Correcting Mandatory Injustice: Judicial Recommendation Of Executive Clemency, Joanna M. Huang Oct 2010

Correcting Mandatory Injustice: Judicial Recommendation Of Executive Clemency, Joanna M. Huang

Duke Law Journal

In 1987, the United States political and social systems lost trust in the judiciary and severely limited its authority by enacting the mandatory Federal Sentencing Guidelines. During this period, many judges were forced to impose sentences they viewed as unjust. Trust in the judiciary was restored in 2005, when United States v. Booker made the Sentencing Guidelines advisory. Despite the increase in judicial discretion, however, judges are still unable to correct sentences imposed during the intervening eighteen years because Booker does not apply retroactively. Unfortunately, the executive and legislative branches are similarly unable to provide adequate remedies. Congressional action is …

The Economic Impact Of Information And Communication Technologies (Icts) On Microenterprises In The Context Of Development, Han Ei Chew, P. Vigneswara Ilavarasan, Mark Levy

Research Collection Office of Impact

This paper investigates the impact of information and communication technologies, especially landline and mobile phones, computers, and Internet cafés in facilitating economic growth in the developing world. Data on access to ICTs, as well as business-relevant behaviors and attitudes, was collected by a multi-stage probability sample of women microentrepreneurs in Mumbai, India. Main findings include evidence that in urban microenterprises owned by women, business growth is a function of ICT access and is related to motivation to use ICTs for business purposes; and that the more positive a woman microentrepreneur feels about her status and power because of her business, …

Four Mediation Stories From Across The Globe, Nadja Alexander Oct 2010

Four Mediation Stories From Across The Globe, Nadja Alexander

Research Collection Yong Pung How School Of Law

In the past 30 years mediation has emerged as a significant dispute resolution narrative around the world. It contains many stories told by different story-tellers -- stories about diverse practices, communities and courts, in creasing institutionalisation, regulation, accreditation, standards, research and theoretical developments. Together these stories weave a tapestry of our social and cultural experience of mediation and define mediation as a narrative, a practice and a profession.

Spatiotemporal Two-Dimensional Solitons In The Complex Ginzburg-Landau Equation, Florent Berard, S.C. Mancas Oct 2010

Spatiotemporal Two-Dimensional Solitons In The Complex Ginzburg-Landau Equation, Florent Berard, S.C. Mancas

Publications

We introduce spatiotemporal solitons of the two-dimensional complex Ginzburg-Landau equation (2D CCQGLE) with cubic and quintic nonlinearities in which asymmetry between space-time variables is included. The 2D CCQGLE is solved by a powerful Fourier spectral method, i.e., a Fourier spatial discretization and an explicit scheme for time differencing. Varying the system's parameters, and using different initial conditions, numerical simulations reveal 2D solitons in the form of stationary, pulsating and exploding solitons which possess very distinctive properties. For certain regions of parameters, we have also found stable coherent structures in the form of spinning (vortex) solitons which exist as a result …

Tools For Evaluating Team Performance In Simulation-Based Training, Michael A. Rosen, Sallie J. Weaver, Elizabeth H. Lazzara, Eduardo Salas, Teresa Wu, Salvatore Silvestri, Nicola Schiebel, Sandra Almeida, Heidi B. King Oct 2010

Tools For Evaluating Team Performance In Simulation-Based Training, Michael A. Rosen, Sallie J. Weaver, Elizabeth H. Lazzara, Eduardo Salas, Teresa Wu, Salvatore Silvestri, Nicola Schiebel, Sandra Almeida, Heidi B. King

Publications

Teamwork training constitutes one of the core approaches for moving healthcare systems toward increased levels of quality and safety, and simulation provides a powerful method of delivering this training, especially for face-paced and dynamic specialty areas such as Emergency Medicine. Team performance measurement and evaluation plays an integral role in ensuring that simulation-based training for teams (SBTT) is systematic and effective. However, this component of SBTT systems is overlooked frequently. This article addresses this gap by providing a review and practical introduction to the process of developing and implementing evaluation systems in SBTT. First, an overview of team performance evaluation …

Effects Of National Culture On Types Of Knowledge Sharing In Virtual Communities, Keng Siau, J. Erickson, Fiona Fui-Hoon Nah Oct 2010

Effects Of National Culture On Types Of Knowledge Sharing In Virtual Communities, Keng Siau, J. Erickson, Fiona Fui-Hoon Nah

Research Collection School Of Computing and Information Systems

Organizations are using virtual communities to facilitate knowledge management and to enhance communication among employees, customers, and other interested individuals. Individual users can use virtual communities to engage in knowledge sharing. Professional communicators need to understand and adapt to a globalized and “flat” world, where people across different cultures interact freely and easily with one another in virtual communities. An intriguing question regarding virtual communities relates to whether national culture affects communication and types of knowledge sharing. This study examines the influence of US and Chinese national cultures on types of knowledge-sharing activities in virtual communities. The findings indicate that …

Data-Driven Approaches To Community-Contributed Video Applications, Xiao Wu, Chong-Wah Ngo, Wan-Lei Zhao Oct 2010

Data-Driven Approaches To Community-Contributed Video Applications, Xiao Wu, Chong-Wah Ngo, Wan-Lei Zhao

Research Collection School Of Computing and Information Systems

With the prosperity of video-sharing websites such as YouTube, the amount of community-contributed video has increased dramatically. Reportedly more than 65,000 new videos were uploaded to YouTube every day in July 2006 and it's estimated that 20 hours of new videos were uploaded to the site every minute in May 2009. In addition to the huge volume of video data, the social Web provides rich contextual and social resources associated with videos. These resources include title, tags, thumbnails, related videos, and user and community information, as illustrated in Figure 1. While billions of user-generated videos accompanied with rich-media information have …

Dispersion Of Cytotoxic Properties Of Multi-Walled Carbon Nanotubes Suspended In Biological Solutions With Tween 80: Their Role In Enhancing Killing Effects Of Nanosecond Pulse Electric Fields On Tumor Cell Lines, Bhargava S. Kalluri

Biological Sciences Theses & Dissertations

The objective of this study was to determine whether multi-walled carbon nanotubes (MWCNTs) suspended in the surfactant Tween 80 give an additive killing effect on tumor cells when exposed to nsPEFs. In this study, MWCNTs were suspended in DMEM and RPMI with or without T80 (surfactant). The size distribution of MWCNTs suspended in these solutions was evaluated with a Delsa™ Nano Zeta potential and sub micro particle Size Analyzer and confirmed with microscopy. The cytotoxicity of MWCNTs dispersed in different concentrations of T80 was evaluated in PANC1 (Human pancreatic cancer cell line) and Jurkat cell lines (Human T-cell lymphoblast cell …

Engaging Emerging Populations Of Adults With Interactive Activities In A 3d Virtual Learning Environment, Kristin Woods Oct 2010

Engaging Emerging Populations Of Adults With Interactive Activities In A 3d Virtual Learning Environment, Kristin Woods

Journal of Extension

The Internet, particularly 3D virtual learning environments, has become a venue of choice for many young adults who have grown up in a period of rapidly advancing technology. With this in mind, a 3D virtual kitchen was created to instruct foodservice staff about foodborne hazards. Respondents reported positively about their user experience, the educational content, and the social aspects of the module. The results of this pilot project indicate that engaging young adults with a media in which they feel comfortable is feasible.

Dissemination Of Outreach Education Programs: In-Person And Computer-Mediated Strategies, Alex Kudryatsev, Marianne E. Krasny, Joseph B. Walther

Journal of Extension

In-person and computer-mediated strategies are used to disseminate Extension programs, but little is known about their relative effectiveness. Using educator surveys, we compared the effectiveness of program dissemination via educator workshops, short presentations, and a DVD in terms of rates and extent of implementation in an urban environmental education program. Workshop participants were more likely to implement programs with youth, although the number of implemented activities did not differ significantly among educator participating in various dissemination strategies.

Speaking The Same Language In Paraprofessional Staff Development, Susan S. Baker, Meredith Pearson Oct 2010

Speaking The Same Language In Paraprofessional Staff Development, Susan S. Baker, Meredith Pearson

Journal of Extension

Literacy is an important consideration in the development of new staff orientation and ongoing training programs for Extension paraprofessional educators. In a project to develop core competencies for nutrition paraprofessionals, investigators learned that some of the competencies, (developed by a panel of Extension professionals) were not expressed using terminology understood by paraprofessionals. Implications for developing effective training programs include using terminology understood by paraprofessionals, engaging in intentional dialog with paraprofessionals to determine common language, and teaching paraprofessionals new terminology when necessary.

Precision Farming Information Sources Used By Cotton Farmers And Implications For Extension, Margarita Velandia, Dayton M. Lambert, Amanda Jenkins, Roland K. Roberts, James A. Larson, Burton English, Steven W. Martin

Journal of Extension

Cotton farmers in Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, Missouri, North and South Carolina, Tennessee, and Virginia were asked where they obtained information about precision farming. Farmers use Extension as a source of precision farming information, but in combination with other sources, including media, crop consultants, trade shows, and other farmers. Farmers using Extension as a source of information tend to be younger, with more education and higher incomes, compared to producers not seeking information from Extension. Understanding the profiles of producers using Extension resources for precision farming information may help Extension design programs to improve information delivery to clients.
