Matter Of S-E-G-: The Final Nail In The Coffin For Gang-Related Asylum Claims?, Lindsay M. Harris, Morgan M. Weibel Jan 2010

Matter Of S-E-G-: The Final Nail In The Coffin For Gang-Related Asylum Claims?, Lindsay M. Harris, Morgan M. Weibel

Journal Articles

In July 2008, the Board of Immigration Appeals (BIA)1 affirmed an Immigration Judge’s (“IJ”) denial of asylum to three young Salvadoran siblings fleeing gang violence and threats. This decision affects the likelihood that other youth and their family members fleeing gang violence will gain protection in the United States. The reach of the BIA decision in Matter of S-E-G-2 stretches far beyond the facts of the actual case or gang cases in general and may shape the future of asylum based on membership in a particular social group. The BIA published Matter of S-E-G- as one of only 36 precedent …

Stories Told And Untold: Confidentiality Laws And The Master Narrative Of Child Welfare, Matthew I. Fraidin Jan 2010

Stories Told And Untold: Confidentiality Laws And The Master Narrative Of Child Welfare, Matthew I. Fraidin

Journal Articles

In most states, child welfare hearings and records are sealed or confidential. This means that by law, court hearings and records may not be observed. The same laws and court rules also preclude those who are authorized to enter and watch from discussing anything learned or observed in a closed courtroom or from a sealed court record with anyone not involved in the case. It is the restriction on speech—on telling stories about child welfare—with which this Article is concerned. I will argue in this Article that the insights of narrative theory and agenda-setting studies help us understand the damaging …

Virtual Hood: Exploring The Hip-Hop Culture Experience In A British Online Community., Natalia Cherjovsky

Electronic Theses and Dissertations

In this fast-paced, globalized world, certain online sites represent a hybrid personal-public sphere'where like-minded people commune regardless of physical distance, time difference, or lack of synchronicity. Sites that feature chat rooms and forums can offer a deep-rooted sense of community and facilitate the forging of relationships and cultivation of ideologies. This dissertation investigates whether this trend is relevant to web sites concerning hip-hop. This genre is arguably one of the most pervasive and influential global cultural forms, yet it is markedly different from most other forms of globalized culture because it emerged within and is still embedded in a distinct …

Removing The Blindfold And Tipping The Scales: The Unintended Lesson Of Ashcroft V. Iqbal Is That Frivolous Lawsuits May Be Important To Our Nation, Kenneth S. Klein Jan 2010

Removing The Blindfold And Tipping The Scales: The Unintended Lesson Of Ashcroft V. Iqbal Is That Frivolous Lawsuits May Be Important To Our Nation, Kenneth S. Klein

Faculty Scholarship

This Article questions whether the gain of curbing perceived frivolous litigation is worth the cost of undermining the core civic value of neutrality of justice. In Ashcroft v. Iqbal, the Supreme Court weighed in on the public debate about frivolous litigation. The lqbal opinion is essentially a memorandum by the Supreme Court written to the trial judges of America, encouraging these judges to aggressively, indeed very aggressively, identify and dismiss potentially frivolous civil complaints. That leeway-wrapped mandate comes at a cost. A cornerstone of our civic philosophy is that the judicial branch, as a general proposition, is a neutral …

Adolescent Girl Writers: "I Can Be Good At It, If I Like It", Hannah H. Chai

Mid-Western Educational Researcher

A common perception that girls are good at writing may lead educators to overlook girls. This study examined the writing engagement of three sixth grade girls and how their writing self-perception affected their attitudes in a writing classroom. Using a qualitative case study methodology, three themes emerged: the importance of writing tasks, the influence of reading interests on writing, and time as an external factor. Although these themes are important, the participants of this study alluded to a greater underlying factor; that of writing volition, i.e., desire to write. Volition was the key in engaging the girls as writers.

Co-Constitution, Causality, And Confluence: Organizing In A World Without Entities, Kenneth J. Gergen Jan 2010

Co-Constitution, Causality, And Confluence: Organizing In A World Without Entities, Kenneth J. Gergen

Psychology Faculty Works

The shift in focus from entities to process in organizational theory is both theoretically challenging and rich in potential. In this chapter I first consider two major challenges to the traditional science of organizations, including a shift from research devoted to establishing empirically based covering laws to a science invested in generating futures through participatory practices. I then consider a theoretical orientation to process, one that illuminates the collaborative or co‐active constitution of what we take to be entities, and the ongoing process required to sustain a world of independent events or actions. Finally, with this emphasis on co‐active process …

Dangerous Terrain: Mapping The Female Body In Gonzales V. Carhart, B. Jessie Hill Jan 2010

Dangerous Terrain: Mapping The Female Body In Gonzales V. Carhart, B. Jessie Hill

Faculty Publications

The body occupies an ambiguous position within the law. It is, in one sense, the quintessential object of state regulatory and police power, the object that the state acts both upon and for. At the same time, the body is often constructed in legal discourse as the site of personhood - our most intimate, sacred, and inviolate possession. The inherent tension between these two concepts of the body permeates the law, but it is perhaps nowhere more prominent than in the constitutional doctrine pertaining to abortion. Abortion is one of the most heavily regulated medical procedures in the United States, …

Of Christmas Trees And Corpus Christi: Ceremonial Deism And Change In Meaning Over Time, B. Jessie Hill

Although the Supreme Court turned away an Establishment Clause challenge to the words “under God” in the Pledge of Allegiance in Elk Grove Unified School District v. Newdow, the issues raised by that case are not going away anytime soon. Legal controversies over facially religious government speech have become one of the most regular and prominent features of Establishment Clause jurisprudence – and indeed, a second-round challenge to the Pledge of Allegiance is currently percolating, which is likely to result in resolution by the Supreme Court.

That resolution will depend on an understanding of the social meaning of the practice …

Co-Teaching Beliefs To Support Inclusive Education: Survey Of Relationships Between General And Special Educators In Inclusive Classes, Ida Malian Ph.D., Erin Mcrae

Electronic Journal for Inclusive Education

Co-teaching is a prevalent approach to providing effective instruction in inclusive classes. The purpose of this study was to determine teachers’ perceptions of compatibility and discrepancy between their approaches to teaching, personal characteristics and efficacy of co-teaching. Noonan’s Co-teacher Relationship Scale was adapted to survey the co-teachers statewide. Results of the statewide survey of Arizona general and special educators teaching in inclusive classes are presented as they relate to their responses. Various aspects of co-teaching relationships and teacher implementation of co-teaching models are discussed. The authors derive attributes of co-teachers in Arizona that indicate compatibility and sustainability of co-teaching arrangements. …

Home And School Literacy Practices In Africa: Listening To Inner Voices, Jacob Marriote Ngwaru, Kwasi Opoku-Amankwa

Institute for Educational Development, East Africa

The voices of the main stakeholders in literacy and schooling – pupils and parents – have seldom been given adequate space in studies of school and classroom discourse in sub-Saharan Africa. The present paper attempts to redress this imbalance by presenting the voices of pupils from a multilingual urban primary school in Ghana and of parents from a rural bilingual school in Zimbabwe. The Ghanaian study highlights challenges associated with using an unfamiliar language, English, as the medium of instruction, selective teacher treatment in the classroom that leaves some children lacking confidence to participate and the strong influence of the …

Hiv/Aids-Related Human Security Risks For Young Women In Rural Uganda, Shelley Jones Jan 2010

Hiv/Aids-Related Human Security Risks For Young Women In Rural Uganda, Shelley Jones

Institute for Educational Development, East Africa

Structural inequities, violence and oppression render young women in rural Uganda highly vulnerable to HIV/AIDS. Their decision-making powers, control over their bodies and sexuality, and access to sexual health resources are critically limited or wholly absent. Yet, prevailing HIV/AIDS programming, notably the President's Emergency Program for AIDS Relief (PEPFAR), emphasizes individual behaviour change to combat HIV/AIDS at the expense of wider societal considerations. This study explores the life experiences of a group of young Ugandan women and argues that the political and ideological battle of ownership (national as well as global) over the HIV/AIDS prevention discourse not only disregards these …

Legal Forms And The Common Law Of Patents, Craig Allen Nard Jan 2010

Legal Forms And The Common Law Of Patents, Craig Allen Nard

Faculty Publications

The question of institutional choice is important in all areas of the law, but particularly in the context of patent law with its divergent stakeholders, decentralized variance among industries regarding how the patent system is viewed and relied upon, and a persistent focus on reform in recent years. For over two hundred years, the courts have been the dominant force in the development of patent law. It should therefore come as no surprise to learn that a significant portion of American patent law, including some of the most important and controversial patent law doctrines, is either built upon judicial interpretation …

The Issues Of Appraising “Meaningful” Participation And Quality Control In Threaded Discussion Board, L.L. Ng

Research Publications (2006 to 2010)

One of the most widely used interactive channels today is the electronic discussion board. This new medium is used as part of feedback-seeking channels. There are two unique characteristics, it does not require the physical presence of anyone and it does not require the simultaneous presence of anyone for feedback-seeking activities to occur. Educational practitioners have also begun to capitalize on these characteristics in their scheme of course assessment. In this study, the threaded electronic discussion board has been incorporated into part of the assessment activities for postgraduate courses. The study aims to investigate how this medium is utilized by …

Faculty Publications - Doctor of Psychology (PsyD) Program

In response to Porter's article, "Theology as Queen and Psychology as Handmaid," three criteria are offered for theology as science. A scientific theology must be open to new discovery, it requires a community, and it is available for practical application. In addition to the benefits offered by Porter, viewing theology as science can promote practical helping efforts within the church.
