I start from the view that small-value consumer claims are a primary reason that class actions exist, and that without class actions many - if not most - of the wrongs perpetrated upon small-claims consumers would not be capable of redress. It would then seem to follow that the class action device should be readily available in small-claims consumer cases. And yet, over the past decade, federal district courts have repeatedly declined to certify class actions on grounds that are specific to small-claims consumer cases. Rethinking Guardianship (Again): Substituted Decision Making As A Violation Of The Integration Mandated Of Title Ii Of The Americans With Disabilities Act, Leslie Salzman

In every state, when an adult has a diminished capacity to make decisions about personal affairs or property management, a court may transfer the individual’s right to make decisions to a guardian. This Article argues that, in most cases, it would be preferable to support decision making rather than supplant it through guardianship, and then seeks to locate a right to receive such support as a less restrictive alternative to the substituted decision making that characterizes guardianship.

Fourth Amendment events generate substantial controversy among the public and in the legal community. Yet there is orthodoxy to Fourth Amendment thinking, reflected in the near universal assumption by courts and commentators alike that the amendment creates only tension between privately held individual liberties and public-regarding interests in law enforcement and security. On this account, courts are faced with a clear choice when mediating Fourth Amendment conflicts: side with the individual by declaring a particular intrusion to be in violation of the Constitution or side with the public by permitting the intrusion. This article addresses concerns expressed by members of the International City/ County Management Association (ICMA) regarding whether the supply of qualified local government managers will keep pace with the future demand for this occupation. The authors developed several important observations, which are based on decades of experience with a Master of Public Administration (MPA) program focused on local government management, plus strategic planning experience in over 100 local governments. We drew upon recent advances in tandem mass spectrometry-based proteomic analyses in order to examine the proteins that remain after a diatom bloom enters the stationary phase, precipitates out of the photic zone, and is subjected to microbial degradation over a 23-d period within a controlled laboratory environment. Proteins were identified from tandem mass spectra searched against three different protein databases in order to track proteins from Thalassiosira pseudonana and any potential bacterial contributions. This Capstone Project addresses the important problem of air pollution in Kosovo and the need for improvement of the air quality monitoring system, in compliance with Directive 2008/50/ EC on Ambient Air Quality and Cleaner Air for Europe. This project has identified eight new possible locations taking in consideration all relevant information about the source of pollution, types of areas, number of inhabitants and other relevant factor. The outcome of this project is a functional and reliable Air Quality Network Monitoring System for Kosovo in order to facilitate the air quality assessment and improve air quality in Kosovo.

A MEMS based multi-sensor chip has been developed for the purpose of monitoring turbidity, TDS, and temperature in a sample of drinking water. The benefits of MEMS technology over conventional sensors include compact size, low power consumption, integration capability, and low cost bulk manufacturing. Two revisions of the multi-sensor silicon chip were designed, fabricated, and tested. The layout of the chip and the fabrication process were redesigned in the second spin to provide more robust and sensitive responses. The present study examined the relationship between test anxiety, working memory, and verbal SAT performance. Test anxiety negatively affects performance because it decreases working memory space available for processing test information. However, the present study wanted to asses this theory with an experimental design to infer causation about test anxiety. Therefore, participants with high and low trait test anxiety were randomly assigned to experimental and control groups. Participants in the experimental group completed the assessments under conditions of elevated stress. However, these conditions had no effect on their performance. Individuals with Sickle Cell Trait have died suddenly after extreme exertion during military training, athletic practice or games (Kerle & Nishimura, 1996; Harrelson, Fincher & Robinson, 1995; Howe & Bowden, 2007). One of those deaths, Dale Lloyd, a football player at Rice University, prompted a change in the National Collegiate Athletic Association's (NCAA) Sports Medicine Handbook Guideline 3c: The Student Athlete with Sickle Cell Trait. Single-walled carbon nanotubes (SWCNTS) are proposed to be one of the most promising nanomaterials, with unique electronic and mechanical properties which lend themselves to a variety of applications. In all cases the quality of the SWCNT material is important, and for some applications it is paramount. Concerns have arisen regarding the microbiological safety of fruit juices due to a number of outbreaks associated with pathogens. Non-thermal technologies for the inactivation of microorganisms are of increasing interest to the food industry for the control of spoilage as well as safety concerns. The objective of this thesis was to investigate the efficacy of ultrasound and ozone treatments for control of microbial issues associated with fruit juices. The design of a solid propellant rocket motor requires the determination of a propellant's burning-rate and its dependency upon environmental parameters. The requirement that the burning-rate be physically measured, establishes the need for methods and equipment to obtain such data. A literature review reveals that no measurement has provided the desired burning rate accuracy. In the current study, flash x-ray modeling and digitized film-density data were employed to predict motor-port area to length ratio. This study demonstrated the successful operation of a new liquid oxygen - gaseous methane rocket engine test facility to characterize the performance of a swirl coaxial injector. In support of safe system functional development, an oxygen compatibility and hazards assessment was completed to identify and minimize operational risks. Facility changes were implemented to create a more fault tolerant system. Major upgrades included initiatives to manage the oxygen risk and mitigate specific oxygen ignition mechanisms. Oxygen compatible materials and facility configuration changes were instituted to achieve safer experimentation. This research evaluated the stability characteristics of a swirl-coaxial injector in an atmospheric combustion chamber using gaseous oxygen and gaseous methane as the propellants. The experiment studies the mixing processes in a laboratory-scale analogue to full-scale engine operating conditions. The injector was tested over a range of mass flow conditions that matched specified scaling parameters for a notional space engine. The scaling parameters used were mixture ratio, velocity ratio, momentum ratio, and momentum flux ratio. A maximum amplitude of 3.52% of chamber pressure was measured when the injector was placed 19 mm from the chamber wall. The associated instability mode--determined …

Microwave imaging techniques for medical applications have been reported in the literature for many years. However, the progress in imaging algorithms, numerical techniques, microwave hardware and computational speed has renewed the interest in this field. Breast cancer detection is particularly attractive from a microwave imaging perspective, the major reason referred to the potentially high dielectric contrast between cancerous tissues and normal breast tissues depending on water content. Low water tissues tend to be low permittivity as fat, whilst high water content tissues tend to be high permittivity as cancerous tissues. Information technology (IT) innovations follow a diverse set of diffusion patterns. Early diffusion models explaining technology diffusion patterns assumed that there is a single homogeneous segment of potential adopters. It was later shown that a two-segment model considering two groups of adopters explains variations in diffusion patterns better than the existing one-segment models. While the two-segment model considers a group of adopters promoting adoption by exerting a positive influence on prospective adopters, it does not consider the members of society who aim to inhibit the adoption process by exerting a negative influence on prospective adopters.
