Taxing Punitive Damages, Gregg D. Polsky, Dan Markel Sep 2010

Taxing Punitive Damages, Gregg D. Polsky, Dan Markel

Scholarly Works

There is a curious anomaly in the law of punitive damages. Jurors assess punitive damages in the amount that they believe will best “punish” the defendant. But, in fact, defendants are not always punished to the degree that the jury intends. Under the Internal Revenue Code, punitive damages paid by business defendants are tax deductible and, as a result, these defendants often pay (in real dollars) far less than the jury believes they deserve to pay.

To solve this problem of under-punishment, many scholars and policymakers, including President Obama, have proposed making punitive damages nondeductible in all cases. In our …

B Cell Adam10 Activity Is Increased By Kainate Receptor Activation: Potential Role Of This Pathway In Th2 Immunity And Cancer, Jamie Sturgill

Theses and Dissertations

CD23 has long been appreciated to be a natural, negative regulator of IgE synthesis. This understanding is due in part to animal models in which CD23 deficient or CD23 transgenic animals display exacerbated or reduced IgE levels respectively. Interestingly, CD23 is susceptible to proteolytic cleavage from the cell surface. When this occurs, CD23 loses its regulatory capability and the solubilized form can lead to pro-inflammatory events through its cytokinergic activity on macrophages. Thus, targeting this specific cleavage would be beneficial to the control of allergic disease by stabilizing CD23 at the cell surface. Inhibitor studies performed by our group as …

Ensemble Learning With Imbalanced Data, Larry Shoemaker Sep 2010

Ensemble Learning With Imbalanced Data, Larry Shoemaker

USF Tampa Graduate Theses and Dissertations

We describe an ensemble approach to learning salient spatial regions from arbitrarily

partitioned simulation data. Ensemble approaches for anomaly detection

are also explored. The partitioning comes from the distributed processing requirements

of large-scale simulations. The volume of the data is such that classifiers

can train only on data local to a given partition. Since the data partition reflects

the needs of the simulation, the class statistics can vary from partition to partition.

Some classes will likely be missing from some or even most partitions. We combine

a fast ensemble learning algorithm with scaled probabilistic majority voting in

order to learn …

Storage Virtualization Promises Agility In The Data Center, Peter Egli Sep 2010

Storage Virtualization Promises Agility In The Data Center, Peter Egli

Regis University Student Publications (comprehensive collection)

Data storage and protection has moved to the forefront of Information Technology solutions because the business value of data has gained in rank and importance in the world of internet commerce. Modern business models are built around instant and continuous data availability and they would not be able to function without this quality. This level of data availability requires data storage technologies to be of increased flexibility and higher performance. However the more sophisticated technologies pose a greater challenge to the architects of data storage solutions who are required to evaluate products of much higher complexity and administrators who need …

The Influence Of Language Production, Comprehension, And Pragmatic Judgment On Prosocial Behavior In Children With Language Impairment, Nicole Yvette Weber Sep 2010

The Influence Of Language Production, Comprehension, And Pragmatic Judgment On Prosocial Behavior In Children With Language Impairment, Nicole Yvette Weber

Theses and Dissertations

The purpose of this study was to examine the relationship between language skills and prosocial behavior in 37 children with language impairment (LI) and 37 typically developing peers matched for age (ranging from 6;11 to 11;1 years). The influence of gender on this relationship was also considered. Three different subtests of the Comprehensive Assessment of Spoken Language (Carrow-Woolfolk, 1999) were used to evaluate language ability in the areas of language comprehension, language production and pragmatic judgment skills. The Teacher Behavior Rating Scale (C. H. Hart & Robinson, 1996) was used to evaluate prosocial behavior. The current study replicated previous research …

Design And Wind Tunnel Testing Of Cal Poly's Amelia 10 Foot Span Hybrid Wing-Body Low Noise Cestol Aircraft, Kristina K. Jameson, David D. Marshall, Robert Ehrmann, Eric Paciano, Rory Golden, Dave Mason

Aerospace Engineering

California Polytechnic Corporation, Georgia Tech Research Institute (GTRI), and DHC Engineering collaborated on a NASA NRA to develop and validate predictive capabilities for the design and performance of Cruise Efficient, Short TakeOff and Landing (CESTOL) subsonic aircraft. In addition, a large scale wind tunnel effort to validate predictive capabilities for aerodynamic performance and noise during takeoff and landing has been undertaken.

The model, Advanced Model for Extreme Lift and Improved Aeroacoustics (AMELIA), was designed as a 100 passenger, N+2 generation, regional, CESTOL airliner with hybrid blended wingbody with circulation control. The model design was focused on fuelsavings and noise goals …

Usefulness Of Self-Report Instruments In Assessing Men Accused Of Domestic Violence, Laura A. Helfritz, Matthew S. Stanford, Sarah M. Conklin, Kevin W. Greve, Nicole R. Villemarette-Pittman, Rebecca J. Houston Sep 2010

Usefulness Of Self-Report Instruments In Assessing Men Accused Of Domestic Violence, Laura A. Helfritz, Matthew S. Stanford, Sarah M. Conklin, Kevin W. Greve, Nicole R. Villemarette-Pittman, Rebecca J. Houston

The Psychological Record

Clinical assessment of domestic violence has traditionally relied on self-report methods of data collection, using structured interviews and lengthy questionnaires such as the MMPI-2. However, in certain situations such as court-ordered domestic violence evaluations, information obtained through self-report methods may be tainted because of willful impression management on the part of the client. The purpose of the current study was to compare selfreport response styles of individuals with varying levels of domestic violence potential in order to determine whether the measures used could accurately differentiate between the groups. Individuals who were currently involved in child custody cases were court ordered …
