Funding Irrationality, Adam S. Zimmerman Mar 2010

Funding Irrationality, Adam S. Zimmerman

Duke Law Journal

This Article challenges the conventional wisdom that claimants in class action settlement funds and other settlement funds make independent and rational settlement decisions. Cognitive psychologists and behavioral economists have long examined the way people make judgments and choices. Such studies show that decisionmakers routinely change their minds based on their view of the status quo, the timing of the decision, and the presence of seemingly irrelevant choices. Because of these cognitive biases, people will buy things they do not want, save too little for retirement, and make risky choices about their health and well-being based on the timing, context, and …

The Motif Of The Patient Wife In Muslim And Western Literature And Folklore, Mounira Monia Hejaiej Mar 2010

The Motif Of The Patient Wife In Muslim And Western Literature And Folklore, Mounira Monia Hejaiej

CLCWeb: Comparative Literature and Culture

In her article "The Motif of the Patient Wife in Muslim and Western Literature and Folklore" Munira Hejaiej examines the tale of modern Tunisian tale of "Sabra" told by women to an all female audience. Hejaiej's analysis includes some of the tale's analogues from various linguistic and cultural contexts, including readings of the medieval variant written in Chaucer's Canterbury Tales. She argues that the comparative analysis provides us with a broader scope of interpretive paths in order to deconstruct essentialized readings of the tale, on the one hand, and to challenge previously accepted conventional boundaries between cultures on the other. …

Multicultural Experience, Idea Receptiveness, And Creativity, Angela K. Y. Leung, Chi-Yue Chiu Mar 2010

Multicultural Experience, Idea Receptiveness, And Creativity, Angela K. Y. Leung, Chi-Yue Chiu

Research Collection School of Social Sciences

Inspired by recent advances in creative cognition research, the authors examined in the current research some creative benefits of multicultural experiences. Study 1 showed that European American undergraduates had better creative performance immediately after being exposed to American and Chinese cultures or to a hybrid culture formed by fusing American and Chinese cultures; this effect was also observed 5 to 7 days after the initial exposure. Studies 2 and 3 showed that exposure to multicultural experiences is positively related to the likelihood of engaging in some creativity-supporting processes—generation of unconventional ideas (Study 2) and receptiveness to ideas originated from foreign …

The Attractive Female Body Weight And Female Body Dissatisfaction In 26 Countries Across 10 World Regions: Results Of The International Body Project I, Viren Swami, David A. Frederick, Toivo Aavik, Lidia Alcalay, Juri Allik, Donna Anderson, Norman P. Li

Research Collection School of Social Sciences

This study reports results from the first International Body Project (IBP-I), which surveyed 7,434 individuals in 10 major world regions about body weight ideals and body dissatisfaction. Participants completed the female Contour Drawing Figure Rating Scale (CDFRS) and self-reported their exposure to Western and local media. Results indicated there were significant cross-regional differences in the ideal female figure and body dissatisfaction, but effect sizes were small across high-socioeconomic-status (SES) sites. Within cultures, heavier bodies were preferred in low-SES sites compared to high-SES sites in Malaysia and South Africa (ds = 1.94-2.49) but not in Austria. Participant age, body mass index …

The Responsibility To Protect And The Decline Of Sovereignty: Free Speech Protection Under International Law, William Magnuson Mar 2010

The Responsibility To Protect And The Decline Of Sovereignty: Free Speech Protection Under International Law, William Magnuson

Faculty Scholarship

State sovereignty has long held a revered post in international law, but it received a blow in the aftermath of World War II, when the world realized the full extent of atrocities perpetrated by the Nazis on their own citizens. In the postwar period, the idea that individuals possessed rights independent of their own states gained a foothold in world discussions, and a proliferation of human rights treaties guaranteeing fundamental rights followed. These rights were, for the most part, unenforceable, though, and in the 1990s, a number of humanitarian catastrophes (in Kosovo, Rwanda, and Somalia) galvanized the international community to …

Computer Aided Phenomenography: The Role Of Leximancer Computer Software In Phenomenographic Investigation, Sorrek Penn-Edwards Mar 2010

Computer Aided Phenomenography: The Role Of Leximancer Computer Software In Phenomenographic Investigation, Sorrek Penn-Edwards

The Qualitative Report

The qualitative research methodology of phenomenography has traditionally required a manual sorting and analysis of interview data. In this paper I explore a potential means of streamlining this procedure by considering a computer aided process not previously reported upon. Two methods of lexicological analysis, manual and automatic, were examined from a phenomenographical perspective and compared. It was found that the computer aided process - Leximancer - was a valid investigative tool for use in phenomenography. Using Leximancer was more efficacious than manual operation; the researcher was able to deal with large amounts of data without bias, identify a broader span …

Don't Tease Me, I'M Working: Examining Humor In A Midwestern Organization Using Ethnography Of Communication, Ajay K. Ojha, Taimmy L. Holmes Mar 2010

Don't Tease Me, I'M Working: Examining Humor In A Midwestern Organization Using Ethnography Of Communication, Ajay K. Ojha, Taimmy L. Holmes

The Qualitative Report

Within organizations, the communicative phenomenon of humor is commonplace. Humorous talk is just as important and frequent to regular discourse that takes place between organizational members. In this inquiry we examine humor as a particular way of communicating between members of a small Midwestern United States organization. Specifically, we examine how three functions of humor (i.e., joking, sarcasm, and teasing) are used amongst members during normal business hours (8:00 a.m. - 5:00 p.m.). Using ethnography of communication, we conduct both fieldwork and interviews discovering that this organization exemplifies humor as a socially constructed phenomenon to complete the typical workday.

Sailing Stormy Seas: The Illness Experience Of Persons With Parkinson's Disease, Melinda Stanley-Hermanns, Joan Engebretson Mar 2010

Sailing Stormy Seas: The Illness Experience Of Persons With Parkinson's Disease, Melinda Stanley-Hermanns, Joan Engebretson

The Qualitative Report

Parkinson's disease is a chronic, progressive disorder with no known cause or promising cure. While substantial information is known about the pathophysiology, little is known about the illness experience of living with the disease. A qualitative study using an ethnographic approach was conducted to provide a rich understanding of the illness experience. The illness experience was apprehended through field work in two support groups and the personal accounts of 14 participants with Parkinson's disease. The metaphor, "Sailing the Sea in The Eye of the Storm," is the overarching theme and was chosen to conceptualize the voyage of persons living with …

Distribusi Fungsional Verba Pada Konteks Plot Dalam Wacana Narasi Dongeng Bahasa Indonesia, Petrus Poerwadi

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya

Every type of verb has a specific distribution in the context of plot in the written Indonesian tale narrative discourse (WNDBI). That specific distribution im- plies specific verb functions and meanings in the context of plot in WNDBI. There are three types of verbs dominant in the use of verbs in the WNDBI, namely materi- al-process verbs, relational-process verbs, and mental-process verbs. Types of claus- es, internal pattern of clauses embedded by certain types of verbs, and characteristics of participants have effects on the functions and meanings of the clauses in WNDBI. The written Indonesian tale narrative discourse possesses a …

Eksistensi Varietas Bahasa Inggris Dan Bahasa Inggris Standar, Flora Deborah Floris

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya

English is not only used by people from ENL (English as a Native Lan- guage) countries to communicate with people from ESL (English as a Second Lan- guage) and EFL (English as a Foreign Language) countries or vice versa, but it even functions as a lingua franca among non-native speakers. As a result, English varie- ties or Englishes emerged. This paper proposes an argument that the coexistence of both standard and varieties of English is equally important.

Interactive Post-Reading Activities That Work, Arwijati Wahjudi Feb 2010

Interactive Post-Reading Activities That Work, Arwijati Wahjudi

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya

The post-reading stage of a reading lesson is often confused with the clos- ing of a lesson. However, having new information from the whilst-reading stage should bring about a change such as the students would know more, or think or feel differently from before. Teachers should help students connect the new information they are now familiar with and their lives. This article re-introduces the importance of the post-reading stage and some workable, meaningful activities. Interactive ac- tivities are chosen so that students not only process their knowledge obtained from the text but also communicate this new knowledge to peers.

On Dirty Words: An Attempt To Intimate The Conundrum Of The Sin, Yazid Basthomi Feb 2010

On Dirty Words: An Attempt To Intimate The Conundrum Of The Sin, Yazid Basthomi

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya

This article analyzes the use of dirty words with reference to sociolinguis- tic and Saussurean conceptual frameworks. It starts with a personal-anecdotal ac- count on the difficulties in dealing with didactic issues in relation to the use of dirty words. In the guise of tackling the problem, sociolinguistic explanation is pursued, which, in the end, shows that sociolinguistic explanation is not really adequate to handle the issue. This relates to the possible notion that dirty words might be enacted as a (very) personal expression, devoid of any physical addressees. Saussu- rean linguistic concepts are also explored, and, yet, similar to …

Innovative Reflection Tools For Hrd Training, Development, And Education, Susan R. Madsen, Katherine A. Tunheim Feb 2010

Innovative Reflection Tools For Hrd Training, Development, And Education, Susan R. Madsen, Katherine A. Tunheim

Marketing and Strategy Faculty Publications

The English word reflection is derived from reflectere, “to bend back” – as a mirror bends back the light, making apparent what is otherwise hidden or mysterious (Johnson, 2006). Reflection bends the light of our experiences back into our minds, to consider what the experience was about and what it meant. Reflection is also a critical element in transformational learning opportunities that should be part of effective training, development, and educational experiences (e.g., courses, workshops, programs). Since developing people is seeded in learning, HRD educators, scholars, and/or practitioners continuously work to understand the most effective methods and techniques to …

Communication Mode Among Malaysians, Ching Hei Kuang, N.L. Wong, Maya Khemlani David

Research Publications (2006 to 2010)

Malaysia is a multicultural society which comprises three dominant ethnic groups: Malays (68%), Chinese (28%), Indians (10%) with other minorities (10%) (The Star July 21, 2009). Most Malaysians tend to behave in ways that could be predictably Asian, that is keeping a low profile when it comes to personality issues and tending to keep things to themselves rather than highlighting them. However, there is a slight difference in how the three ethnic groups communicate when it comes to the discussion of particular issues. This study looks at how Malaysians view ‘silence’ as a tool in human communication. Using surveys as …
