Risk, Everyday Intutions, And The Institutional Value Of Tort Law, Govind Persad Jan 2010

Risk, Everyday Intutions, And The Institutional Value Of Tort Law, Govind Persad

Publications

This Note offers a normative critique of cost-benefit analysis, one informed by deontological moral theory, in the context of the debate over whether tort litigation or a non-tort approach is the appropriate response to mass harm. The first Part argues that the difference between lay and expert intuitions about risk and harm often reflects a difference in normative judgments about the existing facts, rather than a difference in belief about what facts exist, which makes the lay intuitions more defensible. The second Part considers how tort has dealt with this divergence between lay and expert perspectives. It also evaluates how …

In addition, a new framework of multicultural education, called the shalom model, which is drawn from the Bible is presented, along with the characteristics of the model. The goal of multicultural education, according to this model, is to build a community of shalom, an image that is clearly described in Isaiah 11:6. In order to …

I Was Banging My Head Against A Brick Wall: Exclusionary Power And The Gendering Of Sport Organizations, Ruth Sibson Jan 2010

I Was Banging My Head Against A Brick Wall: Exclusionary Power And The Gendering Of Sport Organizations, Ruth Sibson

Research outputs pre 2011

The under-representation of women in sport management has increasingly been recognized by government and nongovernment organizations, and there has been some attempt to redress the imbalance. Research has indicated, however, that the gendering of sport organizations is not simply a numbers' game. The purpose of this study was to analyze the exercise of exclusionary power as an aspect of gender relations within a six member volunteer Board of Directors of an Australian local, grass-roots sport organization. Data were gathered using semistructured interviews, participant observation and documentary evidence over a 15-month period. This study identified that, although numerical under-representation of men …

A New Design For A Turing Test For Bots, Philip Hingston Jan 2010

A New Design For A Turing Test For Bots, Philip Hingston

Research outputs pre 2011

Interesting, human-like opponents add to the entertainment value of a video game, and creating such opponents is a difficult challenge for programmers. Can artificial intelligence and computational intelligence provide the means to convincingly simulate a human opponent? Or are simple programming tricks and deceptions more effective? To answer these questions, the author designed and organised a game bot programming competition, the BotPrize, in which competitors submit bots that try to pass a “Turing Test for Bots”. In this paper, we describe a new design for the competition, which will make it simpler to run, and, we hope, open up new …

Complexities Of Assessing Social And Emotional Competence And Wellbeing In Young Children, Lennie Barblett, Carmel Maloney

Research outputs pre 2011

Developing positive social and emotional growth and development in young children has always been a fundamental priority of early childhood practitioners. However, with an increasing economic and political focus on the foundational early childhood years, there has been a global push for the measurement of outcomes in early childhood education. This paper reports the findings of a major literature review to examine the assessment of social and emotional competence and wellbeing in young children. The review was conducted by a team at Edith Cowan University as part of project funded by the Western Australian Department of Education and Training. It …

A Logo Selection Method, Tulay Girard, Michelle Pope Jan 2010

A Logo Selection Method, Tulay Girard, Michelle Pope

AMTP Proceedings 2010

Many companies and sports teams have revised their logos over time in efforts to reposition their brand image. Still, the need for establishing a reliable method to guide this important decision still persists. This study offers an empirical method for selecting logos for companies and/or brands by testing the perceptions of consumers using 16 bi-polar personality traits adapted from the literature. The data were collected from undergraduate marketing students for demonstration purposes. The paper proposes that the perceptions for a logo of multiple samples from the same target population will be the same. The findings support the proposition. Implications and …

Ontologies For Multilingual Extraction, Deryle W. Lonsdale, David W. Embley, Stephen W. Liddle Jan 2010

Ontologies For Multilingual Extraction, Deryle W. Lonsdale, David W. Embley, Stephen W. Liddle

Faculty Publications

In our global society, multilingual barriers sometimes prohibit and often discourage people from accessing a wider variety of goods and services. We propose multilingual extraction ontologies as an approach to resolving these issues. As envisioned, our ontologies provide a conceptual framework for a narrow domain of interest. Grounding narrow-domain ontologies linguistically enables them to map relevant utterances and text to meaningful concepts in the ontology. Our prior work includes leveraging large-scale lexicons and terminology resources for grounding and augmenting ontological content [12]. Linguistically grounding ontologies in multiple languages enables cross-language communication within the scope of the various ontologies’ domains. Technically, …

Impetuous Desire: A History Of Kettle Falls 1825-1860, Ryan W. Booth Jan 2010

Impetuous Desire: A History Of Kettle Falls 1825-1860, Ryan W. Booth

All Master's Theses

Kettle Falls has been the home to Natives, traders, missionaries and U.S. soldiers between 1825 and 1860. The middle ground created by these various groups first led to collaboration and eventually turned into collapse. The varied reasons for the downfall stem from problems of communication, commerce, cooperation and settlement among all four groups. The greatest hindrance was cultural miscommunication. Hudson Bay Company and the Society of Jesus (Jesuits) used old fashioned and outdated methods, which stemmed from their European roots, in their dealings with the tribes along the Columbia River. The Company and the Society could not keep pace with …

A Comparison Of Two Tools For Analyzing Linguistic Data: Logistic Regression And Decision Trees, David Eddington Jan 2010

A Comparison Of Two Tools For Analyzing Linguistic Data: Logistic Regression And Decision Trees, David Eddington

Faculty Publications

The present paper compares logistic regression (referred to herein as its implementation in Varbrul) with another method for analyzing linguistic data-decision trees. Comparison of the two methods demonstrates that decision trees are able to find the same sorts of generalizations as Varbrul. However, decision trees provide more coarsely-grained output compared with Varbrul’s more informative factor weights. In addition, decision trees often mistakenly overgeneralize. Nevertheless, decision trees can be used in tandem with Varbrul. Because decision trees automatically calculate interactions, they suggest interaction terms that may be considered in subsequent Varbrul analyses. Decision trees also allow continuous variables in contrast to …

"Life Is Beautiful, Or Is It?" Asked Jakob The Liar, Ilona Klein Jan 2010

"Life Is Beautiful, Or Is It?" Asked Jakob The Liar, Ilona Klein

Faculty Publications

In 1999 the 71st Academy Awards ceremony awarded to the film The Last Days the prize for Best Documentary Feature. Underwritten by Steven Spielberg's Survivors of the Shoah Visual History Foundation, this documentary depicts in a compelling, historically objective fashion what the Nazi regime called the "Endlösung" ["Final Solution"]: the effort to annihilate all of European Jewry. In the film, five Hungarian survivors are interviews with honesty and compassion. Their answers record history as it unwound. Clearly, the intent of the interviews is to assure that historical facts are not falsified, nor taken for granted. Documentaries of this kind can …

Playing In A New Key, In A New World: Virtual Worlds, Millennial Writers, And 3d Composition, Joe Essid Jan 2010

Playing In A New Key, In A New World: Virtual Worlds, Millennial Writers, And 3d Composition, Joe Essid

English Faculty Publications

In the author’s courses, students have been augmentationist, not immersionist, in their approaches to using technology. In a virtual world, however, they are born with new skins into strange settings, doing things that might be impossible in the world of matter. Their frequent discomfort at this rebirth corroborates findings in two studies (Mosier, 2009; Howe & Strauss, 2000) that American "Millennials" distrust activities that seem to have no direct bearing on their educational outcomes, established social circles, or professional desires. The chapter describes assignments for such students, in the context of Rouzie s (2005) "serio-ludic "pedagogy. Several touchstones for educators …

Social Capital Influences Upon Internet Usage Of Rural Guatemalan English Teachers For Professional Development, Douglas Hudson Tedford

Frank Dilley Award for Outstanding Doctoral Study

This qualitative study examined Internet usage by Guatemalan English teachers in the rural, indigenous community of San Lucas Toliman, to improve enrollments and persistence in online teacher professional development programs promoted by the Fundación Rigoberta Menchú Tum. Woolcock's concepts of bonding, bridging and linking social capital were united with Rogers's theory of perceived attributes to ascertain why only 5 of 34 teachers completed free online coursework. Research questions addressed teacher concerns about using the Internet, teacher satisfaction with Internet resources, and social influences upon Internet usage. The participatory rural appraisal (PRA) method was employed using a culturally-sensitive native speaker to …

Resting Electromyographic Activity Of Deep Thoracic Transversospinalis Muscles Identified As Abnormal With Palpation, Gary Fryer, Michael Bird, Barry Robbins, Christian Fossum, Jane C. Johnson Jan 2010

Resting Electromyographic Activity Of Deep Thoracic Transversospinalis Muscles Identified As Abnormal With Palpation, Gary Fryer, Michael Bird, Barry Robbins, Christian Fossum, Jane C. Johnson

All KCOM Faculty Publications

Context: In the 1940s, osteopathic researchers suggested that paraspinal tissue abnormality was associated with spontaneous muscle activity, but few studies have since re-examined these reports. Objective: To determine whether abnormal motor activity plays a role in deep paraspinal tissues that appear abnormal to palpation. Methods: Using an observational study design, the PVG of participants with thoracic pain were palpated by two examiners for consensus on the most marked level of tissue abnormality. Dual fine-wire, intramuscular electrodes were inserted into the deep transversospinalis (multifidus, rotatores) muscles at the abnormal level and at two normal sites (above and below the abnormal level). …

Strengthening Labor Standards Enforcement Through Partnerships With Workers’ Organizations, Janice Fine, Jennifer Gordon Jan 2010

Strengthening Labor Standards Enforcement Through Partnerships With Workers’ Organizations, Janice Fine, Jennifer Gordon

Faculty Scholarship

Structures of employment in low-wage industries, a diminished wage and hour inspectorate, and an unworkable immigration regime have combined to create an environment where violations of basic workplace laws are everyday occurrences. This article identifies four “logics” of detection and enforcement, arguing that there is a mismatch between the enforcement strategies of most federal and state labor inspectorates and the industries in which noncompliance continues to be a problem. In response, the authors propose augmenting labor inspectorates by giving public interest groups like unions and worker centers a formal, ongoing role in enforcement in low-wage sectors. In three case studies, …

Beauty In The Dark Of Night: The Pleasures Of Form In Criminal Law, Martha Grace Duncan Jan 2010

Beauty In The Dark Of Night: The Pleasures Of Form In Criminal Law, Martha Grace Duncan

Emory Law Journal

I neither defend nor prosecute defendants. I am a law professor, and my contact with flesh-and-blood criminals extends only so far as visiting prisons and interviewing convicts for research purposes. Some of the prisoners I’ve interviewed have become my friends; others, my long-term correspondents, through the process of my learning and writing about them. Mostly, though, I work not with criminals but with criminal law—a field I adore. You could say, following Max Weber, that I live for as well as off my chosen field.

A Few Words About Women In The Discourse Of Criminal Law Upon Reading Martha Grace Duncan's Essay, Beauty In The Dark Of Night, Nancy Cook Jan 2010

A Few Words About Women In The Discourse Of Criminal Law Upon Reading Martha Grace Duncan's Essay, Beauty In The Dark Of Night, Nancy Cook

Emory Law Journal

The harsh realities of crime, victimization, trial, and imprisonment—all laden with pain and violence—are discussed in opinions laced with antiquated poetic language, beautiful imagery, and soft sounds. Professor Duncan herself constructs similarly unlikely literary pairings in her writing about criminal law texts, interweaving the languages of story and witness into the academic discourse of a law journal essay.
