Online Dispute Resolution With China: Advantageous, But At What Cost?, Jennifer Sackin Jan 2010

Online Dispute Resolution With China: Advantageous, But At What Cost?, Jennifer Sackin

Cardozo Journal of Conflict Resolution

This Note will discuss the use of Online Dispute Resolution (ODR) between businesses and consumers in the United States (U.S.) and their counterparts in the People's Republic of China (P.R.C.). ODR is a growing, highly attractive, and arguably necessary phenomenon in the e-commerce world. It is an accommodating and useful process in that it employs online technology to provide traditional alternative dispute resolution (ADR) mechanisms via the Internet.

Expanding The Brand: The Case For Greater Enforcement Of Mandatory Mediation In Trademark Disputes, Max Vilenchik Jan 2010

Expanding The Brand: The Case For Greater Enforcement Of Mandatory Mediation In Trademark Disputes, Max Vilenchik

Cardozo Journal of Conflict Resolution

Currently, far too many trademark disputes that could have been settled outside of court end up in litigation. While alternative dispute resolution (ADR) has become more prevalent in other areas of the law, many trademark attorneys and their clients do not regularly consider ADR processes, such as mediation, as one of their options because these processes are still relatively new to the trademark law area. This Note will propose that mandatory trademark mediation programs be expanded to ensure that trademark cases that are well suited for mediation end up in mediation rather than in mounting court dockets.

The Earliest House Sparrow Introductions To North America, Michael P. Moulton, Wendell P. Cropper Jr., Michael L. Avery, Linda E. Moulton

United States Department of Agriculture Wildlife Services: Staff Publications

Several authors have argued that three separate introductions of roughly 100 individuals were required initially to establish the House Sparrow (Passer domesticus) in the Brooklyn, New York area. We argue that these claims are in error and that the actual record suggests that it is likely the initial introduction of just 16 birds in 1851 was all that was required to establish the species in New York. We further suggest that a similar level of scrutiny of historical records will reveal more examples of misinterpretations and errors, casting doubt on the validity of studies that claim propagule pressure …

Efficacy Of Methoprene For Control Of Five Species Of Psocids (Psocoptera) On Wheat, Rice, And Maize, Christos G. Athanassiou, Frank H. Arthur, James E. Throne Jan 2010

Efficacy Of Methoprene For Control Of Five Species Of Psocids (Psocoptera) On Wheat, Rice, And Maize, Christos G. Athanassiou, Frank H. Arthur, James E. Throne

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The insect growth regulator methoprene was evaluated for control of Liposcelis bostrychophila Badonnel, Liposcelis decolor (Pearman), Liposcelis entomophila (Enderlein), Liposcelis paeta Pearman (Psocoptera: Liposcelididae), and Lepinotus reticulatus Enderlein (Trogiidae) at application rates of 1, 5, and 10 ppm on maize, wheat, and rice. Methoprene did not completely suppress progeny production during the 40-day test period, but did cause a significant reduction in adult progeny in all psocid species at the application rates of 5 and 10 ppm. At 1 ppm, numbers of adults were reduced for all species on wheat and maize, but only for L. paeta on rice. Nevertheless, …

Genomic And Transcriptomic Studies In Mycobacterium Avium Subspecies Paratuberculosis, J. P. Bannantine, Adel M. Talaat

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Microarray technology is an important tool in functional genomic research. It has enabled a deeper analysis of genomic diversity among bacteria belonging to the Mycobacterium avium complex (MAC). In addition, the expression of thousands of genes can be studied simultaneously in a single experiment. With the complete genome sequence of a bovine isolate of M. avium subspecies paratuberculosis, and the independent construction of DNA microarrays in our laboratories, transcriptomic studies for this veterinary pathogen are now possible. Furthermore, the bovine genome sequence project is completed and bovine arrays have been developed to examine host responses to infection with M. avium …

Volatiles Emitted From Eight Wound-Isolated Bacteria Differentially Attract Gravid Screwworms (Diptera: Calliphoridae) To Oviposit, M. F. Chaudhury, Steven R. Skoda, A. Sagel, J. B. Welch

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Bovine blood inoculated with bacteria isolated from screwworm [Cochliomyia hominivorax (Coquerel) (Diptera: Calliphoridae)]-infested animal wounds was tested as an attractant for oviposition for gravid screwworms. Eight species of gram-negative coliform (Enterobacteriaceae) bacteria mixed with bovine blood singly or all species combined and incubated for various times produced volatiles that attracted gravid flies in a cage bioassay in varying numbers. In 15-min duration tests, volatiles from five species of bacteria (Klebsiella oxytoca, Proteus mirabilis, Proteus vulgaris, Providencia rettgeri, and Providencia stuartii) attracted more females than volatiles of the three species (Enterobacter cloacae, Enterobacter …

Potential For Stable Flies And House Flies (Diptera: Muscidae) To Transmit Rift Valley Fever Virus1, Michael J. Turell, David J. Dohm, Christopher J. Geden, Jerome A. Hogsette, Kenneth Linthicum

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Rift Valley fever (RVF), a disease of ruminants and humans, has been responsible for large outbreaks in Africa that have resulted in hundreds of thousands of human infections and major economic disruption due to loss of livestock and to trade restrictions. As indicated by the rapid spread of West Nile viral activity across North America since its discovery in 1999 and the rapid and widespread movement of chikungunya virus from Africa throughout the Indian Ocean Islands to Asia and Europe, an introduced exotic arbovirus can be rapidly and widely established across wide geographical regions. Although RVF virus (RVFV) is normally …

Characterization Of Arsd: An Arsenic Chaperone For The Arsab As(Iii)-Translocating Atpase, Jianbo Yang Jan 2010

Characterization Of Arsd: An Arsenic Chaperone For The Arsab As(Iii)-Translocating Atpase, Jianbo Yang

Wayne State University Dissertations

Arsenic is a metalloid toxicant that is widely distributed throughout the earth's crust and causes a variety of health and environment problems. As an adaptation to arsenic-contaminated environments, organisms have developed resistance systems. In bacteria and archaea various ars operons encode ArsAB ATPases that pump the trivalent metalloids As(III) or Sb(III) out of cells. In these operons, an arsD gene is almost always adjacent to the arsA gene, suggesting a related function. ArsA is the catalytic subunit of the pump that hydrolyzes ATP in the presence of arsenite or antimonite. ArsB is a membrane protein which containing arsenite-conducting pathway. ArsA …

Dynamic Multivariate Simplex Splines For Volume Representation And Modeling, Yunhao Tan Jan 2010

Dynamic Multivariate Simplex Splines For Volume Representation And Modeling, Yunhao Tan

Wayne State University Dissertations

Volume representation and modeling of heterogeneous objects acquired from real world are very challenging research tasks and playing fundamental roles in many potential applications, e.g., volume reconstruction, volume simulation and volume registration. In order to accurately and efficiently represent and model the real-world objects, this dissertation proposes an integrated computational framework based on dynamic multivariate simplex splines (DMSS) that can greatly improve the accuracy and efficacy of modeling and simulation of heterogenous objects. The framework can not only reconstruct with high accuracy geometric, material, and other quantities associated with heterogeneous real-world models, but also simulate the complicated dynamics precisely by …

Major: Sociology

Degree: Doctor of Philosophy

Administrators and educators have been given the responsibility of working towards improving racial and social interactions in their school settings. It is important to note that most of the literature on diversity programming suggests that the perception held by a school's administration of what constitutes an all encompassing racially and culturally diverse program plays an important role in its implementation and success.

With the continual growth of minority populations in the United States, …

Regulatory And Functional Aspects Of Foxo3a Transcription Factor And Their Implications In Prostate Cancer, Melissa Elise Dobson Jan 2010

Regulatory And Functional Aspects Of Foxo3a Transcription Factor And Their Implications In Prostate Cancer, Melissa Elise Dobson

Wayne State University Dissertations

The P13K/Akt pathway is a critical mediator of growth factor signaling involving many cellular functions. The deregulation of this pathway has been shown to be involved in the development of various cancers. One of the main targets of this pathway is FoxO3a, a transcription factor whose target genes are involved in important cellular processes such as apoptosis, cell cycle control, and glucose metabolism. FoxO3a is regulated by various post translational modifications including acetylation, ubiquitination and phosphorylation. The transcription factor is directly phosphorylated by Akt on 3 residues: Threonine 32, Serine 253 and Serine 315. Phosphorylation by Akt generates binding sites …

August 2010

Advisor: Dr. Cheng-Zhong Xu

Major: Computer Engineering

Degree: Doctor of Philosophy

Internet traffic often exhibits a structure with rich high-order statistical properties like selfsimilarity

and long-range dependency (LRD). This greatly complicates the problem of

server performance modeling and optimization. On the other hand, popularity of Internet

has created numerous client-server or peer-to-peer applications, with most of them,

such as online payment, purchasing, trading, searching, publishing and media streaming,

being timing sensitive and/or financially critical. The scheduling policy in Internet servers …

Argument Construction, Argument Evaluation, And Decision-Making: A Content Analysis Of Argumentation And Debate Textbooks, Neil Stuart Butt Jan 2010

Argument Construction, Argument Evaluation, And Decision-Making: A Content Analysis Of Argumentation And Debate Textbooks, Neil Stuart Butt

Wayne State University Dissertations

Critical thinking abilities, especially the advanced critical thinking abilities required for decision-making, are important to both individuals and democratic policy making processes. Previous studies have indicated that argumentation and debate instruction can improve critical thinking abilities, but there are reasons to believe that current approaches are not as effective at developing decision-making ability as they could be, in part because they focus too heavily on argument construction, rather than argument evaluation and decision-making. In order to test which approaches to teaching argumentation and debate best encourage decision-making abilities, researchers need to know which elements are included in current argumentation and …

The Impact Of Mitochondria On Preimplantation Development In The Rhesus Macaque, Tiffini Charieace Gibson

Wayne State University Dissertations

Assisted Reproduction Technologies (ART) have been used to treat infertility since 1790. In the centuries following, dramatic advances have been made in the field of infertility research through the employment of a variety of species. Despite these advances, determination of oocyte and embryo quality remains largely subjective. Ascertainment of methods to measure oocyte and embryo quality to improve selection in ART clinics and increase pregnancy success rates is imperative. These methods are only possible with a more comprehensive understanding of the cellular and molecular properties of oocytes and preimplantation embryos. A key component of all cells, including oocytes and embryos, …

Fighting For Survival: Coal Miners And The Struggle Over Health And Safety In The United States, 1968-1988, Richard Fry

Wayne State University Dissertations

My dissertation focuses on coal mining and occupational health and safety in the United States from 1968 to 1985. In the late 1960s, coal miners faced the constant risk of injury, occupational disease, and death. The dangerous conditions in the coal industry resulted in a massive explosion at the Farmington mine in West Virginia in 1968, which killed 78 miners. The Farmington disaster spurred miners to campaign for the reform of state and federal coal mine health and safety laws in the United States. They rejected the national leadership of their union, the United Mine Workers (UMW), which they perceived …

The current study investigates media's influence on Caucasian women to culturally appropriate the physical features generally ascribed to African American women through non-surgical and or surgical cosmetic procedures and vice versa. Participants were 26 African American women and 54 Caucasian women who had previously undergone either non-surgical or surgical cosmetic procedures. Results indicate that African American women were more likely to culturally appropriate than Caucasian women. For African American women high media exposure to cosmetic surgery media messages played a significant role in the cultural appropriation process. Results also indicated that Caucasian women culturally appropriate at the same level, whether …

Bewitching The Stage: Elizabethan And Jacobean Witch-Lore And Witch-Hunt, Kyoung H. Lee

Wayne State University Dissertations

This project hypothesizes that the early modern stage witch's grotesque femininity and her masculine presumption of agency were the effective signifiers of the feminine covert, what men fantasized about the reproductive secrets of womanhood and their control over the feminine activities. My investigation of late Elizabethan and Jacobean drama indicates that the fictional witch is postulated as the negative example of female fertility and feminine nurture: the witch not only interferes in the natural process of fertility in humans as well as in nature but she also contaminates maids and mistresses with her mismanagement and overconsumption of household resources. I …

Distributed Cinema: Interactive, Networked Spectatorship In The Age Of Digital Media, Erik Wayne Marshall Jan 2010

Distributed Cinema: Interactive, Networked Spectatorship In The Age Of Digital Media, Erik Wayne Marshall

Wayne State University Dissertations

Digital media has changed much of how people watch, consume and interact with digital media. The loss of indexicality, or the potential infidelity between an image and its source, contributes to a distrust of images. The ubiquity of interactive media changes aesthetics of images, as viewers begin to expect interactivity. Networked media changes not only the ways in which viewers access media, but also how they communicate with each other about this media. The Tulse Luper Suitcases encapsulates all of these phenomena.

Online News Media Use And Political Tolerance, Jessi Mccabe Jan 2010

Online News Media Use And Political Tolerance, Jessi Mccabe

Wayne State University Dissertations

This study examined the relationship between online news media use, selectivity in media content, and political tolerance. Tolerance develops as result of exposure to a diversity of ideas and perspectives, which the media provide. Online news use encourages and requires users to selectively expose and navigate through information based on personal choice. Online news permits individuals to choose information based on personal opinion and preference in ways traditional forms of mainstream media do not allow. Therefore, it was expected that online news use and selectivity in media content would negatively relate to tolerance.

A total of 305 participants were surveyed …

The Influence Of Transfer System Factors And Training Elapsed Time On Transfer In A Healthcare Organization, Beverly Jo Mihalko

Wayne State University Dissertations

Organizations and other sponsors of training face increasing pressure to demonstrate the value or impact of their training programs on individual and organizational performance. A critical element in the validation of training effectiveness is the permanent transfer of learned knowledge, skills, and behaviors to the workplace. The generalization of learned material to the job and maintenance of trained skills, are greatly influenced by training design, trainee characteristics, and work environmental factors. Using a multidimensional approach to identify all factors that promote or inhibit transfer could provide performance technologists and instructional designers with the insight necessary to design and develop strategic …

University Students' Attitudes Towards Body Hair And Hair Removal: An Exploration Of The Effects Of Background Characteristics, Socialization, And Societal Pressures, Bessie Rigakos Jan 2010

University Students' Attitudes Towards Body Hair And Hair Removal: An Exploration Of The Effects Of Background Characteristics, Socialization, And Societal Pressures, Bessie Rigakos

Wayne State University Dissertations

Body hair removal is a behavior that is taken for granted by many women in the United States. Existing feminist literature suggests that body hair removal is a major component of societal norms. This study aimed to contribute to the literature by exploring the social factors that influence the extent of women's depilation from public/visible body areas and private/hidden body areas, and the number of depilatory methods utilized. A total of 303 female students from Wayne State University completed questionnaires asking about their attitudes towards body hair/hair removal. It was confirmed that the vast majority (291 or 96%) remove their …
