Semiotics 101: Taking The Printed Matter Doctrine Seriously, Kevin Emerson Collins Oct 2010

Semiotics 101: Taking The Printed Matter Doctrine Seriously, Kevin Emerson Collins

Indiana Law Journal

The printed matter doctrine is a branch of the section 101 doctrine of patent eligibility that, among other things, prevents the patenting of technical texts and diagrams. The contemporary formulation of the doctrine is highly problematic. It borders on incoherency in many of its applications, and it lacks any recognized grounding in the Patent Act. Yet, despite its shortcomings, courts have not abandoned the printed matter doctrine, likely because the core applications of the doctrine place limits on the reach of the patent regime that are widely viewed as both intuitively "'correct" and normatively desirable. Instead of abandoning the doctrine, …

Etsu Today - Fall 2010, University Marketing And Communication, East Tennessee State University

ETSU Today [magazine]

We have welcomed an all-time enrollment record this fall semester, exceeding 15,000 students for the first time in the 99-year history of the institution. here is no question that ETSU has become the dominant organization in this region. With enrollment higher than ever and a work force of some 2,300 faculty and staff, we currently contribute about three–fourths of $1 billion to the regional economy. It’s an amazing story, really. How a small school for teachers, originally enrolling 29 students on October 2, 1911, has evolved into the East Tennessee State University of today. ETSU has survived depression and war, …

Dna-Nanoparticle Superlattices Formed From Anisotropic Building Blocks, Matthew R. Jones, Robert J. Macfarlane, Byeongdu Lee, Jian Zhang, Kaylie L. Young, Andrew J. Senesi, Chad A. Mirkin Oct 2010

Dna-Nanoparticle Superlattices Formed From Anisotropic Building Blocks, Matthew R. Jones, Robert J. Macfarlane, Byeongdu Lee, Jian Zhang, Kaylie L. Young, Andrew J. Senesi, Chad A. Mirkin

Department of Chemistry: Faculty Publications

Directional bonding interactions in solid-state atomic lattices dictate the unique symmetries of atomic crystals, resulting in a diverse and complex assortment of three-dimensional structures that exhibit a wide variety of material properties. Methods to create analogous nanoparticle superlattices are beginning to be realized, but the concept of anisotropy is still largely underdeveloped in most particle assembly schemes. Some examples provide interesting methods to take advantage of anisotropic effects, but most are able to make only small clusters or lattices that are limited in crystallinity and especially in lattice parameter programmability. Anisotropic nanoparticles can be used to impart directional bonding interactions …

The Inherent Structure Of Free Speech Law, Joshua P. Davis, Joshua D. Rosenberg Oct 2010

The Inherent Structure Of Free Speech Law, Joshua P. Davis, Joshua D. Rosenberg

William & Mary Bill of Rights Journal

To date no one has discovered a set of organizing principles for free speech doctrine, an area of the law that has been criticized as complex, ad hoc, and even incoherent. We provide a framework that distills free speech law down to three judgments: the first about the role of government; the second about the target of government regulation; and the third a constrained cost-benefit analysis. The framework can be summarized by three propositions: first, the Constitution constrains government if it regulates private speech, but not if government speaks, sponsors speech or restricts expression in managing an internal governmental function; …

Sociology, Economics, And Gender: Can Knowledge Of The Past Contribute To A Better Future?, Julie A. Nelson Oct 2010

Sociology, Economics, And Gender: Can Knowledge Of The Past Contribute To A Better Future?, Julie A. Nelson

Economics Faculty Publication Series

This essay explores the profoundly gendered nature of the split between the disciplines of economics and sociology which took place in the late 19th and early 20th centuries, emphasizing implications for the relatively new field of economic sociology. Drawing on historical documents and feminist studies of science, it investigates the gendered processes underlying the divergence of the disciplines in definition, method, and degree of engagement with social problems. Economic sociology has the potential to heal this disciplinary split, but only if the field is broadened, deepened, and made wiser and more self-reflective through the use of feminist analysis.

Corporate Governance And Mindfulness: The Impact Of Management Accounting Systems Change, John Joseph Williams, Alfred E. Seaman Oct 2010

Corporate Governance And Mindfulness: The Impact Of Management Accounting Systems Change, John Joseph Williams, Alfred E. Seaman

Research Collection School Of Accountancy

The International Federation of Accountants (2009) argues that a governance structure should go beyond conformance with regulations and equally support a performance dimension that can lead to better outcomes. This paper explores the relationship between these two governance dimensions and the capacity for mindfulness, utilizing organizational theory that describes high reliability organizations. Survey data was obtained from top-level accounting professionals in a sample of 124 Canadian firms. Regression results support the hypothesis that both the conformance and performance dimensions of governance are significant determinants of the capacity for mindfulness. Additional analysis shows that the explanatory power of this relationship persists …

We have designed and implemented a 3D virtual world based on the Co-Space concept encompasses the Youth Olympic Village (YOV) and several sports competition venues. It is a massively multiplayer online (MMO) virtual world built according to the actual, physical locations of the YOV and sports competition venues. On top of that, the Co-Space is being populated with human-like avatars, which are created according to the actual human size and appearance; they perform their activities and interact with the users in realworld context. In addition, autonomous intelligent agents are integrated into the Co-Space to provide context-aware and personalized services to …

Business Network-Based Value Creation In Electronic Commerce, Robert John Kauffman, Ting Li, Eric Van Heck Oct 2010

Business Network-Based Value Creation In Electronic Commerce, Robert John Kauffman, Ting Li, Eric Van Heck

Research Collection School Of Computing and Information Systems

Information technologies (IT) have affected economic activities within and beyond the boundaries of the firm, changing the face of e-commerce. This article explores the circumstances under which value is created in business networks made possible by IT. Business networks combine the capabilities of multiple firms to produce and deliver products and services that none of them could more economically produce on its own and for which there is demand in the market. We call this business network-based value creation. We apply economic theory to explain the conditions under which business networks will exist and are able to sustain their value-producing …

Secureangle: Improving Wireless Security Using Angle-Of-Arrival Information, Jie Xiong, Kyle Jamieson Oct 2010

Secureangle: Improving Wireless Security Using Angle-Of-Arrival Information, Jie Xiong, Kyle Jamieson

Research Collection School Of Computing and Information Systems

Wireless networks play an important role in our everyday lives, at the workplace and at home. However, they are also relatively vulnerable: physically located off site, attackers can circumvent wireless security protocols such as WEP, WPA, and even to some extent WPA2, presenting a security risk to the entire network. To address this problem, we propose SecureAngle, a system designed to operate alongside existing wireless security protocols, adding defense in depth. SecureAngle leverages multi-antenna APs to profile the directions at which a client's signal arrives, using this angle-of-arrival (AoA) information to construct signatures that uniquely identify each client. We identify …

Online Multiple Kernel Learning: Algorithms And Mistake Bounds, Rong Jin, Steven C. H. Hoi, Tianbao Yang Oct 2010

Online Multiple Kernel Learning: Algorithms And Mistake Bounds, Rong Jin, Steven C. H. Hoi, Tianbao Yang

Research Collection School Of Computing and Information Systems

Online learning and kernel learning are two active research topics in machine learning. Although each of them has been studied extensively, there is a limited effort in addressing the intersecting research. In this paper, we introduce a new research problem, termed Online Multiple Kernel Learning (OMKL), that aims to learn a kernel based prediction function from a pool of predefined kernels in an online learning fashion. OMKL is generally more challenging than typical online learning because both the kernel classifiers and their linear combination weights must be learned simultaneously. In this work, we consider two setups for OMKL, i.e. combining …

Electromagnetic Field Calculations For Microlens Optical Systems, Jian Wang Oct 2010

Electromagnetic Field Calculations For Microlens Optical Systems, Jian Wang

Department of Mechanical and Materials Engineering: Dissertations, Theses, and Student Research

Microlenses are becoming more widely used in modern optical equipment. When the microlens diameter is comparable with the incident electromagnetic illumination wavelength, diffraction effects through the microlens aperture dominate and significantly affect the microlens optical properties leading to differences from that predicted by ordinary geometrical optics theory. In this work, the continuous-profile symmetrical biconvex microlens is selected for investigation. Its optical properties, with both monochromatic plane wave and TEM00 mode Gaussian beam illumination, are studied using the full-field Separation-of-Variables method (SVM) in the oblate spheroidal coordinate system by calculating the electromagnetic field distributions inside of and adjacent to the microlens. …

Severity And Characteristics Of Developmental Delay Can Be Assessed Using Variability Measures Of Sitting Posture, Anastasia Kyvelidou, Regina T. Harbourne, Nikolaos Stergiou Oct 2010

Severity And Characteristics Of Developmental Delay Can Be Assessed Using Variability Measures Of Sitting Posture, Anastasia Kyvelidou, Regina T. Harbourne, Nikolaos Stergiou

Journal Articles

Purpose: We sought to identify measures of variability from sitting postural sway that are significantly different among infants who were developing typically, those who were developmentally delayed or hypotonic, and those who later on had a diagnosis of spastic or athetoid cerebral palsy.

Methods: Sixty-five infants were evaluated when they were just developing the ability to sit upright by assessing center of pressure (COP) data, using measures of both amount and temporal organization of COP variability.

Results: The results indicated that measures of variability of COP could discriminate between infants with developmental delay and infants with cerebral palsy and add …

Mining Collaboration Patterns From A Large Developer Network, Didi Surian, David Lo, Ee Peng Lim Oct 2010

Mining Collaboration Patterns From A Large Developer Network, Didi Surian, David Lo, Ee Peng Lim

Research Collection School Of Computing and Information Systems

In this study, we extract patterns from a large developer collaborations network extracted from Source Forge. Net at high and low level of details. At the high level of details, we extract various network-level statistics from the network. At the low level of details, we extract topological sub-graph patterns that are frequently seen among collaborating developers. Extracting sub graph patterns from large graphs is a hard NP-complete problem. To address this challenge, we employ a novel combination of graph mining and graph matching by leveraging network-level properties of a developer network. With the approach, we successfully analyze a snapshot of …

Using Artificial Neural Networks For Transport Decisions: Managerial Guidelines, Robert L. Cook, Lawrence O. Jenicke, Brian Gibson

Journal of Transportation Management

One information technology that may be considered by transportation managers, and which is included in the portfolio of technologies that encompass TMS. is artificial neural networks (ANNs). These artificially intelligent computer decision support software provide solutions by finding and recognizing complex patterns in data. ANNs have been used successfully by transportation managers to forecast transportation demand, estimate future transport costs, schedule vehicles and shipments, route vehicles and classify earners for selection. Artificial neural networks excel in transportation decision environments that are dynamic, complex and unstructured. This article introduces ANNs to transport managers by describing ANN technological capabilities, reporting the current …

Generalized Newton's Method Based On Graphical Derivatives, T Hoheisel, C Kanzow, Boris S. Mordukhovich, Hung M. Phan Oct 2010

Generalized Newton's Method Based On Graphical Derivatives, T Hoheisel, C Kanzow, Boris S. Mordukhovich, Hung M. Phan

Mathematics Research Reports

This paper concerns developing a numerical method of the Newton type to solve systems of nonlinear equations described by nonsmooth continuous functions. We propose and justify a new generalized Newton algorithm based on graphical derivatives, which have never been used to derive a Newton-type method for solving nonsmooth equations. Based on advanced techniques of variational analysis and generalized differentiation, we establish the well-posedness of the algorithm, its local superlinear convergence, and its global convergence of the Kantorovich type. Our convergence results hold with no semismoothness assumption, which is illustrated by examples. The algorithm and main results obtained in the paper …

Russell Kirk And The Rhetoric Of Order, Eric Grabowsky Oct 2010

Russell Kirk And The Rhetoric Of Order, Eric Grabowsky

Electronic Theses and Dissertations

The corpus of historically-minded "man of letters" and twentieth century leader among conservatives, Russell Amos Kirk, prompts one to reflect upon a realist rhetoric of order for conservative discourse in particular and public argumentation in general. In view of building a realist rhetoric of order within the present spectrum of modern to postmodern thought, this dissertation project contains two related layers of study. At one level, the author both builds and departs from the realist approach to communicative epistemology known as "rhetorical perspectivism" toward a theoretical framework for the study of rhetoric that is based upon Aristotle and St. Thomas …
