Predictors Of Attitudes Toward Lesbians And Transgender Women In Relationships On A College Campus, Alishia Anne Wrubleski Jan 2010

Predictors Of Attitudes Toward Lesbians And Transgender Women In Relationships On A College Campus, Alishia Anne Wrubleski

Honors Theses

The purpose of this study was to gain a better understanding of the attitudes which perpetuate intolerance toward LGBT individuals, and to recognize, in particular, the unique attitudes transpeople face as a minority in the nation and even in the LGBT community. This research contributes to the bodies of research concerning the interrelatedness of intrinsic religiosity, political conservatism, sexism, the rape myth, lack of effective legal protection, and the intolerance of gender non-conformists. I have identified distinctions between attitudes on the part of both women and men, as well as toward different gender non-conformists. I have also taken research as …

Activist Investor Impact On Ceo Compensation Of Investment Targets, Eric Zacharias Jan 2010

Activist Investor Impact On Ceo Compensation Of Investment Targets, Eric Zacharias

CMC Senior Theses

This paper examines the “activist effect” on the levels and structures of CEO compensation when a company is targeted by a sample of activist groups. Activist investors are focused funds that use their resources to influence management of target investments in an effort to increase shareholder value. Due to their efforts to impose return enhancing agendas on the management of targets, activists have developed a reputation as “raiders” and are commonly feared by management. In this paper, the nature of activist investing is discussed, including a review of previous research on activism, and an explanation of why compensation changes are …

Short Term Strategies For Long Term Power: The Rise And Potential Fall Of Hugo Chávez, Linden E.S. Schult

CMC Senior Theses

This thesis explores the route to power of Venezuela's President Hugo Chávez and the methods by which he has remained in power throughout his presidency. Also, it explores the potential for Chávez to lose power, given the current economic and political situation in Venezuela. The importance of the oil industry, Chávez's suppression of the opposition and control of the media, and constitutional changes and reforms are all discussed as keys to Chávez's continuance in power.

Parents Super-Sizing Their Children: Criminalizing And Prosecuting The Rising Incidence Of Childhood Obesity As Child Abuse, Cheryl Page Jan 2010

Parents Super-Sizing Their Children: Criminalizing And Prosecuting The Rising Incidence Of Childhood Obesity As Child Abuse, Cheryl Page

Journal Publications

With all of the mudslinging that is taking place in the current healthcare debate, very few proponents and opponents seem to be addressing the elephant in the room-obesity. Childhood obesity, specifically, is rising at an alarming rate. "The prevalence of obesity (BMI 30) continues to be a health concern for adults, children and adolescents in the United States." Sadly, the rate of adult obesity is increasing almost as dramatically as that of childhood obesity. Based on the National Health and Nutrition Examination Survey (NHANES) study, in the combined years of 2003-2006, of children between the ages of two and nineteen, …

or several decades, and in a variety of contexts, national security and environmental protection interests have clashed. Balancing these competing concerns is a challenging task. However, in the wake of the tragic events of September 11, 2001, the U.S. government “drastically changed its approach to how it handled important environmental concerns in relation to national
defense issues."

The most common manifestation of the tensions between national security and environmental protection objectives is the Navy’s use of sonar in U.S. waters. The oceans that surround the United States on both coasts provide the U.S. Navy with an indispensable buffer zone in …

Poem (Film Review), Kathrin M. Bower Jan 2010

Poem (Film Review), Kathrin M. Bower

Languages, Literatures, and Cultures Faculty Publications

POEM is the feature-length debut for Ralf Schmerberg, a self-taught photographer and filmmaker known for his music videos of German bands Die Toten Hosen and Die Fantastischen Vier and his imaginative television commercials. Schmerberg and his collaborator, the writer Antonia Keinz, spent two years reading poetry to determine the final selection of 19 poems for the film project. The concept of creating a film devoted to visual interpretations of poetry was intriguing enough to attract big name actors, including Klaus Maria Brandauer, Meret Becker, Hannelore Elsner, Jürgen Vogel, and Hermann van Veen, as well as camera men who previously had …

Playing In A New Key, In A New World: Virtual Worlds, Millennial Writers, And 3d Composition, Joe Essid

English Faculty Publications

In the author’s courses, students have been augmentationist, not immersionist, in their approaches to using technology. In a virtual world, however, they are born with new skins into strange settings, doing things that might be impossible in the world of matter. Their frequent discomfort at this rebirth corroborates findings in two studies (Mosier, 2009; Howe & Strauss, 2000) that American "Millennials" distrust activities that seem to have no direct bearing on their educational outcomes, established social circles, or professional desires. The chapter describes assignments for such students, in the context of Rouzie s (2005) "serio-ludic "pedagogy. Several touchstones for educators …

Insurance Law Between Business Law And Consumer Law, Jeffrey E. Thomas Jan 2010

Insurance Law Between Business Law And Consumer Law, Jeffrey E. Thomas

Faculty Works

The U.S. legal system has multiple and complex regulatory regimes for insurance which combine statutes, administrative regulations and common law rules. Regulation of insurance is predominantly done by the fifty states, and this increases the system’s complexity. The regulatory regimes generally divide the industry, the subject of regulation, from the consumers, which are to be protected, without regard for the status or sophistication of the insurance consumer. This article focuses on the role of insurance law and regulation within the legal system, and in particular the divide between business or commercial insurance and that provided for consumers, more commonly known …

Opposition To Clinics Tests Attorney-Client Privilege; Students Working On Pro Bono Cases Leave Schools Vulnerable To Confidentiality Challenges, Patrick C. Brayer Jan 2010

Opposition To Clinics Tests Attorney-Client Privilege; Students Working On Pro Bono Cases Leave Schools Vulnerable To Confidentiality Challenges, Patrick C. Brayer

Faculty Works

This National Law Journal article draws attention to past attempts by government and private parties to pierce the protections of the attorney client relationship, specifically confidentiality, when it comes to the representation of clients by law school clinics. Several law school clinics and innocence projects have defended themselves against actions by prosecuting attorney offices and opposing parties who have attempted to obtain information that is traditionally protected by state and federal confidentiality rules. Law school clinics, public interest organizations, innocence projects, government agencies and Public Defender organizations can better protect themselves from future attempts by opposing parties to invade the …

Insurance Perspectives On Federal Financial Regulatory Reform: Addressing Misunderstandings And Providing View From Different Paradigm, Jeffrey E. Thomas Jan 2010

Insurance Perspectives On Federal Financial Regulatory Reform: Addressing Misunderstandings And Providing View From Different Paradigm, Jeffrey E. Thomas

Faculty Works

Much of the current call for Federal regulatory reform of insurance is based on fundamental misunderstandings regarding American International Group (AIG) and the financial crisis, and because insurance, which is regulated predominately at the state level, provides a different, and potentially useful, regulatory paradigm. The first section of this article will analyze the role of insurance in the financial crisis. It exposes the misunderstandings and explain how insurance had little, if any, role in the crisis. The second section outlines the current, state-based regulatory paradigm for insurance, and will explain how this paradigm has become a barrier for Federal reform …

Misplaced Fears In The Legislative Battle Over Affordable Biotech Drugs, David E. Adelman, Christopher M. Holman Jan 2010

Misplaced Fears In The Legislative Battle Over Affordable Biotech Drugs, David E. Adelman, Christopher M. Holman

Faculty Works

Much like tort reform, the debate over recently enacted legislation on biotech drugs — and particularly regulatory supplements to patent protection — has taken on a significance that dwarfs its impact on prescription drug expenditures. Under the Health Care Reform legislation, Congress enacted two major reforms: First, creation of an abbreviated Food and Drug Administration (FDA) approval process for follow-on biologics (FOBs), which are the analogues of generics for biotech drugs. Second, establishment of a twelve-year “data exclusivity” period in which clinical testing data collected by brand-name innovators cannot be used by producers of FOBs to satisfy FDA testing requirements. …

Fireguard - A Secure Browser With Reduced Forensic Footprint, Don Griffiths, Peter James

Australian Digital Forensics Conference

Fireguard is a secure portable browser designed to reduce both data leakage from browser data remnants and cyber attacks from malicious code exploiting vulnerabilites in browser plug-ins, extensions and software updates. A browser can leave data remnants on a host PC hard disk drive, often unbeknown to a user, in the form of cookies, histories, saved passwords, cached web pages and downloaded objects. Forensic analysis, using freely available computer forensic tools, may reveal sensitive and confidential information. A browser’s capability to increase its features through plug-ins and extensions and perform patch management or upgrade to a new release via a …

The 2009 Analysis Of Information Remaining On Disks Offered For Sale On The Second Hand Market, Andy Jones, Craig Valli, Glenn S. Dardick, Iain Sutherland, G. Dabibi, Gareth Davies

Australian Digital Forensics Conference

The ever increasing use and reliance upon computers in both the public and private sector has led to enormous numbers of computers being disposed of at the end of their useful life within an organisation. As the cost of computers has dropped, their use in the home has also continued to increase. In most organisations, computers have a relatively short life and are replaced on a regular basis with the result that, if not properly cleansed of data, they are released into the public domain containing data that can be relatively up to date. This problem is exacerbated by the …

Race And Sex In Organizing Work: "Diversity," Discrimination, And Integration, Tristin K. Green Jan 2010

Race And Sex In Organizing Work: "Diversity," Discrimination, And Integration, Tristin K. Green

Emory Law Journal

This Article provides the first extended analysis of the conscious consideration of race and sex in organizing work. It draws on research and literature in the fields of sociology, social psychology, and organizational theory to expose the risks and possibilities of permitting race- and sex-based decisions organizing work for workplace equality. Based on this empirical foundation and on established Supreme Court case law setting limits and conditions on the use of race and sex in employment decisions under Title VII, the Article presents an argument that is equally normative and doctrinal.

Exxon Shipping Co. V. Baker: The Perils Of Judicial Punitive Damages Reform, Jeff Kerr Jan 2010

Exxon Shipping Co. V. Baker: The Perils Of Judicial Punitive Damages Reform, Jeff Kerr

Emory Law Journal

The Supreme Court¿s recent decision in Exxon Shipping Co. v. Baker established a conservative one-to-one cap on the ratio of punitive to compensatory damages in maritime law. This decision raises the question whether the Court will apply a similar constitutional limit in future punitive damages cases. In the meantime, lower courts have already begun to rely on Exxon Shipping as persuasive authority for limiting punitive damages further than the Supreme Court¿s previous cases require. This Comment argues that Exxon Shipping¿s one-to-one cap in maritime cases is inconsistent with key principles of punitive damages law, advises against the application of Exxon …

States Of Being: Response Piece, Martha Fineman Jan 2010

States Of Being: Response Piece, Martha Fineman

Emory Law Journal

Professor Huntington’s exploration of the potentially positive role for emotion and social norms in rethinking the place of the state in family regulation is an important contribution to the field. However, in order to accomplish the ambitious tasks she sets out for herself, I suggest that she should give more attention to clarifying the meaning of key concepts. Elaboration of certain assertions and terms would strengthen her observations and arguments, making both more persuasive. In the following Parts, I raise some key issues and questions regarding the concepts and terms that warrant further development and articulation.

The Vulnerable Subject And The Responsive State, Martha Albertson Fineman Jan 2010

The Vulnerable Subject And The Responsive State, Martha Albertson Fineman

Emory Law Journal

Equal protection law under the United States Constitution requires that in order to be treated equally, individuals must be treated the same. This sameness-of-treatment version of equality ignores contexts, as well as differences in circumstances and abilities on the part of those whose treatment is compared. Most perplexing is the way in which the equal protection doctrine ignores existing inequalities of circumstances and presumes an equivalence of position and possibilities. Such a narrow approach to equality cannot be employed to combat the growing inequality in wealth, position, and power that we have experienced in the United States over the past …
