The Caribbean Court Of Justice: A New Judicial Experience, Désirée P. Bernard
The Caribbean Court Of Justice: A New Judicial Experience, Désirée P. Bernard
International Journal of Legal Information
The Caribbean Court of Justice which was inaugurated in April 2005 comprises two jurisdictions, an original and appellate. The object of establishing the Court in its original jurisdiction was to interpret the provisions of the Revised Treaty of Chaguaramas and adjudicate disputes which may arise among the member states of the Caribbean Community and/or their nationals, and the states in relation to development of a Single Market and Economy. The appellate jurisdiction of the Court was intended to provide a court of last resort replacing the Judicial Committee of the Privy Council in England which was and in most instances …

It's Not Funny: Creating A Professional Culture Of Pro Bono Commitment, Douglas L. Colbert
Faculty Scholarship
Professor Colbert challenges the popular view that regards lawyers as selfish, greedy and uncaring to the legal needs of the outside community. In his article, he recognizes that the lawyers with whom he is familiar are fulfilling the lawyer’s ethical obligation of engaging in pro bono service and “provid[ing] legal services to those unable to pay,” while also embracing the language in the Preamble to the Model Rules of Professional Conduct that refers to the attorney “as a public citizen who has a special responsibility to the quality of justice.” Professor Colbert asks colleagues in the legal academy whether they …

Reflections On Success And Failure In New Governance And The Role Of The Lawyer, Lisa T. Alexander
Reflections On Success And Failure In New Governance And The Role Of The Lawyer, Lisa T. Alexander
Faculty Scholarship
While the recent global economic downturn and the change in power in U.S. government force us to reexamine the efficacy of new governance approaches to public problem-solving and regulatory reform, the contributions of Symposium participants affirm that new governance will likely continue to be with us in the not-so-distant future. Thus, there is a continuing need to clarify the lawyer's role in new governance. This Afterword begins that task by (1) reassessing the core normative goals of much new governance jurisprudence and practice, analyzing and critiquing the limited role for lawyers envisioned in this field; (2) positing how lawyers should …

A Service-Learning Project: Disability, Access And Health Care, Elizabeth Pendo
Articles
Last summer, I was thinking about a public service project for my disability discrimination law course. I teach the course in fall, and try to incorporate a project each year. Integrating a public service project into a traditional doctrinal course fits within the trend toward expanding teaching techniques beyond the case method in order to better prepare students for the practice of law., It was also inspired in part by the Carnegie Foundation's 2007 report, "Educating Lawyers: Preparation for the Profession of Law," as a way to foster "civic professionalism," and to "[link] the interests of legal educators with the …
Statewide Capital Punishment: The Case For Eliminating Counties' Role In The Death Penalty, Adam M. Gershowitz
Statewide Capital Punishment: The Case For Eliminating Counties' Role In The Death Penalty, Adam M. Gershowitz
Vanderbilt Law Review
The State of Texas is known as the capital of capital punishment.' But is that reputation deserved? In a way, yes. Texas sends more people to death row than any other state, and it executes them far faster. However, in another way, it is incorrect to suggest that "the State" of Texas is a prolific user of capital punishment. Death penalty cases are prosecuted by counties, not the state, and a majority of Texas's counties have never imposed the death penalty. In fact, only a handful of Texas's 254 counties regularly seek the death penalty. Many other states have a …
