Electronic Discovery: A Fool’S Errand Where Angels Fear To Tread?, Milton Luoma, Vicki Luoma

Annual ADFSL Conference on Digital Forensics, Security and Law

Electronic discovery has transformed the discovery phase of civil litigation in recent years. The expectations of lawyers and parties were initially established in the Rowe and Zubulake cases that led to a complete revision of the electronic discovery rules contained in the Federal Rules of Civil Procedure. Subsequent cases have underscored the importance of document search methodologies and implications for attorneys, IT professionals, and digital forensics professionals. The authors review how electronic discovery has evolved thus far and offer recommendations regarding the electronic discovery process.

Verbal Disputes And The Internalism/Externalism Debate In Epistemology, John M. Fraiser May 2010

Verbal Disputes And The Internalism/Externalism Debate In Epistemology, John M. Fraiser

Theses

Looking at those debates which are commonly regarded as verbal disputes we can detect two kinds of verbal disputes: (STDC) cases in which disputing parties apply the Same Term or phrase to Different Concepts; (DTSC) cases in which disputing parties apply Different Terms or phrases to the Same Concept. While cases of (STDC) or (DTSC) may be verbal disputes, I will argue that (STDC) and (DTSC) are neither necessary nor sufficient conditions for a verbal dispute. I will explore the identity of a verbal dispute, the conditions for its occurrence, and methods for detecting it. I develop a condition for …

Wide Right: Why The Ncaa's Policy On The American Indian Mascot Issue Misses The Mark, André Douglas Pond Cummings May 2010

Wide Right: Why The Ncaa's Policy On The American Indian Mascot Issue Misses The Mark, André Douglas Pond Cummings

Law Faculty Scholarship

Of the many civil rights and social justice issues that continue to cloud United States race relations, one persists in dividing parties: the use of American Indian mascots and imagery by collegiate and professional athletic teams. Scholars and academics weigh in annually on this divisive issue, while certain university administration officials vigorously defend continued use of Native American mascots and monikers at their institutions. Across the United States, various university officials and alumni debate the continued use of mascots such as the “Fighting Sioux,” the “Running Utes” and “Chief Illiniwek.”

In a broader context, the mistreatment and abuse of American …

Discovering Alaska's Interior: A Historical Geography Of The 1885 Allen Expedition, Russell W. Vander Lugt May 2010

Discovering Alaska's Interior: A Historical Geography Of The 1885 Allen Expedition, Russell W. Vander Lugt

Arctic and Northern Studies

"This thesis examines the geography and history of interior Alaska by tracing the route of Henry Allen's 1885 expedition and evaluating Alaska's physiography from both Clyde Wahrhaftig's and Allen's perspectives. Since the U.S. Army took a leading role in Alaska's era of exploration during the late nineteenth century, specific insights are drawn from Lieutenant Allen's expedition and its context within early Russian and American exploration to interpret the historical geography of Alaska. The purpose of this monograph., however, is more comprehensive than merely tracing Allen's expedition or Wahrhaftig's classification. This study's measure of success will be the extent to which …

The Relationship Of Georgia's Rural Foreign Language Teachers' Sense Of Efficacy To Teacher Attrition, Peter Swanson, Robin Huff May 2010

The Relationship Of Georgia's Rural Foreign Language Teachers' Sense Of Efficacy To Teacher Attrition, Peter Swanson, Robin Huff

The Rural Educator

Foreign language teachers are in critical need in many parts of rural America. Using Bandura's conceptual framework of self-efficacy teaching languages as a theoretical lens, the researchers created a scale to measure foreign language teacher efficacy and administered alongside a well-known efficacy survey to in-service rural teachers (N = 167) in Georgia. Data analysis indicates that the new instrument is psychometrically sound and there are two dimensions to language teacher efficacy: Content Knowledge and Facilitating Instruction. Positive correlations between the two surveys suggest that teaching languages requires more than just strength of content knowledge and FL teachers may need assistance …

Understanding Reading Intervention From A Child's Perspective: Interviews With Adolescents, Parents, And Teachers, Lori Juhas Despaux

LSU New Orleans Theses and Dissertations

This qualitative phenomenological study explored the perceptions and experiences of the middle school students who participated in learning center support as elementary students in independent schools. There were 16 participants from three sites included in the study: six students, seven parents, and three learning specialists. The research questions guiding this study included: (1) What are the perspectives of students on the impact of the learning center experience in regard to reading development? (2) How does the child's discernment of how he or she is perceived academically by his or her reading teacher contribute to/hinder the process of learning to read? …

The New Voseo Culto: An Exploration Of The Complexity Of Familiar Address In Chilean Spanish, Patrick Roy Rouse May 2010

The New Voseo Culto: An Exploration Of The Complexity Of Familiar Address In Chilean Spanish, Patrick Roy Rouse

LSU New Orleans Theses and Dissertations

In Chilean Spanish, second-person address is non-uniform in that the vos competes with the conventional tuteo and a third, mixed form has emerged. To add to this complexity, the form speakers choose has been shown to correspond to socioeconomic strata. Upper classes use tú, lower classes use vos, and young, middle class speakers choose the mixed form in which the verb is conjugated according to the voseo and is used with the pronoun tú. The causes and effects of this second-person schism in Chile are explored here, as well as the resulting sociolinguistic issues and consequences. In a study of …

Legal Exoneration: A Case Study Through The Life History Of John Thompson, Celeste Lofton-Bagert May 2010

Legal Exoneration: A Case Study Through The Life History Of John Thompson, Celeste Lofton-Bagert

LSU New Orleans Theses and Dissertations

The term "exonerated"‖refers to a legal acquittal of a former conviction due to the introduction of new evidence. Since 1989, the number of legal xonerations has increased dramatically due to DNA and other new evidentiary technologies that can demonstrate innocence of formally convicted persons. This research focuses on the lived experience of exoneration and its aftermath through a life history of John Thompson (JT), a New Orleans native, convicted of murder and sentenced to death in 1985. In 2003, after eighteen years in Angola, the Louisiana State Penitentiary, fourteen on death row, JT was exonerated. Exoneration theoretically removes the official …

Closet Space: Investigating Gay Identity Through Advertising In Gay Media, Jonathan A. Hanna May 2010

Closet Space: Investigating Gay Identity Through Advertising In Gay Media, Jonathan A. Hanna

USF Tampa Graduate Theses and Dissertations

The objective of this research was to examine advertising in gay media publications, namely, The Advocate, in order to assess how advertising corresponds with gay identity formation. This study differed from previous inquiries in that the application of hegemony theory formed the basis of the project and was used as a tool to explicate the preponderance of certain images in gay media advertising and what they signify for gay men. Likewise, a phenomenological method of analysis was applied to the advertisements in order to render them more accessible as aesthetic and literary mediums. Classifying the advertisements according to their notional …

Hidden Markov Model With Binned Duration And Its Application, Zuliang Jiang May 2010

Hidden Markov Model With Binned Duration And Its Application, Zuliang Jiang

LSU New Orleans Theses and Dissertations

Hidden Markov models (HMM) have been widely used in various applications such as speech processing and bioinformatics. However, the standard hidden Markov model requires state occupancy durations to be geometrically distributed, which can be inappropriate in some real-world applications where the distributions on state intervals deviate signi cantly from the geometric distribution, such as multi-modal distributions and heavy-tailed distributions. The hidden Markov model with duration (HMMD) avoids this limitation by explicitly incor- porating the appropriate state duration distribution, at the price of signi cant computational expense. As a result, the applications of HMMD are still quited limited. In this work, …

The Feminine Representation Of Booker T. Washington And W.E.B. Dubois In Langston Hughes' Not Without Laughter, Matthew Mosley May 2010

The Feminine Representation Of Booker T. Washington And W.E.B. Dubois In Langston Hughes' Not Without Laughter, Matthew Mosley

LSU New Orleans Theses and Dissertations

Langston Hughes' novel Not Without Laughter works within the historically narrow framework of African American uplift ideology. Hughes implies Booker T. Washington's racial uplift ideology from Up From Slavery within Aunt Hager Williams. In addition, Hughes implies W.E.B. DuBois' racial uplift ideology from Souls of Black Folk within Tempy Siles. In both characters, he criticizes the ideologies. In addition, the ideologies work toward an initial construction of masculinity for Sandy, the protagonist, and ultimately undermine an argument for gender equality.
