equal opportunity to gather evidence and prepare their cases. Furthermore, they will be effectively deprived of the opportunity and the resources to develop the educational and employment skills necessary to progress to productive adult lives. It is well documented that juveniles of color are more likely than their white counterparts to be arrested,1 referred to juvenile court rather than to diversion programs, charged, waived to adult court, detained …
