This project looks at the possibility that airlines are overlooking an opportunity to save money and at the same time provide a better service to their customers. On certain regional-jet flights, airlines handle carry-on baggage in a way that avoids many of the pitfalls that drive mishandled baggage claims on other flights. This paper investigates the feasibility of using this very reliable carry-on bag system for all bags (checked and carry-on) on all passenger flights, thus potentially enabling commercial airlines to provide a more reliable service that customers prefer. Lawyers Acting Badly, Or Not? Misconduct In Ip Litigation: Recent Examples And The Questions They Raise, Lisa Dolak

Misconduct in civil litigation is not a new phenomenon. Nor is it confined to particular types of cases. Because of their characteristic intensity. however, intellectual property cases may be more likely to inspire bad behavior than other types of cases. The associated pressures seem, on occasion, to lead litigants and trial lawyers to succumb to the temptation to step outside the bounds of vigorous advocacy.
Trial and appellate judges in a number of recent IP cases have wrestled with the issue of whether certain litigation tactics crossed the line between advocacy and abuse. For example, trial judges have recently rebuked …

The Alaska Department of Public Safety and the UAA Justice Center conducted numerous research projects and published numerous articles on domestic violence, sexual assault, child sexual abuse, and stalking. These research projects were used to develop new multidisciplinary and multifaceted initiatives to combat violence against women in Alaska. This poster describes our researcher-practitioner partnership and its impact on policy and practice.

Assessment Of Legal Information Needs And Access Problems Of Lawyers In Uganda, Innocent Tuhumwire, C. Okello-Obura
Library Philosophy and Practice (e-journal)
Access to the right kind of legal information is imperative for efficient and effective performance in any judicial process. This study investigated the legal information needs and problems faced by lawyers (as main consumers of legal information) in accessing legal information. The study used a survey design in which a structured questionnaire was used to elicit the required data. It was carried out in Kampala, the capital city of Uganda. The study found that law reference; laws of other countries; law reports; update of court rules and judge cases constitute the most needed legal information of lawyers and attorneys in …

Even though almost everyone concedes that the caseload crisis in Missouri is real, the dire state budget situation makes a significant infusion of new resources virtually impossible. So if Missouri, like most other states, is truly broke, then realistically can the state find the funds needed to fix its broken indigent defense system? This Article is a basic introduction to the provision of indigent defense services in state courts throughout the country and the ethical obligations of the attorneys who provide those services. First, the Article briefly quantifies what currently exists in our right to counsel systems - what we know, and what we do not know. The Article then discusses the rules that generally govern the ethics of representation provided by indigent defense attorneys. Third, the Article examines the measures by which attorneys can know whether they are fulfilling and will continue to fulfill their ethical obligations. Finally, the Article discusses the …

In this short Article, I sketch the methodology my colleagues and I at Pace Law School use to incorporate practice standards into our clinical teaching and reflect on how a standards-based teaching paradigm could be adapted to the training, supervision, and evaluation of public defenders. Then, I briefly consider how standards and standards-based teaching assist in the administration of assigned counsel plans and in the evaluation of the performance of public defender organizations. While admittedly there is no rule of stare decisis (binding precedent) in international law or investor state arbitration, increasing number of tribunals refer to “precedents”. This trend has led many to ask if there is a system of binding precedent in investor state arbitration. This paper seeks to answer this question with a qualified affirmation – though there is no strict rule of binding precedent in international investment law, previous decisions do have a limited but powerful precedential value. While previous decisions are not binding, they provide guidance and may influence future tribunals in their decision making. The current regime …

For many years, the primary vehicle that advocates used to protect the fundamental right of the accused to the effective assistance of counsel was the Sixth Amendment to the United States Constitution, as incorporated to the states by the Fourteenth Amendment. For some time, most obviously during the Warren Court years, this federal strategy proved fruitful; indeed, it resulted in a series of landmark decisions by the United States Supreme Court that impact indigent defense systems to this day. A subsequent sea change in the Court's jurisprudence, however, which placed great emphasis on federalism, particularly the doctrines of justiciability and …

This workbook provides government employees background information related to tort liability and risk management. Past experience with lawsuits against government entities are summarized. The reasons for the lawsuits and results are analyzed. The objective is to provide an understanding of the basis for past claims so the number of future claims and awards can be reduced. This will result in the ultimate objective of reducing highway crashes.
Based on the results of the data analysis and the review of the background material, recommendations are made for consideration. Many of the recommendations deal with various types of documentation.
