The U.S. Experience With Mandatory Copyright Formalities: A Love/Hate Relationship, Jane C. Ginsburg Jan 2010

The U.S. Experience With Mandatory Copyright Formalities: A Love/Hate Relationship, Jane C. Ginsburg

Faculty Scholarship

Copyright formalities – conditions precedent to the existence or enforcement of copyright, such as provision of information about works of authorship that will put the public on notice as to a work’s protected status and its copyright ownership, or deposit of copies of the work for the national library or other central authority, or local manufacture of copies of works of foreign origin – have performed a variety of functions in US copyright history. Perhaps of most practical importance today, formalities predicate to the existence or enforcement of copyright can serve to shield large copyright owners who routinely comply with …

Physical And Chemical Interactions Between Marine Phytoplankton And Particle-Colonizing Bacteria, Jason Robert Graff Jan 2010

Physical And Chemical Interactions Between Marine Phytoplankton And Particle-Colonizing Bacteria, Jason Robert Graff

Open Access Dissertations

It is inherently difficult to study the direct interactions between marine microbes due to the size of the organisms and microscale environments in which they exist. Recent evidence suggests that the direct associations between marine phytoplankton and particle-colonizing bacteria can influence marine microbial community succession, microalgal primary production, toxin production by marine phytoplankton, and have potential implications for human health. The goal of this dissertation was to elucidate some of the physical and chemical mechanisms that regulate microbial interactions, particularly the colonization of phytoplankton and other marine particles by bacteria. To accomplish these goals, I used a creative and multi-disciplinary …

Abstention: The Unexpected Power Of Withholding Your Vote, Grant M. Hayden Jan 2010

Abstention: The Unexpected Power Of Withholding Your Vote, Grant M. Hayden

Faculty Journal Articles and Book Chapters

This Article examines the effect of abstentions on the outcome of votes. Scholars (and voters) operate under two basic assumptions about the nature of abstention. First, they assume that an abstention affects all alternatives in equal measure. Second, and relatedly, people assume that a voter’s preferred alternative will be less likely to win if that voter abstains (and, of course, more likely to win if she votes). Removing the potential full support of a vote and replacing it with the fifty-fifty proposition of an abstention should hurt the chances of a voter’s preferred alternative. These two assumptions guide the thinking …

Theodore Roosevelt On Labor Unions: A New Perspective, Louis B. Livingston Jan 2010

Theodore Roosevelt On Labor Unions: A New Perspective, Louis B. Livingston

Dissertations and Theses

Historical studies of Theodore Roosevelt's views about labor and labor unions are in conflict. This was also true of contemporary disagreements about the meaning of his labor rhetoric and actions. The uncertainties revolve around whether or not he was sincere in his support of working people and labor unions, whether his words and actions were political only or were based on a philosophical foundation, and why he did not propose comprehensive labor policies.

Roosevelt historiography has addressed these questions without considering his stated admiration for Octave Thanet's writings about "labor problems." Octave Thanet was the pseudonym of Alice French, a …

Calvin And Conciliation, Alexander S. Haines Jan 2010

Calvin And Conciliation, Alexander S. Haines

CMC Senior Theses

The popular conception of John Calvin today is as a divisive figure within Christianity, who vehemently opposed some beliefs while demanding rigid acceptance of others. In this thesis, I intend to investigate the accuracy of that conception by exploring how Calvin approached ecumenicalism theologically and practically. This will cover Calvin's understanding of the Church, his cooperation and disagreements with other Christians, and evaluate what Calvin might contribute to an ecclesiology useful for the Church today. Calvin has gained a poor reputation in modern times both for participation in historical events, including the execution of Servetus, and also for the association …
