Profitable Globalization And The Ethical Dilemma Of U.S. Job Loss, James G. Hendee
Profitable Globalization And The Ethical Dilemma Of U.S. Job Loss, James G. Hendee
McNair Scholars Research Journal
In theory, profitable globalization practices in developed, industrialized countries share a symbiotic relationship with cheaper off-shore human resources in third-world, poor, or underdeveloped nations. A short case study of Wal-Mart Stores, Inc. is given, which examines Wal-Mart's increased use of the cheaper Chinese workforce. By seeking out a lower cost labor force in a yet developing country, an ethical dilemma arises in that the business in the industrialized nation must ignore or disregard the job loss this decision creates within the borders of the home nation. Political and philosophical differences have led opponents to create an anti-thesis known as anti-globalization. …

Christian Legal Society Chapter of University of California, Hastings College of the Law v. Leo P. Martinez
On Writ Of Certiorari To The United States Court Of Appeals For The Ninth Circuit
From the Introduction and Summary of Argument
This case poses the question whether a student group organized around religious beliefs will be able to ensure these beliefs are shared by its leaders and voting members, and still be able to participate in a program at a public educational institution designed to encourage speech from a wide range of student groups.

What Does It Cost To Access Justice In Canada? How Much Is “Too Much”? And How Do We Know? Literature Review, Kim Taylor, Ksenia Svechnikova
What Does It Cost To Access Justice In Canada? How Much Is “Too Much”? And How Do We Know? Literature Review, Kim Taylor, Ksenia Svechnikova
Canadian Forum on Civil Justice
Barriers to accessing justice are a serious social concern. It is widely understood among those who work within the justice system, litigants and the general public, that cost is a barrier to accessing justice. Cost was raised as a concern by every litigant who participated in the Civil Justice System and the Public project.

Human Rights And Domestic Violence: An Advocacy Manual, Human Rights Clinic
Human Rights And Domestic Violence: An Advocacy Manual, Human Rights Clinic
Human Rights Institute
Though international law is traditionally called “the law of nations,” it governs far more than relations between the countries of the world. International human rights law pushes the boundaries of State responsibility and allows individuals to directly demand accountability for both governmental action and inaction that violates basic human rights. International human rights treaties declare the minimum standards by which States (i.e. nation-states, or countries) are expected to comply. The theme of the 2010 Fourteenth Annual Domestic Violence Conference at Fordham Law School, “Expanding Our Vision: Human Rights, Victims’ Rights, and Approaches to Diverse Families,” for which this manual was …

The Need For A National Civil Justice Survey Of Incidence And Claiming Behavior, Theodore Eisenberg
The Need For A National Civil Justice Survey Of Incidence And Claiming Behavior, Theodore Eisenberg
Cornell Law Faculty Publications
Civil justice issues play a prominent role in society. Family law issues such as divorce and child custody, consumer victimization issues raised by questionable trade practices, and tort issues raised by surprisingly high estimated rates of medical malpractice, questionable prescription drug practices, and other behaviors are part of the fabric of daily life. Policymakers and interest groups regularly debate and assess whether civil problems are best resolved by legislative action, agency action, litigation, alternative dispute resolution, other methods, or some combination of actions. Yet we lack systematic quantitative knowledge about the primary events in daily life that generate civil justice …

Women Lawyers, Women’S Rights In Senegal: The Association Of Senegalese Women Lawyers, Judy Scales-Trent
Women Lawyers, Women’S Rights In Senegal: The Association Of Senegalese Women Lawyers, Judy Scales-Trent
Journal Articles
L'Association des Femmes Juristes Sénégalaises (The Association of Senegalese Women Lawyers) has been working to improve the lives of women in Senegal for almost forty years. In a predominantly Muslim country where most women do not even attend high school, these women have used their legal skills to make change. With little money, no paid attorneys on staff, and using a borrowed room in a law firm as an office, they have successfully pushed the government to make positive changes in the Family Code and other laws and have played an important role in the development of human rights consciousness …

Free To Air? Legal Protection For Tv Program Formats, Neta-Li E. Gottlieb
Free To Air? Legal Protection For Tv Program Formats, Neta-Li E. Gottlieb
Coase-Sandor Institute for Law & Economics Research Paper Series
Television is only as strong as its programming. The use of program formats has slowly but surely developed into an important component of the television industry. This paper examines the surprising gap between the constantly growing, multi-billion-dollar trade of program formats and their unclear and contradictory legal treatment. Using an interdisciplinary approach, I look at the characteristics of both the product at hand and the markets it serves to examine possible justification for legal protection. I argue that the use of the term "TV format" is misleading and that a clear separation between the unpublished and published stages of the …
